"This book addresses the specific position of domestic workers in the context of evolving human rights norms. Human rights law has somewhat belatedly begun to address the structured inequalities and exclusions that define the domain of domestic work. The continuum of exploitation that has historically defined the everyday of domestic work exclusion from employment and social security standards and precarious migration status have frequently been neglected. However, as in other areas of international law, it is primarily the moments of crisis, incidents of human trafficking, slavery or forced labour, that have captured the attention of human rights law. Drawing upon a broad range of case studies, Care, Migration and Human Rights presents a thorough examination of key issues such as the commodification of care, the impact of the jurisprudence of the CJEU and the European Court of Human Rights on 'primary care providers', as well as the effect that trends in migration law have on migrant domestic workers. Recent years have witnessed significant developments in international human rights law relating to domestic violence. No longer viewed as a matter 'essentially within the domestic jurisdiction of the State', domestic violence now frequently commands the attention of international human rights bodies. The obligations imposed on States include positive obligations of due diligence to prevent, investigate and to punish domestic violence, whenever and wherever it occurs.1 Judicial dialogue across the borders of human rights and refugee law has also expanded access to asylum for women fleeing domestic violence, bringing with it a gradual recognition of the positive obligations that international law now imposes on States. However, as recent cases such as Jessica Gonzalez v the United States2 and Opuz v Turkey3 reveal, significant gaps remain between the rhetoric of human rights law and the reality of everyday enforcement and implementation on the ground. These gaps are most keenly felt by refugee women. While State practice suggests greater gender inclusivity and sensitivity in the practice of refugee law, women fleeing domestic violence continue to face obstacles in making their claims heard.

Tensions between the constitutional commitment to equality and the politicization of Islam create conflicting claims for Pakistan's legal system. These claims have focused, in particular, on the sphere of intimate domestic and sexual relationships. Although the fundamental rights chapter of the Constitution guarantees equality before the law, the pursuit of gender equality has frequently been sacrificed to religious-cultural claims defining and limiting women's status. Yielding to such claims has served the interests of nation-building while at the same time guarding against any serious threat to the modernizing agendas of Pakistan's political élite. Lost within such compromises is the recognition of women as bearers of rights, with equal rights to participate in the definition of religious-cultural norms. Lost also is a recognition of difference. Feminists, Islamic reformists and secularists have all been marginalized and excluded from a state that claims to guarantee equality to all. This article examines the strategies pursued by feminist movements within Pakistan and within the legal profession in attempting to resist the demands of conservative Islamist movements.

This article forms the introduction to a special issue on comparative perspectives on the regulation of abortion and on the sociopolitical contexts within which proposals to expand access to abortion for women are won and lost. This introduction frames the collection of articles in the special issue and highlights key themes that reappear throughout the articles, such as the risks associated with the turn to law to secure the vindication of rights. Many of the articles contained in the special issue are concerned with the 'after-rights' moments associated with the implementation of abortion law in practice.

Human rights law has begun to address the inequalities and exclusions that structure the domain of domestic work. The "everyday" of exclusions from employment law and social security, and precarious migration status, had, until recently, attracted only limited attention. This article examines the reforms introduced in the Overseas Domestic Workers (ODW) visa regime in the United Kingdom. The move towards a more precarious migration status for migrant domestic workers marks a rejection of the reforms secured through sustained political activism. It also highlights the contingency and instability of political moments that secure progressive change for migrants, and the enduring limits of human rights law.
