The paper offers a short introduction into the legal framework of the Croatian and Italian labour law system with respect to agency work. The European Union legal framework, some of the most important cases of the Court of Justice of the European Union as well as common issues in both countries are also elaborated upon. More importantly, the paper also addresses some specificities which could be used de lege ferenda in both countries. ; Rad obuhvaća kratki uvod u pravni okvir hrvatskoga i talijanskog sustava radnog prava u pogledu agencijskog rada. Osim toga, u radu se daje prikaz pravnog okvira Europske unije u tom području, predstavljaju se neke od najvažnijih odluka Suda Europske unije, kao i zajednička rješenja oba pravna sustava. The paper aims at analysing Croatian professional sport and the impact of the COVID-19 crisis on it. Football was taken as a model for other team sports because of the share of professional sports clubs in the Republic of Croatia in football. In addition, the legal framework set in football may apply to other sports for successfully developing a similar pattern. The analyses are conducted into the revenues (sponsorships, ticketing and TV rights), and expenses (expenses on behalf of players remuneration) of the football clubs in the First Croatian Football League, providing an overview of the professional status of sports clubs, athletes and coaches. It also encompasses an analysis into measures taken by the Government of the Republic of Croatia to support Croatian sport during the COVID-19 crisis. The COVID-19 crisis has been taken as a possible starting position for better regulation of sports in future, especially as regards the professional sports in the Republic of Croatia contributing significantly to the promotion of the Republic of Croatia worldwide.
This book presents the findings of a project (2018–2019) that undertook evidence-based research in order to promote and support good governance in the context of the regulation of football players' agents (now referred to as 'intermediaries') in the European Union. The project recieved financial support under the EU's Erasmus+ Programme. The findings was supported by national reports and stakeholder input at international seminars.
The organisation of work and employment relations is a core issue of social policy, but also touches on fundamental questions of the political and legal order of communities. While employment relations have been researched in detail with regard to the general structure of employer-employee relations, there are hardly any information and studies available on the employment relations in the specific area of sport governance. This is even more the case in so-called Olympic sports that are organised outside of professional leagues and where athletes only rarely have an employment contract with a club. Against the backdrop of various approaches to sport governance on the national level and an increasing number of conflicts between athletes and sport governing bodies, this Fact Report provides unique data on the employment and social relations of athletes in Olympic sports in 29 European countries (27 EU members + Norway + UK). Data were gathered by national experts of the 29 countries and presented in five Regional Summaries (Northern, Central, Eastern, South-Western and South-Eastern Europe). The findings of the report serve as a sound basis for engagement with and discussion among the different stakeholder groups on the international, continental, national and regional level. As a result, the project team first looked more closely at the fields of enquiry and categories of employment relations in the specific context of sport and developed a research tool (January to April 2021). Adding to that, the large number of countries, the different approaches to sport governance and policy as well as the short time span of the data collection period (from April 2021 to August 2021) yield that the findings presented in this Fact Report are interim. The data and findings will be updated over the course of the project period (until December 2022).
Sports policy is somewhat of 'a new kid on the block' for the EU. It only acquired a competence in sport following the adoption of Lisbon Treaty in 2007, in force since 2009. This is not to say the EU lacks experience in sporting matters. For many years, the EU institutions have grappled with the issue of how to reconcile the specificity of sport with the demands of EU law. This debate is ongoing, but not the subject of our enquiry. Our focus is to assist the EU in considering the merits of adopting a sport diplomacy strategy, first mooted by a High-Level Group on Sport Diplomacy in 2016. Four members of that group form part of the research team for this study. EU action since that report indicates enthusiasm for sport diplomacy. However, to act effectively in this relatively new field of EU activity, the EU institutions and the Member States require an evidence-base. The aim of our project was to undertake primary research and stage a series of Multiplier Sport Events (MSE) to provide such evidence on the efficacy of sport as a diplomatic tool. During our six MSEs, we invited a wide range of actors to share their thoughts and experiences on the practice of sport diplomacy. These events reinforced our view of the value of sport in helping the EU achieve its external relations ambitions. In this study, we claim that now is the time for the EU to act more strategically in this field and adopt an EU Sport Diplomacy Strategy.
