Milli Güvenlik Kurulu, "devletin milli güvenlik siyasetinin tayini, tespiti ve uygulanması ile kararların alınması ve gerekli koordinasyonun sağlanması" çerçevesinde, silahlı kuvvetler komuta kademesi ile hükümet üyelerinin Cumhurbaşkanı'nın başkanlığında biraraya gelerek, karşılıklı görüş alış verişinde bulundukları ve görüş belirdikleri bir organdır. Özellikle kriz dönemlerinde dönemlerinde Türk siyasal hayatında oldukça etkili bir işlev görev Milli Güvenlik Kurulu, uygulamada oynadığı bu rol nedeniyle, zaman zaman ülkenin "en üst karar organı" nitelemelerine maruz kalmaktadır. Milli Güvenlik Kurulu (MGK), 1961 Anayasası'yla faaliyete başlamıştır. Türkiye'de Milli Güvenlik Kurulu'ndan önce de çeşitli savunma kurulları faaliyette bulunmuştur. Bunlar; Harb Encümeni(1922), Yüksek Müdafaa Meclisi ve Umumi Katipliği (1933) ve Milli Savunma Yüksek Kurulu(1949) dur. Ancak bunların görev alanları askeri savunmaya yönelik sınırlı bir alanı kapsamaktadır. Türkiye'yi bu tür bir organ arayışına iç siyasi gelişmeler ve dengeler ile dış dinamikler ve konjonktür götürmüştür. Dış dinamiklerin başında, özellikle İkinci Dünya Savaşı'ndan sonra ABD öncülüğünde bütün dünyada meydana gelen savunma konseptindeki değişiklik gelmektedir. Bu savaştan sonra milli savunma, kavramından daha kapsayıcı bir kavram olan milli güvenlik kavramına geçilerek, ABD örneğindeki Milli Güvenlik Konseyi(National Securty Cuoncil) gibi milli güvenliği sağlamakla görevli organlar kurulmuştur. Ancak Milli Güvenlik Kurulu uygulamasına Türkiye açısından bakıldığında, mevzuat ve geleneklerden hareketle, iç dinamiklerin belirleyici bir rol oynadığını görmek mümkündür. Bu nedenle Türkiye uygulaması, Batı ülkelerinden önemli ölçüde farklılıklar göstermektedir. Ülkemiz örneğinde asker ve sivillerin eşit oranda temsil edildiği MGK'nda milli güvenlik kavramı çerçevesinde ülkenin ekonomik, siyasal ve sosyal ve kültürel bütün sorunları müzakere edilmekte, toplantı sonucunda alınan kararlar, "alınması zorunlu görülen kararlar" amir hükmüyle Bakanlar Kurulu'na bildirilmektedir. Bu durum, askeri otoritenin devlet yapısı ve siyasal karar süreçleri içindeki özerkliği ile kendisini Batı ordularından ayıran aşırı merkezi yapısının bir sonucudur. Milli Güvenlik Kurulu, mevcut yapısı ve işleyişiyle, üç önemli soruna yol açmaktadır:1-Milli güvenlik kavramının kapsamının müphem ve muğlak bırakılması, uygulamada temel hak ve özgürlüklerin kısıtlanmasına yol açmaktadır.2-Kurul'a katılan kuvvet temsilcileri vasıtasıyla ordu iç politikaya müdahaleyle karşı karşıya bırakılmaktadır.3-Sivil idareyi devamlı gözetim altında tutan bir mekanizma görevi gören Milli Güvenlik Kurulu, yürütmenin gücünü kırmakta, enerjisini tüketme, zayıf ve etkisiz bırakmaktadır.Anayasa'da ve ilgili mevzuatta düzenlenen Kurul'un yapısı yeniden ele alınmalıdır. Kurulun amacı, statüsü, görevleri tartışmalara imkan vermeyecek şekilde, net bir şekilde ortaya konulmalıdır. Yapılacak yeni düzenlemede Kurul, asker -sivil hesaplaşma alanı olmaktan çıkarılma ve bir "danışma kurulu" statüsünü aşmamalıdır.THESIS SUMMARYThe National Security Council is an organ, consisting of the armed forces command rank and goverment members, who convene within the frame of "determination, designation and application of state's national security policy, taking decisionds and providing the necessary coordination", under the presidency oy the Head of State and mutually exchange views and state opinions. The National Security Council, whic performs a quite efective function especially in crises periods, due to the role it plays in application, is being exposed from time to time to " the highest decision organ" of the country description. The National Security Council (MGK), began activity by the Constitution of 1961. Before the National Security Council in Turkey there had been other various defence committees. These were War Council (1922), High Defence Assemly and General Clerkship (1933) and National Defence High Council (1949). However, the duty scopes of these cover a limited area directed towards military defence.Turkey has been carried to the search for such an organ by the internal and external development and balances and by external dynamics an conjunture. The most important of the external dynamics ist the change in the defence concept, that occurred around the world especially after the Second World War in the leadership of the USA. After this var it has been passed from national defence concept to national security, which concept is more comprehensive and as with the example of the USA's National Security Council, organs, appointed to ensure the national security have been established. When looked at the National Security Council application from the viewpoint of Turkey, however, starting from the regulations and customs, it is possible to see that the internal dynamics play a determining role. Therefore the application in Turkey shows substantial differences from the Western Countries. In our country's example in the National Security Council, where the military and civils are represented equally, within the frame of national security concept, economic, political, social and cultural and all problems ar negotiated. Decisions, taken at the end of the meeting, "decisions, regarded as compulsory" are communicated to the Council of Ministers by a superior's order. This situation is a consequence from the autonomy of the military authority from the state structure and political decision mechanism and from its excessive centralized structure, whic distinguishesit from the Western Armies. The National Security Council, with its present structure and functioning, opens the way to three important questions:1-Leaving the national security concept vague and confusing results practinally in the restriction of the basic rights and freedoms. 2-Through the power representatives joining the Council, the army is left face to face with intervention in domestic politics. 3-The National Security Council, which functions as a mechanism, holding the civil execution constantly under supervision, breaks down the strength of he execution, exhausts its energy, leaves it weak and unefective. The Council's structure, coordinated in the constitution and reladet regulations, must be handled anew. The Council's purpose, its status, and duties must be determined in a neat manner, which leaves no ways for debates. The Council in this new arrangement, should stop being a form of military-civil accounts-settling and should not exceed its status of "consulting comittee".

Uluslararası sistemde temel örgütlenme birimi olarak kabul edilen ulus devlet sistemi Ortaçağ döneminde Avrupa'dan tüm dünyaya yayılarak gelen bir yapıya karşılık gelmektedir. Bu yapının 1648 Westphalia Antlaşmasından başlayarak bir dizi siyasi, ekonomik ve sosyal gelişmeler sonucunda özellikle Fransız İhtilali sonrasında tüm dünyaya yayıldığı ve uluslararası politikada hakim siyasal örgütlenme biçimi olduğu kabul görmektedir. Modern devlet sistemi olarak adlandırılan bu yapıda tüm devletlerin sınırları belirli bir toprak parçası üzerinde vatandaşları üzerinde son sözü söyleme yetkisine sahip oldukları ve meşru güç kullanma tekelini elinde bulundurdukları genel kabul gören bir anlayıştır. Söz konusu bu modern devlet sistemi tüm devletlerin aynı özelliklere sahip olduğu veya olması gerektiği ön kabulüne dayanmaktadır. Tüm ulus devletlerin benzer gelişmeler neticesinde kurulduğunu öngören bu yaklaşım sistemde var olan tüm devletlerin bazı asgari standartlara sahip olduğunu ve standart kalıplar içinde var olduklarını ifade etmektedir. Bir başka deyişle modern ulus devlet modeli esasında tek tip ve standart bir devlet modeli öngörmektedir. Oysaki ulus devlet sistemi Avrupa dışındaki bölgelerde Avrupa'da yaşanan sürece benzer bir gelişim süreci göstermemiştir. Bu nedenle dünyanın birçok bölgesinde ortaya çıkan ulus devlet modelleri bir ulus devlette olması gereken şartları taşımadan ortaya çıkarak varlıklarını sürdürmektedirler. Özellikle Birleşmiş Milletler Sisteminin kurulmasının ardından bağımsızlıklarını kazanan birçok eski sömürge devleti bir ulus devlette olması gereken asgari standartlara sahip olmadan devletleşme sürecine girmişlerdir. Bu devletler hukuki olarak uluslararası toplum tarafından ulus devlet formunda kabul edilmiş olmalarına rağmen fiili olarak bir ulus devlette olması gereken özelliklere sahip olamadıkları için standart bir ulus devlette olması gereken işlevleri yerine getiremedikleri görülmektedir. Gelinen noktada bu tür devletler başarısız olarak adlandırılarak diğer devletlerden olumsuz olarak ayrışmaktadırlar. ii Bu durum bu devletlerin başarısız ve uluslararası sistemin hatalı veya bozuk parçaları olarak görülmelerine neden olmaktadır. Çünkü bu devletler vatandaşlarına diğer başarılı devletlerin sağladığı güvenlik, sağlık, eğitim gibi temel hizmetleri sağlayamadıkları gibi ülke içinde yaşadıkları silahlı çatışmalar nedeniyle gerek komşuları gerekse küresel sistem için kitlesel göçler, salgın hastalıklar, küresel terörizm gibi birçok soruna neden olmaktadır. Bu çalışma uluslararası politikada başarısız devlet sorununa odaklanarak başarısız devletselliğe neden olan unsurları tartışmaya açmaktadır. Bu noktada çalışmanın ortaya koyduğu tez; başarısız devletselliğin başarısız devletlerin kendilerinden kaynaklanan bir sorun olmasının yanında bu durumun aynı zamanda küresel kapitalist sistem ve sömürge devletlerinin uyguladıkları yanlış politikalardan kaynaklanmasıdır. Bu açıdan çalışma öncelikli olarak modern ulus devletin oluşum süreci ve unsurlarını inceledikten sonra başarısız devletlerin temel özelliklerini ortaya koyarak bu duruma neden olan sebepleri incelemeyi amaçlamaktadır. Ayrıca başarısız devletlerin neden olduğu uluslararası sorunlara dikkat çekerek bu sorunun çözümü için yeni yaklaşımlara ihtiyaç olduğunu vurgulamaya çalışmaktadır. ; The nation state system, which is accepted as the basic organization unit in the international system, corresponds to a structure that has spread from Europe to the whole world starting from in the middle ages. It is accepted that this structure has spread all over the world especially after the French Revolution as a result of a series of political, economic and social developments starting from the 1648 Treaty of Westphalia. It is a dominant form of political organization in today's international politics. In this structure, which is called the modern state system, it is generally accepted that all states have the authority to say the last word on the territory of a certain territory and hold the monopoly of using legitimate power. This modern state system is based on the assumption that all states have or must have the same characteristics. This approach, which envisages that all nationstates are established as a result of similar developments; states that all the states in the system have some minimum standards and exist within standardized patterns. In other words, the modern nation-state model provides a uniform and standardized state model. However, the nation-state system has not shown a similar development process in the regions outside Europe. Therefore the nation-state models that emerged in many parts of the world continue to exist without having to meet the requirements of a nation-state. Especially after the establishment of the United Nations System, many former colonial states, which gained their independence, entered the process of state building process without having the minimum standards required in a nation state. Although these states were legally accepted by the international community in the form of nation-state, they cannot fulfill the functions they should have in a standardized nation-state because they do not actually have the characteristics that should be in a nation-state. At this point, such states are considered to be unsuccessful and they are negatively differentiated from other states. This causes these states to fail and be seen as faulty or damaged parts of the international system. Because these states do not provide basic services to their iv citizens like other successful states, such as security, health and education and also they cause many problems such as mass immigration, epidemics, global terrorism for both the neighbors and the global system due to the armed conflicts in the country. This study focuses on the problem of the failed state in international politics and discusses the factors causing failed statehood. At this point, the thesis of the study; Besides the fact that the failed statehood is a problem arising from the failed states themselves, this is also due to the false policies implemented by the global capitalist system and the colonial states. In this respect, the study primarily aims to examine the main features of the failed states after examining the formation process and elements of the modern nation-state and to examine the reasons that cause this situation. It also tries to emphasize the need for new approaches to solve this problem by drawing attention to the international problems caused by the failed states. La tesi sostiene che, mentre molte teorie di pianificazione si sono concentrate sulle differenze, il multiculturalismo e risoluzione dei conflitti sociali, non c'è ancora sufficiente approfondimento su come queste differenze possano restare profondamente irrisolte e come questa debolezza possa essere fortemente legata a razionalità contrastanti e a una sorta di "slittamento dei livelli di senso" o "equivoci" cognitivi tra i soggetti coinvolti (Bourdieu e Wacquant, 1992). Soprattutto in termini di conflitti urbani espliciti, generati non da opposti interessi economici o differenti volontà politiche, ma semplicemente da differenti background culturali e comportamentali, il livello cognitivo di com-prensione tra le persone coinvolte ha un ruolo fondamentale in termini di consapevolezza e di effi-cacia delle scelte. Dunque il legame tra pianificazione, governance, contesti istituzionali e partecipazione delle comu-nità è, prima di tutto, una questione di reciproca, profonda e vera comprensione, piuttosto che la continua ricerca di nuovi strumenti e politiche. Partendo dalla convinzione che i conflitti siano una fonte incredibile di soluzioni creative e inaspet-tate all'interno dei contesti urbani, dei sistemi di pianificazione e di condivisione di valori, questo lavoro si propone di sondare come la Mobilitazione Cognitiva (Dalton, 1984), per la cura e la prote-zione di un bene comune, può essere in grado di guidare una comunità nella lotta per i propri diritti, permettendo l'acquisizione di conoscenze politiche e abilità specifiche per il raggiungimento di decisioni condivise collettivamente, la costruzione di nuove forme di azione politica dal basso, nuove processi di educazione (Dolci, 1974) e ampliamento culturale contro il prevaricare di Egemonie politiche e sociali (Gramsci, 2007). Utilizzando metodi quantitativi e qualitativi, l'autore presenta due esperienze di pratiche insorgenti provenienti dall' Europa meridionale: (1) un tradizionale Caso-Studio nell' area marina protetta dell' Arrábida, in Portogallo, per illustrare come la mobilitazione cognitiva, volta alla genuina e profonda comprensione delle istanze portate avanti dalla collettività, può realizzare forme di partecipazione che, guardando ai problemi in termini di risorse, permettono alla comunità di collaborare democra-ticamente cercando soluzioni nuove e condivise in grado di modificare profondamente un piano isti-tuzionale il quale, a causa di una profonda contrapposizione tra poteri gioco e valori espressi, ha ge-nerato forme di conflitto dichiarato, ma anche latente; (2) un caso di Participatory Action Research nella valle del fiume Simeto, in Italia, dove le comunità locali, attraverso una forte mobilitazione collettiva, sono state in grado di difendere e curare il fiume Simeto, il più grande in termini di bacino idrogeologico in un territorio caratterizzato da scarsità idrica come la Sicilia, minacciato dalla scelta istituzionale di collocare un inceneritore proprio in un area fortemente incentrata sull'agricoltura, per il suo sostentamento economico, e profondamente legata al paesaggio circostante, in termini di riconoscimento e senso di appartenenza. Questo lavoro può avere importanti implicazioni sia per la teoria, che per la pratica di pianificazione. La scelta di un approccio multi-disciplinare, inoltre, aiuta nella comprensione di come sia possibile trasformare l'antagonismo in spirito competitivo tra soggetti, diversi per natura e per cultura, concentrandosi principalmente sul rispetto e l'apprendimento reciproco, sulla costruzione di processi veramente inclusivi e sulla scelta di soluzioni davvero condivise. ; The thesis argues that while many planning theories have focused the sight on the social differences, multiculturalism and conflicts resolution, there is not yet sufficient acknowledgement on how these differences can be deeply unsolved and how this weakness could be strongly linked with conflicting rationalities and with a 'cognitive slipping' planes of meaning (Bourdieu & Wacquant, 1992). Especially in terms of inexplicit urban conflicts, generated by not opposite economic interests or political will, but by simply and natural differences of the cultural and behavioral baggage, the cognitive level of understanding between people involved plays a fundamental role in terms of awareness and choices efficacy. So this works wants underlines that the link between planning, governance, institutional adjustments and community engagement is, first of all, a matter of mutual deep and real understanding, rather than new form of tools and policies. Starting from the persuasion that conflicts are an incredible source of unexpected creative solution for urban contexts, planning systems and sharing values, this paper aims to probe how a 'cognitive mobilization' (Dalton, 1984) of a community, for the care and the protection of a common good, can be able to "fight for a right" in terms of acquiring political resource and skills to reach own decisions, and constructing new form of genuine power through education (Dolci, 1974) and culture against a 'dominant discourse' (Gramsci, 2007). Using quantitative and qualitative methods, the author presents two field experiences of insurgent practices in the southern Europe: (1) a traditional Case-Study of a Marine Protected Area in Arrábida, Portugal, to illustrate how a community mobilization, that aims to understand really every form of instance and claim, can realize forms of participation that, first of all, sight problems in term of resources, and then allowed people to work democratically together building new and shared solutions able to modify deeply an institutional plan that, due to a displacement between powers and values, generated forms of conflicts between stakeholders, especially in terms of economic and decision making point of view; (2) a case of Participatory Action Research in the Simeto river valley, Italy, where local communities through a strong mobilization were able to defend and took care the river, the biggest in terms of basin in a scarcity water territory, threatened by the institutional choice to collocated an incinerator in a valley strongly based on agriculture, for its economic sustenance, and deeply linked with the landscape, for its recognition and sense of belonging to . This understanding, it is suggested, has important implications for both planning theory and practice. Choosing a multi-disciplinary approach, this work attempts to explore if and how it is possible to transform the antagonism between enemies in competitive spirit among subjects, different for nature and culture, focusing on respect and mutual learning and on the building up of processes really inclusive and choices really shared

1. Introduction Important political, administrative and economic changes occurred in Turkey and the world in the last 50 years, especially during post-1980 neo-liberal era. Decentralization, rapid urbanization and metropolization processes that emerged by means of these changes have boosted authority, spending and responsibility of local governments. Local governments gradually came to the fore in the process of service delivery. However, especially, allocation of self-income and resources to local governments have not shown a similar level of increase. In this study, this dilemma is analyzed in cases of municipalities in Turkey. The purpose of this study is to reveal the contradiction between the increased burden of duty and income of the municipalities. By this way, it is aimed to provide a scientific basis for policy makers in solving self-income problems. In this context, the situation of the municipalities in Turkey has been analyzed. The case is studied with both theoretical and numerical data and the problem has been clearly demonstrated. 2. Trends of Fiscal Autonomy, Fiscal Decentralization and Decentralization Although a single, universal and unique definition cannot be made, decentralization is generally defined as the transfer/assignment of decision-making responsibility, power and authority of resource creation from higher level administration (central government) to lower levels of administration (regions, local governments and NGOs) (Cheema & Rondinelli, 2007: 1, Leung, 2004: 1, Edquist, 2005: 9, Yuliani, 2004, Hinsz vd., 2006: 2, Eryılmaz, 2002: 225). According to the definition of Litvack ve Seddom (1999: 2) and World Bank, decentralization is the transfer of authority and responsibility for public functions from the central government to subordinate or quasi-independent government organizations or the private sector (Keskin, 2008: 2). Fiscal decentralization forms the financial aspect of devolution to regional and local administrations. Moreover, European and American writers use terms like "centrallocal (or intergovernmental) financial relations" and "fiscal federalism" in order to refer to fiscal decentralization. The first phase of fiscal decentralization is the division of spending responsibilities and revenue sources between levels of government (national, regional, local etc.). The second phase is the amount of discretion given to regional and local governments to determine their expenditures and revenues (both in aggregate and detail). This discretion gives regional and local governments the ability to determine their budgets by levying taxes and fees and allocating resources (Davey, 2003: 1). The essence of fiscal decentralization is the authority and responsibility of subnational governments to finance their local services to a certain extent (Ebel & Yılmaz, 2002: 34). In other words, fiscal decentralization occurs when higher levels of government cede influence over budgets and financial decisions to lower levels (Sharma, 2008). Decentralization and fiscal decentralization trend that has developed in the framework of thinking that local governments should be strengthened has also created the infrastructure of financial autonomy. Fiscal Autonomy aims to enable local governments to have adequate, healthy and sustainable resources in order to ensure the institutionalization of democracy and effective implementation of their services. In that framework, it is defined as local governments' fulfillment of their duties and responsibilities independently from the center. To achieve this aim, local governments manage/spend assets and resources in line with their laws (in accordance with the interests of the local population). They also make budgets and borrowings (Ulusoy & Akdemir, 2009: 260-265, Yontar & Dağ, 2014: 150, Çelik, 2013: 22). 3. Increased Responsibility of Municipalities as a Result of Urbanization and Metropolization in Turkey The urbanization rate was very slow in the early years of the Republic of Turkey. The population living in rural areas began to migrate to urban areas in the 1950s due to improvements in transportation infrastructure, change of the land ownership regime, mechanization and modernization of agriculture, technological developments, increase in industrialization, and other economic/social changes. In particular, migration to cities increased in line with the population growth. This accelerated the need for better highway networks and settlement areas, and new housing (Tosun, 2015: 202- 203, Şahin, 2013: 79). There have been serious population increases in cities such as Istanbul, Izmir, Adana, Ankara and Bursa. This trend caused significant problems in terms of urban services in these cities (Keleş, 2009: 289). Local governments and especially municipalities took on the most important tasks of on-site analysis of the mentioned problems and solving them with practical - permanent proposals. 4. Comparative Analysis of Revenues and Expenditures of Municipalities in Turkey Municipalities became center-dependent units from financial, political and administrative aspects. It is mainly due to inefficient income structure that is dependent on central transfers, not on self-income. It is clear that this situation causes many negative effects on the functioning of municipalities. However, inadequacy of self-income or dependency needs to be demonstrated with numerical data in order to see the adverse trend in a concrete way. This enables a comparison in an international scale and identification of appropriate sample countries for the planned changes for these comparisons. Furthermore, it becomes possible to analyze financial interdependence among different municipal levels and all municipalities. Through detailed assessments, the dilemma between metropolization and fiscal decentralization in Turkey has been put forward in this study. 5. Basic Financial Problems of Municipalities in Turkey The main financial problems of the municipalities can be listed as lack of sustainable revenue sources, ineffective use of available resources, over-dependence on shares transferred from general budget tax revenues collection, inadequacy of self-income sources (Yüksel, 2004). Because of these financial problems, there are many negative situations faced at the local level. 6. Conclusion There is a trend of urbanization and metropolization in Turkey. 93% of the total population lives within the municipal boundaries. 84% of the population within municipal boundaries is within the borders of the metropolitan municipalities. Metropolitan municipalities have the highest burden of responsibilities. Then comes the provincial municipalities, district and town municipalities. However, amount of incomes is in the opposite order. This situation, prevents municipalities from enjoying the benefits of fiscal autonomy and fiscal decentralization. Instead, they become highly dependent on the central government. To get rid of this dilemma, a three-stage policy must be followed. Firstly, efficiency in spending should be achieved. Secondly, steps should be taken to make the most out of available income sources. Finally, municipalities should be provided with new sources of revenue in order to get rid of the fiscal dilemma. While these steps are being taken, rather than applying a general method, political characteristics and administrative, economic, cultural of Turkey should be taken into consideration and Turkey-specific system should be established.

Petrol dünya yüzeyinde en fazla tüketilen enerji kaynağıdır. Dünyanın tüm ülkeleri için olduğu kadar Türkiye açısından da vazgeçilmez stratejik öneme haizdir. Küresel ve/veya bölgesel pek çok askeri ve siyasi gelişme bu çok değerli enerji kaynağı etrafında şekillenmektedir. Türkiye, bu enerji kaynağına sahip ülkelere çok yakın komşu ülke olmakla birlikte kendi yer altı zenginlikleri bakımından fakir bir ülkedir ve petrol tüketiminin % 90'dan fazla miktarını ithal etmektedir. Türkiye ekonomisi petrol fiyatlarındaki dalgalanmalardan etkilenmekte, cari açık, ödemeler dengesi, dış borç yükü ve enflasyon gibi makroekonomik dengeler petrol fiyatlarına göre şekil almaktadır. Ülkemizde petrol piyasası dikey bütünleşik bir kamusal örgütlenmeye tabi iken 2000'li yıllarda başlayan özelleştirme çalışmaları ile rafineri, petrokimya petrol dağıtım alanlarında yapısal regülasyon tesis edilmiş ve petrol piyasası rekabete açık bir piyasa yapısına kavuşmuştur. Petrol açısından dışa bağımlı bir ülke konumunda olan Türkiye hazine gelirlerinin büyük miktarını yine bu enerji kaynağı üzerindeki dolaylı vergilerden karşılamaktadır. Akaryakıt satış fiyatlarının % 60-65'e varan miktarlarda vergi yükü bulunmakta olup petrol satışlarından dolayı 2011 yılında devlet kasasına giren toplam vergi miktarı 39,2 milyar liradır. Bu miktar, ülkemizde 2011 yılında toplanan verginin % 13'üne tekabül etmektedir. Petrol ürünleri üzerindeki bu aşırı vergi yükü, komşu ülkelerde 4-5 kat ucuza satılan bu ürünün kaçak yollarla ülkeye sokulması riskini de beraberinde getirmektedir. Ülkemizin oldukça uzun doğu ve güneydoğu kara sınırları ile bu bölgelerdeki istikrarsız yapı, ayrıca 3 tarafının denizlerle çevrili olması ve bu geniş alanda denetim kurulması noktasında yaşanan zorluklar hem karayolu hem de denizyolu ile yapılan kaçakçılığın artmasına yol açmaktadır. Aynı şekilde akaryakıt olarak kullanılabilen atık yağlardan elde edilen ve 10 numara yağ adı altında yapılan satışlar da rekabetçi piyasa yapısı, can, mal ve çevre güvenliği üzerinde tehditler meydana getirmektedir. EPDK özel ve genel kolluk birimleri ile birlikte petrol piyasasında denetime yönelik yoğun çaba sarfetmekte olup Kurum bütçesinin yaklaşık üçte birini bu alana aktarmaktadır. Ülkemizde ulusal marker uygulamasını merkezine alan bir denetim sistemi yürütülmektedir. Ülkemizde rafineri, işleme, depolama, iletim, taşıma, ihrakiye, serbest kullanıcı, dağıtım, bayilik faaliyetleri EPDK tarafından verilen ve belli kurallara bağlı lisanslar çerçevesinde yürütülebilmektedir. Lisans sahiplerine tehlike sorumluluğu çerçevesinde sigorta yükümlülüğü ile piyasa şeffaflığının sağlanabilmesi ve spekülatif fiyat hareketlerinden korunulabilmesini teminen de bildirime ilişkin regülasyon yükümlülüğü getirilmiştir. Ayrıca bu enerji kaynağının ülkenin kamu düzeni üzerinde üstlendiği vazgeçilemez rol nedeniyle acil durum stokları tutuma yükümlülüğü de belli lisans sahipleri açısından zorunlu hale getirilmiştir. Petrol rezervlerinin önümüzdeki 40-50 yıllık süreçte dünya ekonomileri, siyasi ve politik gelişmeleri üzerinde rolünü artırarak sürdüreceği hesaplanmakta olup piyasa yapısının yakın gözetim ve denetim altında bulundurulması hayati önem taşımaktadır. Bu doktora tezinde birincil ve ikincil mevzuat hükümleri ile birlikte EPDK ve Danıştay kararları çerçevesinde piyasa yapısı üzerindeki devlet kontrolü ve idari müdahaleler incelenmeye çalışılmıştır. ; Petroleum, consumed mostly on earth with the biggest share, is an energy sourcewith inescapable strategic importance for all the countries in the world as well as Turkey. Many military and political improvements in the world acquire a shape around this valuable energy source. Turkey, along with being a close neighbor country to the countries with this energy source, is a poor country from underground richness point of view and imports more than 90 % of her consumption. As a country at a position dependent on external sources for this energy source, Turkish economy has been affected from the fluctuations in the petroleum prices; macroeconomic equilibrium such as current gap, payment balance, external debt load and inflation take a shape according to the fluctuations in the price of petroleum. For this reason, stability in the petroleum market has a great importance for our country to continue economic public order. As petroleum market in our country used to have a vertical united public organizational structure, with the privatization efforts in the years of 2000, structural regulation was established in the fields of refinery, petro-chemistry, petroleum distribution areas, and the petroleum market has gained a structure open to competition. As a part of social regulation in addition to structural regulation, rules towards protection of environmental sensitivenesses and consumers, accreditation, standardization and technical regulation based on safety of goods/services have been made fit on legal frame. With the establishment of EPDK as an independent organizer framed below liberal economic understanding in the energy markets, petroleum market has also been started to be kept under supervision and inspection. Turkey, as a country dependent on external sources, has been making most of her treasury income through indirect taxes on this energy source. Tax load reaches up to 60-65 % of fuel oil prices and the total tax collection of the government through petroleum sales is 39.2 billion liras in 2011. This amount is equivalent to the 13 % of the total taxes that have been collected in our country in 2011. This excessive tax load on petroleum products brings the risk of illegal transformation of this product into the country since it is 4-5 times cheaper in neighborhood countries. Quite long east and southeast land borders of our country and the inconsistent structure in those regions, besides being surrounded with seas at 3 sides, and the difficulties that have been faced to set up a control system in this wide area causes the smuggling through both overland routes and maritime lines. In the same way, sales under the name Number 10 Oil that is obtained from waste oils but can be used as a fuel-oil, threatens the competitive market structure, life, property and environmental safety. EPDK has been spending intense efforts by allocating almost one third of the institution?s budget for the inspection of petroleum market together with private and general police force. In our country, an inspection system that is centralized on the national marker application has been performed. Refinery, processing, storage, conveyance, transportation, free user, distribution, franchising activities in our country can only be performed under the frame of licenses bound to certain rules and franchising activities given by EPDK. License owners are also held responsible for regulation related to declaration to be protected from speculative price changes and to provide insurance liability under the frame of threat responsibility with market transparency. In addition to all, due to the inescapable role of this energy source over the public order, responsibility of keeping emergency stocks is brought to be obligatory for some license owners.

Ressaltam, nesse contexto, a solidão, a impessoalidade e a desumanização do Ser que está morrendo. No referido capítulo é discutida ainda a relevância dos cuidados paliativos e os doze princípios para uma boa morte publicados na Inglaterra.No quarto capítulo, aplicação prática: assim na vida como na morte, os autores propõem uma série de atividades práticas para serem desenvolvidas em grupos, com o objetivo de sensibilizar os profissionais a compartilhar, em rodas de conversas nos serviços de saúde sobre a vida e a morte. A organização de tais atividades é no formato de oficinas mediadas pela apreciação de poemas, músicas e textos de apoio.Nas considerações finais o destaque é dado para o fato de que o mais importante parece ser uma atitude solidária junto ao Ser que está morrendo. Bu bağlamda çalışmanın hipotezi; nükleer enerjinin jeopolitik açıdan Türkiye'nin sürdürülebilir kalkınması ve güvenliğinde vazgeçilmez ve zorunlu bir kaynak olduğu, ayrıca nükleer enerjinin bölgesel güvenliğe katkı sağlayacağı savından oluşmaktadır. Ayrıca çalışma enerji alanında faaliyet yürüten ulusal ve uluslararası kurum ve kuruluşların istatistik raporlarının analiz edilmesi sonucu oluşturulan grafik ve tablolar kullanılarak desteklenmiştir. Türkiye'nin nükleer enerjiye sahip olması sonucunda; enerji kaynak çeşitliliğinin sağlanarak enerji arz güvenliğine ciddi katkı sağlayacağı, enerjide ortalama % 75 oranında dışa bağımlı olan ülkemizin enerji kaynağı ithalinin azalması sebebiyle önemli bir dış ticaret açığını kapatacağı, bu bağlamda daha esnek ve bağımsız bir dış politika yürütebileceği sonucuna ulaşılmıştır. In this perspective, Turkey's ever growing dynamic population, urban life and new developments in the industrial field has also generated a gradual increase in energy demand. The energy factor has become a vital resource in securing Turkey's sustainable security and development. In this context, while Turkey continues its research internationally in many fields including diversity in its supplying countries and routes to meet its energy demand, reducing its foreign dependency on energy and ensuring the security of supplies of imported energy sources on one hand, on the other hand we see that Turkey is attempting to provide the supply-demand balance in energy with its strategies of searching for new energy sources with its national energy moves conducted within its own borders; improving the capacity of existing energy sources and increasing investments for alternative energy sources such as renewable and nuclear energy. The most important project planned to increase the energy production capacity and resource diversity in the 21st century Turkey is the "Nuclear Power Plant" establishment project. Despite all the drawbacks, with its successful and substantial efforts in possessing the long awaited nuclear technology, Turkey aims to secure a power factor nuclear technology that will have strategic importance in its national security, and raise its status as a global power. In this study, the necessity of nuclear energy in sustainable security and development as a part of Turkey's main energy policies and the question of the dimension of regional security will be assessed from a geopolitical perspective. In this respect, the hypothesis of the study forms the argument that in geopolitical terms nuclear energy is an essential and indispensible source for Turkey's sustainable development and security, and nuclear energy will also contribute to regional security. This study also aims to determine the effects and results of both the peaceful and military use of nuclear energy in Turkey by conducting a multidimensional evaluation. Basically, this study was carried out according to qualitative research method and data was obtained from literature reviews using both local and foreign literature. In addition, the study was also supported using graphics and tables formed as a result of the analyses of statistic reports by national and international institutions and organizations that are active in the energy field. As a result of Turkey possessing nuclear energy, it is concluded that this will contribute significantly to energy demand security by providing a resource diversity; fill a significant gap in foreign trade due to the reduction in the energy resource imports of Turkey that is on average 75% dependent on imported energy, and subsequently will be able to enforce more flexible, independent foreign policies. Therefore, possessing nuclear energy is considered to be a requirement for Turkey rather than a preference. As a result of the projects developed by Turkey in the nuclear energy field together with the development of technical infrastructure, and owing to the qualified human resources it was concluded that this will contribute significantly not only to the development of heavy industry, but also the development of sectors including construction, steel production, agriculture, medicine, defense and space, and therefore the development of the country. Moreover, with the accumulation of experience and information Turkey has gained in the nuclear field, providing there is an improvement in opportunities and conditions it appears that in the near future the country will secure a major achievement both in terms of establishing a "Nuclear Power Plant" with its own resources where Turkey will be able to use its own underground sources and preparing the groundwork for nuclear power research for development in the military field, and in terms of supporting the national power factors with nuclear energy. Taking the regional facts and geopolitical situation of Turkey into consideration, in this study it was concluded that nuclear energy is not only more economical, but at the same time a security requirement; so in terms of the comparative advantages over other regional countries, it is essential that Turkey has its own nuclear power and nuclear energy is an essential source of energy for both the security and development of the country.

Brazil grew 2.4 percent per year on average in the last 25 years-somewhat less than Latin America, a good deal less than the world, far less than the emerging countries of Asia in the same period, and indeed far less than Brazil itself in previous decades. If anything stands out favorably in recent Brazilian experience, it is not growth but stabilization and the successful opening of the economy. The purpose of this paper is more modest. It is limited to setting out the authors' particular view of recent efforts to consolidate democracy in Brazil while controlling inflation and resuming economic growth. At the same time the paper presents, as objectively as possible, some thoughts on the limits but also the relevance of action by political leaders to set a course and circumvent obstacles to that process. Here and there, the paper refers to the experiences of other Latin American countries, especially Argentina, Chile, and Mexico, not to offer a full fledged comparative analysis but merely to note contrasts and similarities that may shed light on the peculiarities of the Brazilian case and suggest themes for a more wide-ranging exchange of views.

Bu çalışma, Türkiye'nin dış ilişkilerde sosyal, kültürel ve ekonomik kalkınma modellemesini yaygınlaştırarak uluslararası konjonktürde etkililiği'ni artırma hedeflerinde temel amacın ne oranda gerçekleştiğini incelemeye yönelik planlanmıştır. Türkiye'nin daha barışçıl dünya düzeninin inşasında ve korunmasında uluslararası aktör olarak etkililiği'nin ölçümlenmesi amaçlanmıştır. 1980'ler sonrası yeni dünya düzeni arayışlarında, salt bölgesel değil küresel karar verici olma potansiyelini uluslararası ilişkiler aracılığıyla sürekli artırma hedeflerinde Türkiye'nin bu amaçla yürütmekte olduğu çalışmaların son dönemlerde daha da ön plana alınmaya başlandığı görülmektedir. Bilindiği üzere, bugün artık küreselleşme sürecinin aktörlerinden biri olabilmek demokrasi kültürüne sahip olmayı gerekli koşul saymaktadır. Küresel sürecin beraberinde getirdiği yeni demokrasi anlayışı da devletlerarası işbirliğini ve temel özgürlüklere saygıyı esas almaktadır. Hatta küreselleşme sürecinde ekonomik ve siyasal ilişkileri demokrasi ve insan haklarından bağımsız ele almak mümkün olamamaktadır. Dolayısıyla, ekonomik ve siyasal istikrarın ve gelişimin en önemli dayanağını oluşturan demokrasi, küreselleşmenin de en güvenilir altyapısını hazırlamaktadır. Türkiye de, küresel politikalarla istikrarlı bir şekilde demokratik yükselişte etkililiğini artırma gayreti içindedir. Bu ivmenin genel anlamda daha da yükselebilmesi için gereksinim duyulan bilimsel verilere daha sistemli ulaşabilmek adına bu çalışmaya girişilmiştir. Kamu diplomasisine yönelik model oluşturma gayesi taşımaktadır. Metodolojik sınırlama gereği, ülkenin yatırımlarından ve tarihsel bağlarından ötürü Orta Asya'da Kırgızistan özelinde sistematize edilmiştir. Regardless of the basic goal of a nation, the prestige of the nation, its strong recognition in other words, is sometimes the most important factor for the success of its foreign policy. For this reason, respect in politics for a rational foreign policy is indispensable. In our time when power struggle has come out of a struggle with traditional methods such as pressure and military force and has become a much wider struggle of people, prestige has become a very important weapon. There is no doubt that the main purpose of political and cultural promotion in the international arena is to support the external politics that are motivated. For this reason, it is necessary to treat general and long-term promotion politics as a whole of planned actions to improve the reputation of a country and to improve its overall appearance in the world. When we approach to the subject from the point of view of Turkey, it is important to emphasize that since the establishment of the Republic of Turkey, such activities are carried out within a "peaceful" foreign policy. From the standpoint of foreign policy, Turkey has struggled to be in the breakthroughs that can always be regarded as a political equilibrium, especially in its region. The international system is restructured by communication and information movements. In this sense, public diplomacy has become one of the indispensable elements of international strategic communication management because of the importance of agenda-affecting ability. That is why today, almost every developed and developing state has a goal of progress, the state places great importance on acting towards active public diplomacy in order to create a 'positive image' for them in the eyes of foreign public circles. Diplomacy is the knowledge and art of managing relations between states and these relations meticulously. In its broadest sense, it can be defined as the whole of the independent states, that is, the relations between the basic units of the international system and the methods used. Diplomacy is aimed at meeting the opponents, finding their own ideas and proposals, or finding a common solution. Prior to World War II, diplomacy aimed at states that were the sovereign actors of the purely international system. After World War II, emergence of international organizations and civil society organizations as new actors of international relations and emerging communication technologies seem to have changed traditional diplomacy. The possibilities and opportunities obtained by the production, collection, sorting and distribution of the information by a great deal of breadth, ease and speed have also started to be used in the field of diplomacy. This innovation in communication technologies has brought the issue of not only the states but also the peoples of the states to be subject to diplomatic activities. This changing diplomatic environment brings together the concept of 'soft power'. Joseph Nye's soft power, which was further expanded in 2004 by the Soft Power book published in 1990 with the Bound to Lead book and the literary book, is the attainment of the wishes of a nation in world politics, by observing the countries that admire its values, exemplify it, care for its prosperity and opportunities. It is important not only to force others to change using military threats or economic sanctions, but to create agendas in world politics and to attract them as well. Soft power is to make sure others want the results you want and is to attract people instead of pushing them away. Therefore, soft power is the ability to attract others, to win their hearts and minds. Public diplomacy is also one of the most important elements of fine power today, when international politics is in a pragmatic course towards the soft power from hard power. Public diplomacy has to be seen as the sum of the programs that will support the diffusion of cultural and national values. Besides public diplomacy heals the image in foreign countries. In this study is planned to investigate the main purpose of Turkey in the aim of increasing the effectiveness in international conjuncture by expanding social, cultural and economic development model in foreign relations. It is aimed to measure Turkey's effectiveness as an international actor in the construction and protection of a more peaceful world order. Turkey is aiming to continually increase its potential to become a global decision-maker, not just a regional, in the quest for new world order after the 1980s, through international relations. It is seen that the studies that are being carried out for this purpose have begun to be taken more prominently in recent periods. As it is known, today it is necessary to have a democracy culture to become one of the actors of the globalization process. The new understanding of democracy brought about by the global process is based on respect for interstate cooperation and fundamental freedoms. Even in the process of globalization, economic and political relations can not be handled independently of democracy and human rights. Therefore, democracy, which constitutes the most important basis of economic and political stability and development, is also preparing the most reliable infrastructure of globalization. Turkey is also striving to increase its effectiveness with a stable democratic rise through global policies. This work has been undertaken in order to achieve a more systematic approach to the scientific data needed to increase this rate in general terms. It aims to create a model for public diplomacy. Because of the methodological limitations, it was systematized in Central Asia for Kyrgyzstan, due to the investments and historical ties of the country. Therefore, this field is of great importance as a systematic study. In this context, it has been tried to reach the question of how the perception of Turkey has been formed and how it has been constructed in Kyrgyzstan through quantitative statistical data. In general, it has been found that despite the fact that positive perceptions related to Turkey have been reached, Turkey has not been at the height required for development aid for Kyrgyzstan and the public diplomacy it conducted, and the resulting proposals are aimed at this situation.

Demokrasinin vazgeçilmez unsuru olan seçimler, seçmenlerin ülkenin yönetilmesinde söz sahibi olmasını istedikleri kişi ya da siyasi partiye yetki vermesi anlamına gelmektedir. Ancak seçmenlerin oy verme davranışını yönlendiren birbirinden farklı nedenler bulunabilmektedir. Sosyo-ekonomik, psikolojik birçok unsurun etkisiyle hareket eden bu seçmenlerin eğilimleri ülkelere, toplumlara hatta aynı bölge ve şehirlere göre farklılık göstermektedir. Türkiye'de seçmen tercihleri ile seçmen tercihlerini etkileyen sosyo-kültürel, ekonomik vb. etkenler hususunda çok sayıda ve geniş kapsamlı birçok araştırma yapılmıştır. Ancak seçmenlerin seçim zamanlarında gerçekleştirilen siyasal seçim kampanyalarında ortaya konulan vaatleri ne kadar dikkate aldığı ya da vaatlerin kaynağı hususunda ne kadar bilgili oldukları hakkında çok fazla bilgi bulunmamaktadır. Dolayısıyla Türkiye'de seçim kampanyalarında kullanılan seçim vaatlerinin seçmenler tarafından hangi siyasi partiye ait olduğunun bilinirliği bir problem olarak ortada durmaktadır. Bu çalışmanın amacı da bu çerçevede Türkiye'de seçim kampanyalarında kullanılan seçim vaatlerinin seçmenler tarafından bilinirliği ve kampanyalarda kullanılan seçim vaatlerinin hangi siyasi partiye ait olduğunun bilinirliğinin tespitini sağlamaktır. ; As an indispensable constituent of democracy, elections can be defined as the authorization of the individuals or political parties that voters favor most to rule the state. Nonetheless it is likely that a wide range of motives direct polling behavior of voters. Driven from a multitude of factors such as socio-economic and psychological the voters, in their polling behavior, may differ with respect to countries, social communities, regions, provinces and expectations. As an outcome of the differentiation of expectations, it became inevitable that parties with different inclinations would introduce polyphony into political life. A good number of comprehensive studies have been conducted on voter preferences in Turkey as well as socio-cultural, economic and similar factors playing role in voter preferences. Nevertheless it has been detected that there are limited number of researches focusing on to what extent voters pay heeds to the promises outspoken during political campaigns or their knowledge on the party origins of such promises. Hence it appears that the awareness of voters regarding the origin of election promises used by each party in Turkey during political campaigns stands as a problem. Within that scope the purpose of current study is to detect whether the promises given during political campaigns in Turkey are paid attention by voters and the level of awareness on the political party origins of these promises. Current research unveiling the general attitudes and inclinations of Konya voters shall meanwhile offer a general evaluation whether voters take declarations of election into consideration and how attentively they follow the party they vote for. Data essential for this research have been collected from a questionnaire which is listed amongst the resources of secondary data. In this questionnaire, there are close-ended questions in addition to Likert scale questions. Field study has been conducted through face-to-face survey method. Field study has covered collectively 1907 subjects from total 22 districts in Konya; 3 central districts and 19 sub districts. Population includes all the voters in Turkey who bear the ability of electing and being elected. After tabulating basic information and inclination of voters in districts, by taking certain criteria into account such as age, profession and income level, the evaluation shall be based on detecting certain issues voters need urgent solutions and also partial analyses shall be aimed to detect how attentively some populations follow campaign promises while voting for their parties and how attentively they analyze declarations of elections. In this questionnaire, aside from questions directed to gather information on the general evaluation of voters, there are some questions as stated below in order to uncover how attentively relevant populations follow campaign promises of the parties. "All living places shall be disabled-friendly", "A high-quality life standard shall be provided to senior citizens", "A new Constitution underscoring personal freedom and judicial independence", "Per capita income shall rise to 25 thousand dollars", "Low-income families shall be granted houses with no advance payments", "Poor newly-wed farmers shall be aided with zerointerest loan", "The dormitories in KYK (Credit and Dormitories Agency) shall reach to 600-thousand capacity", "All citizens shall be covered with health insurance", "Fight against terrorism and state aid for the victims of terrorism", "Personnel cadre ambiguity shall be stopped", "Small size farmers shall receive support", "Chauffeurs shall pay no VAT (Value added tax), SCT(Special consumption tax)", "SMEs shall pay no VAT", "Poor families shall be assisted with Hilalkart", "Wages for the disabled shall be boosted to 450 TL", "Net minimum wage shall be increased to 825 TL", "The aids for the poor shall be increased", "Poor and middle income citizens shall be provided with full mortgage", "Poor Women shall be granted assistance", "Adaptation Law shall pass and better conditions shall be provided to the retired", "University fees shall be nullified", "Istanbul shall be proclaimed as the new prestige finance center". Accordingly the answers of the voter populations to determine the origin -AKP, CHP or MHP- of the most leading promises in declarations of election and fields have been sought. Declaration of election -which is a partnership treaty signed between political parties to be elected and the voters whose polls they need- has been annexed to the relevant questionnaire because of being an issue ignored in our country. In the analysis part of research, a couple of tables that reflect the thoughts of voters regarding the political party origins of the promises that we deem to have been in relation to certain populations are illustrated. Research sampling consists of subjects bearing the ability to elect and be elected selected via simple random sampling method from voters in Konya. The questionnaire which constitutes in the introduction part general questions such as the age, gender, educational background, marital status, profession and monthly income level of participants has been divided into various groups of questions. Thus it has been aimed to detect the issues voters demand urgent solution and also how attentively voters follow election campaigns and whether they are aware of the political party origins of campaign promises. In the end it has been feasible to reach a conclusion regarding the voter population in Konya, political parties that are popular on the basis of districts. Elections are acknowledged as an indication of democratization for countries since it is verified that national will shall eventually rise as the winner from ballot box. However it is indeed hard to detect how many of the voters demonstrate a conscious attitude. Some voters bear an ideological attitude and partisan identity whereas some voters vote for the party whom they believe to be most beneficial for their own sake. The causes that lead a person to different inclinations are not only psychological but can be attributed to a wide range of variables like economic factors, family, educational level, income level, profession, religious tenets (even ethic origins during the latest ages). As regards the outcome with respect to Turkey it seems challenging to arrive at a certain conclusion for the voter population since other than entrenched votes there are also amphibian votes for the parties and no equal stability can be ensured for each party. Therefore it can be argued that the majority of Turkish voters act pragmatically rather than ideologically. In this questionnaire that constitutes the scope of current research data gathered from 22 districts of the sampling city Konya are supportive of this finding. To illustrate, the collected responses manifest that voters select with no awareness of the programs of parties and actually pay no heeds to such issues. Ulus-devletin yapmak istediği; devleti ya da siyasal iktidarı merkezîleştirmek, kültürü standartlaştırmak, hukukta eşitliği ve ekonomide bütünleşmeyi sağlamaktır.Bugünün dünyasındaki egemenlik anlayışı, genel olarak, bir devletin ülke toprakları üzerinde yönetme yetkisini kullanma hakkı olarak tanımlanmaktadır. Bu kavramın hukuksal bir anlamı olduğu kadar siyasî bir anlamı da mevcuttur ve bu iki anlam iç içe geçmiş durumdadır. Egemenlik devletin gücünü temsil etmektedir. Küreselleşme süreci, ulus devlet yapısı içindeki hükümetlerin gücünü ve etkinliğini azaltmakta, hükümetler; ekonomik nesnelerin, teknolojik yeniliklerin, bilgi, haber ve fikirlerin akışını kontrol etmekte güçlük çekmekte, ulus devletlerin millî ekonomik politika izleme imkânı giderek azalmakta, ekonomik sınırların aşınması millî siyasî sınırların da aşınmasına yol açmaktadır. The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.

Bu çalışmada Orta Asya'da meydana gelen Modernleşme süresi kapsamında bölgede ve Özbekistan'da yaşanan Modernleşme süreci, bu sürecin sebep ve sonuçları incelenmektedir. Bu kapsamda Çarlık Rusyası tarafından bölgeye taşınan Batı tarzı Modernleşmenin Orta Asya/Özbekistan'daki gelişimi, Modernleşmeye verilen tepkiler ve cevaplar, bölgenin Modernleşmeye verdiği cevaplardan birisi olan Ceditçilik Hareketi temel alınarak analiz edilmektedir. Bunu yaparken dönemselleştirmeye gidilmiştir. Orta Asya bölgesi ile Özbekistan'ın ve Modernleşme sürecinin izlediği tarihi seyir Çarlık Rusyası İdaresi, Sovyetler Birliği Dönemi, Bağımsızlık Sonrası Yeni Bağımsız Özbekistan olarak dönemlere ayrılmış ve bu dönemleri incelemek için Ruslaşmak, Sovyetleşmek, Özbekleşmek ve İslamlaşmak isimli dört ana başlık kullanılmıştır. Ancak bu konu başlıkları açıklanmaya çalışılan süreçler tarihi seyir içinde bir arada bulunabildiği için Sovyetleşmek-Özbekleşmek, Özbekleşmek-İslamlaşmak gibi kavram çiftleri türetilmiş ve kullanılma yoluna gidilmiştir. Orta Asya ve Özbekistan'a Batı tarzı Modernleşme Çarlık Rusyası tarafından bu bölgedeki mevcudiyetini desteklemek için getirilmiş ve yönetiminin kalıcı olmasına yardımcı bir araç olarak görülmüştür. Bu yönetimin Orta Asya toplumunun bir kesiminde yarattığı etki Ceditçilik Hareketini ortaya çıkarmıştır. Bölgede modernizmin kendisi ve sebep olduğu etkilerle başa çıkabilmek için onun usul ve yöntemlerini kullanmayı ve Modernizmle uyumlu olmayı savunan Ceditçilere tepki gelişmiştir. Bu tepkinin kaynağı olan Muhafazakâr grup-Kadimciler ise çözümün korumacı ve muhafazakâr bir tutum geliştirmekte yattığını savunmuşlardır. Sırasıyla Ceditçilere ve Modernleşmeye ayrıca Çarlık Rusyası ve Sovyet İdaresine tepki olarak Modern olan her şeyin reddini savunmuşlardır. Ancak bu tutumu istikrarlı bir şekilde sürdürmemişler karşı oldukları bu sisteminin sağladığı faydaları kullanma konusunda pragmatik bir tutum takınmışlardır. Buna en güzel örnek II. Dünya Savaşı ve sonrasındaki dönemde parti kadrolarında oluşan boşlukların muhafazakârların yoğun olduğu kırsal kesimden gelen gençlere açılmasıdır.Modernleşme taraftarları Ceditçiler arasındaki önemli isimlerden birisi olan İsmail Gaspıralı ve ilk kuşak Ceditçiler Çarlık Rusya'sının bir gün devrini tamamlayıp dağılacağını, bu yüzden de o güne eğitim faaliyetleri yoluyla hazırlanılması gerektiğini savunurken, onlardan sonraki kuşak Ceditçiler ise bu amaçtan uzaklaşmaya ve Çarlık İdaresi içinde hak sahibi olmaya sıcak bakmaya başlamıştır. Bu durum 1917 Ekim Devriminden sonra daha da aleni bir hal alacak, Ceditçilerin bağımsızlık talepleri yerini yeni sistem içinde bir mevki işgal çabalarına bırakacaktır. Ancak bu kuşak daha sonraki yıllarda Sovyet idaresi tarafından yeteri kadar sadık bulunmadıkları için toptan tasfiye edilecektir. Bu tasfiye hareketine devam edilmesine Avrupa'da patlak veren II. Dünya Savaşı engel olmuş, Sovyetler Birliğini Orta Asya ile ilgili planlarını değiştirmeye mecbur bırakmıştır. Sovyetler Birliği kendini Nazi Almanya'sının saldırısından koruyabilmek için Sovyet sistemi yanlısı kadroları savaş meydanında kullanmıştır. Orta Asya ve Özbekistan'da onlardan boşalan kadrolara ise kırsal kesimden gelen eğitimsiz gençleri istihdam etmeye mecbur kalmıştır. İşte bu sayede kırsal bölgeye çekilen ve daha sonraki dönemlerde radikal hareketlerin de temelini oluşturacak olan Kadimci-radikal düşünce ve onun yansımaları devlet bürokrasisi içinde kendine yer bulabilmiştir. İlk olarak Brejnev dönemindeki kısmı gevşemeden yararlanarak varlığını hissettiren radikal hareketler 1991 yılında Sovyetler Birliğinin dağılmasından sonra yeniden gündelik ve siyasi hayatta söz sahibi olmaya çalışacaktır. Ancak bu girişimleri Sovyet Döneminde yetişen ve bağımsızlık sonrasındaki dönemde iktidarda kalmayı başaran Sovyet dönemi bakiyesi yönetici eliti endişelendirmiştir. Bunun sonucunda Özbekistan yönetimi kendisine muhalif gördüğü her şeyi önce baskı altına almayı denemiş daha sonra da ezmeye çalışmış, bunda da büyük oranda başarılı olmuştur. Özbek Devleti ve yönetiminin bu sert ve müsamahasız tutumu ülkedeki ılımlı ve barışçı kanat da dâhil olmak üzere muhalefetin tüm unsurlarının zamanla marjinalleşmesi ve radikalleşmesini beraberinde getirmiştir. Özellikle muhafazakâr gruplar içindeki radikal unsurlar Modernizmin ürünü ve yansıması olarak kabul ettikleri ülke yönetimi ve otoriter siyasi sisteme karşı sert bir tutum geliştirme yoluna gitmişlerdir. Gördükleri siyasi-psikolojik şiddetin de etkisi ile ülke muhalefeti ve bunun içindeki radikal unsurlar kendilerinin de Özbekistan'da yaşanan Modernleşme sürecinin bir sonucu olduklarını gözden kaçırır hale gelmiştir.Sonuç olarak birbirlerinden çok farklı gözükseler de, 20. Yüzyıl Orta Asya'sının Modernleşme yanlıları olan Ceditçiler ve onların muhalifi Kadimciler ve bağımsızlık sonrası dönemin radikalleri de dâhil olmak üzere, bahsedilen grupların hepsi Modernleşme sürecinin bir sonucudurlar. İşte bu çalışmada siyasi denklemin farklı taraflarında yer alan bu aktörlerin birbirlerini besleyen ve üreten, değiştirip, dönüştüren bir süreç ortaya çıkardıklarına ve bu sürecin sonucu olduklarına vurgu yapılmaktadır. --- In this doctoral dissertation, the modernization process which Central Asian region and Uzbekistan experienced in the late 19th and early 20th centuries will be discussed under the title of Uzbek Modernization. Tsarist Russia was the agent of Modernization and carried out Western style Modernization version to Central Asia. While Central Asia's indigenous population's response to Modernization occurred as a Jadidism (Usul-u Cedit) movement, which is one of the main components of that Modernization effort, will also be included and examined under the title. The unique Central Asian-Uzbek Modernization experience divided into 4 periods. Those periods are named as follows: Tsarist Russia Administration, Soviet Era, Construction of Uzbek ethnicity and Re-Islamization. But in order to explain the periods, dual concepts like Sovietness-Uzbekness, Uzbekness-Islamizaiton created and used together. Because those social and cultural evaluations can be found together in the same period.Western style Modernization perception was brought to Central Asia by Tsarist Russia to strengthen its presence in that region, and it was accepted as a necessity for the permanent rule in Central Asia. But because of that mandatory regulations opposition to Modernization process starts quickly. Inconvenience from the Modernization led disadvantaged ones look for a possible solution. In search for the possible options there has raised questions about how to recover the lost superiority in the Central Asian region. As in other parts of the world, the effects and reflections of the Modernization process have been experienced in Central Asia and Uzbekistan. The best solution to that unwanted situation, which failed to combat this new political and cultural structure that formed a new world order and reshaped the international space according to its own understanding, was the adoption of the ideas, discourses and methods of Modernization. This process worked similarly also in Central Asia, and a Modernization movement emerged among the Muslims of Russia in order to counter the threat from the Western Civilization and Tsarist Russia, regarded itself as the representative of Modernism in Asia. That unique Muslim modernization movement was called Jadidism.Although there has been a reaction to Jadits-Progressives. The Conservative ones-Kadimciler, argued that in order to avoid the possible damages of the Modernization a protectionist and conservative attitudes must be developed. Central Asian community must be sealed itself from the Modern world and lay in a perfect isolation. Within that context Conservative group advocated a rejection of all the notions of Modernization as a response to Jadids, as well as Tsarist Russia and Soviet Union, respectively. However, the did not maintain this attitude constantly, and they choose to took pragmatic attitude while gathering the benefits of the system, which they opposed.While İsmail Gaspıralı and the first generation of Jadits argued that one day the tsarist Russia would complete its life cycle and fall, so that Muslim Population of Tsarist Russia should be prepared to that situation through educational activities. But the following generations of Jadits began to move away from this aim and choose to have a post in Tsarist Administration bureaucracy. This situation will become more common after the October Revolution of 1917, and Jadits demands of self-determination and autonomy will be abandoned. However, this generation will be liquidated by the Soviet administration in the following years because they were not considered sufficiently loyal enough. That liquidation or Purges interrupted because of the II. World War II in Europe. That Purges forced the Soviet Union to change its plans for Central Asia. In order to protect itself from the attack of Nazi Germany and overcome uneasy situations in the battlefields the Soviet Union wasted its pro-Soviet cadres on the battlefield. The vacant positions form that enlisted cadres were filled with uneducated young people from rural areas in Central Asia and Uzbekistan in order to continue to governmental activities. That's the turning point for the radical thought that were retreat to the countryside and forced to go underground in order to survive. Thus, those radical thoughts which would later become the basis of radical movements, could sweep into state bureaucracy. The intransigent radical thoughts first express their presence during the Brezhnev era, because of the loosening state control and after the independence 1991, they did express their presence in daily life and in political stage more fearlessly and aggressively. However, the remaining Soviet-era ruling elite, that experienced Soviet style state bureaucracy and managed to stay in power in the post-independence period, panicked with the opposition actions. As a result, the Uzbek State administration first tried to suppress the opposition normally, and then crushed them bitterly. This harsh and intolerant attitude of the Uzbek State forced and marginalized the opposing parties. Because of the marginalization some of the strict elements of the opposition, those elements became radicalized. Those radicalized elements adopted a Post Modern attitude towards the authoritarian political system, which they regard it as the product and reflection of Modernism. With the effect of the political-psychological violence, Uzbek opposition groups and its radical elements have missed the point that they're also components and results of the Modernization process in Uzbekistan.As a result, although they appear to be very different from each other, Jadits and Conservatives and the radicals of the post-independence period are all the result of the Modernization process in the region. In this dissertation, it is emphasized that those actors on different sides of the political equilibrium generate a process that feeds and produces, changes and transforms each other and that they are the products of the Modernization epoch.

Meşrutiyet döneminin önemli isimlerinden biri olmuştur. Kökü 16. yüzyıla uzanan, Süleymaniye şehrinin kurucusu ünlü Kürt aşireti Baban ailesine mensuptur. İslamcılık düşüncesinin güçlü temsilcilerinden Babanzâde Ahmed Naim'in kardeşidir. Hukuk Mektebi'ni bitirdikten sonra Mülkiye ve Mühendis Mektepleri'nde hocalık; İkdam, Tanin, Şura-yı Ümmet gibi gazetelerde köşe yazarlığı yapmıştır. Hukukla ilgili eserlerinin yanı sıra Bismarc biyografisi ve Dreyfus Meselesini anlattığı kitapları da bulunmaktadır.Meclis-i Mebusan'da Bağdat (1908) ve Divaniye (1912) mebusu olarak yer almış, İbrahim Hakkı Paşa Kabinesi'nde Maarif Vekilliği (1911) siyasi kariyerinin en üst noktası olmuştur. 26 Aralık 1913'te, henüz 37 yaşında iken ders verdiği sırada vefat etmiştir.Meşrutiyet düşüncesini resmetmeye çalıştığım bu tezde onu tanımlayabilecek temel kavramlar; itidal, tedrici tekâmül, meşruiyet,parlamenter sisteme bağlılık, teamül , uzlaşma kültürüdür.Babanzâde, Meşrutiyet'i demokrasi ile eşanlamlı bir yönetim olarak gördüğü için yazılarını, demokrasiyi oluşturan temel unsurları (çoğunluk, çoğulculuk, yasama, yürütme, yargı, güçler ayrılığı, basın özgürlüğü, hukukun üstünlüğü vb.) esas alarak sınıflandırdım.Nitekim 1909 Ağustos'unda yayınlanan Şeyhülislamlık Beyannamesi'ni değerlendirdiği yazılarında; hâkimiyet-i milliye, iktidarın denetlenmesi, güçler ayrılığı, müsavat kavramlarını vurguladığı görülmektedir.Yaşanan olaylara sosyolojik izahlar getirmesi, akademik kimliğinin yazılarına akseden önemli bir parçasıdır. Ancak sistem içerisinde padişaha biçtiği rol de oldukça sınırlıdır: Milletin birliğini ve ülkenin bütünlüğünü temsil eden, siyasi yetkileri azaltılmış sembolik bir makam.Ona göre; halk Meşrutiyet yönetimiyle beraber iktidara ortak olmuştur. Ancak sınırsız bir özgürlük elde etmemiştir. Hakkını kurallar içerisinde aramalıdır. Rüşvet, tembellik, düzensizlik gibi toplumsal hastalıkların tedavisi için siyasi ve medeni terbiyenin yükselmesi gereklidir.Çoğulculuk kavramına çok erken sayılabilecek bir dönemde vurgu yapması onun demokrasi çıtasının yüksekliğini göstermektedir. Ona göre azınlıkta kalan siyasi hareketler ancak sağlam ve tutarlı fikirlerle hayatta kalabilirler.Karmaşık seçim sisteminde en iyi sonucu alabilmek için İttihad ve Terakki'nin hem seçmenlerine hem adaylarına hem de parti yöneticilerine tavsiyelerde bulunur. Bu tavsiyeler günümüzde dahi yerleşmemiş olan parti içi demokrasi anlayışı açısından oldukça önemlidir.Dini inançların seçim malzemesi yapılmasına karşı çıkar. Siyasi cinayetlere şiddetle karşıdır. Partisinin seçim başarısını açıklarken güçlü bir analizci olduğu görülmektedir.Basının halkın sesi olduğuna dair iyimserliği siyasi rekabetin labirentlerinde kaybolur. Bu alandaki düzensizliğin önlenmesi için bir Matbuat Cemiyeti kurulmasını ve bir Matbuat Nizamnamesi hazırlanmasını önemsemiştir. Yabancı basının iç politikada taraf olmasına karşı çıkar.Osmanlı Devleti'nin azınlıkları Türkleştirmeye çalıştığı ithamını bir iftira olarak görür. Ancak herkesi ortak vatan ve ortak vatandaşlık çatısı altında bir araya getirecek Osmanlıcılık politikasının da gerekli olduğunu savunur. Eşitlik talep eden azınlıkların eski ayrıcalıklarının devam etmesini istemelerini ise bir çelişki olarak görür. Kültürel amaçla kurulan Kürt Teavün ve Terakki Cemiyeti'ne (1908) üye olması ve bu Cemiyet'in gazetesinde yazı yazması, azınlıkları Türkleştirmenin yanlış olacağını savunması kendisinin Türkleşmiş Kürt olduğu iddiasını çürütür; Osmanlıcılık idealine samimiyetle bağlı Kürt kökenli bir aydın olduğunu gösterir.Arnavutluk'un Osmanlı Devleti'nden ayrılış süreci tam bir travma etkisi doğurur. Çünkü bu ayrılış "ümmet" anlayışına vurulan ilk darbedir. Arap siyasi hareketlerine, bu süreçte yaşananları bir ibret olarak hatırlatır.Devleti oluşturan unsurlardan başta yasamayı (Meclis) öne çıkarırken daha sonra yürütmeyi ilk sıraya geçirmiştir. Bir hükümet kurulurken padişah-sadrazam-Meclis arasında güvenoyu alınmasını sağlayacak bir işbirliğini gerekli görür. Bugünkü tabirle teknokrat bir koalisyon hükümeti kurulmasına, yürütmeyi zayıflatacağı için karşı çıkar.Örfi İdarenin hatalarının üstünü örtme çabası ve muhalefetin sesini daha gür duyurabileceği açık alan mitinglerine karşı çıkması onun demokrasi anlayışında tespit edebildiğimiz nadir kırılmalardır. Halaskarân Zabitan tehdidi karşısındaki dik duruşu ise takdire şayandır.Ona göre, yasama organının diğer parçası olan Ayan Meclisi'nin varlığı -aristokratik bir geçmişe dayanmadığı için- sadece bir sebeple anlamlıdır: Kanunların hazırlanması sürecinde ihtiyaç duyulan teenniyi sağlaması. Buna rağmen zaten Meclis'in feshinde onay hakkına sahip olan Ayan Meclisi'nin bir de hükümeti düşürebilecek istizah (gensoru), kendi üyelerini seçme gibi haklara sahip olursa sistemdeki tek güç olacağı uyarısını yapar. Meclis müzakerelerinin uzamaması için yaptığı teklifler tam bir uzman görüşüdür. Muhalefet milletvekillerinin iktidarın istediği kanunları engellemek için başvurduğu obstrüksiyon (engelleme) yöntemlerini demokrasi dışı uygulamalar olarak tanımlar.Ocak 1912'de Meclis'in ilk feshinin ardından aynı yıl Ahmet Muhtar Paşa Kabinesi döneminde yeniden feshedilmesi çabasına şiddetle karşı çıkar. Bu amaçla dile getirilen Meclis'in ömrüne dair fikirleri ustaca çürütür.Güçler dengesi bağlamında Meclis'in istizah hakkına karşılık hükümetin cevabın ertelenmesi hakkının hangi dengede olması gerektiğini izah eder. İstizah, güven oylaması ile sonuçlanan bir yöntem olarak kullanıldığı için iktidarın denetlenmesinde daha hafif bir yöntem olarak sual yöntemini teklif eder. Meclis'in adem-i itimad oyuna karşılık Hükümet'in Meclis'i feshetme hakkını düzenleyen 35. maddenin değiştirilmesi meselesi, güçler dengesi başlığının en önemli konusudur. Anayasa'da yapılan 1909 tadilatıyla bu denge İttihad ve Terakki tarafından Meclis lehine bozulmuştur. 1912'de dengenin yeniden kurulması için yapılan teklifin de İttihadçılardan gelmesi muhalifler tarafından şiddetle eleştirilmiştir.Babanzâde, yargı alanında reform ihtiyacını kabul etmektedir. Ancak bunun da tedrici bir şekilde olması gerektiğini savunur. Mahkemelerin tekliği esas olmasına rağmen bir süre daha memurların yargılanması için idari mahkemelerin varlığını sürdürmesi gereklidir. Gezici sulh mahkemelerinin kurulması adi suçların çözümünü hızlandıracaktır. Hâkimlerin ilmi yeterliliklerini artırmak için hukuk mekteplerinin sayısı artırılmalı, gayret eksikliğini gidermek için görevde yükselme şartlarını belirleyen objektif kriterler getirilmelidir.Ordu ve adliye mensubu memurların politikadan uzak durması şarttır. Ancak bu sayede saygınlıklarını koruyabilirler. Küçük düzeydeki memurların halkı bilgilendirmek amacıyla politikayla ilgilenmesi yanlış olmaz, aksi takdirde siyasi güç kısa zamanda yerel zorbaların eline geçer. Constitutionalizm as an effective intellectual, politician, journalist and an auther.He is a member of Baban Family which is a famous Kurdish tribe in 16. Cc. The founder of Suleymaniye city. He is the brother of Babanzâde Ahmet Naim who is the most powerful represantative of Pan-İslam. After graduation from law school,he worked at Mülkiye and Engineering Schools and wrote articles to İkdam, Tanin, Şura-yı Ümmet newspapers. In addition to his Works about law, he wrote Bismarc biography and the book which he told about Dreyfus matter.He worked as a representative of Bağdat and Divaniye in Grand National Assembly (Mebusan Meclisi). He worked as an Education Minister with İbrahim Hakkı's Goverment. This position was his top career. While he was teaching ,26 th December 1913 at 37 years old he died.When I want to describe his constitutionalism with this thesis, I can say these terms: moderate, improving step by step, legitimacy, devotion on the system of parliament, customs, culture of reconcile.As Babanzâde has seen constitutinalism and democracy the same, I classified his writings as the basic items: majority, pluralism, legislation, propulsion, judgement the diversity of powers, the freedom of press and dominiant of law.In his writings which criticized Şeyhülislam Declaration in 1909 August, it is seen that he focused on soverignity, inspecting the power goverment, the diversity of power and equality.His sociological way of describing the events is important part of his career. Effect and cause, inevitable change, the relation of part and whole, evolutionist approach, the thing that some problems can only be solved by the maturity of the society and the necessity that the innovation must started by the concrete need are some of them.When İttihad and Terakki Party was powerful, his defensing the rivals seat untouchable position of its and the rights of being retired shows his dependancy on democracy.In Sultan Reşat's ascending the throne anniversary writings his supporting increasing the subsidy of sons in law on the behalf of protecting their honour in the assembly refutes the idea of opposition against the throne. But the role of the Sultan is very limited in his system it is a symbolic stage which represents the unity of the nation and the unity of whole country.According to him the people participated in the political power with constitutinaolism. However,they couldn't get endless freedom. They have to look for their right according to the rules and law. The social disorders like bribery, laziness, untidiness can be solved by increasing the level of political and civilized understanding of society.His focusing the concept of pluralism at early period shows his improving the idea of democracy for him weak political movements can only stay alive by strong and coherent ideas.He has some suggestions both to the candidates and voters of İttihad and Terakki in order to be succesful on the complicated voting system. These suggestions are very important for the today's changeable party and democracy understanding.He is opposed to misusing of religious beliefs. He is strongly object to political murders. While he is describing his party's voting success, he is seen to be a strong analisist.The optimism of the press about being the voice of the nation disappears in the labyrinth of political competition. He gave importance to the foundation of press and to the event of preparing a press declaration in order to prevent the disorders in this field. He opposes to foreign press's side in inside policy.The minorities of Ottoman Empire sees the accusation of making them Turkish as a slander. On the other hand,he thinks that the Ottoman policy which will make all the natives and non-natives United is a most that the minorities who demands equality and also demanding their old privilages is seen as a contradiction by him. The event of being a member of the Kurdish Teavün and Terakki Association founded with the aim of culture (1908) and writing many articles in this association's newspaper and defending that it would be wrong to make Kurdish people Turkish refutes that he is a Kurdish. It shows that he is a Kurdish-rooted, intellectual person who is strongly devoted himself to Ottoman idealism.The period in which Albania seperated from Ottoman Empaire reveals a real travma. Because this parting is a real blow for the Muslim Community. He sees it as a sample for the Arabic political movements.He gives importance to legislation but then he finds carrying a law more important than legislation. He thinks a cooperation providing with winning a vote of confidence among Sultan-Grand Vizier and Assembly is necessary. He objects to today's technocrat coalition goverment, because of its dangerous effects on carrying out the law.His effors to conceal the faults of cencorship and his objections to opposition party's demonstrations are his defects of his democracy understanding. However,his standing upwright against the threat of Halaskarân is worth to appreciating.In his opinion, existing Ayan Assembly another part of legislation is only meaningful -because of not depending on the aristocratic past- while laws being pirepared the needed calmness is because provided. Neverthless he warns that if Ayan Assembly has the right to select its own members and to give interpellation in Parliment, it will be the unique power.His suggestions not to last the parliment discussions are totally expert ideas. He identifies the methods which the opposition party's members applied for preventing the power's laws are out of democracy.He is strongly against to the efforts of repealing during Ahmet Muhtar Paşa Kabinet period again after the first repealing of parliment in January 1912. He eliminates the ideas of the life-span of the Assembly.He explains the necessary balance between assembly's interpellation right and goverments delaying right to answer. As interpellation is a method used for voting for trust he proposes as a light method "questioning method" to inspect the goverment.The problem which is about the changing of the 35. Matter the right of repealing the goverment is the most important subject of the power balance. The change in 1909 constitution ,this balance was ruined against the Parliment by İttihad and Terakki. In 1912 the proposal by İttihad and Terakki to rebuild this balance was strongly criticized by the opponents.Babanzâde accepts the need for a change in judgement. But he defends that is should be step by step. Although the courts are the only way to judge, managerial courts must exist to judge the officers for a while. Founding portable peace courts will make the solution the vulgar crimes faster. The number of law schools should be more in order to develop the judge's careers and there should be some objective criteria to improve on their careers and to prevent the effort deficiency.It is a condition for army and judge staff to be away from the policy. Providing that they can protect their esteem. Low-level officers' dealing with the policy is not wrong, otherwise political-power can be subsituted with local tyrants. The officer's union rights have disappeared today.
