Jornades de Dret Català a Tossa (12es: 2002: Tossa de Mar, Catalunya) ; Conté les ponències i les comunicacions presentades en les XII Jornades de Dret Català, celebrades a Tossa de Mar (Girona) els dies 26 i 27 de setembre de 2002. L'objecte de les Jornades fou reflexionar sobre l'impacte de la creixent europeïtzació del dret privat sobre el dret civil català i sobre altres ordenaments del nostre entorn. Inclou aportacions en català, en castellà i en anglès d'autors com ara Luis Díez-Picazo, Encarna Roca, Hugh Beale, Antonio-Manuel Morales, Ulrich Magnus i Sixto Sánchez, entre altres. En el llibre també es recull la transcripció de les intervencions de representants de tots els estaments jurídics catalans sobre el nou Codi Civil de Catalunya

Euroopan komissio luotiin jotta se voisi ajaa yhteisöjen intressiä. Sen vuoksi siitä päätettiin tehdä itsenäinen. Mutta koska Euroopan Unionin vaikutus jäsenmaissaan on hyvin vahvaa, myös talouden kannalta, haluavat jäsenmaat vaikuttaa komissioon mahdollisimman paljon. Tämän vuoksi komission itsenäisyys vaarantuu. Perustamissopimukset koettavat hoitaa ongelman luomalla komissiolle joita-kin suojamekanismeja. Mutta ovatko ne riittäviä? Vaikuttaa siltä, että komissioon pystytään vaikuttamaan liikaa sen jokapäiväisessä työssä. Tämä vaikuttaminen alkaa jo komission nimittämisvaiheessa ja jatkuu koko ajan komission pohtiessa uuden lainsäädännön tarvetta ja komission valmistellessa uutta lainsäädäntöä. Komission lakiehdotelman sisältöön vaikuttavat usein paljonkin muut instituutiot, jäsenvaltiot sekä intressiryhmät. Tämä johtaa siihen, että komissio ei täysin pysty toteuttamaan yhteisöjen in-tressiä. Monin eri tavoin komission päätöksiin voivat vaikuttaa yksittäisten tai use-ampien jäsenmaiden edut, vaikka tarkoitus olisi ajaa yhteisöjen etua. The European Commission was created so that it could work to fulfil the Community Interest. Therefore it was decided to be an independent institution. But because the European Union affects its Member States very deeply, not least in budgetary ways, the Member States seem to want to influence the Commission as much as possible. Therefore the independence of the Commission is at stake. The Treaties try to deal with the problem by setting some protective mecha-nisms on the Commission. But is it enough? It seems that the Commission gets in-fluenced too much in its everyday work. This influencing starts already at the nomi-nation of the Commissioners, continues all the while when the Commission is decid-ing if new Community legislation is needed and while it drafts new legislation. The substance of the drafts are often influenced very much by the other institutions, Member States and interest groups. What this means is that the Commission can't fulfil its task at seeking the best of the Communities. In many different ways the decisions of the Commission may further the good of one or some interested parties instead of the Community In-terest.

'Writing is a process; the act of transforming thoughts into print requires a non-linear sequence of stages or creative acts' (James B. Gray, cited by Cassany, 1993). I would add that it is also the act of transforming experience. This article describes my own personal process of transformation in the experience and understanding of vulnerable employment - a slow, open, recursive and difficult process. The first, academic, section flows easily. Then things get harder. The auto-ethnography was the most challenging part. Firstly because it was a matter of personal reflection; then because of a having to strip naked, as it were. Finding a reasonably elegant and flexible way to link the two sections was demanding, and one of the objectives of the exercise was to reach a satisfactorily readable end result.

La UE es troba a les portes d'una ampliació que comportarà la incorporació de deu noves llengües oficials, moltes de les quals amb unes dimensions demogràfiques i una vitalitat cultural inferiors a la llengua catalana. L'article comenta que la situació actual del català a la UE és injustificable i escandalosa i que ho resultarà encara més després de l'ampliació. La previsible modificació del règim lingüístic de la UE tendirà a la reducció de les llengües de treball per raons d'eficiència, però l'ampliació de les llengües oficials hauria de permetre incloure-hi llengües com la catalana, que ja són oficials en el seu territori. Tampoc hi ha cap raó perquè el català resulti exclòs dels programes lingüístics europeus, en els quals participen fins i tot llengües de països externs a la UE. Les comunitats lingüístiques amb poders legislatius han de poder regular l'ús públic de les llengües en el seu espai igual que els estats; altrament la mateixa UE indica que sols la independència política garanteix un tracte igualitari. ; The EU is about to enter into an expansion that will mean the incorporation of 10 new official languages, many of which have a lesser demographic dimension and cultural vitality than Catalan. This article comments that the current situation of Catalan in the EU is unjustifiable, scandalous even, and will be even more so following amplification. The foreseeable modification of the EU's linguistic regime will tend towards the reduction of the working languages for reasons of efficiency, but the amplification of its official languages should permit the inclusion of languages like Catalan, which are official in their own territories. Nor is there any reason why Catalan should be excluded from European linguistic programs which are participated in even by the languages of countries outside the EU.
