Abstract

The introduction of the human rights in the Constitutions, that is the main characteristicof the Constitutional states, has given an important role to ConstitutionalCourts because they are responsible for protecting and interpreting those rights. Thisrole assigned to judges has been discussed because it means a restriction to the decisionsthat can be adopted by a political majority. In this paper, the characteristics ofthe tension between democracy and constitutionalism will be studied and it will beargued that judicial power can be a guarantee of democracy if we understand its roleas an interpretative role of the contents of the Constitution. ; La inclusión de los derechos humanos en los textos constitucionales, principal característica de los Estados constitucionales, ha otorgado mucho protagonismo a losTribunales Constitucionales, que son los encargados de custodiar e interpretar elalcance de tales derechos. Se ha cuestionado esta función del poder judicial por seruna restricción a la decisión de las mayorías políticas. En este trabajo, se analizan las características de la tensión entre constitucionalismo y democracia y se intenta ver como el poder judicial puede entenderse como una garantía a la democracia al ser sutarea principalmente interpretativa a partir de lo contenido en el propio texto constitucional.
