The paper is devoted to the American diplomacy in the Eastern Mediterranean in the firsthalf of the 1960s. The Cyprus question's role in the US regional policy was analyzed. Thepresidents` doctrines concerned the Middle East priority and the communist threat preventionwere the guiding ideas of the US foreign policy. Therefore, the Cyprus interethnic conflict of1963-1964 was regarded as a potentially dangerous phenomenon. An earlier reconciliationproject for Greek and Turk communities proposed by the US was researched in this article. TheUS doctrinal policy was based on direct the interference in the conflict and involving of theAmerican military forces in the peacemaking operations. The possibility of partial restriction ofthe Cyprus sovereignty or its total abolition was discussed by the American diplomats at thatperiod. The geographical partition of the communities was considered as a clue to the Cyprusquestion. An attention was paid to the external factors that influenced on the US decisionstowards Cyprus. American interests in the Middle East, the specific features of the relationsbetween Greece and Turkey, insecurity in the so called «Eastern flank of NATO», postcolonialpolicy of Great Britain were reviewed as such factors. A special challenge for the US diplomacywas negative and intransigent attitude by the Greek and Turk community's leaders towardsexternal influence. In 1964 the USA send two diplomatic missions to convince the opposingparties of the need to accept the American project. The US diplomatic activity strengthened theinternationalization of the Cyprus question. After the fail of the conservative US projectstowards the Cyprus question, a way to the international peacekeeping operation provided by theUnited Nations had been paved. ; В статі аналізується американська дипломатія в Східному Середземномор'ї впершій половині 1960-х рр. Користуючись президентськими доктринами щодопріоритетності Близькосхідного регіону та недопущення «комуністичної загрози», СШАрозцінювали міжетнічний конфлікт на Кіпрі 1963-1964 рр. як потенційно небезпечнеявище. Досліджується американський проект примирення греків та турків-кіпріотів довведення на острів міжнародного контингенту ООН. Доктринальна політика США тогочасу спиралась на консервативних засадах й допускала залучення власних національнихзбройних сил в якості миротворців. Проговорювалась можливість частковогообмеження кіпрського суверенітету та територіальне розмежування громад острова.Окрема увага приділена зовнішнім факторам, що вплинули на США при прийняттізазначеного рішення: власні інтереси на Близькому Сході, особливості відносин міжГрецією та Туреччиною як фактор нестабільності НАТО, постколоніальна політикаВеликої Британії тощо. Особливу складність становила непримиренна позиція лідерівгрецької та турецької громад острова по відношенню один до одного та до зовнішньоговпливу. В 1964 р. США надіслали на Кіпр дві дипломатичні місії з метою довестиворогуючим сторонам вигідність американських проектів та схилити супротивниківприпинити конфлікт. Дії США поглибили інтернаціоналізацію кіпрського питання,налаштували громади острова проти зовнішнього впливу. Але, в той же час, ці заходивідкривши шлях до миротворчої діяльності ООН, яка розпочалась відразу після згортанняамериканського проекту.
The article studies the origin and essence of the right to peaceful assemblies and analyzes the historical development of the contents of the right to peaceful assemblies. Several possible definitions are given, in particular in the international law and national legislation. Examples of definitions derived by philosophers and lawyers are also given. The paper outlines historical experience of Ukraine on the issue of the protection of peaceful gatherings, as well as the current situation, both in the legislative aspect and in the aspect of legal proceedings. The factors limiting the right to peaceful assemblies, namely place, time and method, are analyzed. The details of such components of the place factor as private property and public institutions are disclosed. As an example, the paper addresses the cases of British and American Supreme Courts, as well as the cases of ECHR. In addition, the article seeks to establish a reasonable timeframe, illustrating, as an example, the cases of the ECHR and the British Supreme Court. The latter factor determines the factor of the method, substantiating its theoretical aspects by judicial practice. In a separate section, the article deduces a three-component test, emphasizing the importance of the three-component test as the only effective mechanism for setting the framework for the regulation of peaceful assembly. At the same time, possible shortcomings of each link of the three-component test are presented separately. The paper concludes that the establishment of specific general restrictions on peaceful assembly is not possible either in terms of place, or in terms of time or method. Therefore, it is important to remember the need for individual consideration of each case and the application of a three-component test in order to balance the right to peaceful assembly.Article received 26.02.2019 ; Статтю присвячено дослідженню питань обмеження права на мирні зібрання. A number of international legal issues on the deployment of a peacekeeping operation in the east ofUkraine remain unresolved: who and on what line the peacekeeping contingent should share, the legitimization of the peacekeeping operation, the manning of the peacekeeping contingent.Presenting main material. It is acceptable for the United Nations to deploy peacekeeping forces on the internationally recognized border ofUkraine and theRussian Federation. This will stop the support of the separatists from the Russian territory. The position of the RF consists in the division of the conflicting sides according to the actual line of contact. This means that potential peacekeepers, if sent to the conflict zone, will appear in the depth of Ukrainian territory. Their presence will have a "freezing" function and will not allow the Armed Forces of Ukraine to carry out measures to ensure national security and defense, the return of control over temporarily occupied territories in theDonetsk and Lugansk regions.There are two main types of UN operations:- peacekeeping - requires the documented consent of the parties to the conflict, can be carried out by regional organizations, in cooperation with the UN or independently; the UN mandate is desirable, but it may not be;- peace enforcement - requires the existence of a UN Security Council mandate, but does not require the consent of the parties to the conflict.Another group of problems relates to the allocation of peacekeeping contingents. The region, which came under the control of the occupation administration, was declared "the area of implementation of measures to ensure national security and defense, repelling and deterring the armed aggression of theRussian FederationinDonetskand Lugansk regions." This excludes the UN from among the potential regulators, or requires the use of regional organizations instead of UN contingents, in fact, there are only three combat-capable contingents in this region: the NATO Response Force, the European Union Operational and Tactical Union (CJTF), the CSTO Collective Peacekeeping Forces.Conclusions. Thus, for the solution of specific tasks in the context of the conflict in the East of Ukraine, the usual peacekeeping operation or UN political mission is not suitable, but it is precisely the creation of an individual partnership of the forces of various organizations and, possibly, individual states. Such a partnership can include a political and diplomatic mission of the UN and the OSCE, and will rely on the components of the NATO, EU and CSTO crisis response forces to establish the guaranteed separation and violent development of the heavy weapons of the parties. Such a combination of power components makes sense only in the case of full implementation of Minsk agreements.
The right of citizens to meet peacefully and to hold meetings, rallies, marches and demonstrations is prescribed by Art. 39 of the Constitution of Ukraine. Participation in such public activities could be regarded as a form of direct and independent expression of the people's will, as well as the reaction of a society to the actions of the state. In order to prevent a conflict between the society and state, as well as disunity between them, the state should not ignore above-mentioned people's activities. The specified right belongs to the subjective person' srights, the principal purpose of which is to influence the state bodies for solving the most important society-state issues by coordinating and forming the citizens' opinion and the way of its expression, as well as an element of democracy, a mode of participation in the management of state and local affairs. At the same time, it should be noted that such meetings may not always have the nature of political events, and the mentioned right is not always the political one.The vast majority of specialists in the field of law, in particular, the constitutional law, regards the aforementioned right as a type of citizens' political rights that belong exclusively to Ukrainian citizens who have reached 18 years of age and have acquired full legal personality (with some exceptions concerning the right to association in public (non-political) organizations and the right to individual and collective appeals), and express the content of legal relationship between the individual and the state.However, not all scientists agree with the fact that mentioned right belongs exclusively to citizens of a certain state.The right to peaceful assembly is one of the inalienable, inherent rights in a democratic world. It should be noted that resembling rules are accommodated in the acts of international law, as the part of national legislation, in particular, the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights. Furthermore, the international documents establish it as the right of any person, not only the citizen's one. This right is an inalienable one of every person that is provided for both foreigners and stateless persons, hence the subject matter should be considered not as political rights of citizens, but as civil rights of people. Therefore, the appropriate amendments should be made to the current legislation of Ukraine and, primarily, to the Constitution of Ukraine. ; Статтю присвячено визначенню місця права на мирні зібрання в системі конституційних прав і свобод людини і громадянина.На основі проведеного аналізу думок фахівців з питань конституційного права, конституційних положень та міжнародних документів щодо місця права на мирні зібрання в системі конституційних прав і свобод людини і громадянина наголошується, що вказане право варто розглядати не як політичне право громадян, а як одне з особистих, громадянських прав людини.Запропоновано внесення відповідних змін до статті 39 Конституції України.

The article deals with the criterion of "effectiveness – value – time " for the military-economical estimate and choice of the best alternative from the whole complex of possible peacemaking operations, which maximizes the index in a state of the norm increase of the effectiveness of the peacemaking`s system under it`s use, which is related to the average geometrical increase of finances and time`s expenses for the implementation of such an operation. ; Обговорюється критерій "ефективність-вартість-час" для військово-економічного оцінювання і вибору кращої альтернативи із сукупності можливих миротворчих операцій, що максимізує показник у вигляді нормованого приросту ефективності системи миротворчості при її застосуванні, віднесеного до середньогеометричного приросту витрат фінансів і часу на проведення такої операції.
It has been grounded that the right to freedom of peaceful assembly is a unique right that unites the right and freedom of its realization. The realization of this right by some subjects, as well as the obligation of public administration subjects to create conditions for the unimpeded realization of the right to freedom of peaceful assembly require an understanding of the outer shell (form) of realizing the right to freedom of peaceful assembly. Forms of realizing the right to freedom of peaceful assembly have been studied. It has been substantiated that the realization of this right is not limited to the constitutionally prescribed forms, namely meetings, rallies, marches and demonstrations. Much more forms of realizing the right to freedom of peaceful assembly are contained in subordinate regulatory acts. The legal order in Ukraine, based on a generally acceptable type of legal regulation, reveals a number of new forms, which in their essence are forms of realizing the right to peaceful assembly. On the basis of the analysis of the current legislation and the current legal doctrine, the author has formulated classification features and has conducted classification of the forms of realizing the right to freedom of peaceful assembly. The classification is based on such features as normative and legal certainty (constitutional, normatively defined forms and others), involvement of participants (internal and external forms), mobility (static and dynamic forms), isolation of participants (closed and open forms), venue (gatherings held indoors or outdoors), sphere of interests' realization (political, social, economic, cultural, sports, etc.). It has been summarized that the forms of realizing the right to freedom of peaceful assembly make it possible to understand the purpose pursued by the subject of realizing this right, and the place of holding a peaceful assembly significantly influences the further mechanism of ensuring its realization, since the combination of the form and content of the right to freedom of peaceful assembly makes it possible to understand the true essence of this right, as well as to adjust measures to ensure its realization in order to create optimal conditions not only for the realization of this right, but also to prevent its abuse. Thus, they guarantee the rights, freedoms and interests of the rest of the population. ; Досліджено форми здійснення права на свободу мирних зібрань. Обґрунтовано, що здійснення цього права не вичерпується конституційно встановленими формами як-то збори, мітинги, походи та демонстрації. На підставі аналізу чинного законодавства сформульовано класифікаційні ознаки та прокласифіковано форми здійснення права на свободу мирних зібрань.
Under the conditions set out in Part 2 of Art. 19 of the Constitution of Ukraine of the legal order in Ukraine, according to which state bodies to which the National Police of Ukraine belongs, their officials are obliged to act only on the basis, within the powers and in the manner provided by the Constitution and laws of Ukraine, is usually an important issue regulatory and legal regulation of the activities of the bodies of the National Police of Ukraine on ensuring the exercise of the right to freedom of peaceful assembly. The article examines the legal acts, namely the Law of Ukraine "On the National Police", the Criminal Procedure Code of Ukraine, the Resolution of the Cabinet of Ministers of Ukraine, as well as the departmental regulatory acts of the Ministry of Internal Affairs of Ukraine, the Head of the National Police of Ukraine regarding the right to exercise the right to freedom of peaceful assembly. However, the norms of these acts are too general to organize and ensure the exercise of the right to freedom of peaceful assembly by the National Police of Ukraine. The author believes that the adoption of a separate law on peaceful assembly should be amended accordingly to the Law of Ukraine "On Citizens' Appeals", which regulates the authority of the National Police of Ukraine to respond to a message about the intention to exercise the right to peaceful assembly. In addition, the proposed amendments to the Law of Ukraine "On the National Police" will fill in the gaps in the legal regulation of the powers of the National Police of Ukraine to enforce the right to freedom of peaceful assembly. ; Виявлено прогалини законодавства щодо регулювання повноважень органів Національної поліції України, спрямованих на здійснення особами права на свободу мирних зібрань, що негативно позначається на правовому порядку в Україні, який ґрунтується на тому принципі, що органи державної влади, до яких належить Національна поліція України, та їх посадові особи зобов'язані діяти лише на підставі, в межах повноважень та у спосіб, передбачені Конституцією та законами України. Запропоновано низку змін до Закону України «Про Національну поліцію», які заповнять наявні прогалини законодавства у нормативно-правовому регулюванні діяльності Національної поліції України.

A number of international legal issues on the deployment of a peacekeeping operation in the east ofUkraine remain unresolved: who and on what line the peacekeeping contingent should share, the legitimization of the peacekeeping operation, the manning of the peacekeeping contingent.Presenting main material. It is acceptable for the United Nations to deploy peacekeeping forces on the internationally recognized border ofUkraine and theRussian Federation. This will stop the support of the separatists from the Russian territory. The position of the RF consists in the division of the conflicting sides according to the actual line of contact. This means that potential peacekeepers, if sent to the conflict zone, will appear in the depth of Ukrainian territory. Their presence will have a "freezing" function and will not allow the Armed Forces of Ukraine to carry out measures to ensure national security and defense, the return of control over temporarily occupied territories in theDonetsk and Lugansk regions.There are two main types of UN operations:- peacekeeping - requires the documented consent of the parties to the conflict, can be carried out by regional organizations, in cooperation with the UN or independently; the UN mandate is desirable, but it may not be;- peace enforcement - requires the existence of a UN Security Council mandate, but does not require the consent of the parties to the conflict.Another group of problems relates to the allocation of peacekeeping contingents. The region, which came under the control of the occupation administration, was declared "the area of implementation of measures to ensure national security and defense, repelling and deterring the armed aggression of theRussian FederationinDonetskand Lugansk regions." This excludes the UN from among the potential regulators, or requires the use of regional organizations instead of UN contingents, in fact, there are only three combat-capable contingents in this region: the NATO Response Force, the European Union Operational and Tactical Union (CJTF), the CSTO Collective Peacekeeping Forces.Conclusions. Thus, for the solution of specific tasks in the context of the conflict in the East of Ukraine, the usual peacekeeping operation or UN political mission is not suitable, but it is precisely the creation of an individual partnership of the forces of various organizations and, possibly, individual states. Such a partnership can include a political and diplomatic mission of the UN and the OSCE, and will rely on the components of the NATO, EU and CSTO crisis response forces to establish the guaranteed separation and violent development of the heavy weapons of the parties. Such a combination of power components makes sense only in the case of full implementation of Minsk agreements.
The article studies the origin and essence of the right to peaceful assemblies and analyzes the historical development of the contents of the right to peaceful assemblies. Several possible definitions are given, in particular in the international law and national legislation. Examples of definitions derived by philosophers and lawyers are also given. The paper outlines historical experience of Ukraine on the issue of the protection of peaceful gatherings, as well as the current situation, both in the legislative aspect and in the aspect of legal proceedings. The factors limiting the right to peaceful assemblies, namely place, time and method, are analyzed. The details of such components of the place factor as private property and public institutions are disclosed. As an example, the paper addresses the cases of British and American Supreme Courts, as well as the cases of ECHR. In addition, the article seeks to establish a reasonable timeframe, illustrating, as an example, the cases of the ECHR and the British Supreme Court. The latter factor determines the factor of the method, substantiating its theoretical aspects by judicial practice. In a separate section, the article deduces a three-component test, emphasizing the importance of the three-component test as the only effective mechanism for setting the framework for the regulation of peaceful assembly. At the same time, possible shortcomings of each link of the three-component test are presented separately. The paper concludes that the establishment of specific general restrictions on peaceful assembly is not possible either in terms of place, or in terms of time or method. Therefore, it is important to remember the need for individual consideration of each case and the application of a three-component test in order to balance the right to peaceful assembly.Article received 26.02.2019 ; Статтю присвячено дослідженню питань обмеження права на мирні зібрання. The article deals with the analysis of the legal regulation of freedom of peaceful meetings in the national legislation of Ukraine, international legal acts ratified by the Verkhovna Rada of Ukraine, decisions of the European Court of Human Rights, which are related to the sources of law in Ukraine. The relevance of this topic is beyond doubt due to the existing gaps in the legal regulation of peaceful meetings in Ukraine.The purpose of the article is to study and compare the projects of Law of Ukraine "On Guarantees of Freedom of Peaceful Meetings" in accordance with international legal acts and practice of the European Court of Human Rights. The study examines decisions of the European Court of Human Rights in relation to Ukraine – "Verentsov v. Ukraine" and "Shmushkovych v. Ukraine," a number of issues were identified in the rules of the national legislation that require further legal regulation and provided practical recommendations for the improvement of the current legislation.Moreover, the article proposes the author's approaches to solving the problem of the advance warn- ing of the holding of the peaceful meeting, which should depend on the size of the meeting, the reasons for restricting peaceful meetings and the special procedure for appellate consideration of cases of restrictions on the freedom of peaceful meetings. The author also emphasizes the need for the adoption of a special Law "On Peaceful Meetings," which must embody European principles and standards for a peaceful meeting. ; Стаття присвячена дослідженню проблем реалізації права на свободу мирних зібрань в Україні. Обґрунтовано необхідність урегулювання відносин, пов'язаних з проведенням мирних зібрань, спеціальним законом. The relevance of the topic arises from the need to research the information component of the UN peacekeeping operations, being an important tool for achieving its goals in the area of peace and security. The objective of the study is to analyze the information support for the UN peacekeeping operations. The methodological basis of the research is general scientific research principles. Researching the information mechanisms of the UN system, systematic and analytical methods were used with their inherent analysis and synthesis. The historical approach made it possible to trace the evolution of the UN activities in the field of the information support for peacekeeping. The comprehensive use of various methods allowed the creation of a modern picture of the information support for the UN peacekeeping operations. Over the past decade, the UN has repeatedly failed to effectively resolve the conflict, and today its potential has not been improved in this area yet. Negative results in many cases were the consequence of the fact that the facilities available to the Organization did not meet the requirements.

The author analyzes the circumstances in which the ECHR may admit that the state interferes with the right to peaceful assembles and whether this interference is legitimate from the prospective of European Convention.According to the ECHR case law, either act or nonfeasance of general or individual character taken before, during, or after the peaceful assembly could be considered as an interference in the right to peaceful assemble even if such actions had no apparent effect on the actual conduct of peaceful assembly, or formally legally not related to its consequences. The interference may also be recognized when the authorities take no necessary actions related to conduction of peaceful assembly in cases where such actions could be reasonably expected.In order to verify that the interference with the right to freedom of peaceful assembly meets the conditions of the Convention, the Court uses the special three-part test. The interference does not violate the Convention if it is prescribed by the law, has at least one legitimate aim, and is necessary in the democratic society.As to the first requirement, the general practice of the ECHR is used. The restriction on peaceful assembly would be considered as prescribed by the law if the law is accessible and sufficiently precise to enable the citizen to foresee the consequences of his or her behavior, whether lawful or not.It is very hard for applicant to prove that the restriction of the right to freedom of peaceful assembly does not pursue one of the legitimate aims of the Convention. The ECHR in most cases does not question the reference of the state to one of the legitimate aims under the Conventions. The only possible way for the applicant to prove that the restriction does not pursue one of the legitimate aims is to provide Court with the strong evidence that the reference given by the state is purely formal and another hidden aim exists that is not prescribed by the Convention.Interference with the freedom of peaceful assembly must also meet the criteria of necessity in a democratic society.
