This study describes the psychological process initiated by exposure to torture in a group of Palestinian political ex-prisoners living in the West Bank and the Gaza Strip. The occurence of physical and psychological torture and sexual abuse during the interrogation and imprisonment is assessed. The study further inquires about the coping resources and actual coping modes that the Palestinian political prisoners employed in order to protect their dignity in face of prison hardships, and analyzes the occurence of the "torture syndrome" and the factors related to the level of symptoms. Die Moralischen Wochenschriften, mit ihrem Ursprung im niederländischen und englischen Raum, wirkten im 18. Jahrhundert maßgeblich bei der Entstehung des Journalismus sowie bei der Bildung neuerer Typen von Narrativik und Essayistik mit. Sie bildeten somit eine Brücke zwischen Journalismus und Literatur. Zu dieser Zeit entwickelte sich im Zuge der Aufklärung ein neues selbstbewusstes Publikum, das politisch wie kulturell stärker auftrat und einen großen Bildungswunsch verspürte. Dieses wurde zur Leserschaft und Zielgruppe des Wochenschriftsjournalismus, der es durch Moralbotschaften lehrte. Die vorliegende Diplomarbeit beschreibt die Epoche der Aufklärung sowie die politischen und gesellschaftlichen Gegebenheiten im Italien des "Settecento". Zudem verschafft die Arbeit einen Überblick über die italienische Presselandschaft und die spektatorialen Vorläufer der Moralischen Wochenschriften. Außerdem erläutert sie deren typischen Gattungsmerkmale. Der Hauptteil der Arbeit beschäftigt sich mit (straf)rechtlichen Fragestellungen in der Moralischen Wochenschrift 'Il Caffè' von Alessandro und Pietro Verri sowie mit Cesare Beccarias Werk 'Dei delitti e delle penne', das für eine grundlegende Neuordnung der gesamten Strafrechtspflege und für die Normierung des Rechtswesens eintritt. Beccaria empfindet die Todesstrafe sowie die Folter als unnötig und fordert daher deren Abschaffung. Um den objektiven Schaden, der bei einem Verbrechen in einer Gesellschaft entsteht, zu erheben, ermittelt Beccaria die Schwere des Verbrechens sowie der Bestrafung. Beccaria erarbeitet in seinem Buch auch Vorschläge zur Strafprävention, die selbst im 21. Jahrhundert noch nützlich sind. Die Zeitschrift 'Il Caffè' beschäftigt sich ebenso mit rechtlichen Angelegenheiten und veröffentlicht von 1764-1766 alle zehn Tage eine Ausgabe. Sie verfolgt einen typisch aufklärerisch-utilitaristischem Zweck: die Öffentlichkeit, Männer wie auch Frauen, auf unterhaltsame Weise über unterschiedlichste Lebensbereiche aufzuklären und zu belehren. ; Moral Weeklies have their origin in the Netherlands and England. In the 18th century they played a leading role in the emergence of journalism and were considerably involved in the formation of new types of narrativity and essay writing. By doing so, they built a connecting link between journalism and literature. At that time, thanks to the Enlightenment movement, a new self-confident public developed that was interested in social as well as political topics and had an enormous desire for education. That bourgeoisie was taught morals by the Periodicals and became their new readership and target group.This diploma thesis describes the epoch of the Enlightenment and the political and social conditions that predominated in Italy in the 18th century. Furthermore, it gives an overall view into the history of the Italian press and the precursors of the Moral Weeklies. Besides, typical characteristics of that special kind of journals are explained and clarified. The main part of this academic paper discusses issues of crimes, punishments and law in the periodical essay 'Il Caffè' by the Verri brothers and in the essay 'Dei delitti e delle pene' by Cesare Beccaria, which demands a total reform of the criminal law. Beccaria considers the death penalty and the torture as needless and therefore advocates their abolition. In his opinion, a crime should be punished according to the damage it causes to the society. In his masterpiece, Beccaria also offers ideas, that are still useful today, to prevent crimes. The Moral Weekly 'Il Caffè' addresses legal topics as well. Das Ziel der vorliegenden Arbeit ist es, die Isolationshaft des früheren PKK Führers Abdullah Öcalan zu untersuchen, welcher 1999 verhaftet wurde und seither im Hochsicherheitsgefängnis auf Imrali inhaftiert ist.Sowohl die Haftbedingungen der Isolationshaft als auch die Anschuldigungen wegen Menschenrechtsverletzungen werden im Lichte des Folterverbots des Art.3 EMRK erörtert.Diese Vorschrift fungiert als Basis für alle weiteren Überlegungen und wird durch eine genaue Aufschlüsselung den Schutzrahmen klären. Die Diskrepanz zwischen dem Europäischen Gerichtshof für Menschenrechte und dem Europäischen Komitees zur Verhütung von Folter und unmenschlicher oder erniedrigender Behandlung oder Strafe, soll aufgezeigt werden.Anschließend wird der genaue Ablauf des CPTs mit der Türkei in den letzten zehn Jahren anhand von CPT Berichten und Antworten der Türkischen Behörden analysiert und die Entwicklung der Isolationshaft von Abdullah Öcalan im Lichte der Einhaltung dieser CPT Empfehlungen beurteilt. Nachdem der EGMR eine kontroverse Meinung in seinen Urteilen von 2003 und 2005 vertritt und die Isolationshaft von Abdullah Öcalan als keine Verletzung des Art.3 EMRK erachtet, wird die Relevanz der CPT Standards im Vergleich zur Rechtsprechung des Gerichtshofs geprüft und der Einfluss des Komitees auf die Mitgliedstaaten betrachtet.An dieser Stelle wird ebenso der Dialog zwischen dem CPT und der Türkei im Fall Öcalan beurteilt und die generelle Rolle des CPT als präventives Organ in der Etablierung von Menschenrechtsstandards diskutiert.Aus Anlass der lang ersehnten Aufhebung der Isolationshaft von Abdullah Öcalan im November 2009 durch den Transfer von 5 weiteren Gefangenen auf die Gefängnisinsel, soll diese Diplomarbeit einen Einblick in die Entwicklung samt Fort- und Rückschritten in der Isolationshaft über die letzten zehn Jahre geben. ; This thesis deals with the isolation regime of Abdullah Öcalan, who was arrested in 1999 and since then has been imprisoned as a sole inmate in the High Security Prison of Imrali for ten years. The aim is to investigate the detention conditions imposed on the detainee and to find out about the allegations of Human Rights violations in this case of isolation. The principle of the prohibition of torture, laid down in Art.3 ECHR, serves as the basis for this research and will be analyzed, thereby clarifying the scope of protection. On the momentous occasion of the sudden end of the isolation regime in November 2009, this thesis aims at imparting a comprehensive knowledge about the development of the isolation regime, the perception of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) regarding human rights conformity as well as the controversial judgments of the European Court of Human Rights (ECtHR) and consequently the improvements that have been achieved by transferring five convicts to Imrali.The discussion of the monitoring procedure will give an insight view of the detention conditions, which will be assessed on the basis of the CPT reports and recommendations as well as the corresponding responses of Turkey. The detailed examination of the four visits that have been carried out by the CPT in 1999, 2001, 2003, and 2007 will show the different stages of the isolation regime. Since the Court holds a controversial view concerning Human Rights violations in the isolation regime, the relevance of the CPT standards will be investigated in comparison to the case law of the Court.
