O artigo enfoca, pela óptica do direito econômico, as influências das políticas econômicas privadas (basicamente do capital transnacional) e dos entes internacionais sobre as políticas econômicas públicas, especialmente as realizadas pelos Estados em desenvolvimento. Enfatiza a mutação do neoliberalismo de regulamentação para o de regulação como exigência dos poderes econômicos privados, identificando entre os seus resultados o enfraquecimento do Estado e a descrença na democracia. The concession of the Spanish Telephone System to the National Telephone Company of Spain (CTNE) in 1924 represents one of the most outstanding events in the contemporary history of this country. Regardless of the scope chosen: technical, social, political or economical, it is not possible to understand the Industry of Telecommunications in Spain without the intervention of the current "Telefónica Corporation", the successor in time to the first National Telephone Company created during the Dictatorship of General Primo de Rivera. Reasons which lead to the creation of the CTNE, the connection of this company with the North American multinational ITT and the way in which it was able to take control of the whole Telephone Market in Spain will be described in this work. ; La adjudicación del sistema telefónico español, en 1924, a la compañía telefónica nacional de España (ctne), representa uno de los acontecimientos más destacados de la historia contemporánea de este país. con independencia del ámbito que se escoja: técnico, social, político o económico, no es posible entender el sector de las telecomunicaciones en España sin la presencia y el concierto de la actual corporación telefónica, sucesora en el tiempo de aquella primera compañía telefónica nacional, surgida durante la dictadura del general primo de rivera. en este trabajo se desvelarán las razones que condujeron a la creación de la ctne, las conexiones que esta compañía mantenía con la multinacional norteamericana itt y la manera en la que logró hacerse con el control de todo el sistema telefónico español.

Economic reasoning is a distinctive feature of competition law. At first sight, it may appear as foreign to judges. A closer analysis, however, shows that there is no conflict of logic between economic and judicial reasoning. Some points of convergence between these modes of reasoning are underlined. In addition, it is submitted that obstacles to judicial acknowledgement of economic reasoning are purely relative. The proposed analysis then proceeds to investigate how economic reasoning may be incorporated into judicial methods. It is shown that this is achieved by way of ordinary mechanisms. Indeed judges may use economic analysis to determine the relevant facts and legal tests. It follows that judicial control over economic reasoning – including that of competition authorities – can be explained by a very general theory of judicial review, according to which the depth of judicial control over grounds of fact and law depends on the dynamics of litigants' contentions. ; Le raisonnement économique se présente comme un trait distinctif du droit de la concurrence. Il peut apparaître étranger au juge. L'analyse plus approfondie qui est proposée révèle cependant qu'il n'y a pas d'opposition entre la logique économique et la logique juridique. Certains points de convergences sont mis en lumière. Il est par ailleurs démontré que les obstacles à la prise en considération du raisonnement économique par le juge ne sont que relatifs. L'analyse cherche ensuite à rendre compte de l'insertion du raisonnement économique dans la méthode du juge. Celle-ci peut être expliquée à partir d'éléments habituels du jugement : les éléments de la qualification juridique des faits et sa structure. Il en découle qu'il est possible de rendre compte du contrôle juridictionnel exercé sur le raisonnement économique – notamment celui des autorités de concurrence – à partir d'une théorie du contrôle de motivation dont la portée est très générale : la théorie du manque de base légale.

"Levels of political involvement still are surprisingly different among European citizenries. Apparently, neither the establishment of democratic institutions nor the rise in competences among mass publics has lead to a convergence of the levels of political involvement. Only at a very general level, systemic differences can be noted between the settled democracies of North-western Europe and the newer democracies of Southern Europe. The analyses presented here examine several explanations of the cross-national differences in political involvement by developing multi-level models combining the impact of various factors at the individual and the macro level using the first wave of the European Social Survey (2002-2003) as the primary data source. The results show that of the social capital factors, only the support for norms and values contributes to the explanation of political involvement after the conventional antecedents at the individual level are taken into account. Neither social capital understood as an individual resource, nor social capital understood as a conditional effect at the macro level, appears to be very relevant for the explanation of differences in political involvement. Instead, the multi-level models tested here underline the relevance of conventional individual-level factors. Cross-national differences in political involvement are mainly due to differences in the distributions of these factors in the various countries." (author's abstract)

The recently established European Globalization Fund (EGF) is an attempt to better share the benefits of globalisation at the EU-level, targeting workers who loose their job due to trade-induced mass lay-offs. We find that the typical income shock for trade displaced workers is a serious one. However, workers displaced not through trade suffer a similar income shocks. We argue that the trade focus and the centralization at EU level may be justified on political economy grounds because trade policy is also decided at the EU level. But current EGF rules leave too much room for discretionary decisions. Therefore, we propose that the EGF focus on two simple active labour market schemes: a wage insurance scheme and lump-sum mobility allowances. ; Le tout nouveau Fonds européen de mondialisation (FEM) représente une tentative de partager les bénéfices de l'ouverture aux échanges au niveau européen, en ciblant des aides sur les travailleurs perdant leur emploi dans le processus de délocalisations. Nous montrons que les effets de ces délocalisations représentent un choc de revenu important, même si d'autres travailleurs perdant leur emploi pour d'autres raisons souffrent de pertes de revenus de niveau similaire. En dépit de cela, il existe une rationalité à la création d'un outil centralisé au niveau de l'Europe, dans la mesure où la politique commerciale est aussi décidée au niveau européen. In der empirischen Sozialforschung ist Einkommen ein sozioökonomischer Indikator für soziale Schichtung und soziale Ungleichheit. Am Beispiel des European Social Survey (ESS) wird hier gefragt, wie sich Daten zum Gesamt-Nettoeinkommen eines Haushalts mit möglichst wenig Fragen in praktikabler Weise so erheben lassen, dass die Belastung für Interviewer und Befragte minimiert wird und dass die erhobenen Daten in verschiedenen Ländern tatsächlich die gleichen sozialen Fakten repräsentieren. Es werden fünf Faktoren identifiziert, die einen Einfluss auf die Qualität der Einkommensmessung haben: Definition des Haushalts, Haupteinkommensquelle, Zusammensetzung des Einkommens, Familienverhältnis des Befragten zum "bread winner" sowie Wissensstand des Befragten. Die Verfasser zeigen, wie Einkommen im ESS klassifiziert wird, und schlagen ein alternatives Modul aus fünf einkommensbezogenen Fragen vor, das die Erhebung vergleichbarer Einkommensdaten in den ESS-Staaten erleichtern soll. Issues that are not solely corporate or business concerns, they have become public, political, and ethical concerns. They have become economic concerns, particularly due to the erosion of public confidence in the integrity of corporate leadership and the institutions that are charged with their oversight.

The author first describes the context of transformation, namely the globalized, postindustrial society and the processes of deregulation, re-regulation and resistance. Then, the working of GATS is discussed which extended the existing GATT into the field of services, "and integrated it into the structures of the newly founded World Trade Organization." GATS is an instrument of liberalization and deregulation of the service sector - its implications on education are outlined. There are times in our history where new technologies burst onto the scene and have a major impact on our lives. We live in one such time. The Internet is revolutionizing how people and organizations interact with each other. Examples of these paradigm changes include how students are now being educated online with minimal face time with their teachers; governments are being forced to adapt to the new circumstance where once formidable geographical boundaries between countries are being lowered by information technology; and the military is realizing that it needs to harness this new technology or be defeated by it.

"Translation of questionnaires is the most frequently chosen route to implementing 'equivalent' instruments in cross-national and cross-lingual survey research. The article presents the framework of current survey translation practice: the various procedures proposed for translation and for assessment of translation products and the respective advantages or disadvantages of each. In doing so, pointers are made to research gaps in questionnaire adaptation and evaluation for cross-cultural work and to the need for interdisciplinary transfer from cognitive survey research, translation studies and statistical analysis in order to establish a thorough-going methodology of questionnaire adaptation, assessment and documentation." "Die Umweltberatung als Praxis und berufliche Tätigkeit entsteht Mitte der achtziger Jahren in Europa. Obwohl Deutschland als Vorbild für die europäische Umweltberatung dienen kann, ergeben sich verschiedene Auffassungen dieser Tätigkeit in Europa, wie man am Vergleich zwischen Frankreich und Deutschland zeigen kann. Wir unterscheiden bei der Analyse der Umweltberatung den Aspekt der gesellschaftlichen Relevanz und den Bezug zur Natur. Die Umweltberatung in Deutschland begreift sich als Bürgerberatung oder als Verbraucherberatung und versteht sich als Teil einer sozialen Bewegung. Die Umweltberatung in Frankreich begreift sich dagegen als Beratung für Entscheidungsträger und distanziert sich gern von der grünen Bewegung. Diesem Unterschied entspricht das jeweilige Verständnis der Gesellschaft, das die deutschen und französischen Umweltberater haben. Da wo die deutsche Umweltberatung sich überwiegend auf die Bevölkerung stützt um den erhofften gesellschaftlichen Wandel anzutreiben, ist die französische Umwe1tberatung bestrebt, diesen Wandel hauptsächlich durch technischen Innovationen zu fördern. Während die einen das Wandlungspotential der Gesellschaft an der Betroffenheit der Bevö1kerung messen, setzen die anderen auf die Flexibi1ität der gese11schaftlichen Strukturen. Es herrschen also zwei Versionen der gesellschaftlichen Dynamik: im ersten Fall gelten die Weltanschauungen der Menschen und ihre Motive als Hauptzugang zur Gesellschaft; im zweiten Fall zielt die Handlung auf die Gesellschaft die als autonomes Gefüge verstanden wird. Nimmt man dagegen den Bezug zur Natur als Schwerpunkt der Umweltberatung in Europa, verblaßt die Differenz zwischen Deutschland und Frankreich. In beiden Fällen wird das Wissen über die Natur mit einem allgemeinen Wissen verbunden, das hauptsächlich wissenschaftlich, technisch und recht1ich fundiert ist. Es bi1den sich jedoch Regionen nach Themen die mehr oder weniger Re1evanz finden. So wird, z. B., bei der Weiterbildung der Umweltberater in Frankreich das Thema der Schadstoffe im Haushalt vernachlässigt, aber dafür wird die Stadtplanung intensiver behandelt als in Deutschland. Diese Tendenzen hängen mit gesellschaft1ichen Formen des Zusammenlebens zusammen, die mit einer Tradition verbunden sind. Die Familie, die kleine Gruppen und die Nähe, im allgemein, werden in Deutschland bevorzugt gegen den abstrakten Vertrag in Frankreich." (Autorenreferat)
