ESPAÑOL: Este trabajo tiene como objeto el comentario y la transcripción de la copia del fuero de Villavicencio de 1221, que hemos encontrado inserta en un documento de Felipe II de marzo de 1573 en el Archivo Municipal de Villavicencio de los Caballeros (Valladolid). Las normas de este fuero nos permiten ver el desarrollo jurisdiccional del concejo de la villa frente a los demás poderes instalados en esta villa del reino de León. / ENGLISH: This research has the objective of transcribing and commenting a new copy of the Municipal Charter of Villavicencio from the year 1221. This Municipal charter was founded inside a document of king Felipe II from March 1573, that it was at the Municipal Archive of Villavicencio de los Caballeros (Valladolid). The rules of this document let us to see the jurisdictional development of the medieval village council facing the rest of the political powers settled in this village of the kingdom of León.

È quanto emerge in merito al gioco d'azzardo, talmente radicato nei comuni medievali da apparire inestirpabile. In questa prospettiva, l'apporto dei frati predicatori si rivela prezioso nel disciplinamento del ludus azardi ad opera delle autorità comunali, sia come ispiratori che come estensori di riforme sul gioco. Queste ultime offrono molteplici spunti di riflessione sull'esistenza di un legame di reciproca alimentazione fra dottrina canonistica e predicazione. / ENGLISH: During the 15th century, games and entertainment become a more common activity in everyday life and as such imply a complex relationship between preaching friars and jurists. The practice of gambling was so diffused that it was ineradicable from daily medieval life. In this perspective the preaching friars – as inspirers and compilers of reforms – provided a precious contribution to regulate gambling practices through municipal governments. These reforms provide us with many opportunities of analysis on the existence of a bond of mutual encouragement between canon law and preachers.

Il VI secolo rappresenta per l'Italia il punto di non ritorno per la formazione di una nuova rete di popolamento, basata soprattutto su insediamenti accentrati, caratterizzata da un'edilizia in forma di capanne. La frattura con la tarda romanità è ben evidente non solo per le strutture abitative ma anche per le nuove forme economiche e di gerarchia che andarono sviluppandosi. Nella formazione ed evoluzione del villaggio alto-medievale si osservano così varie soluzioni iniziali, specchio di poteri con diversa connotazione, che costituiscono nella diacronia la progressiva adesione alla terra delle élite e lo sviluppo sempre più marcato del controllo di mezzi di lavoro, persone, animali ecc. In età franca questi segni sono molto forti e tali da marcare significativamente l'urbanistica dei villaggi. L'alto medioevo non fu quindi un periodo di scarso popolamento o di mancate politiche agricole; rappresenta invece un periodo nel quale si posero, attraverso una fitta rete di villaggi, le basi per i successivi sviluppi. La "croissance" dell'anno Mille è senza dubbio un mito da sfatare o perlomeno ridimensionare con fermezza.
ITALIANO: L'Arazzo (o meglio, il ricamo) di Bayeux è una delle opere artistiche più note del Medioevo, che narra per immagini la conquista dell'Inghilterra da parte dei Normanni guidati dal duca Guglielmo il Conquistatore. Immagini tratte dal ricamo sono riprodotte su migliaia di oggetti che vogliono evocare l'età medievale; e al contempo l'opera è stata oggetto di centinaia di studi in molti paesi europei, da parte di storici, storici dell'arte e studiosi di narrativa. In tutto ciò, alcune domande e alcune risposte mancano, in particolare per quanto riguarda la cultura politica espressa nell'opera: è indubbio che il ricamo sia una narrazione delle imprese di Guglielmo il Conquistatore, un tentativo di conciliazione tra Inglesi e Normanni e in parte un'esaltazione del ruolo del vescovo Oddone di Bayeux; ma è anche l'espressione di una serie di ideali politici e modelli di ordine, una lettura e una valutazione del sistema di potere contemporaneo, organizzato attorno al regno e fondato sulla preminenza aristocratica e sul valore dei legami personali. Il volume si propone di seguire questa linea di ricerca, mostrando come, da molti punti di vista (il cerimoniale politico, il ruolo del re, i legami di fedeltà aristocratici), il ricamo rifletta un immaginario sociale e una serie di ideali politici ben riconoscibili. / ENGLISH: The Bayeux Tapestry (or rather, embroidery) is one of the most famous medieval artworks, which narrates in images the conquest of England by the Normans led by Duke William the Conqueror. Images taken from the embroidery are reproduced on thousands of objects evoking the Middle Ages, and at the same time the work has been the subject of hundreds of studies in many European countries, by historians, art historians and narrative scholars. In all of this, some questions and some answers are lacking, in particular with regard to the political culture expressed in the work: there is no doubt that the embroidery is a narrative of the exploits of William the Conqueror, an attempt to reconcile the English and Normans and in part an exaltation of the role of Odo, bishop of Bayeux; but it is also the expression of a series of political ideals and models of order, a reading and an evaluation of the system of contemporary power, organized around the kingdom and based on the primacy of the aristocracy and the value of personal ties. The volume aims to follow this line of research, showing how the embroidery, from many points of view (the political ceremonial, the role of the king, the aristocratic bonds of fidelity), reflects a social imaginary and a series of clearly recognizable political ideals.
The town of Ravenna, in northern Italy, today contains eight buildings listed on the UNESCO World Heritage list, all dating between the fifth and the sixth centuries - a time when it was one of the most important cities of the Mediterranean. The Roman town underwent a major transformation at the beginning of the fifth century, from a small Roman 'Municipium' to an Imperial capital. This role called for new buildings of power, housing the Imperial Court and the related bureaucratic body, a Bishop's Palace and other monuments suche as the Circus. In addition this walls, churches and others community zones were created; all following late antique models such as Milan, the previous capital, and of course Constantinople. An expansion of Ravenna's infrastructures was also necessary, in particular new roads and sewer system, a port, warehouses, and aqueducts. From the fifth century to the Early Medieval period Ravenna flourished as one of the main centres of North Italy and during this period its archbishop played an important role in the religion, politics and economy of the region. This paper seeks to illustrate the archaeological evidence related to the 'longue durée' of the urban centre of Ravenna as a fulcrum of power and control.

ITALIANO: Se nell'Italia del tardo medioevo era possibile essere sudditi "per natura", per natura cittadini, per natura principi, per natura membri di un partito, era possibile essere anche "naturalmente" nobili? Il contributo prova a rispondere a questa domanda prendendo le mosse dal cosiddetto trattato sulla nobiltà di Bartolo di Sassoferrato (Tractatus de dignitatibus) per secoli dotato di larghissima popolarità in tutta Europa. Dopo aver reso conto della situazione degli studi, il saggio illustra i contenuti dell'opera, riassumibili in una netta affermazione della dipendenza della nobiltà dalla voluntas del Principe (paragrafo 2), e nell'idea che non possa esistere alcuna nobiltà naturale se non come volontaria creazione di chi detiene il potere politico (paragrafo 3). Sono quindi (paragrafo 4) illustrate le radici del pensiero bartoliano in tema di nobiltà (vale a dire, oltre al Codex, l'Italia duecentesca e popolare, con le sue leggi antimagnatizie); nonché l'applicazione concreta di quei principi nel tardo medioevo, mostrando in particolare come i ragionamenti del De dignitatibus siano consonanti all'evoluzione dell'identità nobiliare in molte parti della penisola, in primis a Firenze, a Bologna, a Venezia. Il paragrafo 5 è invece dedicato alle eccezioni rispetto a questo modello, che non sono solo precedenti a Bartolo (Aristotele, Dante) quanto soprattutto a lui contemporanee, come affermato nello stesso trattato. Il saggio si sofferma sul caso di Milano e su altri contesti (i centri piemontesi in particolare, da Asti a Torino) dove la nobiltà ancora nel Tre-Quattrocento è proposta come fatto di natura, più che come prodotto della politica. / ENGLISH: In late medieval Italy it was possible to be subjects "by nature", citizens by nature, princes by nature, members of a party by nature; was it also possible to be noble by nature? This paper seeks to address this question starting from the so-called treaty on nobility written by Bartolus de Saxoferrato (Tractatus de dignitatibus), which gained vast popularity all over Europe for centuries. After taking into account the state of the art, the essay outlines the contents of the treaty: Bartolus sharply claimed that nobility depended on the Princes' voluntas (section 2), thus inferring that no natural nobility could exist unless intentionally created by those who exerted political power (section 3). The roots of Bartolus' thought on nobility are then examined (namely, besides the Codex, thirteenth-century 'popular' Italy, with its anti-magnate legislation), as well as the practical application of these principles in the late medieval period, by highlighting how the argument of the De dignitatibus matched with the evolution of noble identity in various parts of Italy, especially in Florence, Bologna, and Venice (section 4). Finally, section 5 deals with the exceptions to this model, not exclusively prior to Bartolus (Aristotle, Dante), but above all contemporaneous with him. The paper scrutinizes the cases of Milan and other cities (communes in Piedmont, from Asti to Turin) where nobility was still conceived as a natural, rather than political, fact in the fourteenth and fifteenth centuries.
ITALIANO: Il contributo analizza il passaggio della lex da un inquadramento essenzialmente teologico e orientato al confronto con la Rivelazione e il diritto divino nella cultura e predicazione altomedievali alle importanti novità successive alla redazione del Decretum di Graziano, quando il coinvolgimento dei predicatori nella riforma degli ordinamenti socio-economici e politici, unitamente all'osmosi tra pratiche giudiziarie e penitenza sacramentale, suscitò l'attenzione crescente dei frati per la cultura giuridica del loro tempo. In conclusione si esamina l'effettiva circolazione di una cultura religiosa e giuridica comune a predicatori e legislatori, presentando come caso-studio gli Statuta sabaudi del 1430. / ENGLISH: The paper focuses on the transition of the idea of "law" from a mainly theological and exegetical framework by the high medieval culture and preaching to the important news following the drafting of the Gratian's Decretum, when the greater involvement of preachers in the reformation of socio-economical and political systems, along with the osmosis between judicial practices and sacramental penance, made as a result the increasing attention of the friars to the contemporary legal culture. Finally, the paper discusses the true movement of a common and shared religious and juridical culture between preachers and lawmakers, through the casestudy of the Savoy Statuta of 1430.
ITALIANO: Il volume affronta un tema poco praticato dalla storiografia medievistica italiana – le prigioni e i loro abitanti – e cerca di mettere in risalto le specificità del caso milanese intorno al rapporto tra carcerati, giustizia e misericordia. Indagare la condizione dei carcerati si rivela un modo per cogliere le dinamiche di esclusione e di inclusione sociale pertinenti al controllo della devianza, una via di accesso all'ideologia religiosa, un mezzo per scavare nelle condizioni sociali ed economiche di una fetta di popolazione che, senza indagini di questo genere, rimarrebbe confinata a rappresentazioni di maniera, e permette infine un'ulteriore verifica dei meccanismi di relazione tra governanti e governati in uno stato, in questo caso principesco, del tardo medioevo. / ENGLISH: This book deals with a little practiced theme by italian medieval studies – prisons and their inhabitants – and seeks to highlight the specificity of the case-study of Milan around the relationship between prisoners, justice and mercy. Investigating the condition of prisoners it's been a way to grasp the dynamics of social exclusion and inclusion relevant to the control of deviance, an access road to religious ideology, a way of delving into social and economic conditions of a slice of the population that, without investigations of this kind, would remain confined to rhetorical representations, and finally allows further verification of relationship's mechanisms between government and governed people in a princely state of the late Middle Ages.
ITALIANO: Sulla scorta della recente monografia di C. Ginzburg e dei rilievi di Pedullà, è possibile identificare nella parola nondimanco/nondimeno un passaggio importante della scrittura rinascimentale del politico. Essa però non compare solo nelle opere di Machiavelli o Guicciardini e nella riflessione intellettualmente più consapevole, ma anche nell'ingente mole di lettere che costituiscono i carteggi di governo del tempo. In questo tipo di testi pragmatici conservatisi per lo stato di Milano in età sforzesca ricorre come una parola-chiave dell'attrito fra legge e trasgressione (o eccezione ritenuta legittima), fra diritto e pratica. Rivela il dilemma tra un assunto investito di valore (il duca deve onorare i contenuti dei capitoli convenuti con i sudditi e le sue promesse, la consuetudine esige rispetto, le divisioni fazionarie vanno superate) e il timore che esso venisse calpestato o invece la volontà, se non la necessità, di attenuarlo. Questa congiunzione sintetizzò così l'esigenza di sfumare la norma, adeguarla alla circostanza, far convivere diritti o ragioni di opportunità potenzialmente contrastanti. Si pone insomma come spia di uno dei principali motivi di tensione scoperti nello stato tardo-medievale, dibattuti da una lunga tradizione di studi che va da O. Brunner a R. Fubini, fra l'autorità del principe, quale arbitro dell'eccezione richiesta di volta in volta dalla stessa varietà delle situazioni concrete, e la cultura legalitaria dei corpi territoriali, i quali richiamandosi al diritto e alla consuetudine cercarono di arginare i poteri «straordinari» che il signore veniva attribuendosi. / ENGLISH: On the basis of the recent monograph by C. Ginzburg and G. Pedullà's review, it is possible to identify the word nondimanco/nondimeno (nonetheless) as an important element in Renaissance political writing. However, it does not only appear in the work of Machiavelli or Guicciardini and in the more conscious reflections by the intellectuals, but also in the huge amount of letters that constitute the government correspondence of the time. In these kinds of pragmatic texts, referring to the state of Milan in the Sforza age, it recurs as a key word of a dilemma: the friction between law and transgression (or exception considered legitimate) and also between law and practice. On one hand, it expresses an assumption invested in value: the duke must hon or his promises and the contents of the chapters agreed on with his subjects; custom demands respect; factional divisions must be overcome. At the same time it reveals the concern that this principle could be trampled upon, or instead the will, if not the need, to attenuate the more general rule. This conjunction thus summarized the requirement to nuance the law, to adapt it to circumstance, and to conciliate potentially conflicting rights or reasons. In short, it stands as an indicator of one of the main causes of open tensions in the late medieval state, debated by a long tradition of scholars ranging from O. Brunner to R. Fubini: the opposition between the authority of the prince, as arbiter of the exception requested from time to time from the same variety of concrete situations, and the legalistic culture of the territorial bodies, which, referring to law and custom, tempted to stem the "extraordinary" powers that the duke was attributing to himself.
In August 923, Charles the Simple was imprisoned by Count Heribert II of Vermandois, spending the rest of his life in prison. The six years between his imprisonment and his death, however, have never been the focus of a sustained study: Charles usually disappears into a jail cell and out of history. This article uses the difficult source material for West Frankish history in the early and mid-920s to examine the resilience of Carolingian kingship. To retain their position, this article argues, the regimes seeking to replace Charles had to navigate a confusing political environment in which there were no ready-made paths to consensus about what to do with an imprisoned king.
ITALIANO: La cancelleria segreta sforzesca ha rappresentato uno dei casi di studio più esplorati nell'ambito della "storia documentaria delle istituzioni". La storia della segreta, tuttavia, è rimasta incompleta: gli anni al potere di Francesco II (1522-1535) non sono stati oggetto di ricerca. L'articolo intende colmare questa lacuna, e si propone anche di offrire considerazioni di più ampio respiro sulla complessità della seconda "restaurazione" sforzesca. La prospettiva storico-documentaria fa emergere un forte grado di progettualità nell'azione di governo di Francesco II, capace, tra enormi difficoltà, di rivestire un ruolo fondativo nell'assetto istituzionale dello Stato di Milano nell'età moderna. / ENGLISH: The Sforza secret chancery is one of the most investigated case studies in the context of the "documentary history of the institutions". The chancery's history, however, has remained incomplete: scholars have neglected the years of Francesco II (1522-1535). This article aims to fill this gap, offering broader considerations on the complexity of the second Sforza "restoration". The perspective of documentary history highlights the strong political agency underlying Francesco II's governance. Despite his predicaments, Francesco proved to be able to actively design important elements of what would become the institutional framework of the State of Milan in the early modern period.
ITALIANO: Dopo la fine dell'età napoleonica il ripristino dell'organizzazione e delle modalità di funzionamento degli archivi degli Stati italiani fu condotto sotto il segno di una forte continuità rispetto al periodo antecedente la Rivoluzione francese, confermandone il ruolo fondamentale di difesa dei diritti sovrani e di supporto alla politica e all'amministrazione. Lo sviluppo degli studi storici ed eruditi nella prima metà del secolo XIX, provocò una crescente pressione da parte degli studiosi per avere accesso agli archivi del medioevo e dell'età moderna, nel quadro di una battaglia che assunse anche un significato latamente politico. Nonostante la progressiva apertura degli archivi, realizzatasi, in tempi e con modalità diverse nei vari Stati preunitari, fu solo con i provvedimenti di unificazione della legislazione archivistica nazionale negli anni Settanta che fu riconosciuto il diritto di accesso agli archivi come fonti per la storia. / ENGLISH: After the end of the Napoleonic era, the organization and functioning of the archives of the Italian States was restored in strict continuity with the the ancien régime. In particular, the main – if not only – function of the central state archives, located in the capital cities (the Archivio di Corte in Turin, the Archivio Governativo in Milan, the Archivio dei Frari in Venezia, the Grande Archivio in Naples, etc.) was to provide kings, governments and central bureaucracies with documentary support for their political and administrative activities. Starting from the 1830s scholars began to be allowed to consult medieval and early modern archives for historical research. The struggle for the recognition of the right to consult archives by historians was political in nature, and intimately connected to the struggle for the Unification of Italy and the affirmation of liberal principles. It is only with the archival legislation issued in the 1870s by the nascent Kingdom of Italy that such rights were openly recognized.
ITALIANO: L'economia altomedievale costituisce uno dei temi più frequentati dalla storiografia dell'ultimo secolo e l'Italia, ovvero il cuore di quello che fu l'impero romano, rappresenta indubbiamente un ambito privilegiato in cui esaminare le trasformazioni strutturali che si ebbero nel passaggio dall'età antica al Medioevo. Questo studio cerca di ricostruire le vicende complesse dell'economia in età longobarda, in particolare tra la fine del VII secolo e la conquista carolingia, analizzando la problematica sia dal punto di vista della produzione che dalla prospettiva del mercato, mettendone in evidenza le convergenze strutturali, in un orizzonte politico-sociale più ampio. L'età di Liutprando costituisce il cuore dell'analisi, ma il discorso si spinge fino all'età carolingia, per cercare di verificare l'impatto che ebbe la conquista franca sulla Penisola. Le regioni centro-settentrionali del regno longobardo costituiscono l'impalcatura che sorregge questo lavoro, ma non mancano incursioni comparative – sempre utili a comprendere meglio i fenomeni – nelle strutture socio-economiche del ducato-principato longobardo di Benevento, che per molto tempo costituì uno spazio politico sostanzialmente autonomo. / ENGLISH: Early medieval economy is one of the most frequented topic by modern historiography and Italy, the heart of the old Roman Empire, represents undoubtedly a privileged area where we can examine the structural transformations that occurred in the passage from Antiquity to the Middle Ages. This study tries to reconstruct the complex events of the economy in the Longobard period, specifically between the end of the seventh century and the Carolingian conquest, analyzing the question both in terms of production and market, attempting to highlight its structural convergences, in a broader political-social perspective. Liutprando's age constitutes the core of the analysis and the central-northern regions of the Longobard kingdom are the scaffolding on which this work is built but, in an attempt to better understand some phenomena by comparing them, there is no shortage of forays into the socio-economic structures of a political space for a long time essentially autonomous such as the Longobard duchy-principality of Benevento.
