In today's world where fewer and fewer barriers and borders limit relationships, interactions between things, people, services, it is no wonder that in a globalized economy like ours, interests, connections, needs of various aspects from people all around the world, happen to coexist and working their way out in certain defined places. There are indeed, some places which more than others, for various reasons ranging from political situation, location, economy rather than taxation, have the ability to attract capital and resources from other countries, giving rise to international financial hubs. One on all in Europe is definitively the Grand Duchy of Luxembourg which with an area of 2,586 km² and a population of only 602,005 people, it is home to more than 130 international banks, Europe's number one investment fund centre, World's top ten largest Private Equity houses, Europe's number one cross-border insurance center, and EU-regulatory framework and EU-wide licensing of financial services. The following chapters, indeed, aim to disclose the main features which bring Luxembourg to be that leading financial center in Europe, the reasons why so many international banks and firms choose the Grand Duchy as their home, the most relevant aspects of the country economy with a focus on the leading sectors. The first two chapters will give a global overview of what the situation is in Luxembourg in order to have a picture of today business and highlighting the strength of the grand duchy economy, bringing on aspects and achievements globally acknowledged. The second chapter however will give more insights on the specific of Luxembourg tax system, detailing the appealing tax regime and even so, the support and protection of the double tax conventions signed with countries worldwide, strengthen the business climate in this country. The analysis will go through the key factors that make Luxembourg so attractive, like favourable tax treaty agreements with 57 countries, a very competitive company taxation at 28.59%, no withholding taxes on dividends, paid to EU or double tax treaty resident, lowest VAT rate in Europe at 15%. Will together be analysed, the most used incentives for the entities, as the investment tax credits (Luxembourg tax law, indeed provides a tax credit available and amounts to 13% of the increase in investments in tangible depreciable assets made during the tax year), or the new regime of the intellectual properties which give the possibility to have on a net income from qualifying IP assets, a benefits of an 80% exemption from income taxes. The essay will continue with the coverage of the core business of Luxembourg financial activity; the third chapter will give a detailed analysis of banking and wealth management, asset management services offered, the corporate finance services required by all the entities which are created and have the registered office in the Grand Duchy, followed by the analysis pf private equity and venture capital investments, real estate investment vehicles, and hedge funds which can be considered the main features of the country financial activity. The last two chapters will analyze and emphasize the international character of the system and the future prospective on how the economy, the activities and the services may evolve, giving more insights on which the priorities will be in the near futures and where the efforts will be made in other achieve some certain standard of sustainability. The fourth chapter indeed will focus on the constantly growing relationship established with the Chinese economic world the Arabic world, which both play a very important role in the today economy and happen to be two of the main actors of Luxembourg financial system. The fifth and last chapter will highlight how Luxembourg has a comprehensive domestic climate finance agenda which since 2015, have seen the government and the financial services industry, working together in a dedicated climate finance task force to implement a coherent and fully integrated climate finance strategy. The Luxembourg government contributes to the technical support facility of the Amundi Planet Emerging Green One, the largest green bond fund in the world. This Luxembourg based investment fund targets green bonds emitted by banks in developing countries and at the same time helps develop green bond policies, training programs, and best practices in such markets through the technical support facility.

Tra le strategie di contrasto ai multiformi fenomeni criminosi afferenti al patrimonio culturale, riveste un ruolo cruciale l'affermarsi, a livello internazionale, del principio della responsabilità penale individuale. A fronte dell'attuale scenario internazionale, in cui i beni culturali sono stati sovente oggetto della furia iconoclasta di gruppi estremisti, la presente ricerca si propone di acclarare quale rilevanza penale sia riconosciuta dal diritto internazionale, in una prospettiva de iure condito, alla distruzione intenzionale del patrimonio culturale quand'anche questa sia svincolata dai conflitti armati. Onde risolvere tale queastio iuris, la ricerca adotta quel preciso ragionamento giuridico, sviluppato dai tribunali internazionali penali, al fine di affermare la responsabilità penale individuale per la violazione di norme internazionali. In specie l'indagine si occupa di verificare la sussistenza dei tre requisiti che, in ossequio alla giurisprudenza internazionale penale, sono necessari affinché un individuo possa ritenersi penalmente responsabile a livello internazionale per la distruzione di beni culturali: ovverosia, (a) l'esistenza di una norma internazionale che imponga un determinato obbligo di tutela dei beni culturali; (b) la produzione di serious conseguenze in seguito alla violazione della suddetta norma; (c) la generalizzata comminatoria della sanzione penale negli ordinamenti nazionali. Ciò posto, la prima parte del lavoro – avente perlopiù carattere introduttivo – è volta a fornire un inquadramento sistematico del corpus normativo posto a tutela del patrimonio culturale all'interno del sistema di garanzia dei diritti umani. In questo contesto, viene in evidenza come l'interesse del legislatore internazionale in materia si sia declinato in diversi approcci connotati, sia da una progressiva estensione della nozione di bene giuridico protetto, che dall'evoluzione della ratio di tutela perseguita. Al fine di dimostrare quanto detto, si analizza: in primo luogo il diritto internazionale umanitario, le cui disposizioni hanno riconosciuto un'immunità al patrimonio culturale nella sua consistenza materiale, salvaguardandolo dai danni, seppur collaterali, derivanti dalle ostilità armate; e in secondo luogo, la normativa di più ampio respiro che, abbracciando la più estesa nozione di cultural heritage, ha inteso la tutela del bene culturale quale componente essenziale del rispetto dei diritti umani. Una volta chiarita la genesi del sistema normativo, ci si sofferma funditus sulla evoluzione dello stesso, prestando particolare attenzione all'emersione di nuove finalità di tutela. Tramite l'analisi del law enforcement attuato dalla Corte di Strasburgo e dalla Corte interamericana dei diritti umani, in materia di diritti culturali dell'uomo, si provvede ad inquadrare gli obblighi internazionali a protezione dei beni culturali sotto la lente dei diritti umani. Passaggio, questo, che appare centrale onde comprendere la reale portata del divieto di distruggere il patrimonio culturale in qualsivoglia contesto, e non solo in quello bellico. Esaurita la trattazione concernente le norme primarie, ed individuata dunque la sussistenza di specifici obblighi internazionali, l'indagine si concentra poi sulle conseguenze scaturenti, sul piano secondario, in caso di violazioni. Avendo riguardo alle reazioni poste in essere nella Comunità internazionale, essenzialmente realizzate tramite forme istituzionalizzate, quali quelle dell'UNESCO e delle Nazioni Unite, ci si occupa di appurare il grado di gravità riconosciuto alla rottura della legalità in materia. Sicché, guardando al dato fattuale, cioè all'azione solidale ed istituzionale attuata dagli omnes in risposta alla distruzione iconoclasta, si ricostruisce la natura erga omnes del divieto di distruggere il patrimonio culturale, e più in generale degli obblighi protettivi a questo relativi. Acclarato che la distruzione deliberata del patrimonio culturale integra una violazione grave del diritto internazionale, l'ultima parte dell'indagine – che rappresenta forse quella più innovativa – è volta ad accertarne la rilevanza penale nell'ambito dei sistemi giuridici nazionali. Infine, seguendo un ragionamento induttivo, che muove quindi dalle esperienze nazionali, e che si colloca comunque in una prospettiva de iure condito, potrà evincersi l'esistenza o meno di un principio generale, comune agli ordinamenti interni, volto a responsabilizzare penalmente l'individuo per la distruzione deliberata del patrimonio culturale in tempo di pace. ; The principle of individual criminal responsibility plays a crucial role among all the different strategies to face the manifold criminal phenomena which currently undermine cultural heritage. Against the recent historical background, where the cultural heritage has been intentionally injured because of iconoclastic waves, the present research pursues a main objective, which can be summarized into the following query: is it possible to affirm the consolidation of the principle of the individual criminal responsibility vis-à-vis the intentional destruction of cultural property committed during peace time? In order to solve this question, the research follows the reasoning adopted by international criminal courts in order to affirm the principle of individual criminal responsibility for violations of international law. In particular the present work, which consists of two parts, aims to ascertain the fulfillment of the three criteria enunciated by the international criminal courts: (a) the existence of rules of international law laying down a specific obligation to protect cultural property; (b) the production of serious consequences in case of violation of such rules; (c) the generalized criminalization, into national legal systems, of a such offence. Consequently, the first part of the work – of an introductive character – is addressed to a systematic overview of the relevant legal framework, whose evolution highlights how the international tools have been characterized by either a progressive extension of cultural good notion, or an evolution of the pursued ratio legis. Therefore, the analysis takes moves from the ius in bello norms which have granted an immunity to cultural property, based on its civilian character and aiming to prevent those damages which are typically caused by armed conflicts. Finally, and especially, it considers those norms of a wider scope which – embracing the broader notion of cultural heritage – have interpreted the cultural property protection as a constituent part of the human rights protection system. Thus, addressing the attention on the most recent achievements of this evolutional process, the research turns to those legal instruments – such as Article 27 of the Universal Declaration of Human Rights (1948) and Article 15 of the International Covenant on Economic, Social and Cultural Rights (1966) – whereby the international obligations related to cultural property could be interpreted as tools to defend a humankind interest, namely the peaceful enjoyment of the cultural rights: i.e. the right to take part to cultural life, as well as the right to have a cultural identity. However, the pivot of the present research is its second part, which is focused on the consequences deriving from the violations of the relevant international rules protecting cultural property and, consequently, from the cultural rights infringements. Indeed, the second part intends to establish whether the Rome Statute provisions has been overtaken by new rules of customary international law, according to which the intentional destruction of cultural heritage constitutes, besides a war crime, even a crime against humanity. To this scope, the analysis deals with the reactions that international actors have implemented for facing the iconoclasm plague. In order to ascertain the criminalization degree, the work firstly focuses on the pertinent case-law of the international criminal tribunals: indeed it is known that the International Criminal Tribunal for the former Yugoslavia before, and the Extraordinary Chambers in the Courts of Cambodia then, have already condemned the intentional attacks directed against cultural sites as crimes against humanity sub specie of persecution. Ultimately, the object of the last part is represented by the national legal systems, whereby it is given to retrace the criminal relevance degree which is recognized to the destruction of cultural heritage.

Nell'ultimo decennio si è manifestata una crescente attenzione alle relazioni di interdipendenza tra di- mensione urbana e dimensione rurale dello sviluppo territoriale. È un interesse alimentato dalla diversa percezione con cui ormai viene colto il rapporto tra città e campagna, tra economie urbane ed economie rurali, considerate dal pensiero economico-politico classico come due mondi separati. Questo processo è particolarmente visibile nel con- testo europeo, dove per ragioni non solo insediative e funzionali, ma anche economiche, sociali e culturali l'avvento di modelli di sviluppo post-industriali ha portato a più complesse forme di ibridazione tra modelli di sviluppo urbani e rurali. L'articolo si propone in primo luogo di esplorare il processo di acquisizione di tale nuova sensibilità alla dimen- sione europea e comunitaria, sia attraverso una lettura sintetica di alcuni documenti u ciali in materia di sviluppo territoriale, sia osservando gli esiti dei principali progetti di cooperazione che a rontano le relazioni urbano-rurali. Tale lettura costituisce la base per introdurre criticamente quattro speci che dimensioni cognitive e progettuali dell'in- terazione urbano-rurale: la dimensione paesaggistica e ambientale, la dimensione sociale e culturale, la dimen- sione economica, la dimensione energetica. Nelle considerazioni conclusive vengono in ne indicate alcune s de peculiari per le scienze del territorio e per la generazione di più e caci politiche nello scenario urbano-rurale. ; In the last decade a growing attention has been devoted to the interdependence between the urban and rural dimensions of territorial development. It is an interest depending by the changing perception of the relations among city and countryside, urban economies and rural economies respect to that provided by the classical political- economic thought in western countries. This process is particularly sharp in Europe, where for spatial, economic, social and cultural reasons, the transition towards a post-industrial society has also led to a broader hybridization of the urban and rural models of development. The aim of the article is rstly to explore the extent of this new sensibility towards urban-rural relations at the European level, particularly through an exploration of policy documents and in- novative projects that have tried in recent years to focus on urban-rural interactions. This framework constitutes the base to critically discuss four di erent dimensions in which the urban-rural relations can be explored from a cogniti- ve and planning perspectives: the landscape and environmental dimension, the social and cultural dimension, the economic dimension, the energy dimension. The conclusive paragraph addresses some speci c challenges for the planning culture in order to improve the e ectiveness of territorial policies towards the urban-rural scenario.

This paper is focused on the position of the Spanish Constitutional Court on the control of the requirements that have to be met in order to open exceptional legislative procedures in accordance with the Spanish Parliamentary Regulations, in particular, regarding the abbreviated one single reading procedure. For this purpose, the requirements enabling the abbreviated procedure and the consequences stemming from its applicationfor ius in officium are subject to study in the first place, highlighting the limited, and sometimes misleading, statements of Spanish doctrine on the matter. Then, we will approach, on the one hand, the relevance of the legislative decisions adopted in this extraordinary way, and on the other, the parliamentary practice on this matter carried out to date. We also will expose the latest doctrine of the Spanish High Court about the nature and simplicity of formulation of the initiatives processed by this special channel, and finally will present a personal contribution about the constitutional limits of the requirements enabling this abbreviated procedure. ; In questo articolo si esamina la posizione della Corte Costituzionale Spagnola in merito alla supervisione dei presupposti abilitanti previsti dal Regolamento Parlamentare Spagnolo per l'avvio di procedimenti legislativi straordinari, in particolare, per il procedimento abbreviato mediante lettura unica. Per questo motivo, analizzeremo in primo luogo le circostanze che permettono l'avvio di detto iter procedurale abbreviato e le conseguenze derivanti dalla sua applicazione nel ius in officium, mettendo in evidenza le scarse occasioni in cui la dottrina spagnola si pronuncia in merito e i pareri, in alcune occasioni inaccurati, espressi a tal proposito. Di seguito verrà esaminata, da una parte, la rilevanza delle decisioni legislative adottate attraverso questo iter straordinario e, dall'altra, la prassi parlamentare finora adottata al riguardo. Successivamente, analizzeremo i pronunciamenti più recenti della Corte Costituzionale Spagnola sulla natura e la semplicità di formulazione delle iniziative sottoposte a questo iter speciale, per poi esporre una tesi personale in merito ai limiti costituzionali dei presupposti abilitanti di detto procedimento abbreviato.
