In handelspolitischen Fragen spricht die EU nach außen hin mit einer "Stimme". In Verhandlungen mit Dritten müssen die Mitgliedsstaaten zunächst zu einer gemeinsamen Verhandlungsposition gelangen. Der Aufsatz untersucht, inwieweit die institutionelle Ausgestaltung der Union die Herausbildung einer gemeinsamen Verhandlungsposition prägt. Abstimmungsverhalten und Verhandlungskompetenzen in der EU beeinflußen die Wahrscheinlichkeit eines erfolgreichen Abschluß internationaler Verhandlungen und deren zentralen Inhalte. Die jüngsten Verhandlungen zwischen den Vereinigten Staaten und der EU in den Bereichen Landwirtschaft, öffentliche Beschaffung und Luftverkehr zeigen deutlich, daß sich die institutionellen Mechanismen der EU auf die Inhalte internationaler Handelsabkommen auswirken. How can the UN Security Council contribute to the maintenance of international peace and security in times of heightened tensions, global polarisation, and contestation about the principles underlying the international legal and political order? In this Trialogue, experts with diverse geographic, socio-legal, and ideational backgrounds present their perspectives on the Security Council's historic development, its present functions and deficits, and its defining tensions and future trajectories. Three approaches engage with each other: a power-focused approach emphasising the role of China as an emerging actor; an institutionalist perspective exploring how less powerful states, particularly the elected members of the Security Council, exert influence and may strengthen rule-of-law standards; a regionalist perspective investigating how the Security Council as the central actor can cooperate with regional organisations towards maintaining international peace and security. The aim of China's Silk Road Initiative is to bolster both its international legitimacy and its geopolitical power. One important element of the initiative is the plan to transport export goods by high-speed train to Western Europe. In order to ensure that rapid freight transit is profitable in the long term, Beijing believes that major changes are needed along the borders of Central Asia. The Chinese government has explicitly called for reforms from its partner countries, including Kazakhstan and Uzbekistan, meaning greater economic openness, regional cooperation and modern border crossings. The opportunities for change in Central Asia are now much better than in the past. Kazakhstan and Uzbekistan's growth models have reached their limits and both countries are now under considerable pressure to reform. Uzbekistan's new president has also announced promising new reform policies. In addition, political rule in Central Asia is now more institutionalized and, therefore, increasing scope for partial reforms. Furthermore, since the beginning of the century, China has become a powerful actor in the region. Unlike Russia, it is interested in better intra-regional cooperation in Central Asia and, ultimately, the Silk Road Initiative provides incentives for reform and greater cooperation at the borders. For Germany and the EU, it might be worth discussing common interests with China and how synergies could be used to positively influence the reforms. En 2014 "Nicaragua inició una demanda contra Colombia para determinar la delimitación de las fronteras entre la plataforma continental de Nicaragua más allá de las 200 millas náuticas y la plataforma continental de Colombia" (La Fm, 2014). Este país ya había presentado una primera demanda en 2001 la cual le resultó favorable, sin embargo, busca mantiene una actitud ambiciosa y se plantea adquirir más plataforma continental y zona económica exclusiva. Estos hechos son preocupantes a los ojos de la población colombiana, la cual rechazó contundentemente la decisión de la Corte Internacional de Justicia. La controversia se desenvuelve en una zona de indescriptible dinamismo político, económico y cultural, de unas características geográficas excepcionales y que presenta grandes ventajas a aquellos Estados que logren controlarla; el espacio en referencia es el Mar Caribe. A su vez, la disputa se enmarca en una reconfiguración global de la distribución de poder, con la confluencia de los intereses de potencias extra continentales. Estas han aportado según el análisis, para aprovechar las desgracias de Colombia. De esta forma, la búsqueda de explicación a diversos interrogantes se legitima, entre estas inquietudes se hallan: ¿Colombia tenía títulos jurídicos que validaran su soberanía sobre el archipiélago de San Andrés, las aguas circundantes, el suelo y el subsuelo marino? ¿Colombia había definido sus límites marítimos con Nicaragua? ¿La búsqueda por parte de Nicaragua de hacerse con una mayor extensión marítima en su costa atlántica es reciente? ¿Quién fue el culpable del resultado del fallo de la Corte Internacional de Justicia de 2012? ¿Qué se espera que pase con las relaciones bilaterales entre Colombia y Nicaragua? ¿Cuál es la importancia geográfica, geoestratégica y geopolítica del Caribe? ¿Cuáles son los intereses de China y Rusia en el Caribe? ¿Tiene consecuencias regionales o internacionales esta controversia? Y finalmente ¿Cuál es el impacto para la seguridad nacional de un Estado el someterse a las instituciones jurídicas internacionales o abstenerse de participar en ellas y no acatar sus sentencias? Con el fin de responder a estos interrogantes y con el propósito de desarrollar un análisis multidisciplinario del tema que convoca este escrito es necesario, en primer lugar, tener claro el desarrollo histórico de la titularidad de los territorios neogranadinos y colombianos, así como su importancia geoestratégica para las potencias coloniales; en un segundo momento, observar la dinámica jurídica y argumentativa que tuvo lugar con cargo a otros casos que son de actualidad y que si bien es cierto pareciera no guardan relación directa con el escenario para Colombia, sí, tienen algunos elementos comunes como lo son la definición de límites entre los estados, el sistema internacional la Corte Internacional de Justicia y los intereses de los estados potencia para preservar y garantizar no solo su desarrollo económico sino su seguridad nacional. Un elemento común evidente en los casos que analizaremos es la participación de la CIJ como organismo del sistema internacional ya sea por los conflictos internacionales de este orden y su intervención directa para dirimirlos por sentencia o por su opinión al mismo respecto, escenario al cual acudió Nicaragua contra Colombia; en tercer lugar, analizar las oportunidades y ventajas que ofrecen el Caribe y el archipiélago de San Andrés y Providencia a quien domine geoestratégicamente sobre ellos, especialmente, para la consecución de intereses nacionales particulares como pareciera puede ser el caso. ; This area of America-the Caribbean Sea seems to live in constant turmoil Londoño, 1973. Within the last few years, the main international rating agencies have become even more prominent. They are mentioned in different circumstances. Some people think these agencies are managed by international speculators; others consider that their work is too technical and impartial, and others believe they should be replaced by exclusively European rating agencies. As seen, there are several opinions, but the fact is that financial analysts' recommendations and investors' decisions, concerning a real, financial economy, are based on the rating given to sovereign debts and companies quoted in international financial markets.This article uses a methodology concentrating the different criteria used by two of the main international rating agencies: Standard and Poor's and Moody's. Spain is the country analyzed and this is done from four points of view: political, economical, solvency, and liquidity. The data compared ranges from December 2001 to December 2012. In diesem Artikel werden die empirischen Ergebnisse des "Rational Design Projects" zusammengefasst. Im allgemeinen unterstützen die Resultate die Hypothesen des Projektes, v.a. jene bzgl. Flexibilität und Zentralisierung, einige Ergebnisse sind nicht überzeugend (v.a. jene bzgl. der Reichweite) oder weisen auf einen Bedarf an theoretischer Neuformulierung hin (v.a. bzgl. der Mitgliederdimension). Es werden auch die weiteren Implikationen der Ergebnisse dieses Bandes angesprochen, konzentriert auf mehrere Themenbereiche, die direkt mit der systematischen Untersuchung von institutioneller Gestaltung zusammenhängen. Zuerst werden die Dilemmas bei der Entwicklung hochformalisierter Modelle zur Anleitung der Analyse betrachtet. Zweitens führt die Diskussion der variablen Kontrolle zu einer expliziteren Berücksichtigung von "Macht" in der Analyse. Es wird auch untersucht, inwieweit Innenpolitik in der Analyse internationaler Institutionen berücksichtigt werden kann. The rapid economic and political rise of Brazil, Russia, India, China and South Africa (BRICS) as an informal co-operative group as well as their individual emergence on the international stage as influential actors have shifted the power dynamics of the international world order. Most importantly, the emergence of BRICS after the financial crisis has changed the structural dynamics of the West-dominated financial system by providing an alternative bypassing the normative structure. Of which, what provided the institutional framework to the BRICS is the New Development Bank and the Contingent Reserve Arrangement- key milestones of cooperation among emerging economies and developing countries. Thereby, this makes it imperative to understand the role of BRICS as an important platform in the international order and how it is shaping the international order.
