Impacto de la legislación aplicable a la catalogación de vehículos históricos sobre el consumo de combustible y el impacto medioambiental del parque automovilístico español. Propuesta para una nueva legislación
Actualmente la mayoría de la población de la Unión Europea se concentra en el medio urbano provocando un aumento de los desplazamientos, lo que lleva al sector del transporte a ser una importante fuente generadora de emisiones nocivas para el medioambiente. Esta situación está llevando a los Organismos Oficiales competentes a adoptar medidas cada vez más duras contra el tráfico rodado centrándolas sobre todo en los vehículos más antiguos por ser los que presentan un grado de contaminación mayor. En los inicios de la automoción se experimentó con las distintas tecnologías y fuentes de energía existentes, decantándose por la que presentaban menos inconvenientes de autonomía y mayor facilidad de repostaje, sin prever las repercusiones negativas que para el medioambiente tenía el uso de motores alimentados con productos derivados del petróleo. No es hasta mediados del siglo XX cuando se señala al humo expulsado por el tubo de escape de los vehículos como uno de los causantes de la contaminación atmosférica existente en las principales ciudades. A partir de ese momento se dicta infinidad de normativa para regular y disminuir estas emisiones nocivas, haciendo que cada vez se fabriquen vehículos más limpios. Junto con el desarrollo de los vehículos nace un movimiento que quiere preservar para las generaciones presentes y futuras los vehículos que van quedando descatalogados y obsoletos, siendo necesario regular su situación para poder conjugar la circulación de los mismos con los problemas medioambientales que causan. En España, en 1995, nace el Reglamento de Vehículos Históricos que viene a ordenar el vacío existente, si bien, el tiempo transcurrido ha puesto de manifiesto las carencias que tiene esa reglamentación y la disparidad de criterios que existe en su aplicación. Esta trabajo hace un esquemático recorrido por las distintas normativas anticontaminación que se han ido aplicando a lo largo de los años, desde el Acuerdo de Ginebra de 1958 hasta la actual norma Euro 6, para después estudiar las emisiones contaminantes producidas por los vehículos en general y los históricos en particular, cuantificando el consumo de combustible y las emisiones a la atmósfera de veintitrés agentes contaminantes producidas por el parque de Turismos existente en España en el año 2015. Con los resultados obtenidos se puede cuantificar la contaminación producida por los Turismos que tienen treinta o más años de antigüedad. Una vez establecidas las carencias que presenta la actual regulación de vehículos históricos y estimadas las emisiones contaminantes y el consumo de combustible de los Turismos más antiguos, se pone en evidencia la necesidad de establecer una nueva regulación que subsane los problemas detectados. Esta nueva normativa mejora de forma sustancial el actual Reglamento de Vehículos Históricos, simplifica los procedimientos para la matriculación y circulación de estos vehículos y propone una medida fundamental basada en adecuar su circulación a la que vienen realizando la mayoría de ellos ahora, consistente en no sobrepasar los 1.500 kilómetros anuales, consiguiéndose de esta forma reducir el consumo de combustible y las emisiones contaminantes de los veintitrés agentes estudiados hasta poder equipararlos de forma global a los datos obtenidos para un Turismo Euro 6. La única forma de que un vehículo histórico se mantenga en perfecto estado de conservación y funcionamiento es circulando. Aun habiendo determinado que un vehículo antiguo contamina más por cada kilómetro recorrido que uno actual, esta tesis doctoral demuestra la hipótesis de que la circulación de un vehículo antiguo no tiene por qué ser más perjudicial para el medioambiente que la de uno actual si la misma se realiza de una forma ordenada, lo cual se consigue con la legislación adecuada adaptada a las circunstancias específicas de este tipo de vehículos. ; Currently the majority of the population of the European Union is concentrated in urban areas causing an increase of the displacements, which takes to the sector of the transport to be an important source generating emissions harmful to the environment. This situation is leading the competent Official Bodies to adopt increasingly hard measures against road traffic, focusing especially on older vehicles because they are those with a higher degree of pollution. In the beginnings of the automotive industry, it was experimented with different technologies and energy sources, opting for less autonomy and easier refueling, without foreseeing the negative repercussions that the environment had on the use of engines powered by products petroleum derivatives. It was not until the middle of the 20th century when smoke was ejected from the exhaust pipe of vehicles as one of the causes of air pollution existing in major cities. From that moment an infinite number of regulations is dictated to regulate and to diminish these harmful emissions, causing that each time they are made vehicles cleaner. Along with the development of the vehicles, a movement is born that wants to preserve for the present and future generations the vehicles that are being discontinued and obsolete, being necessary to regulate their situation in order to be able to combine their circulation with the environmental problems they cause. In Spain, in 1995, the Regulation of Historical Vehicles was born to order the existing void, although the time elapsed has revealed the shortcomings of this regulation and the disparity of criteria that exists in its application. This work makes a schematic tour of the various anti-pollution regulations that have been applied over the years, from the Geneva Agreement of 1958 to the current Euro 6 standard, to then study the pollutant emissions produced by vehicles in general and the history in particular, quantifying the fuel consumption and emissions to the atmosphere of twenty-three pollutants produced by the existing passenger car park in Spain in 2015. With the results obtained can be quantified the pollution produced by the passenger cars that are thirty or more years old. Once established the shortcomings presented by the current regulation of historic vehicles and estimated the pollutant emissions and fuel consumption of older passenger cars, it is evident the need to establish a new regulation to overcome the problems detected. This new regulation substantially improves the current Regulation of Historical Vehicles, simplifies the procedures for the registration and circulation of these vehicles and proposes a fundamental measure based on adapting its circulation to which most of them are now doing, not to exceed the 1.500 kilometers per year, thus reducing fuel consumption and pollutant emissions of the twenty-three agents studied until they can be compared globally to the data obtained for a Euro 6 passenger car. The only way for a historic vehicle to remain in perfect state of maintenance and operation is to circulate. Even though it has been determined that an old vehicle is polluting more for each kilometer traveled than a current one, this doctoral thesis demonstrates the hypothesis that the circulation of an old vehicle does not have to be more harmful to the environment than the current one if it is performed in an orderly manner, which is achieved with the appropriate legislation adapted to the specific circumstances of this type of vehicles.
