The paper analyzes how selected budgetary governance institutions can influence the motivation and capability of public sector entities to generate, implement, and diffuse innovations in public production. Numerical fiscal rules, top-down and concentrated budgetary decision-making process, medium-term budget framework and program budgeting were identified as having positive impacts. The analysis is followed by an assessment of the central government sub-sector budgetary governance system in Poland, which showed that the existing budgetary arrangements might be classified as innovation restrictive. The concentration of public decision-making within the budgetary process and integration of the budgetary governance system with other public governance systems by means of a common programmatic architecture were recommended as prerequisites for effective stimulation of public sector innovativeness.
This article provides an analysis of the tax system of Ukraine in comparison with its counterparts in foreign countries to determine the competitiveness of Ukraine in the world market of goods and investments and to choose the main directions of reforming the tax system in the conditions of economic crisis caused by quarantine measures. The influence and liberalization of the tax system on the socio-economic development of Ukraine and foreign countries is considered and analyzed. Comparisons were made in the following areas: by the level of the overall tax burden, its distribution between the main types of taxes and payer groups, and the fiscal efficiency of tax systems. Having analyzed the data of European countries, the authors of the study compared them from a number of parameters with such major economies of the world as the US, China, Singapore. It has been shown that the EU is somewhat inferior to the US in terms of preferential administration of tax calculation and payment processes, as well as filing tax reporting by taxpayers. However, the EU shows relatively low corporate tax rates (compared to China and the US). Even though China and Singapore have significantly reduced these rates, they remain above the EU average. In order to improve the functioning of the tax system of Ukraine, the authors consider it advisable to focus on the dynamic transformations observed in the new member states of the EU, which, in turn, are one of the main competitors of Ukraine in the world markets of goods and capital, taking their experience to improve the tax climate and improve fiscal and regulatory tax compliance. The authors conclude that the amendments to the tax legislation of Ukraine due to the need to protect economic entities in the period of the COVID-19 pandemic are effective, sufficient and consistent with the world's legal practice. That is why the liberalization of the tax system is one of the determining factors in the socio-economic world development today. Formation of a modern competitive, social, market economy, integrated in the EU, guaranteeing stable economic growth, implementation of a balanced budgetary and social policy is impossible without the implementation of an effective tax policy to ensure support of the taxpayer. ; Niniejszy artykuł stanowi analizę porównawczą ukraińskiego systemu podatkowego oraz jego odpowiedników w innych krajach. Ma ona na celu ustalenie konkurencyjności Ukrainy na światowych rynkach towarowych i inwestycyjnych oraz wskazanie głównych kierunków reform systemu podatkowego w dobie kryzysu ekonomicznego wywołanego zastosowaniem środków związanych z kwarantanną. Rozważaniom oraz analizie poddano wpływ liberalizacji systemu podatkowego na rozwój społeczno-ekonomiczny Ukrainy oraz innych krajów. Dokonano porównań w następujących obszarach: poziom ogólnego ciężaru podatkowego, rozłożenie go pomiędzy główne rodzaje podatków i grup płatników oraz skuteczność fiskalna systemów podatkowych. Po przeanalizowaniu danych pochodzących z krajów europejskich autorki porównały je z kilkoma parametrami opisującymi duże gospodarki świata, takie jak Stany Zjednoczone, Chiny czy Singapur. Wykazano, iż UE nieco gorzej radzi sobie niż USA pod względem preferencyjnego administrowania wymiarem podatku oraz z procesami płatni czymi, a także w zakresie wypełniania zeznań podatkowych przez podatników. Jednakże w krajach UE są stosunkowo niskie stawki podatku od osób prawnych (w porównaniu do Chin i USA). Mimo iż Chiny oraz Singapur znacznie zmniejszyły stawki tego podatku, ich poziom nadal pozostał powyżej średniej w UE. Aby usprawnić funkcjonowanie systemu podatkowego na Ukrainie, autorki zalecają skoncentrować wysiłki na dynamicznej transformacji, którą można zaobserwować w nowych państwach członkowskich UE – stanowiących jednocześnie głównych konkurentów Ukrainy na światowych rynkach towarowych i kapitałowych – by opierając się na ich doświadczeniach, pracować nad poprawą warunków podatkowych, co przyczyni się do lepszego wypełniania obowiązków podatkowych w sensie regulacyjnym i fiskalnym. Autorki dochodzą do wniosku, że zmiany ustawodawstwa podatkowego na Ukrainie w obliczu konieczności ochrony podmiotów ekonomicznych w dobie pandemii COVID-19 są skuteczne, wystarczające i spójne ze światową praktyką prawną. Zatem liberalizacja systemu podatkowego jest jednym z decydujących czynników światowego rozwoju społeczno-ekonomicznego.
The purpose of the article is to analyze the current condition and development prospects for the Russian LNG sector. Taking into account the specifics of the functioning of the Russian state, the author chose the realistic paradigm (neoclassical realism), which is useful in the context of showing the relationship between internal structures and external activity of the state. The author argues that Russian expansion in the LNG sector is the result of the lobbying capacity of Novatek – the largest private gas producer in Russia. Although the state budget incurs significant costs related to the implementation of Novatek projects, in particular due to fiscal preferences, it also achieves the possibility of achieving the objectives in external and internal energy policy. Novatek's expansion increases Russia's share in external energy markets; at the same time LNG expansion, it is used for internal purposes. Novatek's dominant position in the LNG sector is confirmed by both already implemented projects and plans for further expansion. The factors favoring Russian expansion are constant state support for Novatek projects, high level of internationalization of implemented projects and favorable forecasts on energy markets. The strong competition between currently dominant LNG producers and the risk of internal competition between Russian exporters are among the key long-term challenges.
Polityka klastrowa, która została wypracowana przez instytucje Unii Europejskiej, a która jest wdrażana od wielu lat bezkrytycznie przez instytucje państwowe, jest niedopasowana do realiów polskiej gospodarki oraz relacji społeczno-gospodarczych, a przez to nieefektywna. Ostatnie badanie wykonane przez Delloite Business Consulting S.A. Benchmarking klastrów w Polsce – 2010 Raport z badania1 wskazuje, że organizacje klastrowe w Polsce nie są rozwinięte i borykają się z problemami finansowymi oraz problemem nieufności przedsiębiorców wobec swojego otoczenia biznesowego i instytucji państwowych. Raport ten potwierdził stwierdzenia zawarte w raporcie PAG, który zostanie omówiony w dalszej części tej publikacji.Polityka klastrowa jest realizowana przez Urzędy Marszałkowskie, co nie przynosi zakładanych rezultatów, bowiem politycy są bardziej zainteresowani tworzeniem nowych inicjatyw klastrowych niż wspomaganiem i rozwijaniem tych, które sami pomagali powoływać do życia.Celem niniejszej pracy jest przedstawienie koncepcji rozszerzenia kompetencji oraz zakresu działalności Specjalnych Stref Ekonomicznych o działalność brokera klastra. W opinii autorów ustawowe przydzielenie SSE roli brokera klastra, bazując na modelu działań odgórnych (top –down), może przynieść pozytywne rozwiązania i zapewnić budowanie klastrów przez profesjonalne organizacje, posiadające zarówno know-how, odpowiednie zasoby ludzkie oraz istniejące struktury organizacyjne.[.] ; Since last two decades, the cluster concept developed by Porter has been widely used as the tool for policy makers to intervene in regional agglomeration and industrialization process. The European Union introduced Cluster Based Policy to its members, aiming on spreading idea of cluster among them, and providing best practices by basing on researches done on existing clusters in Western Europe. The basic assumption of the EU bottom-up CBP is to support recognized cluster initiatives and provide financial means for start up. In this model, the market should prove whenever the cluster initiatives were strong enough to grow up or decease. Poland does not have national CBP and the national policy is based on European recommendations. These recommendations do not fit to Polish social and economic reality. Poland is considered as the one of post-communism countries with all the social and economical limitations appearing from that fact. The citizens and entrepreneurs still do not trust each other as well as they do not trust in government and its institutions. The mentality of people has not caught up the wave of economical changes yet. During last decade in Poland there were established many cluster initiatives. After initial euphoria, especially among politicians, within a period of 2-3 years almost all cluster initiatives and cluster organization in Poland have gotten into financial and organizational troubles. They exist; however, either do not act or act in order to find financial sources to cover basic operational costs, such as the costs of an office, stuff or current payments, thus they are not focused on cluster projects at all. The cluster policy in Poland seems to be ineffective and inappropriate tailored to our social and economical conditions. The authors would like to propose to change bottom-up policy and let government take a part in establishing and supporting cluster organizations in Poland. The Polish government has a tool to intervene on the regional market to create agglomeration processes leading to establishing clusters. The Polish Government legislated the act on Special Economic Zones and thus prepared a useful tool to support regional development. SEZ territorially cover all regions of Poland. So far SEZ have been responsible over attracting investors to the zones by providing them with: fiscal support, help in start-ups, facilitating with governmental institutions and education. The last world crisis showed, it is not so hard to attract a new investor, but it is very hard to keep the investment in region. Due to its long experience and already existing organizational structures SEZ are perfect to undertake the role in cluster policy as the cluster brokers and facilitate all cluster projects. SEZ as the broker of cluster could bring a benefit to the actors of the clusters and increase regional development and competitiveness.
Finding much needed funds from taxes to state budgets and an ever-increasing mistrust of politicians and public opinion to the tax optimization schemes of multinational enterprises (MNEs) and high net worth individuals (HNWIs) have sparked an unprecedented political enthusiasm to address international tax avoidance in the last decade. This enthusiasm morphed into a political mandate given by G20 to the OECD in 2012. Amid a plethora of anti-avoidance rules delivered by the OECD under the BEPS Project, the principal purposes test (PPT) and its derivative under the EU Anti-Tax Avoidance Directive (ATAD) – the General Anti-avoidance Rule (GAAR) – are pivotal. The purpose of this contribution is to take an attempt to answer the main research question: is there room for an application of the GAAR (ATAD) and PPT (MLI) in a similar fashion? The assumption positively verified under this study via the prism of tax policy and technical (legal) reasons is that the less dissimilar an application of the GAAR and PPT will be, the less tax avoidance and fewer disputes arising from this phenomenon appear. However, there is a major caveat: the GAAR and PPT must gravitate towards the General Anti-abuse Principle (GAAP) as follows from the jurisprudence of the Court of Justice of the European Union's (CJEU) rather than to the OECD's version of the GAAR in the MLI (PPT). Only such an interpretative approach may ensure the right balance between fiscal interests of countries and individual economic freedoms of taxpayers. This contention stems from an analysis of the wording and structure of the GAAR and PPT, tax policy aims articulated in the preambles to the MLI and ATAD, the Court of Justice of the European Union's (CJEU) case law, the OECD's Commentary, and the relevant literature. ; Potrzeba znalezienia środków z podatków na finansowanie funkcjonowania państw oraz coraz większa nieufność polityków i opinii publicznej wobec schematów optymalizacji podatkowej przedsiębiorstw wielonarodowych (multinational enterprises, MNE) i najbardziej majętnych osób fizycznych (high-net worth individuals, HNWI) wywołały bezprecedensowy entuzjazm polityczny dotyczący przeciwdziałania międzynarodowemu unikaniu opodatkowania. Ten entuzjazm przerodził się w mandat polityczny udzielony OECD przez G20 w 2012 r. Wśród mnogości propozycji środków prawnych przeciwdziałających unikaniu opodatkowania opracowanych przez OECD w ramach projektu BEPS, za kluczowe należy uznać: test jednego z głównych celów (principal purposes test, PPT) z MLI i ogólną klauzulę przeciwdziałania unikaniu opodatkowania (general anti-avoidance rule, GAAR) z unijnej dyrektywy przeciwdziałającej praktykom unikania opodatkowania (anti-tax avoidance directive, ATAD). Celem niniejszego artykułu jest znalezienie odpowiedzi na główne (tytułowe) pytanie badawcze: Czy GAAR (ATAD) i PPT (MLI) powinny być stosowane w podobny sposób? Hipotezą pozytywnie zweryfikowaną w ramach niniejszego opracowania jest to, że: im bardziej zbiegające się (koherentne) będzie stosowanie GAAR i PPT, tym mniej praktyk unikania opodatkowania i sporów wynikających z tego zjawiska będzie występować między podatnikami i organami podatkowymi. Istnieje jednak poważne zastrzeżenie: GAAR i PPT powinny być stosowane zgodnie z ogólną zasadą przeciwdziałania nadużyciom (general anti-abuse principle, GAAP) wynikającą z orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), a nie zgodnie z PPT zaprojektowanym przez OECD. Tylko takie podejście do stosowania GAAR i PPT może zapewnić właściwą równowagę między interesami fiskalnymi różnych państw a swobodami gospodarczymi podatników. Konstatacja ta wynika z analizy treści i struktury GAAR i PPT, celów polityki podatkowej wyrażonych w preambułach do MLI i ATAD, orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), Komentarza OECD do Modelu Konwencji OECD oraz literatury.

Wydaje się, że "diabelska alternatywa" – rozpad albo głębsza integracja – przestaje być aktualna. Unia Europejska wybrała zdecydowanie tę drugą opcję. Krok po kroku, szczyt po szczycie, Unia posuwa się mozolnie w kierunku głębszej integracji finansowej i fiskalnej, w kierunku zacieśnienia oraz koordynacji współpracy gospodarczej, a także bardziej rygorystycznego egzekwowania kryteriów konwergencji finansowej. De facto strefa euro, a wraz nią cała Unia Europejska, w zakresie spraw gospodarczo-finansowych, najgorsze ma za sobą. Niepokojący z punktu widzenia całej Unii Europejskiej jest Brexit. Wyjście Brytyjczyków z UE jest ogromnym politycznym, militarnym, gospodarczym i wizerunkowym osłabieniem Unii, a może nawet czymś więcej – porażką Unii, a zapewne także i Brytyjczyków. Innym niepokojącym i trwającym problemem Unii jest kryzys migracyjny. Jednak powoli i z opóźnieniem UE zaczyna z niego wyciągać wnioski i urealniać politykę migracyjną. Coraz bardziej niepokojąca staje się kwestia przestrzegania praworządności przez niektóre kraje unijne, jak również jej ocena i zdolność władz UE do uporania się z tym problemem. Unia Europejska nie powróci już zapewne do dyskusji na temat finalite, czyli finalnego celu: czym być – federacją, superpaństwem, czy też konfederacją państw, Europą Ojczyzn? Jednak integracja w głąb będzie postępować z tymi, którzy chcą, a bez tych, którzy nie chcą. Integracja finansowo- -gospodarcza w ramach UGW, wojskowa w ramach WPBiO, także w sprawach imigracyjnej, regionalnej i wymiaru sprawiedliwości. ; European Union, having back constitutional treaty refusal crisis, enlargement problems with new EU members and economic-financial crisis, seems to have overcome the most difficult period. Looks like "the devil alternative" – breaking up or deepen integration – is no more actual. Step by step, through EU leaders summit after summit recovery decisions, European Union is crawling towards deepen financial and fiscal integration. A number of diff erent long-term proposals have been put forward to deal with Eurozone crisis, as European Fiscal Union, a package for European bank recovery and other measures going to strict respect of financial convergence criteria. Brexit, the ongoing process of withdrawal of United Kingdom from EU will have deep impact on UK and EU mutual political-economic relations, being at the same time deep repulse of EU itself. The other unquiet and still lasting problem for EU was a sharp increase in the migration fl ows into European Union territory, making a lot of problems to EU countries. However, after bad results and the lack of proper approach to that problem European Union is preparing new common immigration policy. EU is also facing the impact of accession to office of a Eurosceptic party/governments violating the principles of law and EU values which makes a problem of EU infringement procedure efficiency. Having in mind all EU aspects of crisis, actually, it is difficult to foresee the return to the debate about finalite politique of European Union, which means answering the questions: what does EU have to be? Federation, super-state or only the Europe of Homelands?
