Bezpieczeństwo celne, będące jednym z elementów ekonomicznego wymiaru bezpieczeństwa publicznego, ma wieloaspektowy charakter i jest istotne dla przedsiębiorców, społeczeństwa i państwa. Na poziomie krajowym zadania z tego zakresu realizuje m.in. Krajowa Administracja Skarbowa. Wskazanie na jej rolę oraz działania jest celem artykułu. Hipoteza badawcza została sformułowana następująco: Krajowa Administracja Skarbowa, mając na uwadze znaczenie funkcji ochronnej dla bezpieczeństwa publicznego, podejmuje skuteczne działania, których celem jest minimalizowanie zagrożeń i ochrona, pełniąc tym samym istotną rolę w zapewnianiu bezpieczeństwa celnego. Struktura artykułu obejmuje dwie części oraz podsumowanie. W pierwszej omówiono istotę bezpieczeństwa w aspekcie interesów ekonomicznych, druga odnosi się do roli i działań Krajowej Administracji Skarbowej jako strażnika bezpieczeństwa celnego. W podsumowaniu przedstawiono wnioski płynące z rozważań zawartych w artykule. W badaniach wykorzystano analizę opisową, poprzedzoną przeglądem źródeł literaturowych i aktów unijnego i krajowego prawodawstwa wtórnego. ; Customs security, arguably one of the key factors of the economic dimension of public security, has a multifaceted character: it is crucial for economic operators, the society, and the state. At the national level, activities in this regard are performed by, among others, the National Revenue Administration. The goal of this paper is to discuss its role and activities. The research hypothesis has been formulated as follows: the National Revenue Administration, having regard to the significance of its protective function for public security, undertakes effective measures aimed at minimising threats and ensuring protection, and, as such, plays a key role in providing customs security. The paper has been structured as follows: the first part looks at the essence of security from the perspective of economic interests; the second part refers to the role and select activities of the National Revenue Administration as a guardian of customs security. A relevant summary follows, outlining the conclusions drawn from the considerations presented. The research was based on the descriptive analysis, preceded by a review of the subject literature, as well as an in-depth analysis of domestic and EU secondary legislation. ; Die zollrechtliche Sicherheit, die eine der Elemente auf der wirtschaftlichen Ebene der öffentlichen Sicherheit ist, hat den multidimensionalen Charakter und ist wichitg für die Unternehmer, die Gesellschaft und den Staat. Auf nationaler Ebene nimmt die Aufgaben in diesem Bereich u. a die nationale Finanzverwaltung wahr. Der Artikel zeigt ihre Rolle und Tätigkeiten. Die Forschungshypothese wurde formuliert, wie folgt: die nationale Finanzverwaltung, in der Erwägung der Bedeutung der schützenden Funktion für die öffentliche Sicherheit, nimmt wirksame Maßnahmen vor, deren Ziel die Minderung von Risiken und der Schutz ist, sie spielt also eine wichtige Rolle bei der Gewährleistung der zollrechtlichen Sicherheit. Die Struktur des Artikels umfasst zwei Teile und eine Zusammenfassung. Im ersten Teil wurde das Wesen der Sicherheit im Aspekt der wirtschaftlichen Interesse erörtert, der zweite bezieht sich auf die Rolle und Tätigkeiten der nationalen Finanzverwaltung Polens als Hüter der zollrechtlichen Sicherheit. In der Zusammenfassung wurden die sich aus dem im Artikel enthaltenen Überlegungen ergebenden Schlussfolgerungen dargestellt. In den Untersuchungen nutzte man die beschreibende Analyse, der eine Übersicht der Literaturquellen und Akte der sekundären Rechtsvorschriften auf der EU- und nationalen Ebene vorausgeht. ; Таможенная безопасность, являющаяся одним из элементов экономического из- мерения общественной безопасности, носит многогранный характер и имеет су- щественное влияние на предпринимателей, общество и государство. На нацио- нальном уровне, задачи в этой сфере, в частности, возложены на Национальную налоговую администрацию. В статье рассмотрена роль и деятельность этого ор- гана. Для нужд работы была сформулирована следующая исследовательская ги- потеза: Национальная налоговая администрация, учитывая важность защитной функции для общественной безопасности, принимает эффективные меры, на- правленные на минимизацию угроз и защиту государства, тем самым выполняя важную роль в обеспечении таможенной безопасности. Статья состоит из двух частей и выводов. В первой части обсуждена сущность безопасности в аспекте экономических интересов, во второй – речь идет о роли и деятельности Наци- ональной налоговой администрации – стоящей на стражи таможенной безо- пасности. В исследовании использовался описательный анализ, которому пред- шествовал обзор научной литературы и правовых актов Европейского Союза и национального законодательства.

Celem artykułu jest przedstawienie znaczenia obsługi celnej w procesie zapewniania bezpieczeństwa i ochrony w transgranicznym ruchu towarowym w Unii Europejskiej. Hipoteza badawcza została sformułowana następująco: organy celne, jako służby mające pełne kompetencje w zakresie nadzoru i kontroli nad wszystkimi towarami przewożonymi przez granice celne, potrafią wdrażać w ramach europejskiej unii celnej nowoczesne i spójne rozwiązania, których efektem jest skuteczna ochrona obrotu towarowego – nie tworząc przy tym barier, ale usprawniając obsługę celną. Struktura artykułu obejmuje trzy części oraz podsumowanie. W części pierwszej wskazano na istotę i znaczenie funkcji ochronnej realizowanej przez administracje celne państw członkowskich Unii Europejskiej; druga odnosi się do znaczenia obsługi celnej w procesie ochrony transgranicznego przepływu towarów; trzecia prezentuje wybrane instrumenty, które usprawniają obsługę celną, wpływając jednocześnie pozytywnie na poziom bezpieczeństwa. W badaniach wykorzystano analizę opisową, poprzedzoną przeglądem źródeł literaturowych i aktów unijnego i krajowego prawodawstwa wtórnego. ; The goal of the paper is to highlight the relevance of customs clearance in the process of guaranteeing the security and safety of cross-border trade in the European Union. The research hypothesis has been formulated as follows: customs authorities, acting as the bodies that have full competence over the surveillance and control of the goods transited across the customs borders, are able to implement modern and consistent solutions within the European Customs Union. As a result, trade in goods is effectively safeguarded, no barriers are created, and customs clearance is improved, which facilitates commercial activity. The paper consists of three parts, and a summary. The first part looks at the essence and significance of the protective function performed by customs administrations of the Member States; the second part refers to the relevance of customs clearance in the process of the cross-border flow of goods, and the third part elucidates the selected instruments which enhance customs processing and, at the same time, have a positive impact on the overall level of security and safety. The conclusions drawn from the considerations pondered upon in the paper have been included in the summary. The research was based on a descriptive analysis preceded by a review of the subject literature, as well as a selection of national and EU secondary legislation. ; Das Ziel des Artikels ist die Bedeutung der Zollabfertigung im Prozess der Sicherheits- und Schutzgewährleistung im grenzüberschreitenden Güterverkehr in der Europäischen Union darzustellen. Die Forschungshypothese wurde wie folgt formuliert: Zollbehörde, als die für die Aufsicht und Kontrolle über alle durch die Zollgrenzen beförderten Waren zuständigen Dienste, können im Rahmen der europäischen Zollunion moderne und kohärente Lösungen einführen, welche einen effektiven Schutz des Güterverkehrs zur Folge haben, ohne Schranken dabei zu errichten sondern die Zollabfertigung zu optimieren. Die Struktur des Artikels umfasst drei Teile und eine Zusammenfassung. Im ersten Teil wurde auf das Wesen und die Bedeutung der durch die Zollverwaltungen der EU - Mitgliedsländer ausgeübten Schutzfunktion hingewiesen, der zweite Teil bezieht sich auf die Bedeutung der Zollabfertigung im Prozess der Schutzgewährleistung im grenzüberschreitenden Güterverkehr; der dritte Teil stellt ausgewählte Instrumente dar, die die Zollabwicklung erleichtern und sich positiv auf das Sicherheitsniveau auswirken. In den Untersuchungen wurde die beschreibende Analyse benutzt, deren die Übersicht der Literaturquellen und Rechtsvorschriften der Unions- und Landesrechtsvorschriften vorausgeht. ; В статье рассматривается значение таможенного обслуживания в процессе обе- спечения безопасности и защиты в трансграничном движении товаров в Евро- пейском Союзе. Исследовательская гипотеза была сформулирована следующим образом: таможенные органы, имеющие полномочия в области надзора и кон- троля над всеми товарами, перевозимыми через таможенные границы, могут вне- дрять, в рамках европейского таможенного союза, современные, комплексные решения, результатом которых является эффективная защита товарооборота – не создавая при этом барьеров, а улучшая таможенное обслуживание. Структура статьи включает в себя три части и резюме. В первой части освящены суть и зна- чимость защитной функции, выполняемой таможенными администрациями го- сударств-членов Европейского Союза; во второй части подчеркнуто значение та- моженного обслуживания в процессе защиты трансграничных потоков товаров; в третьей – представлено выбранные инструменты, способствующие повышению качества таможенного обслуживания, что имеет положительное влияние на уро- вень безопасности. В исследовании был использован описательный анализ, ко- торому предшествовал обзор литературных источников и нормативно-правовых актов законодательства ЕС и Польши.

On 1 March 2017, the Customs Service, which had operated since 1990, became part of the new model of the integrated public administration, i.e. the National Revenue Administration. The aim of the article is to analyze the organizational framework of the customs administration in Poland, to identify reasons for the institutional reform as well as to indicate courses of action of the future policies of the new model of the customs and fi scal administration. The research hypothesis has been as follows: the customs administration in Poland cannot be static against the challenges of the 21st century – the quality of operations, being the fundamental quality of any organization, a characteristic of any system and process, is in need of re-ordering of the entire area related to the management of customs and tax agencies as well as creating modern organization. The research problem that has been posed concerns the transformation of the customs administration in Poland – what reasons, predominantly in the organizational perspective, led to the introduced changes and whether these changes brought a positive outcome in the form of creating a new and eff ective organizational model. The research has employed descriptive analysis, preceded by a review of the subject literature and the secondary legislation. The structure of the article encompasses three parts and a summary. The fi rst section presents the development of the customs administration after World War 2, the second part concerns the reasons for and the implementation of the institutional reform, the third indicates the courses of action and development of the National Revenue Administration. The summary presents conclusions that have been drawn from the deliberations contained within the article. ; 1 marca 2017 r. funkcjonująca od 1990 r. Służba Celna stała się częścią nowego modelu zintegrowanej administracji publicznej, tj. Krajowej Administracji Skarbowej. Celem artykułu jest analiza ram organizacyjnych administracji celnej w Polsce, zidentyfi kowanie przesłanek przeprowadzenia reformy instytucjonalnej oraz wskazanie kierunków przyszłych działań nowego modelu administracji celno-skarbowej. Hipoteza badawcza została sformułowana następująco: administracja celna w Polsce nie może być statyczna wobec wyzwań XXI w. – jakość działania, będąca nadrzędną wartością każdej organizacji, cechą każdego systemu i procesu wymaga uporządkowania całego obszaru zarządzania organami celno-podatkowymi i stworzenia nowoczesnej organizacji. Postawiono pytanie badawcze, jak zmieniała się administracja celna w Polsce. Jakie przesłanki, przede wszystkim w wymiarze organizacyjnym, przyczyniły się do dokonanych zmian i czy zmiany te odniosły pozytywny efekt w postaci stworzenia nowego skutecznego i efektywnego modelu organizacji? W badaniach wykorzystano analizę opisową, poprzedzoną przeglądem źródeł literaturowych i aktów prawodawstwa wtórnego. Struktura artykułu obejmuje trzy części oraz podsumowanie. W pierwszej przedstawiono rozwój administracji celnej po II wojnie światowej, druga część odnosi się do przesłanek i wdrożenia reformy instytucjonalnej, trzecia – prezentuje kierunki działania i rozwoju Krajowej Administracji Skarbowej. W podsumowaniu zaprezentowano wnioski płynące z rozważań zawartych w artykule.

Unia celna jest jednym z najwcześniejszych i najważniejszych osiągnięć Unii Europejskiej. Jubileusz pięćdziesięciolecia jej istnienia należy uznać za znaczący fakt w historii Unii Europejskiej i dobry moment do refleksji nad jej rolą i znaczeniem. Celem artykułu jest zidentyfikowanie najważniejszych osiągnięć europejskiej unii celnej a zarazem zastanowienie się nad jej przyszłymi zadaniami. Zastosowana metodologia sprowadza się do analizy opisowej, poprzedzonej przeglądem źródeł literaturowych i aktów unijnego prawodawstwa wtórnego. Przeprowadzone rozważania pozwoliły wysunąć wniosek, że ponad pięćdziesięcioletnia historia unii celnej pokazuje, że system celny funkcjonujący w jej ramach, z powodzeniem wypełniał swoje funkcje, szybko dostosowując się do nowych zadań i coraz większych wymagań. Dalszy rozwój unii celnej jest niezwykle ważny i wymaga elastyczności i sprawności w działaniu. ; The customs union is one of the earliest and most significant achievements of the European Union. The 50th anniversary if its existence must be acknowledged as a crucial moment in the history of the EU as well as a good opportunity to reflect on its role and relevance. The aim of the article is to indicate and assess the most important achievements of the European customs union and, at the same time, to consider its future objectives. The methodology employed in the paper consists in a descriptive analysis, preceded by a review of the subject literature and the EU secondary legislation. The research findings allowed a conclusion to be drawn that the fifty years of the customs union history have shown that the customs system functioning within the EU has successfully performed its roles, quickly adapting to new challenges and everincreasing demands. The further development of the customs union is critical and requires flexibility as well as efficiency.

The EU customs system is currently a complex arrangement of customs institutions operating within the public and market space of the European Union, institutions which are strongly interlinked and perform multi-faceted tasks resulting from present challenges of the customs policy. The aim of the article is to analyze the definition of the customs system as well as to characterize the legal and organizational dimensions of the Union customs system against the background of challenges related to globalization, with a particular focus on customs administrations of Member States. The methodology employed in the paper consists in a descriptive analysis, preceded by a review of the subject literature and the EU secondary legislation as well as a comparative analysis. The research findings allowed a conclusion to be drawn that the customs system of the European Union efficiently and effectively adapts to new challenges and ever-increasing demands resulting from the changing conditions of the international trade, both in the legal aspect, i.e. regulations on trade in goods, as well as in the organizational dimension, i.e. activities of EU institutions shaping the customs system and customs administrations of Member States.

Administracje celne państw członkowskich, wykonując swoje zadania, muszą działać sprawnie i skutecznie, szybko reagować na wszelkie potrzeby wynikające ze zmiany otoczenia celnego i winny to robić tak, jakby tworzyły jeden podmiot – jedną administrację. Odpowiedź na pytanie, czy i na ile działania administracji celnych Unii Europejskiej zostały ujednolicone tak, aby można było mówić w praktyce o jednej, a nie o 28 różnych służbach celnych, jest celem artykułu. Przeprowadzone rozważania pozwoliły wysunąć wniosek, że w przyszłości nie będzie jednej administracji celnej na poziomie wyłącznie Unii Europejskiej – nadal będą funkcjonować służby celne poszczególnych państw członkowskich, z nieco różniącymi się strukturami organizacyjnymi, ale pełniącymi takie same funkcje i działającymi w oparciu o zharmonizowane prawo celne. Ważnym jest jednak, by różnice w ich funkcjonowaniu były jak najmniejsze i temu służą działania podejmowane w ostatnich latach przez Unię Europejską. ; July 1, 2018 is the 50th anniversary of the establishment of the customs union in the European Union and, at the same time, the anniversary of functioning of the Union customs system – a system composed of 28 customs administrations. In the course of performing their tasks, customs administrations of Member States need to act effectively and efficiently; quickly respond to all the needs necessitated by the changing customs surroundings and they must do it in such a way as if they were one entity – one administration. The aim of the present article is to answer the question whether, and, if so, to what extent the operations of the European Union customs administrations have been standardized so that they may be regarded as one, not 28 distinct administrations. The carried out considerations allowed drawing a conclusion that, in the future, there will be no one customs administration, functioning solely on the European Union level – there will still be customs administrations of respective Member States, with slightly-varying organizational structures but performing the same functions and acting on the basis of harmonized customs law. However, it is crucial for the differences in their functioning to be as little as possible, and that has been the main objective of steps undertaken by the European Union in recent years.
