Sivil Toplum ve Devlet ; Civil Society and State
Çalışmamızda öncelikle sivil toplum kavramının literatürdeki yeri aydınlatılmaya çalışılmış, bu çerçevede kavramın tarihsel gelişimine yer verilerek; "devlet", "kamusal alan", "sivil itaatsizlik" kavramlarıyla ilişkisi irdelenmiştir. Ayrıca günümüzde devletin fonksiyonlarının ve etkinliğinin değerlendirilmesi bakımından bir karşılaştırma ölçütü olarak önemli bir yer tutan sivil toplum kuruluşlarının tanımına ve niteliklerine değinilerek, bu kuruluşların devlet olgusu karşısındaki konumunu belirleyen kavram olan demokrasiyle ilişkisi açıklanmıştır. ; In our study, firstly, it has been tried to explain the place of the concept of civil society in the literature, for this reason the development of the concept in the historical process has been given and its relation with the concepts of "state","public area", "civil disobedience" has been studied. Besides, dealing with the definition and the characteristics ofNGO 's that play an important part as a measure of comparison far the evaluation of the functions and the efjicincy of the state, the relation of these organisations with democracy which is the concept that determines the position of these organizations in view of the slate has been explained.

The author analyzes the latest developments in liberal democracy & the capitalist economy based on the examples of the works of Erich Weede & Klaus von Beyme. The tendency of alleviating economic & political competition is corroborated by means of an analysis of the phenomenon of a multiparty state & today's capitalist economy, which has been increasingly relying on rent-generated income rather than market competition. Civilno društvo i postsocijalizam ; The Civil Society and Postsocialism
Autor polazi od stava da je za kritičko razumijevanje postsocijalizma (kojeg uvjetno određuje kao stanje i proturiječni procesi u Istočnoj Europi nakon demokratske revolucije) i njegovih razvojnih perspektiva upravo primjeren koncept civilnog društva. Upućuje na tri različite društvene struje koje su doprinjele obnovi problematike civilnog društva: neoliberalizam, postmarksizam i disidentski građanski otpor totalitarizmu. Zatim utvrđuje pojam civilnog društva, u smislu koji je dobio u novovjekovnim teorijama prirodnog prava. Na tom tragu precizira vlastito određenje ovog pojma kao analitičkog oruđa za analizu socijalizma i postsocijalizma. Kad je riječ o socijalizmu ukazuje na stalnu napetost između države i neautonomnog ali »realnog socijalističkog društva«, u kome se uvijek iznova javljaju klice autonomne civilne sfere. Na kraju raspravlja o (ne)ispunjenju tri temeljne pretpostavke civilnog društva u aktualnim postsocijalističkim procesima na europskom Istoku, uključujući Hrvatsku i Jugoslaviju. ; The author expresses the opinion that for a critical understanding of postsocialism (which he conditionally defines as the situation and contradictory processes in Eastern Europe after the democratic revolution) and its development perspectives, the most adequate is the concept of civil society. He indicates three different social currents which contributed to the renewal of the civil society issue: neoliberalism, post-Marxism and the dissident civil opposition to totalitarianism. He then determines the concept of civil society within the meaning it had obtained in the modem theories of natural law. Following this line of thought he specifies his own definition of this concept as an analytical means for studying socialism and postsocialism. When it is a question of socialism, he indicates the constant tension between the state and unautonomous but »real socialist society«, in which new seeds of the autonomous civil sphere keep appearing over and over again. Finally, he discusses the non-fulfilment of the three fundamental pre-suppositions for civil society in contemporary postsocialist processes in the European East, including Croatia and Yugoslavia.

Bu çalışmanın amacı, Türkiye'de yurttaşlık haklarının olgunlaşmasının, özellikle yazılı basındaki gelişmelere koşut bir paralellik gösterdiğinin irdelenmesidir. Betimleyici bir yaklaşımın sergilendiği çalışmanın başlangıç noktasını, Osmanlı'nın son dönemindeki Batılılaşma hareketleri ve basının üstlendiği misyon oluşturmuştur. Bu dönemde, yüzü Batı'ya dönük gazetecilerin yenileşme ve hak arayışları ön plana çıkarken; karşılaştıkları önemli engellemeler, sağlanan kazanımların sınırlılığına neden olmuştur. Bağımsızlık savaşı sonrasında kurulan Türkiye Cumhuriyeti döneminde ise, Batı'lı anlamda bir toplum projesi oluşturulmuştur. Bir yandan temel hak ve özgürlükler anayasal güvence altına alınırken; diğer yandan modern bir yurttaş profili gerçekleştirilmiştir. Bununla birlikte, dönemin gerek iç gerekse dış politikasındaki konjonktürel gelişmeler demokrasi fikrinin yaşama geçirilmesinde gecikmelere yol açmıştır. Özellikle bu dönemde, basından beklenilen işlev, kurulan yeni düzeni ve devrimleri desteklemesi ve bu konuda halkı bilinçlendirmesi olmuştur. Kuşkusuz bu dönemde, Cumhuriyet idealine muhalif olan basın üzerinde önemli kısıtlamalara gidilmiştir. Sonuç olarak çok partili siyasal hayata geçiş öncesindeki dönemin ele alındığı bu çalışmada, basının kimi zaman karşılaştığı sınırlamalara rağmen, yurttaşlık haklarının gelişiminde önemli ancak yeterli olmayan bir rol oynadığı vurgulanmıştır. ; Press is to be taken part in the gravity's center of the triangle of state-civil society- democracy that has been contributed directly to the development of citizenship rights in Turkey like western countries. The aim of this study, it is mentioned that the development of citizenship rights shows a conditioned parallellism towards the development of the written press. In the last period of the Ottoman's westernization movements and mission of the press have constituted the begin-ning point of this study that has been exhibited a descriptive approach. At this term, when jour-nalists whose faces became towards West, surpassed their modernization and right seeking, the limitations of the acquired rights were caused by the importance prohibitions. After Independence War and the Republician of Turkey was established, a social project was formed in Western context. Fundemental right and freedoms were taken by constitutional guaranty. And also, the profile of modern compatriot was constituted. However, the concept of democracy was constituted to be delayed by the conjuncturel developments about both internal and external pol-itics. Especially at this period, it was expected that the function of the press supported the estab-lishing, new deal and revolutions and also, educated to public about this subject. Definitely at this term, importance prohibitions on the press which was related to opposition of the ideal of republician, were constituted by the government. As a result of this study which was related to the term about before the plural political life, although the press was confronted with limitations from time to time, it played a significant role about the development of citizenship rights. But, this role did not become efficent for citizenship rights and democracy.

Contemporary states are undergoing a process of rapid transformation that encumbers their functioning & sustains their state of crisis. Their external sovereignty is undoubtedly on the wane, in relation to both global economic actors & transnational & supranational political structures. Internally, the hierarchical functioning of government has been called into question. Although the state's share in the social product is constantly increasing, so are the demands for the state's support & regulation in various areas, resulting in a permanent fiscal crisis of the state. The author claims that the contemporary metamorphoses of the state & the prospects for its development can be understood solely by analyzing the changes in contemporary society. The industrial society, even the "service society" (Dahrendorf), is being transformed into an information & communication society, in which the key processes are the production & distribution of knowledge, while the central power resources are mechanisms of the monopolization of knowledge. The information & communication media play the central role in social & political processes. The new increase of social inequality has intensified the tendency of social desolidarization. The new level of social dynamics, mobility, complexity, & contingency requires a new type of state. The author calls it the "cooperative state" -- the state that provides for the production of essential collective goods in the cooperative process of negotiation & bargaining, in which a plethora of social actors take part. 25 References. Struktura civilnog drustva u Hrvatskoj

The article presents results of a study of the structure of the civil society in Croatia, analyzed by means of the following indicators: the number of the organizations of the civil society; membership in these organizations; the range of these organizations; the composition of the civil society; & the resources of the civil society. In the 1990s in Croatia, the number of the civil society organizations increased greatly. They have relatively small memberships; also, in the 1990s, the active memberships shrank. Civil society organizations can be found primarily in big cities. Insufficient networking & a certain dose of political divisions of these organizations diminish their developmental potential. Foreign organizations & their financial support played a major part in profiling the structure of the civil society. The relatively modest human resources reduce the partnership position of these organizations. The structure of these organizations can be compared to other transitional countries. The war & the humanitarian crisis particularly affected the profiling of the structure of the civil society in Croatia. 2 Tables, 46 References. Adapted from the source document.
Je li drzava prema svojem najvisem odredenju - proslost?

The author claims that in Hegel's Philosophy of Law there are two convergent, overlapping, & concurrent tendencies. The first asserts that the state is such a condition of society in which the universal will of citizens is paramount. It is the sole source of positive law, since only the state warrants the laws that do not do injustice to its subjects. In this theory, the state is considered an ideal universal entity, adjusted to the speculative shifts of auto-reflection. The second claims that as the rational state, the state is a union of different interests, providing good life for its citizens. The principle of their union is a particular benefit; not self-determination as the absolute principle but mutual compromise, mutual achievement & relatively equal contribution that creates interdependence. These two tendencies have entirely defined the understanding of the state in the German cultural space: at one time it is an ideal association among reflective individuals, & at other an apparatus of power. Ages ago, Plato understood justice as the purport & the essential purpose of the very existence of the state. Though Plato distinguishes between the political justice of the state & the personal justice of the individual soul, it was Aristotle who in his practical philosophy developed, apart from the general justice, an appropriate understanding of the special or particular justice & its significance for social progress. The first part of this paper deals with the different types of justice, & the second with civil society. In order to understand the contemporary theories of political justice & the roles of civil society in its realization, the author looks into the history of the European political thought & "civil society," since "civic" or "civil society" ("societas civilis"), was originally a political society. In modernity, Hegel began differentiating between the state as a political community & the "civil society" as a nonpolitical society; his intention was not to separate but to integrate them by means of the public scrutiny & the citizens' governance, Thus Hegel linked Locke's & Montesquieu's opposing definitions of the relationship between the civil society & the state. This is all the more important since Hegel's philosophy is often misinterpreted as the state totalitarianism since we overlook the dangers coming, especially today, both from the civil society reduced to economy & the absolute state, the dangers that Hegel, with his concept of customariness, detected & avoided. 11 References. The author looks into the origin & the evolution of the notion of civil society & outlines the contemporary debates on its meaning & democratic potential, as well as its democratic deficits. The concept of civil society (originally devised by Aristotle & used for centuries in political philosophy), was revived in the 1980s, first in the East-European movements against the Stalinist state socialism, & later in the new social movements in the West & in social sciences in general. Today's understanding of this term is the result of the branching out of the classical term: while originally it denoted an association of citizens as a political community, Montesquieu & Hegel came up with the difference between the civil society & the state as a political community. Later, a series of modern authors, in line with Gramsci, additionally differentiated between the civil & the market societies. The case in point is Jurgen Habermas who defines civil society as a system of spontaneously generated non-state & nonprofit associations connected via the venues of public communication & whose goal is not to win the firsthand political power. Another understanding of civil society has resulted from a long cooperation of the UN & its specialized institutions with the nongovernmental organizations that came to the fore at the major thematic UN-sponsored conferences in the l990s. The author criticizes the idealized picture of civil society as a form of the organization & the democracy-promoting communication of citizens. A developed civil society is undoubtedly important for democracy, but this also requires the appropriate checking mechanisms. The potential deficits of the civil society are reform blockade, the risk of the loss of civilness in populist movements & the social asymmetry of civil activism. Finally, the author looks into a variety of proposals that see in the European civil society the means of the democratization of the European Union. 12 References. Adapted from the source document.
