Abstract: Contemporary international society is characterized, among other elements, by its progressive humanization, which situates human beings at the centre of all international concerns. This conceptual approach, and the capacity of global health to situate itself transversally across multiple dimensions, means that health is a material domain that can become a central axis of international action and of International Law. In this paper are discussed, fi rstly, the international notion of health and its global character in a globalized world; secondly, are analysed certain key aspects concerning health as an object of cooperation and international regulation, particularly as it involves the United Nations and the World Health Organization (WHO). Finally, are presented some of the principal substantive dimensions of current international action in matters of global health. Este planteamiento conceptual y la misma capacidad de la salud global para situarse transversalmente en múltiples dimensiones configuran a la salud como un ámbito material que puede convertirse en un eje central de la actuación internacional y del Derecho Internacional. En este artículo se presenta, en primer lugar, una aproximación a la noción internacional de salud y a su carácter global en un mundo globalizado; en segundo lugar, se analizan algunos aspectos clave en relación con la salud como objeto de cooperación y regulación internacional, en particular en torno a las Naciones Unidas y a la acción de la Organización Mundial de la Salud (OMS); por último, se formula una rápida presentación de algunas de las principales dimensiones sustantivas de la actual actuación internacional en materia de salud global. Cette approche conceptuelle et la même capacité de la santé mondiale à être placé transversalement dans des multiples dimensions confi gure la santé comme un domaine matériel qui peut devenir une pièce maîtresse de l'action internationale et du droit international. Cet article présente, en premier lieu, une approche à la notion de santé internationale et sa nature global dans un monde globalisé; deuxièmement, sont discutés certains aspects référées à la santé comme un objet pour la coopération et la réglementation internationale, en particulier autour de l'Organisation des Nations Unies et de l'action de l'Organisation mondiale de la Santé (OMS); enfin, on fait une brève présentation de certaines des principales dimensions de fond de l'action internationale actuelle autour de la santé mondiale. Summary The case-law of the Chilean Municipal Elections Court, which is now virtually unknown, contains important substantive and procedural elements. The reference to that case-law is both institutional and dogmatic, and its relevance does not refer to a purely historical analysis, but also offers important aspects of the administrative, electoral and procedural law of today. ; Resumen La jurisprudencia del Tribunal de Elecciones Municipales de Chile, hoy prácticamente desconocida, contiene elementos sustantivos y procesales importantes. El aporte de dicha jurisprudencia es tanto institucional como dogmático, y su relevancia no se remite a un análisis meramente histórico, sino que también ofrece aspectos de interés al derecho administrativo, electoral y procesal de nuestros días.

The present article discusses the new issues caused by the growth of private urban developments in America - particularly focused in Argentina - and proposes as a thesis: how the present regulation is insufficient to meet the complexity of the new legal relationships, particularly among the neighbors and entrepeneurs. The text builds its bases on the analysis of comparative law and various court cases, which manifest that such regulation should come primarily from public law, which would give superiority to the administrative, municipal and city-planning in the regulation of the subject. ; Este artículo analiza la nueva problemática ocasionada por el crecimientode desarrollos urbanísticos privados en América – particularmente enfocado a la Argentina - y propone como tesis que el derecho privado que actualmente normativiza la cuestión, es insuficiente para dar respuesta a la complejidad de las nuevas relaciones jurídicas que se entablan, particularmente entre vecinos y emprendedores. Sostiene y fundamenta sobre la base del análisis de derecho comparado, casos y diversos fallos judiciales, que esa regulación debe provenir esencialmente del derecho público, dando así preponderancia al derecho administrativo, municipal y urbanístico en la regulación del tema.

The municipal social services must give precedence to or regain the main role of citizens in taking social decisions at a municipal level, by providing innovative mechanisms to express and coordinate, thus allowing for greater participation fromcitizens and social entities. The article analyses the contributions and opportunities for civic participation, and goes deeper into the democratisation of public policies in the municipal sphere. A systematic and reflexive assessment of the contexts, objectives, dimensions, opportunities and mechanisms aimed at incorporating civic participation into social services management. In addition, results and conclusions are presented from recent empirical research into participation in municipal social policies, comparing the reality and trends in studies and experiences, both nationally and internationally. ; Els Serveis Socials municipals ha de prioritzar/recuperar el protagonisme ciutadà en les decisions socials municipals mitjançant la innovació en l'articulació i coordinació de mecanismes que permetin una més gran participació dels ciutadans i de les entitats socials. La globalización permeó las fronteras artificiales existentes entre la economía y la sociedad alrededor del mundo. Las actividades empresariales en este ambiente globalizado ha servido como catalizador de las violaciones de derechos humanos como consecuencia de la ausencia de la protección institucional algunas empresas han explotado los vacíos jurídicos y la falta de protección de los derechos humanos. Al respecto, para lograr un cambio paradigmático requiere un fuerte énfasis en los derechos y las obligaciones de las empresas. Este artículo presenta un análisis crítico de las obligaciones de las empresas en material de derechos humanos frente a la falta de cláusulas de estabilización en los contratos de inversión extranjera. En primer lugar, estas cláusulas son examinadas en relación con la responsabilidad en las obligaciones corporativas con relación a los derechos humanos fundamentales. De acuerdo con lo anterior, se analizan las dimensiones sustantivas y procesales de las cláusulas de estabilización. En segundo lugar, apelando a los ejemplos concretos del Acuerdo para el desarrollo de la Minería entre Mittal Steel y el Gobierno de Liberia, así como el proyecto del Oleoducto de Baku‐Tblisi‐Ceyhan como casos de análisis, este artículo busca la aplicación de las cláusulas de estabilidad en las inversiones extranjeras con relación a la protección de los derechos humanos por parte de los Estados y de las empresas. En tercer lugar, se propone una modificación a la forma como se introduce la cláusula relativa a los derechos humanos. Due to the development of the information society, countries face the task of effectively regulating the relevant social relations. The mechanisms of such regulation should correspond to the specifics of such relations. Digitization is one of the modern methods of legal regulation, which is the use of information technology at the state level. The existing scientific achievements on digitalization processes need constant improvement, which corresponds to the specifics of this field. The object of research is digitalization in law in the light of international experience. The article aims to study and analyze digitalization in law in the international legal aspect. The following methods were used during the study: systemic, systemic-functional, comparative, sociological, analysis, synthesis, analogy, observation, classification, and statistical analysis. The article analyzes the phenomenon of digitalization, identifies the main approaches to understanding it. On the example of international experience (such countries as France, Germany, Italy, Georgia, Greece, and Great Britain), the mechanisms of using digitalization in public administration are determined, the legal regulation of informatization is analyzed. Also, based on the study and analysis of doctrinal teachings of international information experience, it is proposed to improve the domestic legal mechanism to ensure the effective functioning of public relations.

Co-operative Law has a long tradition in European countries, like the Industrial and Provident Act in the United Kingdom in1852 or the Prussian Co-operatives Act in 1867. The European Union was no born to create a common law but to remove restrictions on the freedom of establishment. In 2003 the Statute for a European Co-operative Society was approved, but harmonization of European co-operative legislation was never carried out, not even for its most importante distinctive elements. In 2012 the European Commission presented a report about the application of the SCE Statute showing that the SCE Regulation has had relatively little success. The differences between the different legal systems are considerable, both in forma and in content. European Commission expressed its intention not to carry out the harmonization of the European co-operative legislation directly, but to support the harmonization proposals that the co-operative sector presented to it. El derecho cooperativo tiene una larga tradición en los países europeos, desde la Industrial and Provident Act de 1952 en Reino Unido o la Ley prusiana de cooperativas de 1867. La Unión Europea no nació para crear un derecho común sino para surprimir las restricciones a la libertad de establecimiento. In 2003 se aprobó el Estatuto de la Sociedad Cooperativa Europea, pero nunca se ha llevado a cabo una armonización de la legislación cooperativa en Europa, ni siquiera en relación con sus elementos más característicos. En 2012, la Comisión Europea presentó un informe sobre la aplicación del Estatuto de la SCE que mostraba que esta regulación había tenido relativamente poco éxito. Las diferencias entre los diferentes sistemas legales son considerables, tanto formalmente como por su contenido. La Comisión Europea ya manifestó su intención de no llevar a cabo la armonización de la legislación cooperativa europea directamente, pero sí apoyar las propuestas de armonización presentadas por el sector cooperativo.

The document attempts to provide an overview of certain elements that determine the processes of urban planning and management. The assumption is that the evolution of some of these elements is beyond the control of municipal planning instruments. This situation is illustrated on the case of the Municipal governments are deeply influenced by two legal instruments; the Municipal Lax of 1985 and the Tax reform ditto of 1986. In order to present the effect of these instruments a brief description of the urbanization process in Bolivia and the institutional set-up in which it takes place is given. As concluding remarks, the document suggests further action in overcoming purerly spacial and physical approaches to urban planning by their more realistic insertion in the overall national development process. ; El documento intenta dar una visión general de algunos elementos que influencian de manera determinante los procesos de planificación y gestión urbana y que de alguna manera están fuera del control de los instrumentos de planificación municipal. Esto se ilustra a través del caso de los gobiernos municipales en Bolivia. AI respecto, la acción de las municipalidades bolivianas está fuertemente condicionada por dos instrumentos legales: la Ley de Municipalidades de 1985 y la reforma tributaria de 1986. Para poder dar una visión del efecto de estos instrumentos también se da una breve descripción del proceso de urbanización en Bolivia y el contexto institucional en que éste se desarrolla. Como reflexión final se sugiere avanzar efectivamente en la superación de visiones puramente físico-espaciales del desarrollo urbano, insertándolas más realisticamente en los procesos de desarrollo nacional.
