ZusammenfassungMenschen mit einer Autismus-Spektrum-Störung zeigen die gesamte Vielfalt sexueller Fantasien und sexuellen Verhaltens ebenso wie ihre nichtbetroffenen Peers. Dennoch finden sich auch einige Besonderheiten in sexuellem Erleben und Verhalten bei Menschen mit einer Autismus-Spektrum-Störung, die größtenteils auf die störungsspezifischen Symptome zurückzuführen sind. Hierzu zählen eine höhere Diversität bezüglich der eigenen sexuellen Orientierung sowie des eigenen Geschlechtsrollenverständnisses, aber auch Probleme im Hinblick auf das Eingehen von festen Partnerschaften oder im Hinblick auf die eigene sexuelle Funktionsfähigkeit. Darüber hinaus finden sich bei manchen Personen mit einer Autismus-Spektrum-Störung (insbesondere bei Männern) Hinweise auf das Vorliegen hypersexueller Verhaltensweisen sowie paraphiler sexueller Fantasien und Verhaltensweisen. Bisher existieren keine empirischen Befunde, die nahelegen, dass eine Autismus-Spektrum-Störung einen Risikofaktor für allgemeine oder sexuelle Straffälligkeit darstellt. Basierend auf Fallstudien wurden jedoch einige Erklärungsansätze publiziert, die beschreiben, wie in einigen wenigen Fällen die autismusspezifische Symptomatik mit zu der Begehung einer Straftat beigetragen haben könnte, was auch bei der Schuldfähigkeitsbegutachtung Berücksichtigung finden könnte. Hierzu zählen eine fehlende Opferempathie, das Vorliegen kognitiver Verzerrungen oder defizitäre Kommunikations- und Interaktionsfertigkeiten. Straftäter mit einer Autismus-Spektrum-Störung sollten individuell auf sie zugeschnittenen psycho- und pharmakotherapeutischen Interventionen zugeführt werden, um eine erneute Straffälligkeit im besten Falle zu verhindern.

In the United States, many states have sought the objective of uni- formity by enacting the Uniform Division of Income for Tax Purposes Act (UDITPA). In addition, many of those same states have entered into the Multistate Tax Compact (MTC). The salutary objective of both the UDITPA and the MTC is to provide uniform rules for the allocation and apportionment of income, in order to facilitate both compliance and enforcement, as well as to reduce the likelihood of double taxation. The promised uniformity, however, has been at the same time both illusive and elusive. Experience with the UDITPA and the MTC in the United States has demonstrated that a multilateral treaty would not achieve uni- formity amongst the numerous sovereign countries of the world, primarily because there is no paramount supervisory body in the international arena. At the same time, uniformity could be achieved within the United States by pre-emptive federal legislation uniformly interpreted and ap- plied to all of the states. The uniform application of an apportionment formula to distribute the tax base of a multijurisdictional unitary enter- prise would avoid many of the problems of the separate entity approach, producing a fair, equitable determination of the tax base for state income taxes. Part II of this article will examine the treatment of business income of multinational enterprises under tax treaties, and Part III discusses the determination of the tax base of such enterprises. Part IV examines the evolution of the law pertaining to state imposed taxes on, or measured by, the net business income of multistate unitary enterprises, the issues of jurisdiction and the determination of the tax base. Part V addresses vari- ous attempts to achieve uniformity in state taxation. Part VI suggests that in the international setting, the goal of uniformity is unlikely to be achieved by a multilateral treaty, but that within the United States, pre- emptive federal legislation should be enacted.

For a particular subgroup of individuals with severe paraphilic disorders and a high risk of sexual recidivism, the combination of sex drive–reducing medications and psychotherapy is a promising treatment approach. The present quasi-experimental study aims at comparing differences in clinical characteristics and dynamic risk factors between persons receiving (+TLM, n = 38) versus not receiving (−TLM, n = 22) testosterone-lowering medications (TLMs). Individuals receiving TLM were more frequently diagnosed with paraphilic disorders. Neither the criminal history nor average risk scores differed between the two groups. In the +TLM, Stable-2007 scores showed a stronger decrease after TLM treatment was started. This accounted especially for the general and sexual self-regulation subscales. Individual variations in risk, however, were not predicted by TLM but were significantly related to treatment duration and Psychopathy Checklist–Revised (PCL-R) Factor I. Paraphilic patients with problems in self-regulatory abilities seem to profit most from pharmacological sex drive–reducing treatment. Furthermore, therapists seem to underestimate deviant sexual fantasies in medicated patients.

ZusammenfassungDas Selbstregulationsmodell sexueller Rückfälligkeit ("self-regulation model of the relapse process", SRM) stellt eine Theorie zur Ätiologie sexueller Delinquenz und Rückfälligkeit dar, bei der sexuell motivierte Straftaten und Täter unterschiedlichen Rückfallpfaden und Entscheidungswegen zugeordnet werden, von denen aus wiederum auf individuelle Motive, Defizite und Ressourcen geschlossen werden kann. In der vorliegenden Studie wurde eine Stichprobe von N = 68 Männern, die mindestens eine sexuell motivierte Straftat gegen Kinder begangen haben, in Bezug auf die SRM-Typologisierung beurteilt und hinsichtlich verschiedener klinischer, demografischer und kriminologischer Merkmale verglichen. Unter Verwendung des SRM konnten 25 % (n = 17) dem annähernd-expliziten, 25 % (n = 17) dem vermeidend-passiven, 22,1 % (n = 15) dem annähernd-automatischen und 13,2 % (n = 9) dem vermeidend-aktiven Rückfallpfad zugeordnet werden. Männer mit Annäherungszielen wiesen im Vergleich zu denen mit Vermeidungszielen höhere Werte im Static-99 und ein entsprechend höheres Rückfallrisiko auf. Außerdem wurde bei Männern mit Annäherungszielen häufiger die Diagnose einer Pädophilie gestellt. Die Ergebnisse liefern erste Hinweise dafür, dass das SRM ein nützliches theoretisches Modell sein kann, um Gemeinsamkeiten zwischen Männern, die aufgrund eines Kindesmissbrauchsdelikt verurteilt wurden, aufzudecken.

The Explicit and Implicit Sexual Interest Profile (EISIP) is a multimethod measure of sexual interest in children and adults. It combines indirect latency-based measures such as the Implicit Association Test (IAT), Viewing Time (VT), and explicit self-report measures. This study examined test–retest reliability and absolute temporal agreement of the EISIP over a 2-week interval in persons who were convicted of sexual offenses against children ( n = 33) and nonoffending controls ( n = 48). Test–retest reliability of the aggregated EISIP measures was high across the whole sample ( rtt = .90, intraclass correlation coefficient [ICC] = .90) with the IAT yielding the lowest retest correlations ( rtt = .66, ICC = .66). However, these indicators of relative reliability only quantify the temporal stability of individual differences within the group, not the detectability of individual change. Absolute temporal agreement as assessed via Bland–Altman plots ranged from one fourth to three thirds of a standardized unit in the sexual preference scores. This implies that individual change has to exceed medium to large standardized effect sizes to be distinguishable from spontaneous temporal variation in the EISIP measures. Overall, scores of combined measures were largely superior to single measures in terms of both absolute and relative reliability.
