AbstractThe institution of liability serves to mitigate the lack of care in almost all areas, whether private or business. However, we have not yet found such an institution in political decision‐making. Surprisingly, the literature has not discussed a specific institution that subjects political actors who fail to exercise due diligence in their decision‐making regarding personal liability. Hence, this paper aims to fill this gap and derive the necessity of internalizing the negative effects resulting from the imperfections of the market for political services in general and the democratic process, particularly by a liability rule. To design the new institution, we draw on the findings of corporate governance, combining economic thinking in incentives and legal knowledge expressed in the law of the corporation. In this respect, this paper is the first to make a concrete proposal for political liability accompanied by a political judgment rule. However, it is important to emphasize that the aim is not to punish a wrong decision but to provide strong incentives to prevent it ex ante. Political liability must be understood as a process‐oriented institution that considers uncertainty and decision‐making complexities. By proposing and analyzing this new institution, this work contributes to a broader discussion of incentive structures in the political process of modern democracies and shows how the political sphere can learn from the corporate world.

Abstract
As an outcome of the scientific conflict within business valuation theory in the German-speaking area, New Political Economy of Business Valuation has developed a possible approach to explain the dissemination of neoclassical valuation concepts in theory and practice. This explanatory model, designed by Quill (2016), is extended by Follert (2020) to include the share valuation in squeeze-out cases for the compensation of minority shareholders. For this purpose, the different actors in the legal mediation procedure ("Spruchverfahren")—the judge, the auditor as expert, and the conflicting parties—are modeled based on their stereotypical interests. The aim of the present paper is to introduce international scientific community to the scientific conflict between the proponents of investment-theoretical and those of the finance-theoretical conception, and to discuss the role of judicial decision-making from a legal-economic perspective. We would like to illustrate why a judge could benefit from the use of finance-theoretical valuation methods based on the neoclassical capital asset pricing model recommended by the relevant standard (so-called standard 1) of the "Institut der Wirtschaftsprüfer in Deutschland IDW" (Institute of Public Auditors in Germany) ("IDW S 1"). The analysis takes a socioeconomic perspective and argues that judicial valuation is primarily influenced by the judges' tendency to promote their own reputation and by social pressure from their professional environment and different interest groups. This paper adds a further perspective to New Political Economy of Business Valuation. Moreover, the close link between jurisprudence, economics and business economics theory is pointed out. Although the approach presented deals with the squeeze-out under German law, it may be applicable to squeeze-out arrangements in other countries as well, as long as the basic assumptions apply in their legal systems.

In ihrem in Heft 1-2 des 43. Jahrgangs dieser Zeitschrift publizierten Beitrags präsentieren Gawenko und Hinz (2020) einen Vorschlag zur Patentbewertung und tragen damit zur Diskussion um die zweckadäquate Bewertung immaterieller Vermögenswerte im Allgemeinen und die Bewertung geistiger Eigentumsrechte im Speziellen bei. Der vorliegende Beitrag setzt es sich zum Ziel, den Blick für Probleme innerhalb des Gawenko-Hinz-Modells zu schärfen. Aus Sicht der Bewertungstheorie, welche universell zur Bewertung zukünftiger unsicherer Zahlungsströme geeignet ist, ist insbesondere die Verwendung des CAPM als kritisch anzusehen, da dieses Gleichgewichtsmodell die reale Entscheidungssituation eines Gründers nicht abbilden kann. Auch der Umgang mit der gerade bei jungen Unternehmen besonders stark ausgeprägten Unsicherheit erscheint als nicht zweckadäquat. Ziel dieses Kommentars ist es, für diese Probleme zu sensibilisieren, um die Diskussion zu bereichern. Insgesamt wird es auch in Zukunft die Aufgabe der bewertungstheoretischen Forschung sein, den Spagat zwischen Individualität und Typisierung zu schaffen.

PurposeFrom the buying club's perspective, the transfer of a player can be interpreted as an investment from which the club expects uncertain future benefits. This paper aims to develop a decision-oriented approach for the valuation of football players that could theoretically help clubs determine the subjective value of investing in a player to assess its potential economic advantage.Design/methodology/approachWe build on a semi-investment-theoretical risk-value model and elaborate an approach that can be applied in imperfect markets under uncertainty. Furthermore, we illustrate the valuation process with a numerical example based on fictitious data. Due to this explicitly intended decision support, our approach differs fundamentally from a large part of the literature, which is empirically based and attempts to explain observable figures through various influencing factors.FindingsWe propose a semi-investment-theoretical valuation approach that is based on a two-step model, namely, a first valuation at the club level and a final calculation to determine the decision value for an individual player. In contrast to the previous literature, we do not rely on an econometric framework that attempts to explain observable past variables but rather present a general, forward-looking decision model that can support managers in their investment decisions.Originality/valueThis approach is the first to show managers how to make an economically rational investment decision by determining the maximum payable price. Nevertheless, there is no normative requirement for the decision-maker. The club will obviously have to supplement the calculus with nonfinancial objectives. Overall, our paper can constitute a first step toward decision-oriented player valuation and for theoretical comparison with practical investment decisions in football clubs, which obviously take into account other specific sports team decisions.

ZusammenfassungDie ökonomische Rechtsanalyse kann durch ihr spezifisches Instrumentarium und ihre Konzentration auf das Effizienzprinzip mögliche Fehlallokationen aufdecken und dem Gesetzgeber Alternativvorschläge unterbreiten. Der vorliegende Beitrag widmet sich der Rechtsanwaltsvergütung im Strafprozess und arbeitet auf Basis des ökonomischen Ansatzes heraus, dass die gegenwärtige Ausgestaltung des Rechtsanwaltsvergütungsgesetzes sowie die diesbezügliche Ausweitung der Rechte des Angeklagten Anreize setzen, die Verfahrensdauer über ein aus ökonomischer Sicht optimales Niveau hinaus auszudehnen, aus gesamtgesellschaftlicher Sicht ineffizient.

The COVID-19 pandemic affects the everyday and working life of several parts of the population. Politicians, scientists and entrepreneurs face new challenges, decisions are made under enormous uncertainty. Under the primacy of infection control, restrictive political measures have been implemented worldwide with economic, social and mental-health consequences which can hardly be assessed at present. Not at least, the pandemic has eroded bastions of freedom whose existence would have been considered unshakeable in many countries just a year ago. The present paper does not aim at a (final) evaluation of these measures. Rather, the theory of rent-seeking will be used to sketch a mechanism that will be stimulated by the current crisis and that will promote rent-seeking competition that could finally result in non-efficient resource allocations. Given a high degree of uncertainty and incomplete information on both sides of the political market, interest groups try to take advantage from this situation by putting the political actors under pressure. At the end of this chain of effects occurs the problem of restaurant bills and the question: "Who is going to pay for this?"

Der vorliegende Beitrag nimmt dies zum Anlass, die Hintergründe des Vorhabens ökonomisch zu analysieren. Dafür bietet sich die Theorie unerwünschter Handlungen an. Neben der gegenwärtigen Diskussion um höhere Strafen, zeigt der Beitrag anhand der ökonomischen Theorie auf, welche Parameter von staatlicher Seite genutzt werden können, um die Entscheidung eines potentiellen Falschparkers in die gewünschte Richtung zu lenken. Dies sind insbesondere die Entdeckungswahrscheinlichkeit, die Strafart, die Strafhöhe sowie die Gewissenskosten des potentiellen Falschparkers. Auf modelltheoretischer Ebene werden einerseits das Verhalten des potentiellen Falschparkers und andererseits das Verhalten der Kommune diskutiert. Der Aufsatz liefert insofern einen Beitrag zur Stadtökonomik und zeigt verkehrspolitische Implikationen auf.

This article takes this as an opportunity to analyze the economic background of the project. Here the theory of crime offers itself. In addition to the current discussion about higher fines, the paper uses economic theory to show which parameters can be influenced by the state to steer the decision of a potential parking offender in the desired direction. These are, in particular, the probability of detection, the amount of the penalty, the type of penalty as well as the costs of the potential parking offender's conscience. On a model-theoretical level, the behavior of the potential parking offender on the one hand and the behaviour of the municipality on the other hand are discussed. The paper thus contributes to urban economics and shows the implications for transport policy.

ZusammenfassungDer Begriff des Plagiats ist spätestens seit der Causa zu Guttenberg einer breiten Bevölkerung bekannt. Auch in der Wissenschaft mehren sich Fälle von Plagiaten sowie von Eigenplagiaten. Für letztere stellt sich die Frage nach der Beurteilung aus der Perspektive der Institutionenökonomik im Allgemeinen und der Theorie des Urheberrechts und der Verfügungsrechte im Besonderen. Der vorliegende Beitrag analysiert aus dieser Perspektive, warum Wissenschaftler Eigenplagiate begehen und welche Effekte damit verbunden sind. Damit wird versucht, einen Beitrag zur Versachlichung der Diskussion zu liefern.
