Providing specific criminal protection for migrant minors requires the balance of two legal aspects related to the specific weaknesses of the children; on the one hand, the condition of the minor is characterized by the inadequate experience and specific risks of victimization; on the other hand, the migrant status is related to the lack of social and family references, economic need and diversity of culture. The protection the two mentioned legal aspects requires the enforcement of both different rules to be combined; the application of existing regulations, with the evaluation of the crime's circumstances, as well as the definition of new criminal figures, who identify some peculiar forms of possible aggression or endangerment, are both useful solutions for the very problematic balance of the two goods. In order to provide effective protection for migrant minors, it is essential to fully implement the principle of "last resort". Criminal protection, in fact, should only intervene in support and completion of priority preventive administrative safeguards; the administrative protection has to intervene before the commission of serious crimes, which risk compromising, even irremediably, the personality of the vulnerable minor. Otherwise, the administrative action would provide only indirect protection, with no effects on weak persons; an efficient intervention aims to preserve the fragility of the migrant child taking into account the objective risks, often very serious, due to the simultaneous of the two conditions (minor age and migration status). Criminal protection alone would not prevent the maturing of trauma, harassment, exploitation, material and educational deprivation. In the EC and EU Treaties (at present Lisbon Treaty that includes TEU and TEUF), the ICT is not the subject of specific provisions. However it has been held in high regard by the European Institutions. This study therefore examined the provisions of the above mentioned Treaties considered more or less directly or indirectly linked to the computerization in general and that of P.A. in particular, on the basis of which have been issued documents of various types, programmatic or binding. The European Union has placed the development of the ICT among the seven flagships initiatives of the "Europe 2020" prospectus. This program was set for the purpose to influence the social and economic development of Europe and to fight the crisis that began in 2008. This initiative, issued by the European Commission in its communication COM/2010/0245 f/2, was called the European Digital Agenda. It is divided into subprograms wide-­‐ranging, aimed at the development of networks and digitization in all areas of social life, from e-­‐ commerce to the Public Administration. As part of the Digital Agenda actions have been developed in order to establish the substantive and legal conditions to allow legal activities in electronic form to develop the basic technical tools. The second aim of this program is the reliability of the operations normally carried out at a distance. Particular attention was paid to the activity of the Public Administration, always from the point of view of interoperability at European level. At present we have the ISA2 program which 6 aims to encourage, also by specific funding, the administrations to develop advanced interoperable systems, indicating as a solution also the one stop shop. These acts are planning documents (which have the characteristics of soft law acts) whose objectives should be implemented by the administrations of the EU member States. A key legal instrument was approved July 23, 2014: the Regulation 910/2014, called eIDAS, which regulates the conditions of security in all its aspects (not only for electronic signature), giving a lead role to the trust service providers. The doctrine both on the ISA2 programme and on the eIDAS Regulation is currently very limited. While the solutions stimulated by ISA2 are entrusted to the spontaneous initiatives, different is the setting of the law sources discussed in Chapter 3: these are two directives containing very advanced solutions governed directly by European Law. The Directive 2006/123/EC on services in the internal market, which provides the one stop shop. The Directive 2014/24/EU on public procurement, in which the digitization and online management tools are essential to ensure competition and transparency. Finally, we examine two sources connected to each other, the object of which impact significantly on the subject of our investigation: Directive 2013/37/EU on the reuse of public sector information and the regulations being approved on the protection of privacy.

Le tattiche dell'accerchiamento (The tactics of encircling) are those mechanisms through which a social conflict is criminalized. The term is borrowed from Michel Foucault's concept of stratégie du pour tour, a process conducted by different agencies of control that consists of generating fear and constructing exemplar cases on the base of a commune dispositive: the defense of society. The work detects the micro-tactics of this strategy through an analysis of media discourse and an ethnography of the two major penal process against the opposition to the Turin-Lyon high-speed railway project (No Tav Movement). The main argument is that these tactics of encircling reveal a Positivistic legacy and a blend of that with the principle of the Reason of State. The counter-conducts to these tactics of encircling have been performed by the No Tav movement during the last 12 years to reaching the point of a resistance not only to a train but to an overall neoliberal governmentality, in which law mimes the market, is applied by a judicial field that functions as the manager of security and protection, and treats the population through an attempt of separating the good and the bad population.

The article poses the problem of the possible identification in the Italian legal system of an organic collection of regulations that govern and control libraries, with special reference to those that carry out a public service. It is basically a question of establishing if in Italy there is a "library law", that in any case represents a more extensive and complex phenomenon than simple library legislation. Reference is in fact made to the concept of "juridical process", as outlined especially by Norberto Bobbio, regarding and strictly connected to the other fundamental concept of juridical system, within the realm of which juridical institutes are born, in a framework that must exclude the presence of "antinomies", that is to say of contradictions between regulations.It is well known that the Italian situation is characterized by the absence of an organic state law on libraries and by the presence, on the other hand, of a vast legislative corpus of a regional nature; this leads to the emergence in the library field not only of legislative sources that differ from those of the state, but even of a plurality of juridical systems, composed not only of formal laws, but of legislative situations of various nature. What has however been lacking up to now, both on the state side and on that of the region, is an activity of systematizing those regulations capable of outlining with precision and effectiveness some fundamental institutes, first and foremost that of public libraries. The most recent developments of basic local autonomy and the progressive establishment of the need for inter-institutional initiatives, based on the principle whereby in the case of two crimes, the punishment for the more serious crime takes precedence over the application of the punishment for the less serious crime, do perhaps make it possible to foresee a path to a better systemic arrangement, which however cannot disregard, obviously, the effective existence of sufficiently equipped library institutes. This can also form the confirmation of some principles established by the institutional school: that is to say the logical precedence of bodies that can be organized over the pure manifestation of legislative will. ; La questione posta nell'articolo riguarda la possibilità di individuare nell'ordinamento italiano un insieme organico di norme che disciplinano e regolano le biblioteche, con particolare riferimento a quelle che svolgono un servizio pubblico. Si tratta insomma di stabilire se esiste in Italia un "diritto delle biblioteche", che rappresenta comunque un fenomeno più ampio e complesso della semplice legislazione bibliotecaria.Viene fatto riferimento al concetto di "sistema giuridico", così come è stato delineato in particolare da Norberto Bobbio, in riferimento e in stretta connessione con l'altro concetto fondamentale di ordinamento giuridico, nell'ambito del quale si determina la nascita degli istituti giuridici, in un quadro che deve escludere la presenza di "antinomie", vale a dire di contraddizione tra le norme.La situazione italiana è caratterizzata, come è ben noto, dall'assenza di una legislazione statale organica sulle biblioteche e dalla presenza, invece, di un vasto corpusnormativo di carattere regionale; ciò porta a configurare l'esistenza in campo bibliotecario non solo di fonti legislative diverse da quelle statali, ma addirittura di una pluralità di ordinamenti giuridici, fatti non solo di leggi formali, ma di realtà normative di varia natura. E' mancata tuttavia, fino ad ora, sia sul versante statale che su quello regionale un'attività di sistematizzazione delle norme capace di delineare con precisione ed efficacia alcuni fondamentali istituti, primo tra tutti quello della biblioteca pubblica.I più recenti sviluppi dell'autonomia locale di base e la progressiva affermazione della necessità di iniziative inter-istituzionali basate sul principio di sussidiarietà permettono forse di intravedere una strada di migliore organizzazione sistemica, che non può tuttavia prescindere, come ovvio, dall'effettiva esistenza di istituti bibliotecari sufficientemente attrezzati. Ciò può anche costituire una conferma di alcuni principi posti dalla scuola istituzionale: vale a dire la precedenza logica di entità organizzabili rispetto alla pura manifestazione di volontà normativa.

Dal 2 settembre 2006, con l'entrata in vigore del regolamento, d.P.R. 3 maggio 2006, n. 252 (pubblicato nella G.U. n. 191 del 18 agosto 2006), è stata data attuazione alla nuova normativa sul deposito legale, basata sulla legge 15 aprile 2004, n. 106. A fronte delle aspettative dei bibliotecari riguardo a una riforma lungamente invocata - alla precedente legge 374 del 1939 ci si riferiva come ad "una legge da rifare" già nel 19461 - per il momento gli esiti suscitano qualche perplessità: alla condivisibile impostazione generale della legge corrispondono modalità di attuazione che, alla prova dei fatti, sembrano risultare poco chiare a molti dei soggetti coinvolti, tanto che questa fase di prima applicazione della normativa si sta rivelando più impegnativa del previsto un po' per tutti2. Avendo seguito da vicino l'iter della riforma per conto dell'Associazione italiana biblioteche, e trovandomi ad affrontarne gli effetti nel lavoro corrente, vorrei tentare un'analisi di alcuni "punti critici" della nuova normativa, per contribuire a fare chiarezza sulle modalità della sua applicazione, e in vista dei passi successivi attraverso cui essa dovrà dispiegare tutti i suoi effetti: infatti, per la concreta realizzazione del previsto «archivio regionale delle pubblicazioni», si dovrà attendere l'iniziativa delle Regioni, entro il prossimo 2 giugno.Questo contributo non ripercorrerà (se non per quanto sia funzionale all'analisi) tutte le discussioni relative all'ultima riforma3, ma ne passerà in rassegna alcuni aspetti di ordine generale e altri più specifici, in relazione alle tipologie di documenti che stanno presentando maggiori criticità, all'individuazione dei soggetti obbligati al deposito, ai possibili modelli di archivio nazionale e regionale. Si accennerà appena, invece, alle troppo estese e al tempo stesso specifiche problematiche connesse al deposito dei documenti diffusi in rete: la disciplina di quest'ultimo, ai sensi dell'art. 37 del d.P.R. 252, è rimandata a un successivo decreto, con una scelta rispetto alla quale i bibliotecari più consapevoli e l'Associazione hanno immediatamente espresso perplessità e preoccupazione4.Il mio contributo è stato preceduto da un'analisi della legge 106 e del regolamento pubblicata recentemente da Giuseppe Vitiello5, i cui fili conduttori sono il confronto con le contemporanee tendenze internazionali, e la verifica della sostenibilità degli obiettivi della legge alla luce degli adempimenti previsti e della stima dei relativi costi. Anticipo che condivido in larga misura le critiche espresse nel corso di quest'analisi, e avrò cura invece di evidenziare i punti riguardo ai quali me ne discosto; in generale, differenza e limite del mio intervento rispetto all'orizzonte internazionale di Vitiello vanno individuati nel mio dare conto, prevalentemente, di una verifica concreta dell'impatto della nuova normativa, dal punto di osservazione della Biblioteca nazionale centrale di Roma, oltre che, per tutto ciò che riguarda l'iter della legge, dalla "prima linea" dell'AIB. ; The authoress, who on behalf of the AIB, personally followed the reform process of Italian legislation on legal deposit, analyzes the main critical points of the new regulations in force since 2nd September 2006. The most immediate objectives of the article are the clarification of some procedures, and the encouragement to reflect especially in view of the decisions that each single region will be called to make, by June 2nd next, to implement the "regional archive of publications" that will cooperate with the "national" archive linked to the two central national libraries of Rome and Florence, the State Record Library, the National Institute for Graphics and other specialized institutions. At a more general level, the authoress starts from an analysis of some specific problems regarding the different types of documents subject to the law and emphasises some basic deficiencies in reference to the latter. She wonders about the possibility of implementing provisions for making it work better beginning with some minimum instruments that it offers, as long as it is correctly interpreted and there is a desire to rationalize the system, that otherwise risks turning out to be almost unmanageable and uselessly costly. In this sense it seems to be essential that depositary libraries are given the chance of a "conscious purchase" of the documents that reach them - not before having definitively clarified the problems highlighted, in the stage of initial application of the law, in relation to some "untypical" documentary types. Within a framework of cooperation between various institutions, it will then be essential to work for achieving a system of "deposit and conservation at various levels" that considers the different peculiarities of the national archive and of the regional archive, and that develops them within this rationalization, and the achievement of an added value for users. Finally it is hoped that there will shortly be a privileged occasion for confrontation between all the subjects interested in the good functioning of the law, identifiable in the Commission for the legal deposit as described in article 42 of the regulation.

La presente ricerca è finalizzata a vagliare gli approdi raggiunti dalla c.d. "questione animale" e la corrispondente evoluzione della coscienza sociale relativa alla considerazione degli animali. Tali approdi sono il risultato di un importante sviluppo della ricerca scientifica, etica e filosofica e della diffusione nella mentalità sociale di acquisizioni oramai irrefutabili nel campo delle scienze biologiche, zoologiche, cognitive, che hanno reso improponibili le vecchie certezze sulla irriducibile, ontologica, separatezza dell'uomo rispetto agli animali. Da ciò, l'elaborato è volto a porre in rilievo il cammino che tanto l'ordinamento nazionale, quanto quelli comunitario ed internazionale, hanno intrapreso al fine di elaborare tutele concrete nei confronti degli animali, cercando progressivamente di mitigare e smussare quella visione strettamente antropocentrica ed autoreferenziale che è base e fondamento dei sistemi giuridici. Il rapporto che lega l'uomo agli animali ci ha portato a valorizzare gli stessi sotto diversi profili e a predisporre per essi una tutela policentrica. Gli animali integrano, nel nostro modo di concepire la realtà, valori plurimi e ad essi il legislatore ha riferito in tempi diversi le proprie direttive di tutela. Il naturale sviluppo della ricerca ci porta, in ambito penale, ad analizzare l'ultimo momento di svolta legislativa: con la legge n. 189/2004 il legislatore introduce nel codice penale nuovi reati, che tutelano gli animali in quanto tali, per il valore intrinseco di cui essi sono portatori. Argomento di particolare stimolo per il penalista, il presente studio si interroga su quale sia il bene giuridico protetto da tali fattispecie penali. Una volta ripercorse le tesi esistenti in materia, con un focus particolare su quelle tradizionali e maggioritarie orientate sul bene-sentimento, l'elaborato porta argomenti a confutazione di queste teorie e rileva in conclusione come il bene protetto sia semplicemente l'animale. Sollevando lo sguardo dal più ristretto recinto penalistico, la ricerca si propone, infine, di proiettare l'animale nell'intero ordinamento giuridico, evidenziando le caratteristiche di tendenziale soccombenza di questo bene rispetto a numerosi altri, peraltro discendente da precise scelte politico-criminali del legislatore, al fine di comprendere il quadro di liceità/illiceità che l'ordinamento nel suo complesso rende e formulare alcune proposte atte a migliorare de iure condendo un quadro normativo che, nonostante gli innegabili passi avanti fatti, si rivela ancora disorganico ed incoerente. The law no. 189/2004: animal as a legal interest and the political-criminal inconsistency of the regulatory system This research is aimed at evaluating the landings reached by the so-called "animal question" and the corresponding evolution of social conscience relative to the consideration of animals. These finding are the result of an important development of scientific, ethical and philosophical research and of the spread in the social mentality of now irrefutable acquisitions in the field of biological, zoological and cognitive sciences, which have made unthinkable the old certainties about the irreducible, ontological, separateness of man compared to animals. From this, the elaborate is aimed at highlighting the path that both national legal system, as well as the community and international ones, have undertaken in order to develop concrete protections towards animals, gradually trying to mitigate and smooth out that strictly anthropocentric and self-referential vision which is the basis and foundation of legal systems. The relationship that binds humans to animals has led us to value them under different profiles and to arrange for them a polycentric protection. Animals integrate multiple values into our way of conceiving reality and the lawgiver has referred to them at different times its own protection directives. The natural development of the research leads us, in the criminal field, to analyze the last legislative turning point: with Law no. 189/2004 the lawgiver introduces new crimes into the penal code, which protect animals as such, for the intrinsic value they carry. A particularly stimulating topic for the criminal lawyer, this study questions and tries to establish what is the legal interest protected by the criminal law provisions punishing animal cruelty. Once an overview of the existing theses on this subject is provided, which includes the traditional and majority-oriented ones focusing on the sympathetic feelings for animals, the research offers several rebuttals of these theories and concludes by pointing out that the applicable criminal provisions simply protect the animal itself. Lifting our gaze from the narrower criminal area, the research aims, finally, to project the animal into the entire legal system, highlighting the characteristics of tendency to succumb of the animals compared to other legal interest, moreover descending from precise political-criminal choices of the lawgiver, in order to understand the framework of lawfulness/unlawfulness that the legal system as a whole makes and to formulate some proposals aimed at improving de iure condendo a regulatory framework which, despite the undeniable progress made, is still disorganized and inconsistent.

Il presente contributo si propone di analizzare le scelte di politica criminale compiute dal legislatore in tema di gestione della crisi d'impresa, seguendo una doppia direttrice storico-comparatistica. Dopo un excursus storico che ricostruisce l'origine e l'evoluzione della bancarotta (figura centrale fra i reati fallimentari) in Italia, vengono analizzate le discipline di alcuni ordinamenti di Common law e di Civil law in tema di crisi dell'impresa e correlati profili penali: si tratta degli Stati Uniti, del Regno Unito, della Francia, della Germania e della Spagna. La disamina procede incentrando l'attenzione sulla riforma introdotta con il Codice della crisi d'impresa e dell'insolvenza (D.Lgs 14/2019) che dedica un Titolo apposito, il numero IX, alle disposizioni penali. Anche qui sarà dato maggior spazio ai reati di bancarotta, i quali rappresentano ancora oggi il fulcro della disciplina penale sul tema; essi si ripresentano sostanzialmente immutati nel nuovo panorama normativo. Come ultimo passaggio, vengono ricostruiti i confini dell'area di rischio penale attorno alle procedure di allerta e prevenzione della crisi, fra nuove incriminazioni, misure premiali penali e mutamenti nelle posizioni di garanzia degli organi sociali. Le innovazioni registrate sul piano penale a seguito della riforma sono, tuttavia, esigue e certamente non forniscono un'adeguata risposta alle sollecitazioni di chi, da tempo, sottolinea la necessità di adeguare il diritto penale ai profondi mutamenti che hanno interessato il retroterra civilistico. Quella del Codice è evidentemente un'occasione mancata per provare a ricucire lo strappo che si è creato, a partire dalle riforme degli anni Duemila, fra i due comparti: l'uno, il civile, orientato al risanamento e alla prevenzione; l'altro, quello penale, caratterizzato ancora da un tradizionale rigore sanzionatorio e da intenti fortemente repressivi. L'elaborato si conclude con una riflessione su un'ulteriore questione problematica: il delicato coordinamento fra le misure a sostegno delle imprese colpite dall'attuale emergenza sanitaria e le incriminazioni per bancarotta. This thesis aims to analyze the criminal policy choices made by the legislator in terms of corporate crisis management, following a double historical-comparative direction. After a historical excursus on the Italian bankruptcy criminal law, it is provided a comparative analysis of the disciplines on the business crisis and related criminal profiles of some foreign legal systems: United States, United Kingdom, France, Germany and Spain. The following chapters deal with the reform introduced by the new "Codice della crisi d'impresa e dell'insolvenza" (D.Lgs n. 14/2019) in the Italian legal system. The point of view adopted is once again that of criminal law. Finally, the paper concludes with a reflection on the effects that the Covid-19 pandemic produces on the criminal discipline of bankruptcy.

The lack of a coherent European legislative framework, coupled with the principle of state sovereignty, induced unaccompanied migrant children to find themselves in a position which produced a situation of rightlessness, when outside of their own territories. In addition to their harsh condition, Member States national law not always provides rules for their safeguard, also often not harmonized with EU Directives. In some cases, to worsen the situation the lack of adequate policies in respect of their rights, their needs and their claims. This thesis provides an analysis of the international and European discipline, of unaccompanied minor migrants entering Europe. Juveniles, who find themselves in a hope journey without family members or guardianship, are in a very vulnerable position. In consequence of the migration crisis, especially in 2015, a massive flux of UAMs entered the European Union, so its Member States found themselves unprepared to cope with the needs of this specific category. In this thesis it is brought to light the fact that, international conventions alongside with EU legislative scheme provide a fragmented scheme for protection of separated children. Legally binding documents, as relevant International Conventions, European Treaties, Regulations and Directives are analysed, as also Conventions of the Council of Europe in concern to unaccompanied minors asylum seekers. In the paper are outlined and criticized bad practises of States on treatment and neglecting the needs of unaccompanied minor migrants, on breach of the rights of unaccompanied asylum seekers and on marginalizing unaccompanied refugee minors. In this research, have been pointed some good practises, for ameliorating their condition through the study between some European countries. The commitment showed by European Union through the European Action Plan as also by the EU to fulfil the obligations in respect of the rights of UAMs is demonstrated by the interest in revising, amending and fortifying several legally binding documents towards a more comprehensive children based approach. In compliance with this, in confirming expectations and welcoming the challenge for an international an enforced scheme of legal protection on UAMs, highlighted the recent effort of soft law by the CRC Committee and the Committee on Migrants Workers with Joint Comments. It is noteworthy that, the International Community and the European Union are meeting the need for a slow emersion on a dedicated legal framework on unaccompanied minor migrants. In conclusion, deemed that the issue of UAMs is still evolving, by figuring out the actual situation, till the end of 2017, we hope for future better assessments on the rights of the children and their indeed protection by law and by practise.
