The research aims to substantiate economic factors and legal regulation of alimony obligations for minors' maintenance in Russia, referring to other countries' experiences and applying a questionnaire, indicators of the parents' well-being, the satisfaction of the child's needs, and parents' participation in raising a child after a divorce was determined as can be seen in Russia, the USA, Germany, and France. Regression models are built reflecting the influence of the number of alimony payments, the indicator of parent's participation in raising a child, the opportunity costs associated with the choice made by each spouse in favor of the family and children, on the integral indicator of the effectiveness of alimony obligations and its particular indicators. The results obtained have determined the guidelines for forming legal regulation of alimony obligations in Russia, which will increase the legislative efficiency of the recovery of alimony payments
The article analyzes the legislative innovations concerning the enforcement of court decisions on the recovery of alimony in Ukraine. The author analyzes the appropriateness of introducing new powers for enforcement agents from the point of view of maintaining a fair balance between the interests of the society and the interests of the debtor.This issue is urgent because of recent amendments to the Law of Ukraine "On enforcement proceedings." In cases of recovering alimony, state enforcement agents have powers to ban the debtor to use cars, weapons, to hunt, to leave the territory of Ukraine. The danger of abuses by the enforcement agent in the process of execution decisions on the recovering of alimony was noted as a result of changing the order of judicial control in this category of cases from preliminary to the subsequent. These restrictions can be imposed without obligatory preliminary judicial control, as well as in other cases. The actions of enforcement agents to exercise these new powers can be reviewed only with facultative subsequent judicial control, which violates fair balance. The author has analyzed the court practice in appealing of the enforcement agent actions while exercising new powers, which shows that facultative subsequent judicial control still works.It is indicated that introducing new powers only to state enforcement agents is incorrect. This situation is only the fault of the legislator, because private enforcement agents have the right to execute court decisions on alimony recovery as well as state ones, but private enforcement agents do not have the same powers as state enforcement agents do. It can even be called discrimination of private enforcement agents. The amendments to the law are recommended to provide private enforcement agents with the same powers in cases of recovering alimony, as well as to state enforcement agents.In order to comply with the fair balance, it is proposed to extend the list of cases in which it is prohibited to apply restrictions on debtors in enforcement proceedings for the recovery of alimony.Article received 28.02.2019 ; У статті проведено аналіз законодавчих новел, що стосуються виконання судових рішень про стягнення аліментів. His article discusses the issues of the legal nature of the agreement on the payment of alimony, defines the procedural aspects of the consideration of cases on the recovery of alimony in the courts. Based on the analysis of legal norms, scientific doctrine and materials of judicial practice, the author came to the conclusion that the essence of the agreement on the payment of alimony is heterogeneous, the content and structure of the alimony obligation is complex, court decisions on the recovery of alimony differ in specifics. When writing the article, the following methods were used: synthesis, analysis, the method of comparative law, etc. The practical significance of the work lies in the fact that the agreement on the payment of alimony refers to a special kind of enforcement document, the presence of which allows the parties to settle their relations outside of the judicial process. At the same time, in cases when the parties go to court, the consideration of such cases is peculiar, which is due to the ambiguous legal essence of such agreements, in particular, claims for the recovery of alimony, as a rule, arise within the framework of divorce proceedings, deprivation of parental rights or in the case of establishing paternity. Such requirements are interrelated, the legal basis for combining claims is the content of procedural norms, their consideration in one judicial process eliminates the possibility of making contradictory court decisions. As a result of the research, the author determined the relationship and interdependence of the norms of family, civil and procedural type, which allows in practice to identify the specifics and additional opportunities, new ways of proper execution of court decisions on alimony.
Non-payment of alimony by parents for their children is a serious problem in Poland, which has negative social and economic consequences. It results in the inability to satisfy the necessary needs for their proper development and thus deprives them of prospects and a chance for a dignified life. This article begins by explaining the concept of non-alimony and presenting the scale of the phenomenon to gain awareness of the size of this social problem. In the following part, an analysis was carried out on the social aspects of non-alimony. This issue was described from the point of view of the situation of mothers who were forced to take over the entire burden of supporting their children, without the support of former partners. The consequences of the economic abandonment of children by one of the parents are also presented. The social aspect has also been discussed through the prism of the social campaigns conducted over the last few years to shape the correct attitudes of parents. Due to the fact that in Poland the phenomenon of non-alimony is considered primarily in the legal context, the subsequent part of the article presents a synthetic analysis in this respect. It focuses on the changes that the Polish legislator has introduced into the domestic legal system over the last 3 years. The discussion of this issue began with the offence of non-alimony regulated in Article 209 of the Penal Code, due to its amendment in 2017. It was supposed to become an effective tool to mobilise obliged parents to fulfil their obligation to support their children. Further amendments to the legislation were also reviewed in order to further improve the effectiveness of the enforcement of maintenance support.

The child's right to a standard of living necessary for his or her physical, mental, spiritual and social development is ensured by consolidating the parent's responsibility for maintenance. Given the growing number of marriages with foreign nationals and stateless persons, the problems of recovery of alimony during the residence of spouses in different countries have become especially relevant. Despite the undoubted need for international cooperation in this area, many states are not party to any convention governing the recovery of alimony when the payer resides in another state. The article considers the main Conventions and the procedure for recovery of alimony in cross-border relations. Among the most important international regulations governing cross-border alimony relations is the UN Convention of 20 June 1956 on the Recovery Abroad of Alimony; The Hague Convention of 24 October 1956 on the Law Applicable to Child Support Obligations; The Hague Convention of 15 April 1958 on the Recognition and Enforcement of Decisions concerning Child Support; Hague Convention of 2 October 1973 on the Recognition and Enforcement of Decisions Concerning Maintenance Obligations; Protocol of 23 November 2007 on the law applicable to alimony; UN Convention on the Rights of the Child 1989; European Council Regulation No. 4/2009 "On jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in the field of maintenance obligations". The main provisions of these Conventions, which offer a unified approach to the legal regulation of alimony relations, relations on the recovery of alimony, are discussed in the article. Aliment relationsare one of the most important categories of modern family law. The parties to the alimony obligation are the payer of alimony (the person who is obliged to pay alimony) and the recipient of alimony (the person who has the right to demand payment of alimony from the payer). The specifics of parental alimony obligations for the maintenance of minor children are the emergence of these legal relations, regardless of any circumstances, such as loss of employment by a person who is obliged to pay alimony, financial difficulties, other cases of lack of sufficient funds for child support. The legislation enshrines the absolute nature of the maintenance obligations of parents. ; Право дитини на рівень життя, необхідний для її фізичного, розу-мового, духовного і соціального розвитку, забезпечується закрі-пленням обов'язків батьків щодо утримання. З огляду на зростання кількості шлюбів, що укладаються з іноземними громадянами та осо-бами без громадянства, особли-вої актуальності набули проблеми стягнення аліментів у разі проживання подружжя в різних державах. У статті розглянуті основні Конвенції та порядок стягнення аліментів у транскордонних відносинах. Серед найважливіших міжнарод-них нормативних актів, що регулю-ють транскордонні аліментні відно-сини, є Конвенція ООН від 20 червня 1956 року про стягнення за кордо-ном аліментів; Гаазька конвенція від 24 жовтня 1956 року про право, що застосовується до аліментних зобов'язань стосовно дітей; Гаазька конвенція від 15 квітня 1958 про визнання та виконання рішень щодо аліментних зобов'язань сто-совно дітей; Гаазька конвенція від 02 жовтня 1973 року про визнання і виконання рішень стосовно зобов'я-зань про утримання; Протокол від 23 листопада 2007 року про право, що застосовується до алімент-них відносин; Конвенція ООН «Про права дитини» 1989 року; Регла-мент Європейської ради No 4/2009 «Про юрисдикцію, застосовне право, визнання та виконання рішень, а також співробітництво в галузі аліментних зобов'язань». Основні положення цих Конвенцій, що про-понують єдиний підхід до правового регулювання аліментних відносин, відносин щодо стягнення аліментів, розглянуті у статті. Аліментні зобов'язання є однією з найбільш важливих категорій сучасного сімейного права. Сто-ронами аліментного зобов'язання є платник аліментів (особа, яка зобов'язана сплачувати аліменти) і одержувач аліментів (особа, яка має право вимагати від платника сплати аліментів). Специфікою аліментних зобов'язань батьків щодо утримання неповнолітніх дітей є виникнення таких право-відносин незалежно від будь-яких обставин, наприклад, втрати роботи особою, яка зобов'язана сплачувати аліменти, важке мате-ріальне становище, інші випадки відсутності у платника достат-ніх коштів на утримання дитини. У законодавстві закріплений абсо-лютний характер аліментних обов'язків батьків.
The article analyzes the problem of non-payment of parental alimony in Russia, which correlates with the prob-lem of poverty. Children from families with significant financial difficulties, as adults, are trapped in the poverty experienced by their parents. Thus poverty is reproduced from generation to generation. Based on research materials, a social portrait of alimony defaulters is revealed, which are most often divorced young fathers. The article examines measures to increase alimony payments, including such measures as establishing the State Alimony Fund, introducing alimony allowance, establishing a minimum amount of alimony. Foreign experience in solving the problem of non-payment of alimony is analyzed. Conclusion swells upon the fact that the pro-posed measures can significantly optimize the standard of living of children from divorced families.
