Il presente lavoro è volto ad analizzare un particolare aspetto della disciplina della responsabilità civile del medico: si tratta dell'utilizzo di documenti medico-scientifici, variamente denominati practice parameters, practice patterns, written policies, protocols, standards, e riassumibili nella locuzione clinical practice guidelines o linee-guida per la pratica clinica, che viene fatto dai rule makers, siano essi legislatori o giudici, per individuare il criterio di giudizio della condotta tenuta dal medico. Nel primo capitolo, dopo aver brevemente accennato alle necessarie nozioni di epistemologia della medicina, al contenuto delle guidelines e alla metodologia con cui esse vengono prodotte, si dà conto di alcune interazioni tra scienza e diritto verificatesi – con riferimento ai documenti medico-scientifici in esame – nell'ordinamento dell'Unione Europea, del Consiglio d'Europa e poi in quello italiano. Lo studio della responsabilità medica, nonché quello dell'utilizzo delle guidelines, induce poi ad attingere alle risorse della comparazione giuridica. In particolare, si è imposta la scelta dell'ordinamento degli Stati Uniti d'America, in quanto proprio dalla dottrina americana è stata formulata per la prima volta alla fine degli anni '80 l'ipotesi di utilizzare le linee-guida nei processi per medical malpractice. Nel secondo capitolo si offre perciò una ricostruzione dettagliata del sistema delle fonti e del ruolo delle giurisdizioni statali e federali nella produzione e applicazione del diritto americano, con particolare attenzione alla responsabilità civile del medico. Inoltre, per quanto attiene alla struttura della medical malpractice, si rileva che il criterio di giudizio prevalentemente utilizzato è quello della medical custom, che è ritenuta un fatto, il quale deve essere pertanto oggetto di prova dinnanzi alla giuria. Da ciò discende che nei processi relativi alla responsabilità civile del medico assumono particolare rilievo le conoscenze tecniche in materia di medical custom, però negli Stati Uniti una consulenza tecnica d'ufficio non viene praticamente mai disposta dal giudice: poiché l'onere della prova del breach of duty grava sull'attore, si osserva che l'expert witness di parte in materia di negligenza del medico diviene un requisito astrattamente necessario di procedibilità della domanda del paziente. È dunque in un'ottica essenzialmente probatoria, e cioè nell'interazione e – a volte – nella contrapposizione con quanto affermato dalla expert testimony, che la giurisprudenza e la dottrina americane concepiscono l'uso processuale delle linee-guida per la pratica clinica. Si prosegue perciò con l'analisi delle regole della Law of Evidence, con particolare attenzione al vaglio sulla expert witness testimony imposto dal c.d. Daubert test, e alle disposizioni in materia di ammissibilità dei documenti nel trial. Nel terzo capitolo, si dimostra che l'uso delle linee-guida nei processi americani per medical malpractice è un fatto assai più frequente di quello che la dottrina americana ritiene, e che le regole appena descritte in materia di Evidence costituiscono tuttora i riferimenti normativi più significativi per il giudizio di ammissibilità e rilevanza di tali documenti, più che i pochi statutes speciali in materia di linee-guida e responsabilità medica, che sembrano essere invece il modello a cui ha fatto riferimento il legislatore italiano per l'adozione del decreto Balduzzi. Nel quarto capitolo si ritorna al diritto italiano, e si ricostruisce la parabola che ha portato, nel nostro ordinamento, la responsabilità civile dall'illecito aquiliano alla responsabilità per inadempimento dell'obbligazione da contatto sociale. Si mettono inoltre in rilievo le distorsioni operate dalla giurisprudenza, che ha voluto caratterizzare la disciplina di questa responsabilità in senso oggettivo assoluto. Nel quinto capitolo, si rileva che in questo humus – assai diverso da quello della Law of Torts – viene trapiantata dall'art. 3, co. 1 d.l. 13 settembre 2012, n. 158 conv. con modif. in l. 8 novembre 2012, n. 189 l'idea di escludere la responsabilità del medico in caso di rispetto delle linee-guida, che trae ispirazione da alcuni statutes americani, i quali però – come si è detto – non rappresentano "il" modello più autorevole e diffuso in materia negli Stati Uniti. Viene poi effettuato un inquadramento delle guidelines assai differente rispetto a quanto accade oltreoceano: infatti, se l'obbligazione del medico ha ad oggetto una prestazione a regola d'arte, sinonimo di perizia, tali documenti si devono collocare a livello del criterio di qualificazione giuridica della condotta, non a quello dell'accertamento del fatto, e dunque non sono affatto prove, a differenza di quanto ritengono generalmente i giuristi americani. Si sostiene, in seguito, che in forza del principio iura novit curia e dell'esplicito richiamo di cui all'art. 3, co. 1 decreto Balduzzi, il giudice è tenuto a conoscere e a fare uso delle linee-guida per la pratica clinica nell'accertamento della responsabilità civile del medico, nella misura in cui esse siano applicabili al caso di specie e scientificamente valide. Proprio per quanto attiene al vaglio giudiziale di tali documenti, e specialmente a quello relativo alla loro validità scientifica, si propone poi all'interprete italiano di cogliere i frutti dell'esperienza americana, guardando con particolare attenzione al Daubert test. Ma nella circolazione del modello che qui si propone, si è coscienti che l'originale subisce alcune importanti modificazioni, di cui si dà conto. Infine, si definiscono i limiti entro i quali la Cassazione può sindacare l'utilizzo delle linee-guida da parte dei giudici di merito. ; PHD DISSERTATION - ABSTRACT - THE ASCERTAINMENT OF MEDICAL MALPRACTICE THROUGH CLINICAL PRACTICE GUIDELINES AND OTHER SCIENTIFIC DOCUMENTS. This PhD dissertation aims to analyze a specific aspect of Medical Malpractice Law: the use of scientific documents – known as practice parameters, practice patterns, written policies, protocols, standards or clinical practice guidelines – by rule makers (legislators and Courts) in order to identify the standard of care for health care practitioners. In the first chapter, after a short introduction on fundamental notions of medical epistemology, guidelines' content and their production, some interactions between Science and Law are described, picking the European Union Law, Council of Europe Law and finally Italian Law. Research on guidelines and Medical Malpractice calls for taking the advantage of Comparative Legal Studies. In particular, the legal system of the United States of America has been chosen. This because American scholars have first proposed in the '80s to use guidelines in Medical Malpractice trials. The second chapter offers thus a detailed picture of the sources of the law, including the role of state and federal Courts in making American Law. Focusing then on Medical Malpractice, it has to be said that the majority of the States adopted medical custom as the standard of care, which is a matter of fact, to be proven in front of the jury. According to this, in Medical Malpractice trials expert witness testimony about medical custom became very relevant, but no Court in the U.S. appoints experts. This, and the fact that the plaintiff retains the burden of proof of the breach of duty, makes partisan expert testimony mandatory for the claim of the patient to be heard by the jury. Therefore, Courts and scholars in the United States put guidelines in the Evidence Law frame, looking at how they interact – or sometimes clash – with expert testimonies. So, the chapter ends with an analysis of the Law of Evidence, with a focus on the so called "Daubert test" on expert witnesses, and one on the admissibility of documents. The third chapter demonstrates that the use of clinical practice guidelines in Medical Malpractice trials is way more frequent than American scholars think. Furthermore, it shows that the above-mentioned rules of Evidence are still the most relevant source of the law governing admissibility and relevance of these documents. Evidence Law indeed is far more relevant than the small number of state and federal statutes on Medical Malpractice that mention guidelines as a judicial tool for assessing liability. But these statutes seem to have inspired the Italian legislator seems adopting the so called "decreto Balduzzi" (see art. 3, comma 1 d.l. n. 158 of 2012 – l. n. 189 of 2012). The fourth chapter goes back to the Italian legal system, describing the path that brought Medical Malpractice from Tort Law to Contract Law through the so called "contatto sociale" doctrine. Furthermore, the case law caused some distortions of the rules that are now similar to strict liability. The fifth chapter describes a legal transplant from American Tort Law to the very different Italian legal environment: the idea of giving a defense to doctors who complied with clinical practice guidelines. Anyhow, some American state statutes, not the prevailing traditional Evidence Law pattern, have influenced the Italian legislator. Moreover, the conceptual framing of clinical practice guidelines under Italian Law is very different from the original. In Italy, Medical Malpractice is a branch of Contract Law, according to which the clinician is bound to perform treatments with the due technical expertise ("perizia"). Scientific documents can help Courts to define doctor's behavior as coping with technical expertise, which is a matter of law. Guidelines cannot prove any fact. Therefore, they are not related to Evidence Law. The core of this PhD dissertation is that Italian Courts have to take judicial notice of clinical practice guidelines in Medical Malpractice trials. This comes out of the "iura novit curia" principle ("The Court must know the law" principle) and art. 3, co. 1 of decreto Balduzzi, which explicitly talks about clinical practice guidelines and iatrogenic injuries. The above-mentioned scientific documents have also to pass muster under a test of applicability to the case and scientific validity. This dissertation suggests taking the advantage of the American experience, in particular of the so called "Daubert doctrine". However, even this would be a legal transplant, in which the original model would be surely modified, as this work shows. Finally, the fifth chapter describes how Cassazione Court could reverse lower Courts' decisions that apply clinical practice guidelines in Medical Malpractice cases.
Relevance of the topic. Lithuania is not a large country and sports talents are not emerging very often. It does not depend on the social or economic situation of the country (Schnabel et al., 1994; Cedaro, 2000; Carling et al., 2009). When giving the opportunity for the talent to achieve positive results in sports, the talented personalities have to be selected, the purposeful training program has to be concluded as well as the monitoring of the practical implementation of the program has to be performed (Regnier et al., 1993; Durand-Bush, Salmela, 2001; Abernethy, 2008; Vaeyens et al., 2008; Bailey et al., 2010; Burgess, Naughton, 2010; Philips et al., 2010; Ford et al., 2011). Therefore it is very important that the training of the athletes has to be conceptualized, so a small quantity of the talented athletes is developed as optimally as possible. Inaccurate training system prevents the athletes from revealing their own potential. Thus, only the consistent sports training system shall stimulate a more rapid improvement of the sports results, as it is harder to identify a talent than to develop it (Balyi, Hamilton, 1999; Raslanas, 2001; Malina et al., 2004; Balyi, Williams, 2009; Stafford, 2010). It was considered for a long time that success in sports depends solely on the athletes, who are physically strong and developed tactically (Krasilshchikov, 2011), however, due to increase of the competition between athletes (De Bosscher et al., 2006) and major political and commercial influence of sports (Green, Oakley, 2001), there is a necessity to create long-term development programs with respect to different sports (Balyi, Hamilton, 2004; Balyi, Williams, 2009; Stafford, 2010). Long-term development of the young athletes taking place for a period between eight–to–twelve years before becoming elite athlete is a purposeful and integral didactic process (Ericsson, Charness, 1994; Salmela et al., 1998; Balyi, 2001; Balyi, Hamilton, 2004; Balyi, Williams, 2009; Stafford, 2010) which is significantly affected by the body composition of the athletes (genotypic and phenotypic factors) (Heyward, Stolarczyk, 1996; Jebb et al., 2000; Drinkwater et al., 2008; Ostojic et al., 2006; Abraham, 2010), training program (Trninic et al., 2001; Milanovič, 2002; Balčiūnas et al., 2006), exceptionally physical (Drinkwater et al., 2008; Delextrat, Cohen, 2009) and technical fitness (Apostolidis et al., 2004; Karpowicz, 2006), nature of sport performance (Hucinski, 2004; Dembinski, 2005). A reasonable long-term development system of young basketball players began to take shape in seventh decade of the 20th century. Different types of training were distinguished in such system: integral, physical, technical, tactical and theoretic (Stonkus, 1992; Butautas, 2002). The scientists have different opinions on the long-term development. Zeldovič and Keraminas (Зельдович, Кераминас, 1964) provide that 50 % of the total training time in the training cycle of the boys aged 11–14 years should be attributed to the physical and technical training. Dobry (1986) and Stonkus (1985) provide that physical training should prevail (at least 40 % of the total training time) in the training of boys aged 11–14 years. Other scientists (Mikulowsky, Oszast, 1976, Butautas, 2002; Milanovič et al., 2002; Cenic, 2004) state that the technical training is the most important type of training. Based on the opinion of the other group of scientists (Литвинов и др., 1996; Canadian Sports Centres, 2008), the time attributed to the physical training shall be reduced in parallel to the increase of age of an athlete, i.e. during the first year of training the largest part shall be attributed to physical training. One of the most important conditions of effective sports training is control and management of sports training in order to determine and assess physical development, physical fitness, change in the level of technical skills (Johnson, Nelson, 1986; Bouchard et al., 1997; Stonkus, 2002, 2003; Graham et al., 2004; Barfield et al., 2007; Mirkov et al., 2008; Balčiūnas et al., 2009; Robinson, 2010). According to some studies performed, age periods which are the most sensitive for the training of motor abilities (Komi, 1992; Shephard, Astrand, 1992; Kraemer, 1993; Pauletto, 1995; Alter, 1996; Donald, Chu, 1996; Dintiman et al., 1997; Donald, Chu, 1998; Viru et al., 1999; Baquet et al., 2003; Boisseau, Delamarche, 2000; Malina et al., 2004; Ford et al., 2011), technical skills (Schmidt, 1991; Latash, 1993; Burton, Miller, 1998; Schmidt, Lee, 1999; Cabodevilla, 2008; Kasa, 2006; Zambova, Tomanek, 2012) is childhood and adolescence. Scientists (Impellizzeri et al., 2005; Wolf, 2006; Ljach, 2007) provide that with respect to training of young basketball players fitness objectives shall be important next to the training objectives, as they influence achievement of the results of a young personality. Considering that the population of Lithuania is just below 3 million (2.96 million; http://www.stat.gov.lt, 2013), the results and achievement of Lithuanian basketball men national team (5th place in the world ranking, 406 points; http://www.fiba.com, 2013) and of national teams of younger age groups (3rd place in the world ranking, 261 points (http://www.fiba.com, 2013) in the Olympic Games, World and European championships should be treated as exceptional phenomena. A case study of an effective training institution could help to form an assumption on the peculiarities of the long-term development program successfully implemented by the Lithuanian coaches. The relevance of the problem is influenced by the following factors: • a special meaning for the development of a personality has genuine activity in childhood and adolescence (Jovaiša, 1993; 2001); • basketball is becoming a more important social phenomena as sports results represent the country (Wilson, Spink, 2006; Sakalauskas, 2010; Paulauskas, 2010); • in order to form a training concept of young basketball players, tendencies of the training of the training and fitness of the best athletes has to be analyzed (Leonardo et al., 2002; Stonkus, 2003); • train and manage the process of young basketball players so that the best results are achieved in the most important competitions (Balyi, Williams, 2009). It is especially important for Lithuania as it has limited resources of sports talent and finance; • only the scientifically-sound optimum training program of the young basketball players (aged 7–17 years) shall allow the athletes to realize their individual potential in order to achieve results in sports, as well as to realize sensitive opportunities for the development of personality (Aksen, Gunay, 2010). Research problem: due to different training of the young basketball players and different concept of the fitness influencing the training, it is important to determine, which peculiarities of the training programs applied effectively while aiming for the best results influence the fitness of the players during different age periods. Research hypothesis: a case study of coaching of young basketball players of Sabonis Basketball Center aged 7–17 years will reveal the structure of the long-term coaching of the players. Research object: coaching of young basketball players (aged 7–17 years). Research aim: conceptualization of the peculiarities of coaching of young basketball players (aged 7–17 years). Research objectives: 1. Determine the peculiarities of the content changes and amount of load of the training programs of basketball players aged 7–17 years. 2. Evaluate the body composition indicators, physical and technical fitness of basketball players aged 7–17 years by creating the rank scales of the indicators. 3. Determine the model values of the sport performance indicators of basketball players aged 12–17 years. 4. Reveal the selection and coaching model of Sabonis Basketball Center. Originality and theoretical significance of the research As basketball is becoming a more complex sport (faster, more athletic and more versatile), the results depend on many internal and external factors (Stonkus, 2003; Wissel, 2012). Training of young basketball players has become multidimensional, systemic process as multidisciplinary knowledge, methods and measures are used. A revealed phenomenological interaction between training and fitness of young basketball players aged 7–17 years is based on the following aspects: • a selection and training model of Sabonis Basketball Center has been revealed; • a training program of young basketball players aged 7–17 years applied in Sabonis Basketball Center has been revealed; • a rank scale of body composition indicators, physical and technical fitness of young basketball players aged 7–17 years has been formed; • the most sensitive age periods for the training of motor abilities and technical skills of young basketball players have been determined; • the characteristics of sport performance of basketball players aged 12–17 years have been formed. Practical application of the research Training programs and their peculiarities for different age periods provided in this dissertation shall help Lithuanian coaches to organize, plan and implement the long-term development of young basketball players more effectively. The rank scales of young basketball players' body composition indicators, physical and technical fitness and the model indicator values of sport performance, which have been formed for the purposes of this dissertation, shall help to select and train the players, prepare them for competitions and develop the highly skilled athletes. The established sensitive age periods for the training of motor abilities and technical skills shall assist the coaches in developing the abilities of young basketball players more effectively. The rank scales of young basketball players' body composition indicators, physical and technical fitness and the model indicator values of sport performance, which have been formed for the purposes of this dissertation, shall help to select and train the players, prepare them for competitions and develop the highly skilled athletes. The established sensitive age periods for the training of motor abilities and technical skills shall assist the coaches in developing the abilities of young basketball players more effectively. Dottorato di ricerca in Storia d'Europa: società, politica, istituzioni (XIX - XX secolo) ; La ricerca realizzata ha inteso studiare, in un'ottica di lungo periodo e in una prospettiva complessiva, ciò che ha rappresentato l'esperienza del fascismo in un contesto territoriale periferico e non omogeneo, di cui è espressione quel segmento dell'Umbria meridionale costituito in provincia nel gennaio 1927. Tale area si è rivelata un case study esemplare, in grado di offrire interessanti spunti interpretativi. In effetti, all'unico grande polo industriale della provincia, compreso nel territorio della conca ternana, si contrappone la restante parte del territorio provinciale, comprendente città come Orvieto e Amelia, contrassegnate da consolidate relazioni con le regioni limitrofe, espressione di un'Umbria verde, agricola e mezzadrile, ma anche francescana, terra d'arte, di misticismo, ritenuta dalla pubblicistica di regime "cuore" dell'Italia fascista. A partire da ciò, si è creduto opportuno impostare la ricerca attorno a tre questioni principali, ritenute essenziali per cogliere aspetti e dinamiche della società locale nel ventennio mussoliniano. Per fare questo è stata definita una griglia interpretativa funzionale a verificare il ruolo del Pnf nel quadro del rapporto centro-periferia, continuità-rottura. Si è così puntato a esaminare come il fascismo abbia influito sui processi di formazione e consolidamento dei ceti dirigenti locali, verificandone la capacità di rapportarsi con le vecchie élites, di promuoverne di nuove o, magari, di fare coesistere entrambe. Si è poi cercato di approfondire il ruolo che il partito ha svolto in ambito locale, la sua capacità di inserirsi nelle diverse dinamiche territoriali, di creare e controllare reti clientelari e, soprattutto, di rapportarsi con le due realtà che rimangono fuori dal suo controllo, il grande gruppo polisettoriale rappresentato dalla "Terni" polisettoriale di Bocciardo e la Chiesa locale, il tutto al fine di conseguire i propri obiettivi totalitari. Infine, si è affrontata la questione del consenso. In questo senso, è stato preso in considerazione non soltanto il ruolo della violenza attuata dal fascismo per conquistare il potere e la stessa azione repressiva dispiegatasi negli anni del regime, che si dimostra concreta e reale come è normale in una situazione di dittatura, ma si è provato a fare luce sul dissenso e sulle aree di rassegnazione o di consenso tiepido che sembrano persistere nella società locale. Nel procedere si è poi cercato di coniugare la storia politicoistituzionale con quella sociale e in parte economica, attraverso un costante lavoro di analisi e incrocio delle fonti studiate, scelta ritenuta utile per conseguire gli obiettivi prefissati. Certamente, la riflessione sulle origini, l'affermazione, il consolidamento del fascismo in provincia di Terni, offre sostanziali conferme a quanto una parte della storiografia aveva proposto. Nell'Umbria meridionale il fascismo, nei suoi vertici, sorge e si afferma come punto d'incontro dei ceti dominanti tradizionali. Esso si afferma in quanto strumento della reazione agraria e dei gruppi industriali monopolistici di 2 fronte alla conflittualità contadina e operaia e al dilagare del socialismo. La sconfitta delle élites politiche tradizionali alle elezioni politiche del 1919 e a quelle amministrative del 1920, che seguiva l'effervescenza sociale del biennio rosso; la stipula del patto colonico del 1920 sfavorevole per gli agrari; la stessa esperienza, sebbene breve e contraddittoria, dell'occupazione delle fabbriche, sullo sfondo di una situazione economica difficile, ne determina la reazione, che si concretizza per l'appunto nell'adesione al fascismo. Dapprima nella versione squadrista, capace di sconfiggere sul piano militare gli oppositori, anche grazie al diffuso sostegno degli apparati di sicurezza dello Stato, quindi come blocco elettorale e nuova struttura politica in grado di conquistare il potere, il fascismo si configura come una sorta di union sacrée contro il "bolscevismo", in cui confluiscono conservatorismo agrario ma anche impulsi industrialisti e modernizzatori. Più concretamente, esso viene accorpando tutte quelle correnti politiche, contrapposte tra loro nel primo quindicennio del secolo, che avevano costituito il frastagliato universo giolittiano. In questo senso, come l'analisi dei vertici del Pnf provinciale e degli amministratori locali ha permesso di verificare, sino al 1927 a essere protagonisti sulla scena politica locale sono le forze che tradizionalmente facevano parte del blocco agrario. In primo luogo i proprietari terrieri, molti dei quali appartenenti alla nobiltà, a cui si affiancano esponenti della borghesia delle professioni, le cui proprietà erano cresciute a cavallo tra Ottocento e Novecento, nonché alcuni settori espressione diretta del mondo rurale, come gli agenti di campagna, i fattori, ma anche quei contadini che nei primi anni venti erano riusciti ad accedere alla proprietà della terra. In provincia di Terni quindi, dalla conquista fascista sino all'introduzione della riforma podestarile ma, in gran parte, anche dopo, la presenza ai vertici delle amministrazioni municipali e di quella provinciale di esponenti del notabilato locale, essenzialmente aristocratici, proprietari terrieri, professionisti, si rivela dato costante che permette di accomunare la provincia di Terni a realtà come la Toscana, l'Emilia-Romagna e, anche, a parte dell'Italia meridionale. L'attuazione della riforma podestarile, con le prerogative concesse al prefetto nella nomina dei vertici delle amministrazioni comunali, non sembra variare di molto la situazione, almeno nella prima fase di attuazione della riforma. Come è emerso nei comuni della provincia di Terni, il criterio seguito dai prefetti per l'individuazione dei podestà era connesso con la rilevanza sociale ed economica riconosciuta in una comunità ai candidati alla carica che, senza dubbio, un titolo nobiliare e una professione adeguata erano in grado di assicurare, anche magari a scapito della mancanza di qualche requisito previsto dalla legge istitutiva della riforma podestarile. In questo senso, sembra dunque perpetuarsi un modello burocratico e ottimatizio insieme, grazie al quale il fascismo intendeva presentarsi alle comunità locali con un volto rassicurante, al fine di accattivarsi il favore della popolazione. L'analisi prosopografica dei profili relativi a presidi, consultori provinciali, podestà, membri delle consulte municipali, per il periodo 1926-1943, ha reso possibile definire un quadro che vede sostanzialmente confermata l'analisi fatta in una prospettiva nazionale da Luca Baldissara ormai più di una decina di anni 3 fa1. E' cosi emerso il carattere di classe della rappresentanza politico-amministrativa fascista in questi anni, sebbene con alcune differenze effetto delle specificità socioeconomiche caratterizzanti l'area esaminata. Nello specifico, l'esame condotto sul corpus di 147 amministratori (78 podestà e 69 commissari prefettizi) che si succedono nei Comuni della provincia nell'arco di tempo considerato, ha permesso di tracciare l'identikit di un funzionario con un'età compresa tra i quaranta e i cinquanta anni; in possesso di un titolo di studio elevato (laurea o diploma di scuola superiore); in cui la proprietà della terra riveste un ruolo essenziale, coerentemente al tessuto socio-economico prevalente in provincia, e in cui dal punto di vista della professione esercitata appare predominante la figura del libero professionista (in genere avvocato e notaio). Forte è poi il legame dei podestà con il Pnf, più della metà del campione individuato risulta nel partito dal biennio 1920-1922; al tempo stesso, la maggioranza delle designazioni effettuate dai prefetti avviene in accordo con la federazione provinciale fascista. Sembra quindi delinearsi un quadro d'assieme che nel corso degli anni trenta, in gran parte della provincia, vede la predominanza delle gerarchie notabilari nella gestione del potere locale. Da tale situazione si discosta in parte l'area industriale compresa tra Terni e Narni, in cui come avviene in altri contesti urbani o regionali, attraverso il Pnf si assiste all'ascesa di personalità espressione della media e piccola borghesia urbana, per i quali l'istituto podestarile diventa uno strumento di promozione sociale e di affermazione nella gerarchia del potere locale. L'immagine del governo locale che si profila non è però statica, appare invece dinamica e contrassegnata da una forte conflittualità che, a vari livelli, si dimostra uno dei tratti comuni percepibili sotto l'apparente pacificazione realizzata dal fascismo. La forte instabilità presente nelle amministrazioni comunali della provincia di Terni, attestata dall'elevato numero di commissari prefettizi e di podestà retribuiti che si succedono, è testimonianza non solo delle difficoltà incontrate dai prefetti nella selezione di un ceto dirigente adeguato ma, soprattutto, del tentativo delle élites tradizionali, attraversate da interessi diversi e relazioni clientelari e familiari molteplici, di resistere all'azione omologatrice del regime. Indubbiamente, lo Stato fascista, attraverso la promozione di un modello di podestà fondato su competenza, capacità di agire, allineamento alle direttive dei vertici, in nome della proclamata modernizzazione puntava a ricondurre le periferie sotto il controllo del centro. Ecco allora che la ricerca di una concreta azione di governo delle amministrazioni locali, frequentemente sollecitata dal prefetto, da perseguire, ad esempio, attraverso la realizzazione di opere pubbliche funzionali alla mobilitazione di settori diversi della società, diventava il riferimento attraverso cui misurare l'efficienza e, soprattutto, "l'operosità" degli amministratori locali. L'elevato turnover dei podestà rappresenta pertanto una spia che si presta a misurare significativamente le difficoltà incontrate dal regime nell'affermare la propria azione in periferia. Non di rado tuttavia l'intervento del prefetto sui podestà si rendeva necessario per stroncare le lotte intestine e di fazione che si scatenavano all'interno delle élites locali per la gestione del potere. Le modalità attraverso cui tali scontri si manifestano sembrano esprimere dinamiche del conflitto omogenee a quanto accertato da altri studi 1 Luca Baldissara, Tecnica e politica nell'amministrazione. Saggio sulle culture amministrative e di governo municipale fra anni Trenta e Cinquanta, Il Mulino, Bologna 1998. 4 riguardanti realtà comunali, provinciali e regionali diverse. Esse assumono la forma di lettere, esposti, denunzie anonime, che divengono lo strumento di lotta principale tra le fazioni in una dimensione comunale ma, come è stato accertato in chiave provinciale, anche tra i rappresentanti dei diversi poteri locali, oltre che all'interno degli stessi vertici della federazione fascista ternana. A partire dal 1927, con la nascita della Provincia e l'insediamento di istituzioni politiche e amministrative nella città capoluogo, anche per il fascismo locale inizia una fase nuova, l'esame della quale ha permesso di meglio comprendere come in questa realtà si viene definendo il rapporto con il centro. La genesi della nuova entità territoriale è frutto di una serie di variabili legate, da un lato, alle esigenze politiche amministrative dello Stato fascista divenuto regime; a cui si sovrappongono le dinamiche conflittuali interne al fascismo regionale, che portano alla pacificazione dello stesso e alla nascita della federazione provinciale del Pnf. Infine, un ruolo determinante lo ha l'affermazione della "Terni" polisettoriale, vero e proprio potere forte nella nuova provincia, in grado di dare vita a un originale sistema di fabbrica a metà strada tra paternalismo assistenziale e truck-system. Con essa il regime dialoga direttamente, baypassando la neonata federazione provinciale del Pnf e, se necessario, intervenendo per normalizzarla, come dimostra esemplarmente la vicenda politica e personale di Elia Rossi Passavanti, primo federale e podestà di Terni. In questo senso, la ricostruzione dei percorsi personali e professionali dei vertici dell'amministrazione statale (prefetti e questori), degli organi politici (federali, vicefederali, segretari amministrativi, componenti del Direttorio della federazione fascista) ed economici (membri del consiglio provinciale dell'economia, di quello delle corporazioni e del principale istituto bancario del capoluogo), è stata preziosa per le riflessioni che permette di realizzare rispetto al ruolo avuto dal Pnf in provincia e, specialmente, alle dinamiche politiche che si innescano nei rapporti che il partito instaura con le altre autorità, a cominciare da quella prefettizia. Proprio con riferimento ai prefetti, si è potuto osservare che sui nove che si succedono in provincia di Terni nel periodo considerato, ben sei provengono dal Pnf. Tale fatto non sottende necessariamente un'automatica collaborazione con la federazione fascista, quanto piuttosto sembra rispondere all'esigenza del centro di superare i contrasti esistenti tra la federazione fascista e la prefettura che, invece, è situazione ricorrente in provincia. Nel contempo, il succedersi di dodici federali alla guida del partito è prova di una significativa instabilità, dato peraltro ulteriormente confermato dalla netta prevalenza di personalità estranee all'ambiente locale, ben nove. Questo fatto non esprime solo una certa debolezza del fascismo locale, incapace di fornire un ceto dirigente adeguato, ma dimostra la stessa evoluzione che subisce la figura del segretario federale, nei termini di una spiccata professionalizzazione inquadrabile nel più generale contesto di crescente burocratizzazione del Pnf funzionale a consolidarne il ruolo di mediazione e di intervento nell'amministrazione dello Stato, che si rivela uno dei tratti tipici del Pnf staraciano. In questo senso, le guerre che si scatenano tra prefetto e federale nel corso degli anni trenta, ad esempio per la questione delle nomine dei podestà, in cui ruolo determinante lo acquista ancora una volta l'arma dell'esposto e della lettera anonima, attestano il tentativo portato avanti dal partito di far sentire il proprio peso al fine se non di sovrapporsi, quanto meno di affiancare lo Stato in periferia. Affiora così quella di5 mensione policratica che si configura come uno degli elementi caratterizzanti la politica in periferia negli anni del regime. Nonostante i contrasti che si scatenano tra i poteri, le lotte intestine all'interno del Pnf, la cronica debolezza dimostrata dai ceti dirigenti, la federazione provinciale fascista nel corso degli anni trenta riesce comunque a essere vitale e in grado di esercitare il proprio ruolo ai fini della fascistizzazione della società locale. D'altra parte, ai vertici del partito se si escludono i federali e i loro più stretti collaboratori, le restanti cariche continuano a essere gestite in larga parte dal medesimo nucleo originario fascista, fatto di appartenenti al ceto agrario e alla borghesia delle professioni provenienti, per la maggior parte, dall'area ternana. Ciò attesta lo scarso ricambio generazionale esistente all'interno della federazione, ma anche il peso politico ed economico ricoperto dal capoluogo rispetto all'intera provincia. Questi dirigenti fanno parte dei diversi Direttori federali che si succedono e, talvolta, ricoprono contemporaneamente, laddove la legislazione lo consente, incarichi in organismi quali il Consiglio provinciale dell'economia o, anche, alla guida della principale banca locale. Ai vertici del partito il peso degli appartenenti a settori della piccola borghesia e del ceto operaio è invece minore. Soltanto con l'approssimarsi del secondo conflitto mondiale, si fanno strada figure espressione del ceto impiegatizio, ma anche tecnici e qualche sindacalista con alle spalle una carriera nell'apparato burocratico della federazione provinciale, i quali assumono incarichi di un certo peso, come quello di segretario amministrativo o di componente del Direttorio. In questo modo sembra prefigurarsi, sebbene in maniera timida e non paragonabile a quanto accade in altre province, l'affermazione «dal basso e dalle periferie [di] una nuova classe dirigente del regime totalitario»2. Nel corso degli anni trenta dunque, sebbene tra molteplici difficoltà di natura anche economica, il Pnf riesce a dare vita in provincia a una struttura organizzativa in grado di penetrare e inquadrare la società locale. Peraltro, l'afflusso costante di contributi concessi da enti pubblici diversi (amministrazioni provinciali, comunali, Consiglio provinciale dell'economia) e soggetti privati (la Società "Terni" in primo luogo, ma anche altre aziende) a un partito alla continua ricerca di risorse, che la documentazione amministrativa della federazione ternana ha permesso di verificare, rappresenta testimonianza esemplare degli sforzi profusi dal regime per rendere il Pnf un volano di sviluppo del peculiare welfare funzionale alla fascistizzazione della società locale. In questa prospettiva, il rapporto con la Società "Terni" si è rivelato una chiave di lettura che non è possibile trascurare se si vuole comprendere la natura dell'esperienza fascista in provincia di Terni. Si è visto che la stessa nascita della nuova Provincia è connessa alla questione del controllo delle acque del sistema Nera-Velino, presupposto essenziale per la creazione dell'impresa polisettoriale; così come la stipula della convenzione tra il Comune di Terni e la società guidata da Bocciardo, sanziona di fatto in maniera prepotente la forza non solo della grande azienda, ma l'affermazione dello stesso "centro" sulla "periferia". Da quel momento e anche dopo l'inserimento della "Terni" nel sistema delle partecipazioni statali attra- 2 Marco Palla, Il partito e le classi dirigenti, in Renato Camurri, Stefano Cavazza, Id. X, nuova serie, dicembre 2010, 3/10, p. 296. 6 verso l'Iri, operazione che garantì allo Stato il controllo pubblico sull'azienda e sul suo assetto produttivo, la grande impresa per il fascismo ma, più in generale, per la stessa società locale diventa emblematicamente una madre-matrigna. Essa viene percepita come un complesso capitalistico che invade la città e, con i suoi vertici, in grado di dialogare con il centro e, anche, direttamente con il duce, si pone rispetto al Pnf locale in una situazione super partes. Non è così casuale che i federali presentino come risultato della loro azione politica i buoni rapporti che riescono a intrattenere con i vertici aziendali, i quali peraltro si dimostrano costantemente impermeabili all'influenza della federazione fascista. D'altra parte, a partire dalla stipula della convenzione del 1927 e per tutto il decennio successivo la "Terni", insieme al partito, appare senza alcun dubbio uno dei pilastri del regime in provincia. Non soltanto sostiene la federazione provinciale con contributi costanti, essenziali per assicurargli la possibilità di svolgere la propria azione sul territorio; ma, più in generale, con tutto il suo peso di grande gruppo polisettoriale sposa in pieno le politiche economiche, sindacali, sociali del regime, garantendo allo stesso le condizioni per affermare «un sistema di aggregazione/costruzione del consenso/controllo sociale e politico che si adegua al modello del regime reazionario di massa»3. In queste dinamiche si inserisce anche, per quanto è stato possibile accertare in relazione alle fonti disponibili, l'atteggiamento tenuto dalla Chiesa cattolica locale nei riguardi del fascismo. L'analisi condotta con riferimento specifico alla diocesi di Terni-Narni e al vescovo Cesare Boccoleri che la guida nel Ventennio fascista, ha permesso di accertare che, come succede in altre diocesi italiane e coerentemente con le scelte fatte dai vertici vaticani, la Chiesa ternana sembra tenere una posizione di sostanziale appoggio al fascismo e di collaborazione con il Pnf. Ciò emerge in maniera evidente in alcuni momenti: ad esempio, in occasione delle campagne promosse dal regime sul terreno economico e sociale, come per la Battaglia del grano e, soprattutto, dopo la stipula del Concordato, o nel corso della guerra d'Etiopia e di Spagna. Al tempo stesso, anche quando si hanno tensioni nei rapporti tra Stato e Chiesa (per effetto della crisi del 1931 sulle prerogative dell'Azione cattolica o in occasione dell'introduzione delle leggi razziali), le conseguenze concrete per la Chiesa locale sono di scarso rilievo e, comunque, tali da non incidere sostanzialmente sulla natura dei rapporti esistenti con la federazione fascista. Anche la Chiesa locale quindi, sebbene con l'obiettivo di preservare e, per quanto possibile, incrementare la presenza cattolica nella società locale, contribuisce nella sostanza a consolidare e, anche, ampliare il consenso al regime. In particolare, essa si dimostra attiva nel favorire, specialmente nelle aree rurali, quell'azione di «modernizzazione politica» di natura reazionaria, conseguenza del tentativo di organizzazione della società italiana secondo criteri gerarchici e accentratori, che il fascismo è impegnato a portare avanti in periferia. Certamente, un ruolo essenziale ai fini della creazione e, soprattutto, del mantenimento del consenso lo esercita anche la costante opera di vigilanza e repressione di ogni forma di dissenso organizzato e di attività politica di opposizione, che si attua in provincia per opera degli apparati di sicurezza dello Stato fascista. Tale azione si rivela particolarmente efficace se negli anni del regime solo i comunisti, essenzial- 3 Renato Covino, L'invenzione di una regione, Quattroemme, Perugia 1995, p. 58. 7 mente nell'area industriale ternana, riescono a mantenere in vita, per quanto a fatica e in misura ridotta, una forma di opposizione organizzata. E tuttavia, il fatto che continuamente le autorità, sebbene nell'ambito del riconoscimento di quanto fatto dalle diverse organizzazioni del partito a favore del ceto operaio, lamentassero l'inadeguato grado di "comprensione fascista", quando non la scarsa fascistizzazione dei lavoratori delle industrie ternane e la loro "pericolosità" politica, sembra essere la conferma implicita di come in provincia, non solo non scompare l'insofferenza e il dissenso, anche politicamente organizzato, ma, più in generale, sotto la camicia nera, a prescindere dalla propaganda e dall'attività delle differenti istituzioni del regime, non vengono meno nemmeno gli interessi molteplici che contrassegnano la società locale e le diverse realtà presenti sul territorio. In ultima analisi, il fascismo locale appare in grado di esercitare un ruolo attivo nel disegno di fascistizzazione della società, coerentemente con l'accelerazione nel processo di creazione dello Stato totalitario di cui è strumento il Pnf staraciano. Il partito si rivela dunque un vero e proprio centro di potere, espressione di un regime autoritario e tendenzialmente totalitario, con cui, inevitabilmente, tutti i cittadini si trovano a confrontarsi per le necessità della vita quotidiana: in altre parole, a dover essere, almeno una volta nella vita, fascisti. ; This research project is an in-depth study, in a comprehensive and long-term perspective, of what Fascism represented at a local level in a peripheral and non-homogeneous context, as in the case of the Southern Umbria areas, established as an administrative province in 1927. This specific geographical district flagged-up all the prerequisites for an exemplary case study, featuring several significant explanatory points. To this unique large provincial administrative industrial hub located within the Terni basin, other districts, part of the same province, remained juxtaposed. Within their respective areas, these districts included towns such as Orvieto and Amelia, which had strong links with the neighbouring communities, representing the rural, agricultural and mezzadrile aspects of Umbria, land of Saint Francis of Assisi, rich in art and religious meanings, which the Fascist Regime came to proclaim officially as the "heart" of Fascist Italy. On the basis of these introductory remarks, the study focuses its scope of research on three main points, all but essential to understand fully the aspects and dynamics of the local society during the Fascist period, also referred to as the ventennio mussoliniano. An interpretative functional grid has been designed with a view to describe the role of the National Fascist Party (Nfp) within the centre-periphery and continuity-innovation relationships with the previous regime. The study seeks to investigate how Fascism exerted its influence on the establishment and process of strengthening of the local ruling ranks, attesting its ability to relate with the old dominant élites, or promote the emerging of new ones or, in addition, facilitate and support the coexistence of both. Furthermore, the research focuses on the role exerted by the Nfp at a local level, its capability to affect the various localised dynamics of power, to create and control networks of affiliates and, above all, to relate with the two main subjects which remained independent from its control, the important industrial group represented by "Terni" of Bocciardo and the local Catholic Church, with an overarching aim to achieve its totalitarian objectives. Finally, the question of popular consent has also been scrutinised. At one level, the study analyses the 2 role of fascist violence deployed to obtain power and the repressive actions carried out under the Regime, which were highly effective, as one might expect under a dictatorship. At another level, it investigates the popular dissent and the grey areas of passive acceptance and weak consent which were common among strata of the local population. Additionally, in a broader perspective, political and institutional historical analysis has been coupled with social and economic investigation, through a systematic scrutiny and cross-examination of the main sources, as a methodological approach needful to the achievement of the final outcomes of the research. Findings on the origins, development, and strengthening of Fascism within the Terni province appear to concur with the conclusions reached by previous historical research. In the Southern areas of Umbria, Fascism, at its highest level, was brought into power and successfully established by the traditional ruling classes. The establishment of Fascism was supported and facilitated by the agrarian reaction and the monopolistic industrial groups threatened by the discontent of the rural and working classes and the rapid advancement of Socialism. The political defeat of the traditional ruling élites at the 1919 general election and the 1920 local elections, which followed the social turmoil of the so-called red biennium; the agreement of the 1920 patto colonico, disadvantageous to landowners; the occupation of factories, though a brief and contradictory experience, against a background of economic difficulty, caused their reaction and prompted their acceptance and support for Fascism. Firstly, Fascism, in the form of Fascist action squads and their capability of defeating its opponents militarily, with the extensive assistance of the State security services, then as an electoral block and political force capable to achieve power, presented itself as a sort of union sacrée against the threat of Bolshevism into which various groups appear to converge: the agrarian conservatism but also industrial and more modern forces. Undoubtedly, Fascism drew together different political forces, which during the first decade of the twentieth-century had been mutually antagonistic, and segments of the complex and divided political establishment of the Giolitti era. The scrutiny of the highest levels of the local Nfp and civil servants has revealed that, at least till 1927, the main political figures belonged to those forces already part of the agrarian block. Firstly, the landowners, many of whom belonged to the local nobility, supported by members of the professional bourgeoisie, whose estates and wealth had augmented during the nineteenth- and twentieth-century, and other sectors which were the direct expression of the rural milieus, such as the rural agents, farmers, but also those peasants whom, during the first two decades of the twentieth-century, had succeeded in becoming landowners themselves. Therefore in the Terni province, from the establishment of the Fascist regime to the introduction of the office of podestà and, for some time even after, 3 the highest offices of the municipal and provincial administration were held by members of the local nobility, primarily aristocrats, landowners and professionals. This is an invariable characteristic which put the Terni province in alignment with similar situations in Tuscany, Emilia Romagna and other areas of Southern Italy. The administrative reform and the establishment of the podestà authority, together with the prerogatives of the prefectures in appointing members of the highest offices within the municipal administrations, did not radically change, at least during the early phases of the reform, established practice. A survey of the municipalities located within the Terni province, shows that the prefects in the selection process to appoint the podestà took greatly into account the candidates' social and economic status of and, without doubt, a honorific title and tenure of highly considered profession were often sufficient criteria for a candidate to be nominated even when lacking some of the prescribed requisites as outlined by the administrative reform. The Fascist regime therefore, in perpetuating a bureaucratic and grandees system, showed an intention to reassure the existing ruling élites and obtain the support of the local population. A prosopographical analysis of the biographical profiles of headmasters, members of the provincial advice bureaus, podestà, members of the municipal advisory councils, during the 1926-1943 period, has made it possible to outline a summary framework which strongly corroborates the analysis carried out at a national level by Luca Baldissarra over a decade ago.1 What has emerged from this analysis is the class-based character of the Fascist political and administrative representation during those years, though presenting various differences linked to the social and economic specificity of the area scrutinised. In more depth, the study carried out on a corpus of 147 civil servants (78 podestà and 69 prefectural officers) employed by the municipalities of the province during the examined period, made it possible to draw up a profile of the typical officer: between forty and fifty years of age; highly educated (having achieved a high-school or university degree); often a landowner, a characteristic consistent with the social and economic structure prevailing throughout the province, and among whom the status of self-employed (generally lawyer or public notary) represented the most frequent professional position held. Relations between the podestà and the Nfp appear to have been particularly close, over half of the sample identified is composed by individuals who had joined the Fascist Party at an early stage, during 1920-1922; additionally, the majority of the appointments made by the prefects were agreed in advance with the Provincial Fascist Federation. It would therefore appear that during the 1930s, in 1 Luca Baldissara, Tecnica e politica nell'amministrazione. The industrial area comprised within the administrative territories of the two municipalities of Terni and Narni, however, appears to contrast with other districts of the province. In this area, as for similar cases in other municipalities or other regional administrations, the Nfp supported the emergence of members of the small and medium local urban bourgeoisie, as the office of podestà became a vehicle of social advancement and an opportunity to climb up the local hierarchy of power. Despite the apparent pacification established forcibly by the Fascist regime, the dynamics of power within the local government remained characterised by extreme unrest and strong conflict at various levels. The sizeable number of prefectural commissioners and remunerated podestà who succeeded in office, often in rapid succession, bears witness to the instability which marred almost all the municipal administrations of Terni province. This is evidence of the obstacles encountered by the prefects during the selection process of a qualified managerial class but, above all, of the resistance put up by the traditional élites of power, motivated by divergent interests and loyalty to various networks of familial and personal relations, to the process of homologation pursued by the Fascist regime. Undoubtedly, the Fascist regime, in implementing a model of podestà based on competence, on the energetic ability to act, on its alignment to official directives, and in order to achieve a modernisation of the administrative system, aimed at placing the local authorities under the prescriptive control of a centralised State. The actual administrative actions implemented by the local administrative offices, frequently under the guidance and pressure of the Prefects, as for example in the case of the accomplishment of public works functional to the civil mobilisation of various segments of the local community, became a measure of their efficiency and, above all, a measurement of how industrious the local administrators should be. The high turn-over of podestà is a clear indication of how difficult it was for the Fascist regime to implement its plans of action in peripheral areas. Additionally, direct intervention by the Prefects was often necessary to put an end to rivalries and internal power struggles which frequently broke out among local élites. These clashes and their manifestations appear to be similar in their dynamics, as pointed out by previous studies, to other cases occurred in different municipalities, provinces and regions. Resorting to anonymous letters, official complaints, accusations, came to represent the instrument to attack and weaken the opposite factions at a local level, within the municipalities, but also within the provincial administration, among the various representatives of the local administration and even the highest offices of the Terni Fascist Federation. From 1927, following the establishment of the 5 Province and the set up of political and administrative authorities in Terni, now seat of local government, a new phase emerged for the local Fascist Party too. The study of this new province has facilitated the understanding of its relations with central authorities. The establishment of this new local administration was the result of various circumstances linked to the political requirements of the Fascist State following the transition to a totalitarian regime. Additionally, the internal conflict dynamics of the regional Fascist Party played an important role. These led to the inner pacification of the Party and the set up of a Nfp Provincial Federation. Finally, the establishment of "Terni" had a pivotal role too. "Società Terni" (also referred to as "La Terni") came to represent the real "strong power" of the province, capable of imposing a factory regimen based partially on paternalistic assistance and partially on a truck-system model. The Fascist regime dealt directly with "Terni", bypassing the newly-established Nfp Provincial Federation and, where necessary, intervened to impose its authority, as the political and personal vicissitudes of Elia Rossi Passavanti, the first Federal secretary and podestà of Terni, exemplified. In this perspective, drawing together personal and professional career paths of the highest officers (prefects and police commissioners), of both political (federals, deputy federals, administrative secretaries, members of the Fascist Federation Federal Bureau) and economic authorities (members of the Provincial Economic Council, members of the Provincial Corporations Council and of the main bank) has represented an invaluable study, conducive to the understanding of the Nfp's role within the province and, in addition, of the political dynamics at play among the Fascist Party and other authorities, such as the prefectures. With specific reference to the prefects, it is worth noticing that of the nine prefects in office in the Terni province during the period under scrutiny, as many as six were Nfp members. This situation, however, did not necessarily imply a spontaneous collaboration between the prefectures and the Fascist Federation, but it would appear to have been a response to the need of overcoming the conflictual antinomy between the two authorities, which was a recurrent event throughout the Terni province. In addition, the succession of twelve Federals as leaders of the Fascist Party bears witness to a pervasive instability, a fact which is also confirmed by the noticeable preference given to individuals, as many as nine, unconnected with the local milieu. This is certainly a clear manifestation of the local Fascist Party's weakness - which appeared unable to express and produce capable managerial ranks - and of the evolution of the Federal Secretary's role, becoming more and more a professional one, in the context of the remarkable bureaucratisation of the Nfp, aimed at strengthening its mediatory and interventional role on the local administration, one of the main characteristics of the Nfp 6 under the leadership of Starace. Within this framework, the contrast between the prefects and the Fascist Federal secretaries during the 1930s, with regard, as a case in point, to the appointments of the podestà, and the crucial utilisation of official complaints and anonymous letters, bears witness to the Party's attempt to impose its decisions or, at least, to influence the administration at a local level. This, in turn, resulted in a situation of polycracy, which was one of the factors denoting local politics during the Fascist regime. During the 1930s, despite deep rooted conflict among the authorities, the internal power struggles within the Nfp and the endemic ineptitudes of the ruling class, the Fascist Provincial Federation was successful in exerting and promoting the fascistisation of the local community. It is manifest that the highest authorities within the National Fascist Party, with the exception of the Federals and their closest advisors, remained the domain of the original Fascist core, composed by members of the rural class and the bourgeoisie originating primarily from the Terni area. This explains the inadequate generational change within the Fascist Federation and, in addition, the political and economic importance of the Terni area in comparison to the entire province. These political figures were part of the various Federal Bureau and, in some cases at the same time, if the law permitted, held additional offices in different institutional bodies, such as the Economic Provincial Council or were in charge of the main local bank. On the contrary, the influence exerted on the high levels of the National Fascist Party by the small bourgeoisie or by members of the working class remained negligible. It was only with the approach of the Second World War that members of the clerical class, but also technicians and a few tradeunionists already employed within the bureaucratic structure of the Provincial Federation, acquired an enhanced importance and gained access to higher office, such as administrative secretaries or members of the Federal Bureau. The Terni area too, though in a more limited way, which bears not comparison with other provinces, saw the rising «from the bottom and the periphery of a new ruling class within the totalitarian regime»2. During the 1930s therefore, despite various difficulties, including economic issues, the Nfp was successful in creating at a provincial level an organisational structure capable of influencing and organising the local community. Additionally, the regular flow of financial contributions bestowed by various public authorities (provincial administrations, municipalities, Provincial Economic Council) and private companies ("La Terni", first of all, but other businesses too) to a political party constantly seeking financial backing, as thoroughly documented by records of the Terni Fascist Federation, bears witness to the outstanding efforts the Regime made to 2 Marco Palla, Il partito e le classi dirigenti, in Renato Camurri, Stefano Cavazza, Id. X, nuova serie, dicembre 2010, 3/10, p. 296. 7 successfully present the Nfp as a conducive mean to the development of this specific welfare model, with a view to promote the fascistisation of the local community. In this perspective, the Nfp's relation with the "Società Terni" is key to understanding the nature of the Fascist Regime and its role within the Terni province. The establishment of a Province was connected to the control of the water-system of the two rivers Nera-Velino, essential to create an industrial hub; similar reasons were behind the agreement stipulated between the Terni municipality and the Bocciardo Company, which came to sanction resolutely the importance of the Company and, additionally, the supremacy of the "centre" over the "periphery". It was from this period and following the inclusion of "Società Terni" within the system of state-controlled industries through the Institute for Industrial Reconstruction, a transaction which secured State control over the Company and its productive branches, that "La Terni" became firmly linked to Fascism and, more in general, to the local community, though in a controversial and ambivalent mutual relation. The Company was perceived as a capitalistic enterprise which took over the city, its directors being able to negotiate with the central Government directly and with the Duce himself, taking a super partes position in relation to the local Nfp. It was not a fortuitous occurrence that the Federal secretaries gauged their political influence against the effectiveness and strength of the relations they were able to maintain with the executive directors of "Società Terni", whom, on their part, appeared to be impenetrable to any influence exerted by the local Fascist Federation. Additionally, following the 1927 agreement and during the ensuing decade, "La Terni", in conjunction with the Fascist Party, appeared to become, without doubt, one of the main pillars of the province. At one level, it supported the Fascist Provincial Federation through a constant flow of financial contributions, vital to bankroll the Federation's activities within the province; but, at a more general level, asserting its influence as a large industrial group, it was capable of shaping the economic, trade-union and social policies of the Fascist regime, creating those conditions to establish «a system of aggregation/disaggregation of the social and political consensus/control conforming to the mass reactionary regime model»3. Within this dynamic interactions, and on the basis of documents available, the local Catholic Church played a significant role in relation to the Fascist Party. With reference to the specific case of the Terni-Narni dioceses and bishop Cesare Boccoleri, the Church's main leader during the Fascist ventennio, this research has showed that, as in the case of other Italian 3 Renato Covino, L'invenzione di una regione, Quattroemme, Perugia 1995, p. 58. 8 dioceses and in alignment with the decisions taken by the Vatican, the Church authorities in Terni supported the Fascist apparatus and adhered to a policy of collaboration with the Nfp. This was particularly manifest on specific occasions: for example during the economic and social campaigns promoted by the Regime, as a case in point the so-called "Battle of the wheat" and, above all, following the 1929 Concordat with the Catholic Church, or during the Ethiopian and Spanish conflicts. At the same time, even when tensions arose and marred the relations between the Fascist regime and the Catholic Church (following the 1931 crisis caused by the limitations imposed on the prerogatives of Azione Cattolica or the adoption of the 1938 racial laws), the consequences for the local Church were negligible and did not appear to affect the on-going relations with the local Fascist Federation. The local Church therefore in pursuing the aim of preserving and, wherever possible, augmenting the Church's influence on the local community, contributed to reinforce and widen consensus for the Fascist regime. More specifically, the Church's actions were particularly effective in encouraging, especially in rural areas, that precise process of "political modernisation", though reactionary at its core, based on organising the entire Italian society on hierarchical and centralising criteria, which Fascism was promoting particularly at a local level. Additionally, and without doubt, the important function to create and, above all, to maintain a high level of consensus was exerted by the pervasive surveillance and repression of any form of dissent and political opposition, enforced within the province by the Fascist security services. A repressive action which was extremely effective and, during the dictatorship, only the Communist Party, despite being hemmed in to the Terni industrial area, was able to maintain, albeit with great difficulty and in a limited way, a form of organised resistance. The fact that the Fascist authorities continuously, though recognising what had been achieved by the Party's multifarious organisations to favour and support the working classes, lamented the feeble "fascistisation" of the Terni industrial workforce and their being "politically dangerous", would appear to confirm implicitly that throughout the province the opposition and political dissent had not completely ceased. More in general, under the "black shirts", despite the propaganda and the activities of various Fascist authorities and institutions, it remained evident that the diversified interests which characterised the local society and the different realities rooted at local level persisted. Ultimately, the local Fascist Party appeared capable of exerting an active role in the "fascistisation" process of society, in alignment with the creation and implementation of a totalitarian state, being the main objective of the National Fascist Party under the leadership of Starace. The Nfp was therefore a real centre of power, expression of an authoritarian 9 regime leaning toward totalitarianism. A regime against which all citizens had to relate for their everyday life needs: that is to say, all citizens had to act, at least outwardly, as fascists.
L'oggetto della nostra ricerca riguarda le dinamiche sociologiche in materia di gestione del discredito a seguito dello scandalo degli abusi sessuali nella Chiesa Cattolica dal 2002 al 2010, prendendo in considerazione alcuni degli eventi mediaticamente più significativi che hanno caratterizzato l'intera vicenda. Il punto di partenza della ricerca è il 9 gennaio 2002, quando il quotidiano americano The Boston Globe ha pubblicato un'inchiesta relativa a un caso di abuso nell'arcidiocesi di Boston. In seguito abbiamo assistito a una propagazione del fenomeno non solo in altre diocesi del territorio, ma anche in alcuni Paesi europei; tra questi abbiamo incentrato la nostra analisi sulla situazione in Irlanda. Le ragioni di questa scelta sono state dettate dal fatto che dagli Stati Uniti è esploso mediaticamente il caso e per tutto il decorso della vicenda essi si sono posti nello scenario internazionale come opinion leaders, non solo a livello di politiche adottate per contrastare il fenomeno (tra tutte, la zero tolerance), ma anche per quanto riguarda l'adozione di prime specifiche norme in materia di tutela dei diritti dei minori. Il focus sull'Irlanda è invece dettato dalla forte tradizione cattolica presente nel Paese . La scelta degli Stati Uniti e dell'Irlanda, poi, è motivata da alcune ragioni di fondo che sembrano accumunare entrambi i Paesi; innanzitutto, la dimensione del fenomeno (ovvero, negli Stati Uniti dal 1950 al 2002 sono stati segnalati circa 4392 preti accusati di abuso sessuale sui minori ; in Irlanda, invece, tra il 1965 e il 2005 sono state registrate più di 100 denunce di abusi su ventuno preti che operavano nella sola diocesi di Ferns ). Un successivo aspetto fa riferimento, invece, all'interesse dei mass media americani (e irlandesi) circa le modalità di rappresentazione della vicenda, spesso presentata in "termini scandalistici", i cui fatti accaduti circa trent'anni fa sono riproposti all'opinione pubblica come se fossero fatti attuali. Infine, dall'America sono partiti anche i primi processi, che hanno portato in molti casi a gravi crisi finanziarie delle diocesi locali che hanno dovuto risarcire le vittime; inoltre, da qui sono scattate le denuncie contro il Vaticano e il Papa (nel settembre del 2011, infatti, lo SNAP , una delle maggiori associazioni delle vittime, ha presentato un'istanza al tribunale dell'Aja conto Benedetto XVI il cardinale Tarcisio Bertone, il cardinale Angelo Sodano e l'ex Prefetto della Congregazione, William Levada). In Irlanda si presenta uno scenario più o meno simile; i dati del Rapporto Ferns, infatti, hanno evidenziato lo stesso modus operandi delle diocesi locali che, in molti casi, hanno offerto alle vittime grossi risarcimenti monetari per evitare che i casi diventassero uno scandalo per la diocesi stessa o per la Chiesa in generale. Il lavoro è stato diviso in tre sezioni: una prima parte, di taglio sociologico, espone le matrici alla base del concetto di credibilità, prestando particolare attenzione alla credibilità delle istituzioni (con la Chiesa Cattolica) e dell'individuo (nello specifico, abbiamo parlato della relazione tra il sacerdote e il minore-vittima dell'abuso). Successivamente abbiamo analizzato le modalità di costruzione della notizia tenendo presenti gli aspetti caratterizzanti il processo del newsmaking e i valori notizia impiegati per la rappresentazione dei fatti da parte dei quotidiani stranieri ed italiani. Infine, abbiamo affrontato il problema del panico morale, sulla scorta dello studio di Griswold sulla costruzione di un problema sociale in relazione al ruolo e all'influenza mediatica in questo processo (Griswold 1997). Nella seconda parte del lavoro, abbiamo applicato le categorie dei valori notizia, delle strategie di tematizzazione dei quotidiani e del panico morale nella ricostruzione dei casi di abuso in America e in Irlanda. Al fine di offrire un quadro quanto più ampio dei singoli fatti, abbiamo elaborato una breve ricostruzione storica sulla base della documentazione prodotta da alcune fonti ufficiali, quali: il sito ufficiale della Santa Sede, referti medici, indagini governative e inchieste condotte dalle diocesi locali o da autorità giudiziarie. Nell'impossibilità di esaminare tutta l'enorme mole di materiale prodotto dagli organi di stampa durante questi anni, abbiamo selezionato due tipologie di articoli giornalistici: - Per i quotidiani stranieri abbiamo scelto l'editoriale, quale forma giornalistica capace di esprimere il punto di vista della direzione del giornale. Le testate impiegate come fonti sono così suddivise: a. Per gli Stati Uniti, ricordiamo: The Boston Globe e The New York Times; b. Per l'Irlanda, invece, abbiamo: The Irish Times; Per quanto riguarda l'analisi degli articoli italiani, invece, abbiamo selezionato i tre quotidiani più letti in Italia: Il Corriere della Sera, La Repubblica e La Stampa. In questa circostanza abbiamo optato per l'articolo di cronaca, come forma di esposizione di una notizia per eccellenza. Alla ricostruzione storica e mediatica dei principali casi di abusi sessuali abbiamo esaminato la risposta proveniente dalla Chiesa Cattolica nei suoi vari livelli, considerando gli interventi pubblici, le decisioni e i gesti significativi valutando le eventuali analogie e differenze di azione compiute nel corso degli anni da Papa Giovanni Paolo II e da Papa Benedetto XVI. In tal senso, abbiamo fatto riferimento a una fitta documentazione disponibile sul sito ufficiale del Vaticano. I risultati dell'analisi fanno riferimento a due precisi ambiti. In primo luogo, abbiamo preso in esame gli effetti prodotti dai media analizzandoli su due fronti: innanzitutto secondo un'ottica autoreferenziale, ovvero valutando eventuali cambiamenti di posizione rispetto all'avvicendarsi dei fatti e, infine, in relazione alla risposta dell'opinione pubblica prendendo come parametri di riferimento i sondaggi di popolarità e gli indici di fiducia e consenso rivolte alla Chiesa Cattolica. In secondo luogo, poi, abbiamo considerato sulla base delle statistiche e dei sondaggi elaborati, qual è stato il feedback dell'opinione pubblica estera in relazione alla risposta della Chiesa (locale e del Vaticano) e a quel preciso periodo temporale in cui la vicenda si stava evolvendo. Questa modalità riflette una questione fondamentale dell'intera vicenda, ovvero, non essendo ancora conclusa la questione degli abusi (sia da parte della Chiesa Cattolica sia in termini di risoluzione dei casi) al momento non si dispongono di cifre esatte per poter fare una stima circa l'efficacia (o meno) delle strategie di gestione del discredito applicate dalla Chiesa Cattolica. La metodologia impiegata per lo studio sugli articoli è di tipo qualitativo, ovvero, ricorrendo a un'analisi semantica e lessicale con cui abbiamo individuato le parole-chiave, le espressioni maggiormente ricorrenti e i temi (come il dibattito sull'istruzione della Crimen Sollicitationis) collegati alla vicenda; in tal senso, abbiamo applicato lo studio condotto da Dardano (1973) per l'analisi del linguaggio dei giornali. Tra le fonti impiegate per la nostra ricerca abbiamo tenuto conto, come già detto, della documentazione pubblicata on line (dai singoli quotidiani come approfondimenti agli articoli), di quella consultabile negli archivi digitali delle diocesi straniere e di quella reperibile nel sito del Vaticano. Inoltre per quanto concerne il materiale estrapolato dalla "rete" disponiamo: 1. Delle perizie psichiatriche, dei referti medici e delle lettere di corrispondenza tra i vari livelli delle gerarchie ecclesiastiche americane. 2. Dei rapporti delle varie commissioni di inchiesta, come ad esempio: il Rapporto Ryan (maggio 2009), il Rapporto Murphy (novembre 2009) e il Cloyne Report (luglio 2011) diffusi in Irlanda a seguito delle indagini condotte negli istituti religiosi, nelle diocesi del territorio sui casi di abusi sessuali contro i minori e impiegati come strumenti di repressione e prevenzione del fenomeno. Altro esempio è il John Jay Report, uno studio condotto dal John Jay College of Criminal Justice dell'Università di New York, commissionato dalla Conferenza Episcopale dei Vescovi d'America Abbiamo estrapolato i regolamenti, le normative promulgate dalle diocesi locali in materia di gestione dei casi di abuso e nell'ambito della tutela dei diritti dei minori. Alcuni esempi sono: il Framework Document del 1996 (dall'Irlanda), oppure, le Essential Norms promulgate nel 2002 dalla Conferenza Episcopale Americana. 3. Dei discorsi ufficiali, dei comunicati stampa e degli interventi pubblici di Papa Giovanni Paolo II, di Papa Benedetto XVI e di alcuni esponenti del Vaticano. Abbiamo, inoltre, le trascrizioni degli interventi del Papa durante gli incontri con le vittime e durante i viaggi compiuti nei Paesi in cui si sono verificati gli episodi di abusi. 4. Delle normative e dei regolamenti canonici in materia di tutela dei minori dal 1962 ad oggi. Come approfondimento per valutare gli effetti che i casi hanno prodotto in Italia abbiamo raccolto anche una prima serie di interviste, realizzate in Italia e a New York e in Irlanda a giornalisti e vaticanisti che si sono interessati alla vicenda. Ricordiamo qualche nome dall'Italia: Marco Tosatti (La Stampa), Marco Politi (Il Fatto Quotidiano), Stefano Maria Paci (Skytg24) e Andrea Tornielli (La Stampa). Dagli Stati Uniti abbiamo invece: Luciano Clerico, Emanuele Riccardi e Alessandra Baldini (inviati dell'agenzia di stampa Ansa) e Monsignor Lorenzo Albacete (Teologo e giornalista del New Yorker ed editorialista del New York Times). Come testimonianza della situazione irlandese, abbiamo invece un'intervista a Gerard O'Connell (giornalista e collaboratore dell'Irish Times). ; The main theme of our project research is about the sociological dynamics of the discredit as a result of the sexual abuse scandal in the Catholic Church; in particular we consider the mass media coverage on the topic from January 2002 to March 2010. Our start point is January 9th, 2002 when the american newspaper, The Boston Globe published an investigation about a sexual abuse case in the Boston Archdiocese. Then, we considered the development of the issue in the american dioceses and in the other European countries too; from all the cases that happened, we decided to consider the Irish situation. The reasons that moved our decision depends on whether the case began in the United States by the newspaper and throughout the development of all the case, the american mass media played the part as opinion leader within international scenario, not only not only for the politics which have been adopted to contrast the phenomenon (among the many, the "zero tolerance" one), either for the adoption of first specific rules concerning the defense of child's rights. The focus in Ireland has been, whereas, set out by the strong Catholic tradition across the nation . The choice of both the USA and Ireland, is motivated by some major reasons seeming to pool the two countries together: first of all, the phenomenon size (namely in the USA from 1950 to 2002, 4392 cases of sexual abuse onto minors have been reported ; while in Ireland between 1965 and 1005, more than 100 sexual abuses complaints have been registered on 21 priests operating in the Ferns diocese itself ). Another following aspect, whereas, refers to the US mass media interest (and the Irish ones as well) about the representation of the occurrence, often presented in "tabloid terms" whose facts occurred over thirty years ago, are now presented as still topical Eventually, the first lawsuits started out in the US, which in several cases have brought the local dioceses to serious financial problems, as these were supposed to refund the victims; in addition there are allegations to the Vatican and the Pope (in fact, in September 2011 the "SNAP" one of the major victims' association submitted a petition to the Aia court against Benedict XVI, cardinals Tarcisio Bertone and Angelo Sodano and the former congregation chief officer, William Levada ). In Ireland the scenario is quite similar to the above mentioned one, the data from the Ferns Report highlighted the same modus operandi in the local dioceses, which, in most cases offered the victims generous monetary refunds to keep the cases from becoming a scandal for the diocese's sake or the entire Catholic church. The work is divided into three sections: in the first one we treated the theory of the credibility, in particular focusing the Catholic Church credibility and the relationship between the priest and the abused minors. Afterwards we analyzed the news' construction modes, considering the news making process and the news values either, employed for the representation of facts on the Italian and also foreign newspapers' behalf. At last, we talked about the construction of the moral panics and the relationship with the Griswold theory on the construction of the social problems by the mass media influence. Finally, we confronted the "moral panic" issue being spotted from Griswold's study about the construction of a social issue in relation to the media role and influence within this process (Griswold 1997). In the second part of this work we have applied the news values categories, newspapers thematization strategies and the moral panic in the reconstruction of the abuses in Ireland and in the USA. In order to offer a wider pattern of the single facts, we have elaborated a short historical reconstruction based on the documents produced and issued by some official sources such as: the Holy See official website, medical reports, governmental investigations and enquiries carried out by local dioceses and judiciary authorities. Due to the enormous amount of material produced by the press organs during all of these years, we have picked out two typologies of journalism articles: - For the foreign newspapers we have chosen the editorial, as the journalistic form able to express the newspaper's editorial management. The newspapers employed as sources are under this division: a. For the United States, we recall: The Boston Globe and The New York Times; b. For Ireland, we have : The Irish Times; As far as the analysis of the Italian articles, we have, whereas, selected the three Italian most read newspapers: Il Corriere della Sera, La Repubblica and La Stampa. Besides the historical and media reconstruction of the major abuse cases, we examined the response moving from the Roman Catholic church within its various levels, considering the public interventions, the decisions and the significant gestures by evaluating any analogy and difference in the action brought on over the years by the Popes John Paul II and Benedict XVI. In this acceptation we have referred to a voluminous documentation available on the Vatican official website. The outcomes of this analysis refer to two sharp fields. Firstly, we have examined the effects produced by the media, analyzing them onto two different hands: first of all through a self-referring perspective, either evaluating any change of position with respect to the occurrences following one another, and at the end, with respect to the public opinion, taking as standards the popularity surveys and the ratings of trust and consensus towards the Catholic church. Second to this, based on the statistics and the elaborated surveys we considered what was the feedback from the foreign public opinion related to the church's response (locally and from the Vatican either) and to that precise time lap where the deeds were taking turns. This modality reflects one fundamental question of the whole matter, that is, since the question of the abuses has not been resolved yet (both from the church behalf and in terms of resolution of the facts) at the moment there is no reliable numbers to estimate the efficiency or not of the discredit management strategies applied by the Catholic church. The methodology employed in this study is qualitative, namely a semantic and lexical analysis through we have found out the key words, the most redundant expressions and the themes (like the debate about the constitution of the "Crimen Sollicitationis") related to the occurrence; in this acceptation we have applied the study carried out by Dardano for the analysis of newspapers' language. Among the sources employed for our research we held in consideration, as previously said, the online edited documentation (by single newspapers as deeper examination on the articles) those available in the digital archives of the foreign dioceses as well the one at disposal on the Vatican website. In addition, as far as the material excerpted from the "web" we have: 1. psychiatric examinations, medical reports and mail letters exchanged among the various levels of the American clergy hierarchy. 2. Several reports from the enquiry boards, for instance: Ryan Report (May 2009), Murphy Report (November 2009), Cloyne Report (July 2011) released in Ireland after the investigations carried out in religious institutes and facilities, in the local diocese on sexual abuses cases onto minors and employed as repression and prevention means of the phenomenon. Another example is the John Jay Report, a study performed by the John Jay College of Criminal Justice, within the New York University, commissioned by the American Episcopal Conference. We have excepted regulations, rules enacted by local dioceses concerning the management of abuse cases and the safeguard of minors' rights. Some of the examples are the Framework Document, 1996, (from Ireland) and the Essential Norms promulgated in 2002 by the American Episcopal Conference. 3. Public speeches, press communications and public appearances by the Popes John Paul II and Benedict XVI, as well as by other Vatican exponents. Also we have the transcriptions from the Pope's statements during the meetings with the victims and the journeys in the countries where the abuses had occurred. 4. Canonical regulations and norms regarding the minors' rights safeguard from to 1962 up to our days. As a deeper examinations in order to evaluate the effects that these cases produced in Italy, we collected a series of interviews too, carried out in Italy, in New York and in Ireland to journalists and vaticanists getting interested in this occurrence. We recall some name from Italy: Marco Tosatti (La Stampa), Marco Politi (Il Fatto Quotidiano), Stefano Maria Paci (Skytg24) and Andrea Tornielli (La Stampa). From the United States we have: Luciano Clerico, Emanuele Riccardi and Alessandra Baldini (reporters from the press agency Ansa) and Monsignor Lorenzo Albacete (Teologist and journalist for New Yorker and editorialist for New York Times). Il presente lavoro si prefigge la finalità di analizzare taluni aspetti legati al diritto reale di abitazione, con speciale riferimento al divieto di cessione del predetto diritto previsto dall'articolo 1024 del codice civile. Tale problematica, inoltre, è strettamente connessa anche ad altri aspetti pratici, quali l'ipotecabilità e l'espropriabilità del predetto diritto reale. In particolare è apparso opportuno approfondire preliminarmente taluni profili di carattere generale riguardanti il diritto di abitazione, nei limiti in cui essi fossero funzionali alla ricostruzione che si è tentato di proporre. A tal fine, sono stati affrontati alcuni aspetti, quali la natura giuridica e i presupposti soggettivi ed oggettivi, in quanto ritenuti propedeutici al prosieguo della trattazione. In particolare l'esclusione del diritto d' abitazione dal novero dei diritti ipotecabili ha sollevato diverse questioni in dottrina e in giurisprudenza. L'inattitudine del predetto diritto ad essere oggetto d'iscrizione ipotecaria deve essere necessariamente valutato alla luce della propria disciplina. Il diritto d'abitazione consente al titolare di abitare una casa "limitatamente ai bisogni suoi e della sua famiglia" (art. 1022 cod. civ.). Il rapporto che si instaura a seguito della costituzione del diritto è fondato sull'intuitus personae, sia sotto il profilo del contenuto del diritto che sotto il profilo del rapporto dell'habitator con il proprietario dell'immobile. La limitazione dell'esercizio del diritto al soddisfacimento dei bisogni del suo titolare, infatti, da una parte implica che il suo trasferimento ad un terzo potrebbe mutarne il contenuto, con eventuale nocumento per il proprietario; dall'altra implica che qualora la casa risulti di estensione maggiore rispetto alle esigenze dell'habitator, il proprietario potrà goderne per la parte eccedente: il titolare del diritto reale d'abitazione non avrebbe infatti titolo ad opporsi alle ingerenze del proprietario, nei limiti in cui quest'ultimo non molesti il libero godimento dell'altra parte dell'abitazione. Anche sotto questo secondo profilo emerge la personalità del rapporto, essendo rilevante per il proprietario la persona del titolare del diritto, con il quale potrebbe anche trovarsi dover convivere. Tali motivazioni costituiscono la ratio alla base del divieto di cessione e di locazione del diritto in esame, ex art. 1024 cod. civ. Tale divieto costituisce a sua volta il fondamento dell'esclusione del diritto d'abitazione (e d'uso) dall'elenco dei diritti ipotecabili ex art. 2810 cod. civ. La realizzazione della causa di garanzia, infatti, implica che la situazione sostanziale dedotta quale oggetto dell'ipoteca sia alienabile, non potendo immaginarsi una vendita forzata del diritto ove di questo non possa normalmente disporne il titolare. Probabilmente a ciò è legata anche la precisazione posta dall'art. 2810 n. 1) cod. civ., per cui sono ipotecabili gli immobili "che sono in commercio". L'ammissibilità dell'iscrizione ipotecaria sul diritto d'abitazione postula il riconoscimento della sua trasferibilità: è dunque necessaria un'analisi della portata del divieto di cessione di tale diritto posto dall'art. 1024 cod. civ. Come accennato, infatti, tale divieto è posto al fine di tutelare la posizione del proprietario dell'immobile, e dunque a presidio di interessi di natura privatistica: la regola sarebbe quindi applicabile ove non sia diversamente disposto dal titolo costitutivo, mentre con l'accordo di proprietario ed habitator potrebbe prevedersi una più o meno libera cedibilità, grazie al consenso della parte che la disciplina codicistica mira a tutelare. In merito è stato obiettato che il divieto di cessione non solo sia disposto a tutela della posizione del nudo proprietario, ma faccia parte del contenuto stesso del diritto, in quanto al variare del titolare sono destinate a variare anche le esigenze in base alle quali il contenuto di detto diritto è parametrato. In tale ottica, la possibilità che esso circoli, seppure con il consenso del nudo proprietario, porterebbe a rendere variabile la portata stessa del diritto, con conseguente violazione del principio di tipicità e del numerus clausus dei diritti reali, in quanto risulterebbero alterati gli aspetti caratterizzanti della disciplina tipica dell'istituto. Qualora si ritenessero accoglibili siffatte osservazioni, dovrebbe conseguentemente ritenersi che il divieto di cui all'art. 1024 cod. civ. sia inderogabile anche con il consenso del nudo proprietario contro interessato. Il principio della tipicità e del numerus clausus dei diritti reali, infatti, è posto a tutela di interessi di carattere generale, ed ha dunque valenza pubblicistica. Tale principio, come noto, risponde all'esigenza di consentire ai terzi di essere preventivamente a conoscenza dell'esistenza di pesi o vincoli opponibili erga omnes, con conseguente tutela del commercio giuridico; persegue inoltre l'utilità socio-economica di salvaguardare, per quanto possibile, la libertà, l'assolutezza e la pienezza della proprietà fondiaria, ed assurge dunque a principio di rilevanza costituzionale. Altro fondamento del divieto è stato, inoltre, riscontrato in via indiretta nel disposto di cui all'art. 1372 c. 3 cod. civ., per cui è inibita alle parti la stipulazione di contratti ad effetti reali oltre i casi previsti dalla legge. Inoltre, i fautori dell'inderogabilità del divieto ritengono che non sia applicabile al diritto d'abitazione la disciplina che consente il trasferimento dell'usufrutto per un certo tempo o per tutta la sua durata, se non vietato dal titolo costitutivo (art. 980 cod. civ.), mancando in tal caso la compatibilità tra discipline richiesta dall'art. 1026 cod. civ. Nell'usufrutto, infatti, la tutela del nudo proprietario deriva dal fatto che la durata massima del diritto gravante sull'immobile di sua titolarità è ancorata alla durata dell'originario usufrutto su esso costituito. Conseguentemente la cessione del diritto non rischierebbe di produrre una limitazione ulteriore al pieno estendersi delle facoltà proprietarie. Diversamente, in ipotesi di cessione del diritto d'abitazione, la mutevolezza dei bisogni del titolare e della sua famiglia non consente di riprodurre in via pattizia una limitazione del diritto di proprietà che risulti indifferente per il nudo proprietario: la coincidenza dei bisogni del cedente e della sua famiglia con quelli del cessionario e della sua famiglia, infatti, rappresenterebbe un dato verificabile solo a posteriori. La difficoltà di conciliare il patto in deroga al divieto di cessione del diritto d'abitazione con il principio di tipicità dei diritti reali ha condotto parte della dottrina a giustificarne l'ammissibilità ritenendo che esso trasformerebbe il diritto d'abitazione in un altro diritto reale (con conseguente mancata creazione di un diritto reale atipico). In tale ottica, in sede interpretativa potrebbe ritenersi che, con la stipulazione del patto di libera trasferibilità, le parti abbiano inteso in realtà costituire un diritto d'usufrutto, ovvero stipulare un contratto di comodato o di locazione, o che comunque tale diverso diritto esse avrebbero inteso costituire qualora fossero state a conoscenza della nullità del patto (arg. ex art. 1424 cod. civ.). Diversa dall'ipotesi del preventivo patto di cedibilità è quella del trasferimento del diritto con contestuale costituzione in atto di nudo proprietario ed habitator. In tal caso, infatti, il trasferimento potrebbe ottenersi attraverso una rinuncia abdicativa ( la quale deve avere forma scritta art.1350 n.5 e deve essere trascritta ai sensi dell'articolo 2643 n.5) da parte dell'habitator al proprio diritto, con conseguente espansione della nuda proprietà in proprietà piena in virtù del principio di elasticità del dominio. Alla luce di tali premesse, può osservarsi quanto segue. L' intrasferibilità di un diritto reale viene ad incidere anche sulla valutazione del legislatore in ordine all' ipotecabilità del medesimo. La non assoggettabilità ad ipoteca non è conseguenza necessaria dell'inalienabilità, e in diversi casi, pur essendo prevista l'intrasferibilità del diritto, non si esclude che il diritto stesso possa essere ipotecato. Tuttavia, qualora l'intrasferibilità sia connessa, come nel caso dell'abitazione alla natura del diritto, e dunque all'esigenza di preservarne l'identità, che sarebbe invece compromessa dalla circolazione del diritto, le medesime ragioni che valgono ad escluderne l'alienabilità assumono valore determinante anche al fine di escluderne l'assoggettabilità ad ipoteca. E' pacifico l'orientamento secondo il quale il diritto di abitazione, come quello d'uso e il diritto di servitù, non può essere oggetto di ipoteca in quanto non è ricompreso nell'elencazione dell'articolo 2810 del codice civile. L'ipotecabilità di tale diritto non è prevista nemmeno da leggi speciali. Pertanto deve ritenersi che il diritto di abitazione sia inidoneo ad essere oggetto d'ipoteca anche a causa del suo carattere inalienabile. Nel secondo capitolo è stato affrontato il diritto di abitazione spettante al coniuge superstite. La norma di riferimento, l'articolo 540 comma secondo, si trova, com'è noto, nella parte del libro II dedicato ai diritti spettanti ai legittimari e alla loro tutela, e la sua ratio - secondo la Corte Costituzionale (sentenza n. 310 del 26 maggio 1989) va ricercata nella tutela di interessi non patrimoniali quali la conservazione della memoria del coniuge scomparso, il mantenimento del tenore di vita, delle relazioni sociali e degli status symbols goduti durante il matrimonio. La natura giuridica dei diritti ex articolo 540 comma secondo non solo riveste notevole interesse teorico al fine di testare la "messa a punto" degli ingranaggi del complesso meccanismo successorio, ma costituisce un imprescindibile punto di partenza per affrontare - e provare a risolvere - tutte le implicazioni di carattere pratico ed operativo che si presentano all'operatore del diritto. Il diritto di abitazione si "attiva" solo in presenza di determinati presupposti: 1) viene, innanzitutto, in rilievo un PRESUPPOSTO SOGGETTIVO Deve infatti esistere un CONIUGE SUPERSTITE al momento dell'apertura della successione. Il presupposto soggettivo è rispettato anche se il coniuge superstite sia SEPARATO CONSENSUALMENTE o SENZA ADDEBITO? L'articolo 585 c.c. attribuisce al coniuge separato consensualmente o senza addebito gli stessi diritti successori spettanti al coniuge non separato, per cui dovremmo - sulla base di un'applicazione letterale e rigorosa della norma - affermare che ad esso spetti anche il diritto di abitare la casa familiare. Senonchè, in tal caso, risulta "imbarazzante" parlare di abitazione adibita a "residenza familiare" e la norma non avrebbe ragione di essere applicata, venuta meno la sua ratio così come individuata dalla corte costituzionale. 2) viene, poi, in rilievo, quale PRESUPPOSTO OGGETTIVO indispensabile per l'operatività della disciplina in oggetto, l'esistenza di una CASA ADIBITA A RESIDENZA FAMILIARE DI PROPRIETÀ DEL DEFUNTO O COMUNE. Coerentemenente dovrebbe anche sostenerne la sua TRASCRIVIBILITA' A ciò, tuttavia, si oppongono ragioni di ordine pratico: per l'esecuzione della formalità è necessario uno dei titoli previsti dall'articolo 2648 c.c. che, evidentemente, mancano ogniqualvolta si apra una successione legittima. ; The present work aims the purpose of analyzing certain aspects related to the real right of residence, with special reference to the prohibition of the sale of that right under article 1024 of the Civil Code. This issue is also closely related to other practical aspects, such as ipotecabilità and espropriabilità predicted real right. In particular appeared to be investigated preliminarily certain profiles of general questions about the right to housing, to the extent that they were functional reconstruction attempted to propose. To this end, they dealt with some aspects, such as the legal nature and assumptions subjective and objective, as it was considered preparatory to the continuation of the discussion. In particular, the exclusion of the right of 'house from the list of rights ipotecabili raised several issues in doctrine and in jurisprudence. The limitation of the right to meet the needs of its owner, in fact, on the one hand implies that his transfer to a third party could changing its content, with possible harm to the owner; the other implies that if the house appears wider than the needs dell'habitator, the owner will enjoy it for the excess: the holder of the real right of residence would not in fact entitled to oppose the interference of the owner, to the extent where this does not harassing the free enjoyment of the other part of the house. Also in this second profile emerges the personality of the report, being relevant to the owner the person of the right holder, with which it could also be having to live. These reasons are the rationale for the prohibition of the sale and lease of the right in question, pursuant to art. 1024 cod. civ. This prohibition is in turn the basis for exclusion of the right of residence (and use) the list of rights ipotecabili art. 2810 cod. civ. The realization of the cause of guarantee, in fact, implies that the situation substantially deducted as an object of the mortgage is alienable, unable to imagine a forced sale of the right of where this can not freely dispose of the holder. Probably this is also linked to the specification laid down by. 2810 n. 1) cod. civ., why are ipotecabili properties "that are on the market." The eligibility enrollment mortgage on the right of residence demands acknowledgment of its portability, so it is necessary to analyze the scope of the prohibition of the sale of such right place art. 1024 cod. civ. As mentioned, in fact, such a ban is placed in order to protect the position of the property owner, and therefore in defense of the interests of private nature: the rule would be applicable where it is otherwise entitled constitutive, while with the agreement owner and habitator could be foreseen a more or less free transferability, thanks to permission from the legal provision is intended to protect. About it has been argued that the prohibition of the sale not only is willing to protect the position of the bare owner, but is part of the content of the law, because the variation of the holder are intended to vary the demands under which the content of that law is equated. In this context, the possibility that it circles, albeit with the consent of the bare owner, would make variable the scope of the right, resulting in violation of the principle of typicality and the quantitative ceiling of the real rights, as would be altered the characteristic features typical of the discipline of the institute. If you consider it acceptable in such observations should therefore be concluded that the prohibition in Article. 1024 cod. civ. is unavoidable even with the consent of the bare owner against concerned. The principle of typicality and the quantitative ceiling of real rights, in fact, is designed to protect the interests of a general nature, and therefore value journalism. This principle, as is known, meets the need to enable third parties to be previously aware of the existence of weights or constraints opposable erga omnes, resulting in protection of the legal trade; also pursues the socio-economic utility to preserve, as far as possible, the freedom, the absoluteness and fullness of landed property, and then rises to the principle of constitutional significance. Another basis for the prohibition was also found indirectly in the provision of art. 1372 c. 3 cod. civ., it is inhibited to the parties entering into contracts with real effects beyond the cases provided by law. Moreover, proponents of the ban dell'inderogabilità believe that it is not applicable to the right of residence discipline that allows the transfer of the usufruct for a time or for its entire duration, if not prohibited by the title of incorporation (art. 980 cod . Civ.), lacking in this case the compatibility between disciplines required by art. 1026 cod. civ. Nell'usufrutto, in fact, the protection of the bare owner comes from the fact that the maximum duration of the right levied on the property in its ownership is anchored to the duration of the original usufruct of it consists. Consequently, the transfer of the right might not produce a further limitation to the full extend of the proprietary right. Otherwise, in the event of transfer of the right to housing, the changing needs of the owner and his family can not play on a covenantal a limitation of the right to property that is indifferent to the bare owner: the coincidence of the needs of the transferor and of his family with the assignee and his family, in fact, represent a verifiable data only in retrospect. The difficulty of reconciling the pact in derogation from the prohibition of the sale of the right of residence to the principle of typicality of property rights has led some commentators to justify their eligibility believing that it would transform the right of residence in another real right ( resulting in failure to create a real right atypical). In this context, in the interpretative could be considered that, with the signing of the pact of free transferability, the parties intended to actually be a right to use, or enter into a contract of loan or lease, or that such a different law they would be understood if they had been aware of the invalidity of the covenant (arg. art. 1424 cod. civ.). Different from the hypothesis of the budget pact transferability is that of the transfer of the right with simultaneous constitution in place of bare owner and habitator. In this case, the transfer could be obtained through a waiver abdicativa (which must be in writing and must be transcribed art.1350 n.5 under Article 2643 # 5) by dell'habitator his right, resulting in expansion of the bare property in full ownership by virtue of the principle of elasticity domain. In light of the foregoing, it can be observed the following. The 'non-transferability of a real right is to affect also the assessment of the legislature in order to' ipotecabilità thereof. The not being subject to mortgage is not necessary consequence inalienability, and in several cases, even though there is the non-transferability of the right, it is possible that the law itself may be mortgaged. However, where the non-transferability is connected, as in the case of the dwelling to the nature of the right, and therefore the need to preserve the identity, which would be affected by the movement of the right, the same reasons as apply to exclude the alienability take decisive value also in order to exclude the liability to mortgage. And 'peaceful orientation according to which the right to housing, such as the right of use and easement, can not be the subject of mortgage as there is included in listing of Article 2810 of the Civil Code. The ipotecabilità of this right is not provided even by special laws. Therefore, it must be held that the right to housing is unfit to be the subject of mortgage also because of its inalienable character. In the second chapter was addressed the right to housing payable to the surviving spouse. The reference standard, Article 540 paragraph two, is, as is well known, in part II of the book devoted to the rights due to the heirs and their protection, and its ratio - according to the Constitutional Court (judgment no. 310 of 26 May 1989) to be found in the protection of non-pecuniary interests such as the conservation of the memory of deceased spouse, maintaining the standard of living, social relations and status symbols enjoyed during the marriage. The legal nature of the rights under Article 540 paragraph two not only of considerable theoretical interest in order to test the "fine tuning" of the gears of the complex mechanism of inheritance, but is an essential starting point to address - and try to solve - all practical and operational implications that are presented to the operator's right. The right to housing is "active" only under certain conditions: 1) is, first, raised a ASSUMPTION SUBJECTIVE Must in fact exist a SURVIVING SPOUSE upon opening of the succession. The subjective condition is fulfilled even if the surviving spouse is a separate agreement or WITHOUT CHARGE? Article 585 of the Civil Code attaches to the separated spouse or consensually without charge the same inheritance rights pertaining to the spouse not separated, so we should - based on a literal application of the standard and rigorous - say that it is also entitled the right to inhabit the family home. Le aree protette sono quei territori sottoposti ad uno speciale regime di tutela e di gestione, nei quali si presenta un patrimonio naturale e culturale di valore rilevante. Nel presente lavoro si è presa in esame la pianificazione della Riserva Naturale di Tuscania (provincia di Viterbo, alto Lazio), con gli obiettivi di: conservazione dei valori ambientali e di sviluppo economico sostenibile, come disposto della legge istitutiva L.R. 29 del 1997. La sfida è quindi quella di riuscire a promuovere nelle aree protette uno sviluppo economico e sociale rispettoso della conservazione dei ritmi e dei valori della natura, ma allo stesso tempo capace di favorire il rilancio degli antichi saperi artigianali e la creazione di nuove professionalità nel campo dei beni ambientali e culturali e delle attività turistiche compatibili. Si è esaminato lo stato ambientale della Riserva Naturale di Tuscania, rilevando lo stato della flora e della fauna presente, l'ambiente fisico e l'archeologia, lo stato del centro storico (che è all'interno della Riserva), e gli impatti dell'attività agricola delle attività antropiche presenti, cercando di arrivare ad una zonazione della Riserva che rispetti le vocazionalità del territorio. Il coinvolgimento degli Enti per la realizzazione del piano d'assetto della Riserva Naturale di Tuscania, è stato continuo e costruttivo ed ha visto nell'ufficio del parco (istituito verso la fine del 2004), un punto di riferimento per tutti i cittadini di Tuscania e non solo. Quindi compito della gestione sostenibile è quello di regolare l'uso degli ecosistemi e delle risorse su livelli che siano tollerabili dal sistema e che quindi non depauperino le risorse a nostra disposizione. Per la Riserva Naturale di Tuscania è stato predisposto un SIT-GIS per gestire e rielaborare, tutte le informazioni che sono state raccolte nella fase di indagine dello studio scientifico, per definire le vocazioni analizzando tutti gli aspetti caratterizzanti il territorio dell'area naturale,percependola non come una parte geografica a se, ma inserendola nel più vasto concetto di pianificazione intercomunale, provinciale, regionale e nazionale. Il ruolo fondamentale della zonazione è quindi, quello di garantire la conservazione dei valori del territorio assegnando vincoli di tutela diversi alle diverse zone. Lo studio effettuato ha evidenziato la vocazione della Riserva Naturale di Tuscanica (RNT), che è di "parco rurale", che vede nel paesaggio culturale, ovvero storicamente influenzato dall'uomo, la peculiarità principale. A questa si aggiunge la propensione a "parco archeologico", date le antichissime vicende di questo territorio, importante centro etrusco. Dallo studio è emerso che al centro della problematica ambientale c'è il fiume Marta, che scorre nel cuore della Riserva da nord a sud. Il Marta è profondamente perturbato dalla regolazione del lago di Bolsena (paratoie all'incile), dalle centrali idroelettriche ENEL, che interrompono per lunghi e numerosi tratti il corso medio-alto del fiume Marta e dalla presenza di prese irrigue lungo il suo corso. La qualità delle acque è modesta, con ripercussioni sulla microfauna (indice IBE) che sui pesci. Ad appesantire il carico sul fiume c'è anche una cartiera ed il depuratore comunale che oltre gli scarichi civili sopporta anche le acque nere del mattatoio. Per quanto riguarda le fonti diffuse agricole di inquinamento, il problema non appare di estrema urgenza, se non altro paragonato a quanto esaminato sino ad ora, sulle altre fonti di inquinamento; se ne può dedurre quindi, che le attività agricole presenti ad oggi nella RNT possono essere ascritte alla categoria delle pratiche compatibili, nel senso che attribuisce a tale termine la legge 394/1991 e la L.R. 29/1997 (art. 26). Ma la normativa, troppo indirizzata verso una zonazione riferita quasi esclusivamente sul tasso di antropizzazione del territorio, ha reso abbastanza difficoltoso il compito di assegnazione delle zone e sottozone alla RNT. Le disposizioni da rispettare derivano: della legge regionale istitutiva n. 29/97, delle Linne Guida della Regione Lazio e dello schema standard della Regione. Il problema fondamentale della zonazione è quello di cadere facilmente in una separazione netta tra gli habitat, causando quindi una disomogeneità interna all'area protetta. Allo stesso modo, si creano disomogeneità esterne nel momento in cui il parco diventa un'area avulsa a tutto quello che è esterno ai propri confini. A tale scopo, il Piano di Assetto redatto propone un Agenda 21 per permettere agli enti locali di poter gestire in modo compatibile ed unitario la questione ambientale attraverso una polita locale che abbia come obiettivo comune una condivisione di responsabilità per uno sviluppo sostenibile. Ad oggi le restrizioni dettate delle norme di salvaguardia limitano in maniera seria lo sviluppo di Tuscania. Ciò fa avvertire la Riserva come un ente burocratico, un soggetto vincolate lo sviluppo del territorio. Per tali ragioni si auspica una celere approvazione del PdA da parte della Provincia di Viterbo e della Regione Lazio, in modo da poter permettere alla RNT di sviluppare tutte le azioni finalizzate alla tutela e conservazione dell'ambiente ed allo stesso tempo, la concretizzazione di uno sviluppo sostenibile per il territorio. ; The protected areas are those territories subordinates to a special program of protection and management, in which is present a natural and cultural patrimony of important value. In the present job the planning of the Natural Reserve of Tuscania, (country of Viterbo, north Lazio), has been considered with objects of conservation of the environmental values and sustainable economic development, like disposed of law L.R. 29 of 1997. The challenge is to promote in the protected areas an economic development and in the same time conservation of the rhythms and the values of the nature. We examined the state of the flora and the fauna present in the Reserve, the physical atmosphere and archaeology, the state of the historical center (that is inside of the Reserve), and the impacts of the agricultural activity and the anthropic activities present, trying to arrive to a zonation of the Reserve who respect the vocation of the territory. The involvement of the Pubblic Agencies for the realization of the plan in order of the Natural Reserve of Tuscania, has been continuous and constructive and has seen in the office of the park (instituted towards the end of 2004), a point of reference for all the citizens of Tuscania and not only. Therefore, task of the sustainable management is to regulation the use of the ecosystems and the resources on levels that are tolerable from the system and that respect the resources to our disposition. For the Natural Reserve of Tuscania it has been predisposed a SIT-GIS in order to manage all the informations that have been collections in the phase of surveying of the scientific study, in order to define the vocations, analyzing all the characterizing aspects of the territory of the natural area, perceiving it not like a geographic part but inserting in the immensest concept than intercomunale, provincial, regional and national planning. The fundamental role of the zonation is therefore to guarantee the conservation of the values of the territory being assigned various ties of protection to the various zones. The study has evidenced the vocation of the Natural Reserve of Tuscania (RNT), that it is of "rural park", that sees in the cultural landscape, that is historically influenced from the man, the main peculiarity. To this joins the vocation "to archaeological park", like an important Etruscan center. From the study it is emerged that to the center of the problematic is the Marta river, that slides in the heart of the Reserve from north to south. The Marta is disturbed from the regulation of the lago of Bolsena (floodgates to the incile), from hydroelectric centers of ENEL, that they interrupt for long and numerous features the uppermiddle course of the Marta river. The quality of waters is modest, with repercussions on the microfauna (index IBE) that on the fish. To weight down the cargo on the river there is also one paper factory and the communal water conditioner for the civil drainages and also black waters of the slaughterhouse. As far as the diffused sources of agricultural pollution, the problem does not appear of extreme urgency, if not other compared with the other pollution sources; can some deduce therefore, that the agricultural activities presents today to the category of the compatible ones, in the sense that attributes to such term the law 394/1991 and L.R. 29/1997 (art. 26). But the norm, too much addressed towards a zonation reported nearly exclusively on the rate urbanization of the territory, has rendered enough difficult the task of allocation of the zones and subzones to the RNT. The dispositions to respect derive: of the institutive regional law n. 29/97, of the guide line of the Lazio Region and the outline standard of the Region. The fundamental problem of the zonation is that easy falling in one clean separation between the habitats. To such scope, the Plan in Order proposes an Agenda 21 in order to allow to the local agencies of being able to manage in compatible way the environmental system through one local politicy that has like common objective a sustainable development. Today the restrictions dictated of the safeguard norms, limit seriously the development of Tuscania. That makes to perceive the Reserve like a bureaucratic agency, a subject bound the development of the territory. For such reasons hope a quick approval of the PdA from part of the Country of Viterbo and the Lazio Region, so as to be able to allow the RNT to develop a sustainable development for the territory.
Dottorato di ricerca in Storia e cultura del viaggio e dell'odeporica in età moderna ; Expedition into Sicily di Richard Payne Knight, il testo argomento della presente tesi di dottorato, è il resoconto del viaggio svolto in Sicilia, sul finire del diciottesimo secolo, da un ricco inglese accompagnato da due altrettanto benestanti acquarellisti: il noto paesaggista tedesco Philipp Hackert e il ricco dilettante inglese Charles Gore. Creduto perso per più di due secoli, il manoscritto di Knight fu ritrovato soltanto nel 1980 e pubblicato nella sua interezza per la prima volta nel 1986. Scopo del mio lavoro di tesi è far conoscere quest'opera - a lungo considerata come 'minore' - al pubblico italiano attraverso una traduzione critica e metterne in luce l'originalità così come la coerenza interna. Rifacendomi agli studi di chi mi ha preceduto, ho infatti cercato di dimostrare la sostanziale unitarietà del testo, insieme al fatto che tale unitarietà avesse lo scopo di veicolare un messaggio ben preciso: la libertà è condizione necessaria per l'eccellenza umana. Si tratta di un messaggio di chiara matrice illuminista: il giovane Knight – illuminista convinto – legge il suo viaggio attraverso la Sicilia classica come un ritorno alle origini della cultura occidentale, un viaggio a ritroso nel tempo fino all'ideale Winkelmaniano di nobile semplicità e quieta grandezza. Il suo ritorno alle origini è però ostacolato dalla realtà della Sicilia del diciottesimo secolo. L'esperienza del presente va insinuandosi progressivamente nella sua concezione di un passato ideale, imponendo allo sguardo attento di Knight una realtà fatta d'ignoranza e miseria. Queste condizioni sono state portate dall'azione di una classe dirigente e di un clero troppo potenti e corrotti e quindi, in ultima analisi, dalla mancanza di libertà. Nei passaggi della Expedition che descrivono le sue esperienze di viaggio (che caratterizzano almeno due terzi del testo), Knight analizza questa dicotomia tra passato e presente e infine, nella parte finale, dà una forma più generale alle sue idee, fino a giungere alla conclusione che la Sicilia moderna potrebbe tornare alla grandezza delle origini soltanto in seguito a un moto rivoluzionario che coinvolgesse l'intera Europa. E' interessante notare come queste riflessioni precedano di pochi anni la Rivoluzione Francese che però, pur avendo alterato profondamente gli equilibri europei, non fu sufficiente per far emergere la Sicilia dalla sua arretratezza. Il primo capitolo della tesi riporta la traduzione integrale in italiano della Expedition into Sicily con testo inglese a fronte. Il secondo capitolo: L'autore, l'argomento e la storia del manoscritto, è suddiviso in due sezioni. La prima sezione [2.1]: Notizie sulla vita e le opere di Richard Payne Knight, si propone di inquadrare la figura dell'autore del diario e fornire una panoramica sulle sue opere, mentre la seconda sezione [2.2]: Il lungo viaggio di un diario di viaggio ricostruisce, sulla base di dati oggettivi e congetture, la genesi e la storia del manoscritto della Expedition. Il terzo capitolo: Il contesto del viaggio di Knight, tratta del contesto socio-culturale in cui si è svolto il viaggio in Sicilia ed è composto da cinque sezioni. La prima sezione [3.1]: Il contesto storico: dall'Inghilterra alla Sicilia, descrive brevemente la situazione storico-politica dell'Europa, dell'Inghilterra, dell'Italia e della Sicilia in pieno periodo di rivoluzione industriale e dopo la Pace di Utrecht. La seconda sezione [3.2]: Il contesto filosofico: l'Illuminismo inglese e il pensiero di Knight, traccia le linee generali dell'Illuminismo europeo, inglese e italiano che influenzarono Knight prima, e durante e dopo il viaggio in Sicilia. La terza sezione [3.3]: Il contesto artistico: alla riscoperta dei classici tra luci ed ombre, fornisce cenni sul contesto culturale e artistico sia europeo che inglese di quegli anni, soffermandosi in modo particolare sugli autori che svilupparono teorie per definire tali stili. La quarta sezione [3.4]: Il problema del tempo nel Settecento, tratta del dibattito scientifico sul significato e sull'età dei fossili collegato, a sua volta, a quello dell'età della Terra. Si tratta del principale dibattito scientifico del Settecento ed influenza l'idea del tempo, della storia e della geologia di Knight. La quinta sezione [3.5]: Il Grand Tour nella seconda metà del Settecento, presenta una panoramica sulle condizioni logistiche del viaggio in Italia e le motivazioni dei Grand Tourists. Il quarto capitolo: L'analisi del testo e il pensiero di Knight, si suddivide in due sezioni. La prima sezione [4.1]: Analisi del testo, ripercorre brevemente le tappe del viaggio di Knight, approfondisce le scene del diario che si rifanno al pittoresco letterario ed ai caratteri sociali dei siciliani e traccia le conclusioni finali del viaggio. La seconda sezione [4.2]: Gli stereotipi sull'Italia, discute la posizione di Knight su alcuni luoghi comuni che i viaggiatori del suo tempo avevano sugli italiani ed, in particolare, sui siciliani. Infine, aspetti di non stretta attinenza con l'argomento del presente lavoro, ma da me trattati in altra sede, hanno incontrato l'interesse e l'epprezzamento della comunità scientifica internazionale. Si tratta, in particolare, dello studio presentato a Malta in occasione del convegno Encountering Malta: British Writers and the Mediterranean 1760-1840 (novembre 2011), in cui ho proposto un'interpretazione originale del pensiero storico di Knight, collegandolo con quello del noto storico inglese suo contemporaneo Edward Gibbon. Il lavoro è stato accettato per la pubblicazione dalla rivista The Wordsworth Circle. ; Expedition into Sicily by Richard Payne Knight, the text subject of this PhD thesis, is the account of the journey through Sicily taken, at the end of the Eighteenth Century, by a rich Englishman, together with two equally wealthy watercolorists: the renowned German landscape painter Philipp Hackert and the English amateur Charles Gore. Believed lost for more than two centuries, Knight's manuscript was rediscovered only in 1980, and published for the first time in English in 1986. Aim of my thesis is to introduce this work to the Italian audience through a critical translation, and to point out its originality as well as its internal coherence. Referring to the studies of those who preceded me, I have tried to demonstrate the substantial unity of the text, along with the fact that this internal consistency was intended to convey a very precise message: freedom is a necessary condition for human excellence. This is a message clearly influenced by Enlightenment culture: the young Knight saw his journey through Sicily as a return to the classical origins of Western culture, a journey back in time to the Winkelmanian ideal of noble simplicity and quiet grandeur. His return to the origins, however, was hampered by the reality of Eighteenth Century Sicily. The experience of the present crept gradually into his conception of an ideal past, imposing to his watchful eye a reality of ignorance and misery. These dramatic conditions had been brought by a corrupted ruling class and a too powerful clergy, in other words by a lack of freedom. In the analysis of the scenes depicting his travel experiences (featuring at least two thirds of the text), Knight examines the dichotomy between past and present, and finally, in the end, he gives a more general form to his ideas, coming to the conclusion that Sicily could return to the greatness of its origins only after a revolutionary movement involving the whole of Europe. It's interesting to note that these reflections preceded of a few years the French Revolution, which, despite having profoundly altered the European balance, was not enough to bring out the Sicily from its backwardness. The first chapter of the thesis contains the complete translation of the Expedition into Sicily in Italian with the English text opposite. The second chapter: The author, the topic, and the history of the manuscript, is divided into two sections. The first section [2.1]: The life and works of Richard Payne Knight, intends to frame the figure of the author of the diary and provide an overview of his works, while the second section [2.2]: The long journey of a travel diary reconstructs, on the basis of objective data and conjectures, the genesis and history of the manuscript of the Expedition. The third chapter: The context of Knight's trip, traces the socio-cultural context of the trip to Sicily and is composed of five sections. The first section [3.1]: The historical context: from England to Sicily, briefly describes the historical and political situation of Europe, England, Italy and Sicily at the height of the Industrial Revolution and after the Peace of Utrecht. The second section [3.2]: The philosophical context: the English Enlightenment and the thought of Knight, traces the general lines of the European, English and Italian Enlightenment that influenced Knight before, during and after his trip to Sicily. The third section [3.3]: The artistic context: the rediscovery of classics between lights and shadows, provides an outline of the cultural and artistic contexts of the second half of the Eighteenth Century, focusing in particular on the authors who developed theories to define concepts like Beauty, Picturesque and Sublime. The fourth section [3.4]: The problem of time in the Eighteenth Century, focuses on the scientific debate on the significance and the age of fossils, which is linked, in turn, to the age of the Earth. This was the main scientific debate of the Eighteenth Century and it influenced Knight's ideas on time, history and geology. The fifth section [3.5]: The Grand Tour in the second half of the of the Eighteenth Century, presents an overview of the logistical conditions of travel in Italy and the motivations of the Grand Tourists. The fourth chapter: The analysis of the text and of Knight's thought, is divided into two sections. The first section [4.1]: Text Analysis, briefly reviews the stages of Knight's journey, discusses the scenes of the Expedition referring to the literary picturesque and to the social characteristics of Sicilians and, finally, draws the final conclusions of the trip. The second section [4.2]: The stereotypes about Italy, discusses Knight's position on some clichés that the travelers of his time had on Italians and, in particular, on Sicilians. Finally, aspects not strictly relevant to the topic of this work, which I have treated elsewhere, have met the interest and appreciation of the international scientific community. This is, in particular, the study presented at the conference in Valletta Encountering Malta: British Writers and the Mediterranean 1760-1840 (November 2011), in which I have proposed an original interpretation of Knight's historical thought, connecting it with that of the English historian Edward Gibbon's. The work has been accepted for publication by the journal The Wordsworth Circle.
Trumpai apžvelgus UNESCO apibrėžtas skirtingas paveldo tipologijas, dėmesys skiriamas įvairioms kul- tūros vertybėms, kurios, nors ir nepriskiriamos "pagrindinėms" paveldo kategorijoms, simbolizuoja reikšmingą paveldo turtą, siūlantį, be savo įprastos paskirties, daugybę galimybių, kaip jį būtų galima pritaikyti "netradi- cinėms" pridėtinę vertę kuriančioms paslaugoms. Įžanginiame skyriuje pateikiami pavyzdžiai, iliustruojantys netradicinį kultūros paveldą: istorinis maršrutas "Rytų ekspresas", mėlynasis tramvajus Tramvia Blau ar funi- kulierius Tibidabo Funicular Barselonoje; parkai, sodai ir žaliosios erdvės kaip išskirtinių renginių vietos; ypa- tingos ar nykstančios augalijos ir gyvūnijos buveinės; istoriniai piligrimų keliai Via Francigena, El Camino de Santiago de Compostela ir Camí de Cel de Barcelona; Italijos asociacijos Italian Alpine Club (CAI) organizuo- jami Dolomitų kelias ir kalnų žygiai; kruizai, istoriškai reikšmingi komerciniai ir kariniai maršrutai, pavyzdžiui, Viduržemio jūros ir Baltijos jūros turai, maršrutai į Indiją; tradiciniai šou, koncertai, operos, muzikos / šokių renginiai ir ritualai; sausumos ir jūros augalija bei gyvūnija, kuriai gresia išnykimo pavojus; pajūrio ir pakrančių paveldas, pavyzdžiui, švyturiai, istoriniai uostai ir pan. Daugelyje Europos šalių "kultūros paveldui" gali būti priskiriami ir artefaktai, žmonių atrasti daugiau nei prieš 50 metų. Taigi į paveldo apsaugą gali pretenduoti daug įvairių objektų – nuo pirmojo bakelitinio radijo imtuvo ir pokarinių automobilių iki elektroninės kompiuterių įrangos ir dizaino kūrinių. Jeigu etno- gra nės kolekcijos, daug kartų žiūrėtos kino juostos ir TV įrašai taip pat vertinami kaip papildomi elemen- tai (saugomi jau beveik 60 metų), tuomet visa tai sudaro nepakeičiamą ir saugotiną informacijos "šaltinį", kurį dera perduoti ateinančioms kartoms. Be materialiojo paveldo, derėtų saugoti ir nematerialųjį paveldą, pavyzdžiui, muziką, šokius, ritualus, pasakas ir pan., taip pat naujausią, bet ne mažiau svarbų "ateities" pa- veldą. Apsidairius aplink XXI a. ateities muziejus kuratoriaus akimis, gali iškilti pagrįstas klausimas: "Ar ateities kartos, net ir artimos ateities kartos, sugebės suprasti dabartinės kartos kuriamą turinį?" Trumpai panagrinėjus milžiniškus ir įvairialypius paveldo klodus galima užduoti vieną svarbiausių klausimų: "Kaip užtikrinti tinkamą paveldo naudojimą, valorizaciją ir valdymą?" Nepakanka vien tik vadovautis esamu scenarijumi. Būtina pasirengti susitikti su ateities paveldu, galinčiu tapti tikru iššūkiu būsimiems kolekcio- nieriams ar kuratoriams. Paveldas turi daugybę funkcijų ir daugybę vertybių, tad verta gerai ištyrinėti šiuos daugiamačius ir turtingus klodus, kad būtų galima pasinaudoti visais jų teikiamais privalumais. Šiai už- duočiai veiksmingai ir kokybiškai atlikti yra būtina metodologija. "Verčių" požiūrio taikymas analizuojant paveldą galėtų prisidėti sprendžiant problemas ir užtikrintai pagrįsti paveldo išsaugojimo, apsaugos ir val- dymo strategijos apibrėžimą. Šis straipsnis supažindina su logišku požiūriu, nustatant ir grupuojant platų paveldui priskiriamų vertybių spektrą. Nuodugniai išanalizavus vertybes (pradedant nuo akivaizdžiausių), nustatomos naujos vertybės, kurios yra (tiesiogiai) susijusios su inovacijomis ir technologijomis. Vertybių, kurias galima priskirti kultūros paveldui, kiekis didėja, daugėjant suinteresuotųjų šalių, kurios laikomos paveldo naudojimo, konservavimo ir valdymo proceso dalyvėmis. Priimant su paveldu susijusius spren- dimus ir reaguojant į skirtingų suinteresuotųjų šalių poreikius, šių vertybių apibrėžimas yra lemiamas iš esmės dėl to, kad šios vertybės padeda nustatyti konkrečios teritorijos patrauklumo lygį. Kultūros paveldo samprata remiasi įvairialype paklausa, kurią būtina atpažinti visose sudėtinėse kultūros paveldo dalyse, norint nuodugniai ištyrinėti vertybių klodus, kuriuos (kaip bus pristatoma toliau) riboja skirtingi diferen- cijuotos paklausos poreikiai. Norint pasiekti šį tikslą reikia apibrėžti įrankius bei metodus, padėsiančius nustatyti ir vertinti kultūros paveldą atsižvelgiant į skirtingas jam priskiriamų vertybių perspektyvas. Kie- kviena konkreti vertybė išsamiai aprašoma, kad būtų lengviau atlikti atskiro atvejo analizę. Nepaisant visų nukrypimų, plačiąja prasme aiškinama Europos kultūros paveldo idėja perteikia šias vertybes: istorines, atminties, pilietybės, civilizacijos, pripažinimo, tradicijų, meno, mokslo, konservavimo ir technologines. Suvokti vertybių ir kitų skirtingų dalių esmę yra įmanoma pripažįstant ir veiksmingai naudojant mūsų palikimą, vertinant jį kaip sistemą sąveikų tarp įvairių aspektų: paveldo tipologijos (gamtinės, kultūrinės, . nematerialios, . ateities); daugybės "verčių" (ekonominių, investicijų grąžos, socialinių, kultūrinių, išskirtinumo / unikalu- mo ir pan.); geogra nių ypatumų (vertingumo vietinių požiūriu, nacionalinių, regioninių, globalinių, daugiau- sia nevietinių ir pan.); potencialių naudotojų / galutinių naudotojų (ekspertų, specialistų, kolekcionierių, verslininkų, miesto gyventojų, tyrėjų, bendruomenės narių ir pan.). Didžioji dalis šių vertybių yra "potencialios"; kartais nėra galimybių ar poreikio nustatyti jų piniginę išraišką. Daugeliu atvejų išlaidas dengiantis subjektas nėra tas, kuris daug uždirba iš kultūros paveldo "naudojimo", čia susiduriama su savotišku asimetrinės rinkos modeliu. Visuomenės reikmėms skirto kul- tūros paveldo atveju "verčių" "rezultatais" dalijasi skirtingi vertybių grandinės dalyviai, o kultūros paveldą prižiūrinti valstybinė institucija tarp jų būna ne visada. Kartais visas vertybių spektras neatrodo akivaizdus (bent jau) vadovams arba nemanoma, kad būtų tinkama ar "išmintinga" šiomis vertybėmis pasinaudoti. Tokių vertybių naudojimas nebūtinai turi kelti pavojų mūsų paveldui – kultūros vertybės nesivaržo tar- pusavyje, išmintingai jas naudojant, jos nebus "suvartotos". Netgi priešingai, aiškiai apibrėžus vertybių "vertę", jas būtų lengviau atpažinti ir apsaugoti, suformuluojant bazines sąlygas jų tinkamam naudojimui užtikrinti. Toks scenarijus atrodo kaip visiems naudingas susitarimas: miesto gyventojai gali pasinaudoti visais efektyvaus paveldo naudojimo teikiamais privalumais, o suinteresuotosios šalys – džiaugtis didesniu matomu ir išaugusiomis pajamomis. Sėkmingai įdiegtoje sistemoje būtų numatytas struktūrinis vertinimo procesas, atsižvelgiantis ir į speci nes vertinimo procedūras bei rodiklius, ir į ekspertus, prisidedančius prie šios blokinės schemos kūrimo. The introduction provides a selection of examples concerning unconventional cultural assets such as the historical trans- portation means Orient Express, Tramvia Blau or the Tibidabo Funicular in Barcelona; parks, gardens and green areas as scenarios of particular events or peculiar or extinct habitats of ora and fauna; historic itineraries such as via Francigena, El Camino de Santiago de Compostela and the Camí de Cel de Barcelona; the Dolomites and mountain hiking trails of the Italian Alpine Club (CAI); cruises, commercial and military routes important in history such as Mediterranean and Baltic routes, routes to India; traditional shows, concerts, opera, music/dances and rituals; land and marine ora and fauna considered to be at risk of extinction; maritime-coastal heritage such as lighthouses, historical harbours, etc. In many European countries, artefacts realised by human beings more than fty years ago are also considered potential 'Cultural Heritage'. Therefore, a variety of objects might be enlis- ted for protection such as the rst bakelite radio-set, post-war period cars, the early electronic computer equipment and design products. Furthermore, if ethnographic collections, many times movies and TV recordings are considered the complement pictures (that have already been pro- tected for almost sixty years), all of them constitute an irreplaceable 'source' of information to be protected and handed down to posterity. In addition to the tangible heritage, the intangible heritage such as music, dances, rituals, tales, etc. and last but not least the 'future' heritage should be preserved. If we look around in the shoes of a curator of a future museum of the 21st c., it is reasonable to ask ourselves 'Will future generations, even those of the near future, be able to access the content produced by this generation?' Having brie y explored the vast and heteroge- neous universe of heritage, one of the key questions posed to ourselves is 'How can we ensure a proper use, valorisation and management of it?' Along with the current scenario, we should be ready to deal with the future heritage that may represent a real challenge for future collectors or curators. As the heritage represents a multi-function and multi-value domain, there is a need to explore this multidimensional space in order to fully bene t from its richness. Thus, a metho- 129 130 dology enabling to complete the task in an e cient and productive way is required. Application of the 'value' approach in analysing heritage may contribute to solving the problem and provide a valid support in de ning a strategy to preserve, promote and manage it. The present paper outlines the logical approach for identi cation and clustering of the broad range of the values associated with the heritage. The in-depth analysis of values, starting from the more evident ones, leads to identi cation of a set of new values due to or directly connected with innovation and technologies. The plurality of values that can be associated with a cultural asset widens with the variety of stakeholders considered to participate in the process of heritage use, conservation and management. Establishing the values upon making decisions about the heritage and there- fore meeting the needs of di erent stakeholders is crucial, mainly due to the reason that such values contribute to identi cation of the degree of attractiveness of a given territory. The cultural heritage should be considered a system based on the heterogeneous demand to be recognised in its many components in order to investigate the value space throughout its extension that, as it will be outlined later, is delimited by di erent needs of the di erentiated demand; in order to do this, we need to identify and de ne tools and methods of measuring and evaluating the cultural heritage in the di erent perspectives of the value attributable to it. Each speci c value is outlined in detail to facilitate the implementation of the approach to a single case study. The concept of the European cultural heritage, interpreted in the broad sense and with all its declinations, is the bearer of a multitude of values: historical value, testimony, citizenship, civilization, recognition, traditions, artistic, scienti c, conservation and technology. The matter of values and the other di erent elements actively contributing to the overall appreciation and fruitful exploitation of our legacy might be considered a complex of interactions among the following di erent aspects: • Heritage typology (natural, cultural,. intangible,. future) • Wide set of 'values' (economic value, return of investment, social, cultural, exceptionality/uniquely, etc.) • Geographic range (valuable for locals, national, regional, global, non-local mainly, etc.) • Potential users/end users (experts, specialists, collectors, businessmen, citizens, researchers, community members, etc.) Major parts of these values are 'potential'; sometimes there is no chance or need to monetize them. It happens frequently that the one who covers the expenses is not the one who earns much money from the 'use' of the cultural asset, i.e. a kind of asymmetric market model is observed. In case of public cul- tural assets, the 'e ects' of the 'values' are shared among di erent actors in the value-chain, sometimes not including the public body looking after the cultural assets at all. Moreover, sometimes the full set of values is not evident at least to the managers or it is not considered proper or 'wise' to take advantage of them. The exploitation of such values will not necessarily jeopardize our heritage, cultural assets are not rivalling and a wise exploitation will not 'consume' them. On the contrary, a clear identi cation of their 'values' will help to identify and protect them developing the basic conditions to ensure a proper exploitation. Such a scenario looks like a win-win agreement: citizens may bene t from the fruitful exploitation of their own heritage, whereas stakeholders may bene t from enhanced visibility and inco- mes. The full implementation of the system foresees a structured evaluation process taking into account both speci c evaluation procedures, metrics and a network of experts providing their contribution in a kind of block chain architecture. In most cases, these values represent the ful lment of the present expectations of visitors and users. Dottorato di ricerca in Diritto dei contratti pubblici e privati ; La persistente inefficienza nell'utilizzo delle risorse umane nel settore del lavoro pubblico impone l'attenzione sul come la pubblica amministrazione stia tentando di rispondere alle nuove complesse problematiche poste a livello nazionale, internazionale e globale. In un mercato del lavoro in rapido sviluppo il settore del lavoro pubblico mostra una scarsa dinamicità ed una certa resistenza ad accettare soluzioni innovative. Si parla da molto tempo della necessità di innovare il rapporto di lavoro nel settore pubblico "privatizzato" e la pubblica amministrazione in generale, ma solo da ultimo il lavoro alle dipendenze delle pubbliche amministrazioni ha conosciuto uno stimolo all'uso dei fattori premiali e flessibili grazie all'introduzione della valutazione della performance. Innovare attraverso lo strumento della flessibilità contrattuale nel settore del lavoro pubblico significa raggiungere l'obiettivo dell'efficienza. Per questo bisogna indagare se il problema della mancata efficienza sia di carattere giuridico "contrattuale" o le ragioni vadano indagate anche rispetto ad una complessità progettuale che tenga conto della cultura e dei processi sociali. L'indagine, in questa sede, è finalizzata allo studio dell'adattabilità delle tipologie contrattuali di lavoro flessibile, utilizzabili per l'organizzazione e la gestione del personale nelle pubbliche amministrazioni. L'uso di tali tipologie è divenuto, combinato con la necessità di produttività ed efficienza, fondamentale per la politica di sviluppo delle pubbliche amministrazioni, ma soprattutto indispensabile per l'attuazione delle politiche di contenimento della spesa, (così dette di spending review), per il personale che, in modo particolare a partire dalla fine degli anni novanta, ha raggiunto un livello rilevante. Ciò ha generato una serie di provvedimenti limitativi tendenti a bloccare le nuove assunzioni nel tentativo di raggiungere nello stesso momento un contenimento dei costi ed una riduzione del personale ritenuto, non sempre a ragione, eccedente il fabbisogno, il tutto, ovviamente nel tentativo di incrementare l'efficienza dei servizi erogati. Per tipologie contrattuali flessibili di lavoro si intendono tutte quelle che differiscono dal contratto di lavoro subordinato a tempo pieno ed indeterminato, disciplinato dall'art. 2094 cod. civ. e definito contratto di lavoro standard. Partendo dalle linee guida tracciate dalla legge n. 15 del 4 marzo 2009, di riforma del pubblico impiego, sono state analizzate le misure che disciplinano le modalità attraverso le quali le pubbliche amministrazioni possono avvalersi delle tipologie contrattuali di lavoro flessibile. Per meglio inquadrare l'attuale riforma del lavoro nel settore pubblico privatizzato (in questo studio indicata come Terza Riforma) è necessaria la ricostruzione storica della disciplina normativa del rapporto di lavoro nelle pubbliche amministrazioni, prendendo le mosse in un'ottica efficientistica e passando attraverso l'evoluzione dei modelli contrattuali che l'hanno caratterizzata, partendo dal modello unilaterale e autoritativo fino ad arrivare al modello contrattuale pattizio e paritario. Attraverso questa ricostruzione è possibile individuare i principi fondamentali, quali l'efficienza dell'organizzazione delle pubbliche amministrazioni, l'intangibilità dell'organizzazione e del potere datoriale e la relativa responsabilità dirigenziale, la specialità dell'accesso agli uffici pubblici (anche in attuazione del principio costituzionale di uguaglianza contenuto nell'art. 3 e dell'imposizione della stessa Costituzione all'art. 97, co. 3, del concorso pubblico, salvo i casi di deroga stabiliti dalla legge, quale forma di reclutamento a garanzia dell'imparzialità della pubblica amministrazione), che sono il presupposto essenziale posto alla base del possibile utilizzo per le pubbliche amministrazioni sia dei contratti di lavoro standard sia dei contratti di lavoro flessibile. L'uso dei contratti di lavoro flessibile rappresenta uno strumento idoneo, quando inserito tra i vari strumenti ed obiettivi primari delle pubbliche amministrazioni, a garantire la migliore organizzazione degli uffici se finalizzato a perseguire il buon andamento della pubblica amministrazione, così come previsto dall'art. 97 della Costituzione. Grazie ad un opportuno utilizzo delle risorse umane diviene possibile raggiungere anche l'ulteriore obiettivo, primario per le pubbliche amministrazioni, del controllo delle risorse finanziarie. Una conoscenza approfondita della gestione delle risorse umane (dipendenti con contratto di lavoro standard e non) ed una attenta analisi del contesto di riferimento possono favorire una efficiente razionalizzazione delle risorse, non solo in merito all'organizzazione degli uffici e del lavoro, ma anche sul piano politico, economico e sociale, piani con cui fino ad oggi si è dovuto scontrare il datore di lavoro pubblico nell'uso delle tipologie contrattuali di lavoro flessibile inserite nella gestione del personale e delle risorse delle pubbliche amministrazioni. Non a caso l'art. 36 del decreto legislativo n. 165 del 2001, Testo Unico del Pubblico Impiego, ed in particolare il comma 3, così come da ultimo modificato dall'art. 17, comma 26, del decreto legge n. 78 del 2009, ha evidenziato che un sistema che preveda l'uso delle predette tipologie contrattuali come strumento di gestione per le pubbliche amministrazioni deve essere finalizzato a combattere gli abusi derivanti dal suo uso distorto. L'abuso e l'uso distorto delle tipologie contrattuali flessibili ha dato vita ad un intenso precariato, sanato ciclicamente dalle norme dette di "stabilizzazione" (norme che sono state oggetto di valutazione di legittimità costituzionale). Attraverso una attenta analisi dell'attuale contenuto dell'art. 36 del d.lgs. n. 165 del 2001 è possibile individuare, tenendo a mente la disciplina che regola il rapporto di lavoro nel settore privato, da una parte gli aspetti critici dell'impianto regolativo che consentono di verificare la distanza tracciata tra le discipline che permettono l'uso delle tipologie contrattuali di lavoro flessibile da applicarsi al datore di lavoro privato con quelle riservate al datore di lavoro pubblico, e dall'altra individuare quanto sia ancora presente nel rapporto di lavoro alle dipendenze delle pubbliche amministrazioni del modello unilaterale ed autoritativo che caratterizzava il rapporto di pubblico impiego prima della privatizzazione del rapporto di lavoro. Partendo dalla prima versione contenuta nel decreto legislativo n. 29 del 1993, dei primi due commi del citato art. 36, è possibile individuare il campo di applicazione dei rapporti giuridici derivanti dalla stipulazione dei contratti di lavoro flessibile ivi elencati. Sono così messe in risalto le diversità esistenti tra la disciplina prevista per i rapporti di lavoro alle dipendenze del privato datore di lavoro e la disciplina prevista per il pubblico impiego privatizzato. Grazie alla comparazione tra il contenuto delle norme che disciplinano ciascuna tipologia contrattuale flessibile inclusa nel contenuto dell'art. 36 d.lgs. n. 165/2001 ed il suo valore precettivo è stato possibile verificare la specialità che caratterizza il rapporto di lavoro nelle pubbliche amministrazioni e l'uso delle tipologie contrattuali flessibili. Il rinvio inserito nel secondo comma dell'art. 36 del d.lgs. n. 165/2001 al contenuto dei contratti collettivi nazionali di lavoro, che hanno il compito di disciplinare la materia dei contratti di lavoro a tempo determinato, dei contratti di formazione e lavoro, degli altri rapporti formativi e della somministrazione di lavoro, del lavoro accessorio e dei lavoratori socialmente utili, mette in luce la possibilità per l'autonomia collettiva di regolare ed integrare i singoli schemi contrattuali, realizzando, se così fosse, lo schema del modello contrattuale pattizio, ed evidenziando, in realtà, il limite costituito dall'essere circoscritta alla sola individuazione dei contingenti di personale da utilizzare. Una piccola parte dell'indagine è dedicata al lavoro a tempo parziale ed agli incarichi dirigenziali del personale inquadrato con contratto standard che, seppur inseriti nel contesto del rapporto a tempo indeterminato, sono anch'essi espressione di flessibilità del lavoro nelle pubbliche amministrazioni considerati nell'ottica efficientistica dell'organizzazione amministrativa. Gli incarichi di collaborazione coordinata e continuativa e gli incarichi dirigenziali a tempo determinato conferiti a dipendenti sia interni sia esterni all'amministrazione che pubblica il bando presentano degli aspetti critici che hanno avuto spazio per un breve sviluppo. L'analisi del comma 5, dell'art. 36 del d.lgs. n. 165/2001, ha permesso di sviluppare il tema della violazione delle disposizioni imperative; ipotesi che nel passato ha trovato scarsa applicazione ma oggi, grazie alla recente versione introdotta dalla legge n. 102 del 2009, ribadisce, con più forza, la misura disciplinare che prevede il recupero nei confronti dei responsabili dirigenti inosservanti delle somme erogate dall'Amministrazione per l'impiego di lavoratori assunti con contratti di lavoro flessibile illegittimi. Interessante, considerata l'abrogazione della conciliazione obbligatoria in materia lavoro, anche per gli esigui risultati ottenuti, risulta la possibile applicazione al settore pubblico privatizzato delle forme irrituali di deflazione del contenzioso quali l'arbitrato e la conciliazione alla luce delle recenti innovazioni introdotte con la legge n. 183 del 2010, cd. Collegato Lavoro e dalla disciplina emanata, da ultimo, in materia di mediazione con il D.Lgs. n. 28 del 2010 e il D.M. n. 180 del 2010, così come modificato ed integrato dal D.M. n. 145 del 2011. Ulteriori considerazioni giungono dalla previsione obbligatoria, per tutte le amministrazioni, di redigere ogni anno un rapporto informativo da trasmettere ai nuclei di valutazione nonché alla Presidenza del Consiglio dei Ministri sulle tipologie di lavoro flessibile utilizzate relativamente alla quantità numerica ed alla spesa relativa per tipologia. Tale rapporto informativo è uno strumento avente duplice finalità: la prima è quella di permettere di individuare il dirigente responsabile dell'irregolare utilizzo delle tipologie contrattuali non standard, attraverso la verifica degli atti gestionali posti in essere; la seconda si avvale della possibilità, offerta da una rapida conoscenza del fenomeno, di adottare misure mirate a migliorare sia l'aspetto normativo, sia quello organizzativo che di controllo della gestione delle risorse umane e finanziarie. Aspetti che rilevano la necessità di insediare in maniera efficace la cultura della buona amministrazione della cosa pubblica. Questa linea di condotta rappresenta la migliore politica per realizzare i principi di trasparenza ed imparzialità propri delle pubbliche amministrazioni. Principi idonei ad evitare che l'uso dei contratti di lavoro non standard degenerino in forme di precariato o realizzino una alternativa modalità di accesso ai ruoli professionali delle pubbliche amministrazioni, elusiva, grazie al collaudato ricorso a norme che introducono le procedure di stabilizzazione, dei previsti concorsi pubblici di accesso all'impiego pubblico per contratti di lavoro a tempo indeterminato. Alla luce dei recentissimi interventi normativi e giurisprudenziali, merita una trattazione il "caso" rappresentato dai rapporti di lavoro flessibili utilizzati dal Ministero della Pubblica istruzione, sia per il personale docente sia per il personale amministrativo definito ATA. Prendendo spunto dai testi normativi (legge n. 124 del 1999 e D.P.R. n. 430 del 2000), la ricerca ha evidenziato alcuni aspetti critici rispetto all'applicabilità della direttiva comunitaria in tema di contratti a termine. Nelle conclusioni vengono messi in luce i caratteri del modello contrattuale neo-autoritatio, attualmente utilizzato, nella Terza Riforma, dalle pubbliche amministrazioni. Ulteriori considerazioni finali sono orientate ad indagare gli effetti che la imminente riforma del mercato del lavoro, attualmente in discussione in Parlamento, avrà anche nel settore pubblico "privatizzato" ed in particolar modo quali novità introdurrà rispetto all'uso delle tipologie contrattuali di lavoro flessibile; e quali di queste saranno sviluppate nel tentativo di fornire una soluzione circa l'opportunità che la pubblica amministrazione utilizzi - ancora una volta - uno schema negoziale previsto nel settore privato ma "riadattato" alle esigenze di specialità, insite nel rapporto di lavoro del settore pubblico, comunque insuperabili. ; The persistent inefficiency in human resources management in the public sector draws our attention on how the public administration is currently trying to face the new, complex issues raised on a national, international and global level. In a fast-developing labour market, the public sector is showing a scarce dynamism and a certain resistance to accepting innovative solutions. The discussion about the need to innovate the "privatised" working relationship and the public administration in general has been going on for quite some time; still, only recently performance evaluation has been introduced for "privatised" jobs within public administrations. Contractual flexibility in the public sector is an innovation that typically equals to more efficiency. That is why it seems necessary to us to investigate the reasons behind the lack of efficiency: is it only due to contractual issues or are there more complex causes, linked to cultural and social processes? Our study aims to investigate the adaptability of flexible employment contracts – that could be used to handle the organisation and management of personnel in public administrations – within the neo-authoritative contract model's framework. The use of these types of contracts, together with the need for improved productivity and efficiency, has become fundamental to the development policy of public administrations. It is also essential for the implementation of cost containment policies - the so-called spending review – for the personnel who, starting from the late 1990s, reached high levels in the organization. Control measures have been previously taken: aiming at improving the efficiency of the services provided, by containing costs and reducing personnel – wrongly deemed redundant –, new employments were blocked. By flexible employment contracts we mean all those types of contracts which are different from a full-time, permanent contract of employment, disciplined by the Article 2094 of the Italian civil code and defined as standard employment contract. Starting from the guidelines outlined in law n.15 of 4th March 2009 – which reformed public employment – we analyse the measures which discipline the way public administrations can avail themselves of flexible work contracts. To better understand the third reform of labour in the privatised public sector, it is necessary to examine the historical reconstruction of the normative discipline that regulates the working relationship within the public administrations: starting from the assumption of performance improvement, through the evolution of contract types which characterised it, from the unilateral and authoritative model to the pactional and equal one. Thanks to this reconstruction it is possible to identify the fundamental principles which are the basis of a possible use, by public administrations, of both standard employment contracts and flexible ones. This principles are "the efficiency of public administrations' organizations", "the intangibility of the organization, of the employer's power and its relative managerial responsibility", "the access to public offices" (relating to the application of the constitutional principle of equality, included in art.3, and to the imposition with the art.97 co.3 of the Constitution of public competitive examinations as the hiring method, except for dispensations stated by the law, in order to guarantee the public administration's impartiality). When included among the several instruments and primary objectives of public administrations, the use of flexible employment contracts represents a suitable tool to guarantee an improved organization of the offices, especially if it is aimed at pursuing the overall public administration's good performance (according to art.97 of the Constitution). Thanks to an appropriate management of human resources, it also becomes possible to reach a further target of primary importance for public administrations: the control of financial resources. An in-depth knowledge of human resources management (be them either employed through a standard contract or a flexible one), combined with a detailed analysis of the relevant context could support an efficient rationalisation of resources, not only on an organizational level but also on a political, economical and social one. The latter ones being so far the most complicated to deal with when managers tried to use flexible types of contracts within public administrations. It is not a coincidence that art. 36 of legislative decree n.165 of 2001 (Testo Unico per il Pubblico Impiego) and especially paragraph 3, eventually modified by art. 17 paragraph 6 of legislative decree n.78 of 2009, highlights that a system which foresees the use of the above-mentioned types of contracts as a management instrument for public administrations must be aiming at fighting the abuse deriving from its own distorted use. The abuse and distorted use of flexible employment contracts generated a large number of temporary employees, who are being cyclically helped by the so-called "stabilization norms" (norms which themselves have been under scrutiny for their legal validity). Through a detailed analysis of article 36 of legislative decree n.165 of 2001, and bearing in mind the norms that regulate the working relationship within the private sector, it is possible to pinpoint all the critical aspects of the legislative apparatus, thus verifying the separation between disciplines which allow the application of flexible employment contracts by private employers and public ones. This analysis also shows that the "unilateral and authoritative model", which regulated the working relationship within public administration before its privatisation, is still very much applied in that context. Starting from the first revision of the first two paragraphs of the already mentioned article 36, included in legislative decree n.29 of 1993, we can determine the field of application of legal relationships deriving from the stipulation of flexible employment contracts here listed. All the discrepancies between the discipline that regulates the working relationship with a private employer and the one with a privatised public administration are easily highlighted. By comparing the contents of the norms which regulate every single type of flexible contract, included in article 36 of legislative decree n. 165/2001, and its perceptive value, it is possible to verify the specification that characterizes the working relationship within public administrations and how flexible contracts are there applied. The cross-reference - included in the second paragraph of article 36 of legislative decree n. 165/2001 - to the content of the National collective labour agreements, which regulate temporary contracts, "paid apprenticeships" (contratti di formazione e lavoro), other vocational training and supply contracts (altri rapporti formativi e somministrazione del lavoro), ancillary casual labour (lavoro accessorio) and socially useful workers (lavoratori socialmente utili), highlights the possibility for the "collective autonomy" to regulate and integrate single contractual schemes thus realizing the scheme of the pactional contract model and at the same time emphasizing its limit in indicating only the categories of employees to whom that can be applied. A small part of this analysis is dedicated to part-time jobs and managerial assignments for personnel employed through standard contracts which, although falling under the category of permanent jobs, are nevertheless an expression of a certain labour flexibility within public administration on the basis of improved performance and administrative organization. The analysis of article 36, paragraph 5 of the legislative degree n. 165/2001 develops the topic of violation of imperative provisions: rarely applied in the past, a new revision has been re introduced with law n. 102/2009 and now strongly reasserts the application of disciplinary measures against non compliant managers in order to recover funds used to hire employees through illegal types of flexible contracts. Further considerations come from the mandatory requirement, for all public administrations, to present every year to their relevant evaluation board and to the Presidenza del Consiglio dei Ministri an informative report on all the types of flexible employment contracts applied in relation to the number of personnel and the relevant expenditure per type. This informative report has a double purpose: on one side it allows the board to easily locate the manager responsible for misusing non-standard contract types, by checking the managerial decisions taken; on the other side - and on a more general level - it offers the opportunity to adopt measures aimed at improving the legislative and organizational management of human resources and finances. As if to say, it is essential to effectively promote a culture that encourages a good management of the res publica. This trend represents, in our opinion, the best strategy to fulfill the principles of transparency and impartiality peculiar to public administrations. These principles will help avoiding that the implementation of non-standard employment contracts either degenerates into new forms of temporary employment or creates a new, elusive method to access professional jobs within public administrations thanks to the proven resort to the so-called "stabilization norms" and public competitive examinations for permanent positions. In light of the recent regulatory and jurisprudential interventions, we will separately analyze the case of flexible employment contracts applied by the Ministry of Education both for teachers and administrative personnel (called ATA). Starting from law n.124/1999 and D.P.R. n.430/2000, this section highlights the relationship between school employees and the applicability of the EU directive concerning temporary contracts. In the conclusions, we will describe the main characteristics of the neo-authoritative contract model, now used in public administrations. Further final reflections consider the effects that the imminent reform of the labour market, currently being discussed in Parliament, will produce also in the privatised public sector and especially what innovations will introduce in the flexible contractual typologies, in the attempt to provide a solution about whether or not the public administration should or could once again use a contractual scheme different from the one implemented in the private sector.
Se il lavoro dello storico è capire il passato come è stato compreso dalla gente che lo ha vissuto, allora forse non è azzardato pensare che sia anche necessario comunicare i risultati delle ricerche con strumenti propri che appartengono a un'epoca e che influenzano la mentalità di chi in quell'epoca vive. Emergenti tecnologie, specialmente nell'area della multimedialità come la realtà virtuale, permettono agli storici di comunicare l'esperienza del passato in più sensi. In che modo la storia collabora con le tecnologie informatiche soffermandosi sulla possibilità di fare ricostruzioni storiche virtuali, con relativi esempi e recensioni? Quello che maggiormente preoccupa gli storici è se una ricostruzione di un fatto passato vissuto attraverso la sua ricreazione in pixels sia un metodo di conoscenza della storia che possa essere considerato valido. Ovvero l'emozione che la navigazione in una realtà 3D può suscitare, è un mezzo in grado di trasmettere conoscenza? O forse l'idea che abbiamo del passato e del suo studio viene sottilmente cambiato nel momento in cui lo si divulga attraverso la grafica 3D? Da tempo però la disciplina ha cominciato a fare i conti con questa situazione, costretta soprattutto dall'invasività di questo tipo di media, dalla spettacolarizzazione del passato e da una divulgazione del passato parziale e antiscientifica. In un mondo post letterario bisogna cominciare a pensare che la cultura visuale nella quale siamo immersi sta cambiando il nostro rapporto con il passato: non per questo le conoscenze maturate fino ad oggi sono false, ma è necessario riconoscere che esiste più di una verità storica, a volte scritta a volte visuale. Il computer è diventato una piattaforma onnipresente per la rappresentazione e diffusione dell'informazione. I metodi di interazione e rappresentazione stanno evolvendo di continuo. Ed è su questi due binari che è si muove l'offerta delle tecnologie informatiche al servizio della storia. Lo scopo di questa tesi è proprio quello di esplorare, attraverso l'utilizzo e la sperimentazione di diversi strumenti e tecnologie informatiche, come si può raccontare efficacemente il passato attraverso oggetti tridimensionali e gli ambienti virtuali, e come, nel loro essere elementi caratterizzanti di comunicazione, in che modo possono collaborare, in questo caso particolare, con la disciplina storica. La presente ricerca ricostruisce alcune linee di storia delle principali fabbriche attive a Torino durante la seconda guerra mondiale, ricordando stretta relazione che esiste tra strutture ed individui e in questa città in particolare tra fabbrica e movimento operaio, è inevitabile addentrarsi nelle vicende del movimento operaio torinese che nel periodo della lotta di Liberazione in città fu un soggetto politico e sociale di primo rilievo. Nella città, intesa come entità biologica coinvolta nella guerra, la fabbrica (o le fabbriche) diventa il nucleo concettuale attraverso il quale leggere la città: sono le fabbriche gli obiettivi principali dei bombardamenti ed è nelle fabbriche che si combatte una guerra di liberazione tra classe operaia e autorità, di fabbrica e cittadine. La fabbrica diventa il luogo di "usurpazione del potere" di cui parla Weber, il palcoscenico in cui si tengono i diversi episodi della guerra: scioperi, deportazioni, occupazioni . Il modello della città qui rappresentata non è una semplice visualizzazione ma un sistema informativo dove la realtà modellata è rappresentata da oggetti, che fanno da teatro allo svolgimento di avvenimenti con una precisa collocazione cronologica, al cui interno è possibile effettuare operazioni di selezione di render statici (immagini), di filmati precalcolati (animazioni) e di scenari navigabili interattivamente oltre ad attività di ricerca di fonti bibliografiche e commenti di studiosi segnatamente legati all'evento in oggetto. Obiettivo di questo lavoro è far interagire, attraverso diversi progetti, le discipline storiche e l'informatica, nelle diverse opportunità tecnologiche che questa presenta. Le possibilità di ricostruzione offerte dal 3D vengono così messe a servizio della ricerca, offrendo una visione integrale in grado di avvicinarci alla realtà dell'epoca presa in considerazione e convogliando in un'unica piattaforma espositiva tutti i risultati. Divulgazione Progetto Mappa Informativa Multimediale Torino 1945 Sul piano pratico il progetto prevede una interfaccia navigabile (tecnologia Flash) che rappresenti la pianta della città dell'epoca, attraverso la quale sia possibile avere una visione dei luoghi e dei tempi in cui la Liberazione prese forma, sia a livello concettuale, sia a livello pratico. Questo intreccio di coordinate nello spazio e nel tempo non solo migliora la comprensione dei fenomeni, ma crea un maggiore interesse sull'argomento attraverso l'utilizzo di strumenti divulgativi di grande efficacia (e appeal) senza perdere di vista la necessità di valicare le tesi storiche proponendosi come piattaforma didattica. Un tale contesto richiede uno studio approfondito degli eventi storici al fine di ricostruire con chiarezza una mappa della città che sia precisa sia topograficamente sia a livello di navigazione multimediale. La preparazione della cartina deve seguire gli standard del momento, perciò le soluzioni informatiche utilizzate sono quelle fornite da Adobe Illustrator per la realizzazione della topografia, e da Macromedia Flash per la creazione di un'interfaccia di navigazione. La base dei dati descrittivi è ovviamente consultabile essendo contenuta nel supporto media e totalmente annotata nella bibliografia. È il continuo evolvere delle tecnologie d'informazione e la massiccia diffusione dell'uso dei computer che ci porta a un cambiamento sostanziale nello studio e nell'apprendimento storico; le strutture accademiche e gli operatori economici hanno fatto propria la richiesta che giunge dall'utenza (insegnanti, studenti, operatori dei Beni Culturali) di una maggiore diffusione della conoscenza storica attraverso la sua rappresentazione informatizzata. Sul fronte didattico la ricostruzione di una realtà storica attraverso strumenti informatici consente anche ai non-storici di toccare con mano quelle che sono le problematiche della ricerca quali fonti mancanti, buchi della cronologia e valutazione della veridicità dei fatti attraverso prove. Le tecnologie informatiche permettono una visione completa, unitaria ed esauriente del passato, convogliando tutte le informazioni su un'unica piattaforma, permettendo anche a chi non è specializzato di comprendere immediatamente di cosa si parla. Il miglior libro di storia, per sua natura, non può farlo in quanto divide e organizza le notizie in modo diverso. In questo modo agli studenti viene data l'opportunità di apprendere tramite una rappresentazione diversa rispetto a quelle a cui sono abituati. La premessa centrale del progetto è che i risultati nell'apprendimento degli studenti possono essere migliorati se un concetto o un contenuto viene comunicato attraverso più canali di espressione, nel nostro caso attraverso un testo, immagini e un oggetto multimediale. Didattica La Conceria Fiorio è uno dei luoghi-simbolo della Resistenza torinese. Il progetto è una ricostruzione in realtà virtuale della Conceria Fiorio di Torino. La ricostruzione serve a arricchire la cultura storica sia a chi la produce, attraverso una ricerca accurata delle fonti, sia a chi può poi usufruirne, soprattutto i giovani, che, attratti dall'aspetto ludico della ricostruzione, apprendono con più facilità. La costruzione di un manufatto in 3D fornisce agli studenti le basi per riconoscere ed esprimere la giusta relazione fra il modello e l'oggetto storico. Le fasi di lavoro attraverso cui si è giunti alla ricostruzione in 3D della Conceria: . una ricerca storica approfondita, basata sulle fonti, che possono essere documenti degli archivi o scavi archeologici, fonti iconografiche, cartografiche, ecc.; . La modellazione degli edifici sulla base delle ricerche storiche, per fornire la struttura geometrica poligonale che permetta la navigazione tridimensionale; . La realizzazione, attraverso gli strumenti della computer graphic della navigazione in 3D. Unreal Technology è il nome dato al motore grafico utilizzato in numerosi videogiochi commerciali. Una delle caratteristiche fondamentali di tale prodotto è quella di avere uno strumento chiamato Unreal editor con cui è possibile costruire mondi virtuali, e che è quello utilizzato per questo progetto. UnrealEd (Ued) è il software per creare livelli per Unreal e i giochi basati sul motore di Unreal. E' stata utilizzata la versione gratuita dell'editor. Il risultato finale del progetto è un ambiente virtuale navigabile raffigurante una ricostruzione accurata della Conceria Fiorio ai tempi della Resistenza. L'utente può visitare l'edificio e visualizzare informazioni specifiche su alcuni punti di interesse. La navigazione viene effettuata in prima persona, un processo di "spettacolarizzazione" degli ambienti visitati attraverso un arredamento consono permette all'utente una maggiore immersività rendendo l'ambiente più credibile e immediatamente codificabile. L'architettura Unreal Technology ha permesso di ottenere un buon risultato in un tempo brevissimo, senza che fossero necessari interventi di programmazione. Questo motore è, quindi, particolarmente adatto alla realizzazione rapida di prototipi di una discreta qualità, La presenza di un certo numero di bug lo rende, però, in parte inaffidabile. Utilizzare un editor da videogame per questa ricostruzione auspica la possibilità di un suo impiego nella didattica, quello che le simulazioni in 3D permettono nel caso specifico è di permettere agli studenti di sperimentare il lavoro della ricostruzione storica, con tutti i problemi che lo storico deve affrontare nel ricreare il passato. Il rischio di impiegare del tempo per imparare come funziona questa tecnologia per generare spazi virtuali rende scettici quanti si impegnano nell'insegnamento, ma le esperienze di progetti sviluppati, soprattutto all'estero, servono a capire che sono un buon investimento. Questo ci mette nelle condizioni di progettare moduli di insegnamento più immersivi, in cui l'esperienza della ricerca e della ricostruzione del passato si intreccino con lo studio più tradizionale degli avvenimenti di una certa epoca. I mondi virtuali interattivi vengono spesso definiti come la forma culturale chiave del XXI secolo, come il cinema lo è stato per il XX. Lo scopo di questo lavoro è stato quello di suggerire che vi sono grosse opportunità per gli storici impiegando gli oggetti e le ambientazioni in 3D, e che essi devono coglierle. Si consideri il fatto che l'estetica abbia un effetto sull'epistemologia. O almeno sulla forma che i risultati delle ricerche storiche assumono nel momento in cui devono essere diffuse. Un'analisi storica fatta in maniera superficiale o con presupposti errati può comunque essere diffusa e avere credito in numerosi ambienti se diffusa con mezzi accattivanti e moderni. Ecco perchè non conviene seppellire un buon lavoro in qualche biblioteca, in attesa che qualcuno lo scopra. Ecco perchè gli storici non devono ignorare il 3D. La nostra capacità, come studiosi e studenti, di percepire idee ed orientamenti importanti dipende spesso dai metodi che impieghiamo per rappresentare i dati e l'evidenza. Perché gli storici possano ottenere il beneficio che il 3D porta con sè, tuttavia, devono sviluppare un'agenda di ricerca volta ad accertarsi che il 3D sostenga i loro obiettivi di ricercatori e insegnanti. Una ricostruzione storica può essere molto utile dal punto di vista educativo non sono da chi la visita ma, anche da chi la realizza. La fase di ricerca necessaria per la ricostruzione non può fare altro che aumentare il background culturale dello sviluppatore. Conclusioni La cosa più importante è stata la possibilità di fare esperienze nell'uso di mezzi di comunicazione di questo genere per raccontare e far conoscere il passato. Rovesciando il paradigma conoscitivo che avevo appreso negli studi umanistici, ho cercato di desumere quelle che potremo chiamare "leggi universali" dai dati oggettivi emersi da questi esperimenti. Da punto di vista epistemologico l'informatica, con la sua capacità di gestire masse impressionanti di dati, dà agli studiosi la possibilità di formulare delle ipotesi e poi accertarle o smentirle tramite ricostruzioni e simulazioni. Il mio lavoro è andato in questa direzione, cercando conoscere e usare strumenti attuali che nel futuro avranno sempre maggiore presenza nella comunicazione (anche scientifica) e che sono i mezzi di comunicazione d'eccellenza per determinate fasce d'età (adolescenti). Volendo spingere all'estremo i termini possiamo dire che la sfida che oggi la cultura visuale pone ai metodi tradizionali del fare storia è la stessa che Erodoto e Tucidide contrapposero ai narratori di miti e leggende. Prima di Erodoto esisteva il mito, che era un mezzo perfettamente adeguato per raccontare e dare significato al passato di una tribù o di una città. In un mondo post letterario la nostra conoscenza del passato sta sottilmente mutando nel momento in cui lo vediamo rappresentato da pixel o quando le informazioni scaturiscono non da sole, ma grazie all'interattività con il mezzo. La nostra capacità come studiosi e studenti di percepire idee ed orientamenti importanti dipende spesso dai metodi che impieghiamo per rappresentare i dati e l'evidenza. Perché gli storici possano ottenere il beneficio sottinteso al 3D, tuttavia, devono sviluppare un'agenda di ricerca volta ad accertarsi che il 3D sostenga i loro obiettivi di ricercatori e insegnanti.
