A case study of Alaska points out the humanitarian crisis resulting from increasing temperatures & wildfires, decreasing arctic sea ice, & thawing permafrost. Attention is called to four indigenous communities that face imminent relocation because there is no sustainable future in their present locations. Women´s Human Rights are often conceived from global frameworks and, –in universalist terms- to be locally applied. This exercise of "translation" demands us to situate our analysis on those spaces where it is shaped, addressing those different discourses and social actors involved. We find a good example in the grassroots women movements, actively inserted in the political context to propose an intersectional analysis that allows us to contextualize and multiply gender experiences. This work is located in United States and carried out in spaces of creative tension, allowing us to address the dynamics that intervene in local translation of Women´s Human Rights. This study is focused on the work developed by the collective "Mujeres Unidas y Activas" through its campaign "Echoes of the Silence: Raising our Voices" as an example of local translation of Human Rights ; Los derechos humanos de las mujeres son, con frecuencia, pensados desde marcos globales- y en términos universalistas- para ser aplicados localmente. Este ejercicio de "traducción" nos pide situar nuestra mirada en aquellos espacios en los que toma forma atendiendo a los diferentes discursos y actores sociales implicados. Un ejemplo son los movimientos de base de mujeres que de manera muy activa se insertan, proponiendo un análisis interseccional que permita contextualizar y multiplicar las experiencias de género. Situado en el contexto de Estados Unidos, este trabajo se despliega en espacios de tensión creativa que permiten atender a las dinámicas que intervienen en traducciones locales de derechos humanos de las mujeres. Este artículo toma el trabajo desarrollado por la organización Mujeres Unidas y Activas a través de su campaña "Ecos del Silencio. Levantando Nuestra Voz", como ejemplo de traducción local de derechos humanos.
This article examines the connection between rights, courts, and the changing nature of democratic participation. The general comparative model developed is then applied to a time-series analysis of the European Court of Human Rights (ECHR). The article is the first to offer a systematic social science analysis of ECHR decisions with particular emphasis on changing democratic opportunities for individuals at both the domestic and supranational level. The findings reveal how rights and access to legal institutions shape the way courts serve as arenas for public participation—a consequence that brings into question dominant theories of international organization and comparative studies of judicial politics.
In the world, the evolution of recent times has been plagued by violence in the socio-political sphere, derived from an axiological crisis developed by a desire for power, in some cases, survival in others. This has led to countless material and human losses, disregarding those primary human rights, to life, health, and well-being, as fundamental ideals of man. Under that foundation, and in the search for reflection, and the ideal of action of the significant actors, the concern and purpose of study arises, to analyze education for peace and spaces for coexistence from the perspective of human rights, based in a theoretical, conceptual, normative and doctrinal compilation, in a documentary review by experts in the area, wherefactors specific to these issues are described and examined, applying legal hermeneutics, as an ideal method in the examination of political-legal research ; En el mundo, el devenir de los últimos tiempos ha estado plagado de una violencia en el ámbito sociopolítico, derivado de una crisis axiológica desarrollada por un afán de poder, en unos casos, de supervivencia en otros. Ello ha conllevado incontables pérdidas materiales y humanas, desdeñando aquellos primarios derechos humanos, a la vida, a la salud, al bienestar, como ideales fundamentales del hombre. Bajo ese fundamento, y en la búsqueda de la reflexión, y el ideal de acción de los actores significantes, surge la inquietud y el propósito de estudio, analizar la educación para la paz y espacios de convivencia desde la perspectiva de los derechos humanos, basado en una compilación teórica, conceptual, normativa y doctrinaria, en una revisión documental de expertos en el área, donde se describen y examinan factores propios de esas temáticas, aplicando la hermenéutica jurídica, como método idóneo en el examen de investigaciones político-jurídicas.
The approach that Multinational Oil companies (MNOCs) use to comply with their human rights obligations translates to the different levels of engagement with stakeholders. For example, concerns regarding alleged human rights and environmental violations of MNOCs usually start with a notification, and then a formal complaint and if this is handled improperly will result in litigation. The ways MNOCs handle the disputes reflects whether the company pursues an inactive, reactive, active or proactive level of engagement with its human right obligations. This paper evaluates each level of engagement against a selected set of transnational human rights and environmental litigations arising from the Niger Delta. This evaluation reveals that MNOCs with a proactive approach considers the engagement and implementation of their human right obligations as a shared societal responsibility and are more inclined to look at the background of the complaint to solve the underlying problems in collaboration with all stakeholders. This paper, therefore, concludes that a proactive approach will lead to an improvement in human rights and environmental protection, in partnerships with local governments, local communities, and NGOs.
Resumen: El marco internacional de los Derechos Humanos establece tres obligaciones principales de los Estados, en la lucha contra la Trata de mujeres y niñas: "la prevención; la investigación y, enjuiciamiento". España con el "Pacto de Estado en Violencia de Género", pretende la implementación legislativa de políticas públicas protectoras de las víctimas, así como la lucha contra la criminalidad, a través de organismos y estamentos inmersos en posibilitar la coordinación para dar la más eficaz respuesta contra la criminalidad organizada ante el reto de la globalización, e implementar los Derechos Humanos de las víctimas. Abstract: The international human rights framework establishes three main obligations of States, in the fight against the trafficking of women and girls: "prevention, investigation, prosecution".Spain with the" State Pact on Gender Violence", aims to legislative implementation of public policies to protect victims, as well as the fight against crime, through bodies and institutions immersed in enabling coordination to provide the most effective response against organized crime in the face of the challenge of globalization and implement human rights of the victims.
