'Thema dieses Beitrags sind neuere gemeinschaftsorientierte Formen 'sozialer' Kriminalprävention, die zu einem nicht unwesentlichen Teil von personenbezogenen sozialen Diensten getragen werden. Dabei ist das zentrale Argument, dass auch in einem neoliberalen, manageriellen Kontrolldiskurs soziale und sozialpolitische Ansätze aus den präventiven Bemühungen keineswegs einfach verschwunden sind, sondern teilweise sogar deutlich an Gewicht gewonnen haben. Allerdings haben sich im Kontext einer veränderten Konstitution und Regulation des Sozialen, auch die Strategien und Methoden 'sozialer Kriminalprävention' verändert. Eigenverantwortung sowie die Erfordernisse und partikularen Hegemonieverhältnisse parochialer, lokaler Netzwerke geraten dabei in den Mittelpunkt des Interesses. Es wird die These entwickelt, dass die Verlierer, die in diesem 'weichen', auf einer Aktivierung von 'sozialem Kapital' basierenden Kontrollspiel erzeugt werden, gleichzeitig den Kern jener Gruppen darstellen, auf die sich die punitiven, 'post-sozialen' Kontrollstrategien richten.' Hendrik Möller (Widersprüche, 2018, 149, S. 17-28) hat verdeutlicht, dass sich die Bedeutung der Rede von der Kindeswohlgefährdung erst über ihre jeweilige normative Einbindung erschließt. Dies gelte insbesondere im Kontext einer Kinder- und Jugendhilfe, die Kindeswohlgefährdungen formuliert, die unterhalb der Schwelle liegen, an der ein familiengerichtlicher Kindeswohlgefährdungsbegriff staatliche Eingriffe in das Personensorgerecht begründet. An dieses Analyse anschließend argumentiert der folgende Beitrag, dass nicht nur der Grenzbegriff der Kindeswohlgefährdung sondern vor allem der Bezug auf das Kindeswohl eine notorisch problematische Referenz auf die Kategorie des guten Lebens darstellt. Die derzeit sichtbar werdenden Anschlüsse der Kinder- und Jugendhilfe an obrigkeitliche Traditionen sind in dem Kindeswohlbegriff selbst angelegt. Für eine emanzipatorische Kinder- und Jugendhilfe stellt er indes keine angemessenen Deutungen bereit.

Die Autoren kritisieren die regressiven Tendenzen in der Reformdiskussion. Am Beispiel der Teilhabekategorie machen sie deutlich, dass dieser progressiv notierte Begriff durchaus den Einstieg in eine regressive Umdefinition bieten kann und fragen nach den Bedingungen einer Partizipation, die Teilhabe und Selbstbestimmung als Aspekte sozialer und politischer Gerechtigkeit praktiziert.

"Die Ersetzung sozialstaatlicher sowie sozialpädagogischer und sozialarbeiterischer Hilfen durch justizielle Sanktionen gilt als ein Anzeichen für wachsende Punitivität. Hintergrund dessen ist die Annahme, dass Hilfen und Strafen alternative und gegensätzliche Reaktionsweisen auf Delinquenz sind. Demgegenüber akzentuiert der vorliegende Beitrag, dass sanktionskritische Haltungen inzwischen auch in der Sozialen Arbeit in Frage gestellt werden und die Grenze zwischen Hilfen und Strafen weniger klar ist, als gewöhnlich angenommen wird. In der Folge ist es erforderlich, soziale Hilfen nicht mehr nur als eine Alternative zu strafrechtlichen Sanktionen, sondern auch als einen möglicher Bestandteil punitiver Praktiken in den Blick zu nehmen." "Der Artikel setzt sich mit dem Phänomen auseinander, dass die 'wohlfahrtstaatliche' Institution Soziale Arbeit im Kontext einer 'post-wohlfahrtstaatlichen' Neugestaltung des Feldes der Kriminalitätskontrolle keinesfalls substanziell an Bedeutung verloren hat. Soziale Arbeit lässt sich dabei - so die These - weder einfach als wohlfahrtsstaatliches Relikt verstehen, dass einer von der Idee des Sozialen abgewandten Entwicklung zu trotzen vermag, noch hat Soziale Arbeit ihre rehabilitative Orientierung und Funktion als 'people-changing' Agentur aufgegeben. Die Dynamiken im Feld der Kriminalitätskontrolle sind komplexer, als die Debatten um ein post-soziales punitives Risikomanagement oft nahe legen: Soziale Arbeit lässt sich dabei weniger als Antipode sondern vielmehr als produktiver Träger der gegenwärtigen Umgestaltungen des wohlfahrts- und kriminalstaatlichen Arrangements verstehen." Capabilities are conceptualized as people's freedom to choose and conduct a life they have reason to value. The contributions of this volume analyze what social institutions – in particular in the field of education and welfare – may provide in order to enhance capabilities in particular for most vulnerable people

The contributions analyze what social institutions - in particular in the field of education and welfare - may provide in order to enhance capabilities in particular for most vulnerable people. The capabilities approach to social justice does not primarily outline a transcendental philosophical theory of justice but rather a perspective which opens up a conceptual foundation for empirical social research in real life situations. Focusing on the freedoms to achieve actual livings that individuals can have reason to value, the capabilities approach promises to be a fruitful perspective for developing and justifying evaluative metrics for assessing welfare and educational policies. While the potentials and limits of the capabilities approach have been intensively discussed on general and conceptual levels, the role of organizations and institutions for enhancing capabilities is still a blind spot. Capabilities Approach The authors assess the potentials and pitfalls of the Capabilities Approach to issues of education and welfare. Renowned philosophers, sociologists, psychologists, economists and educational scientists explore the conceptual and practical implications of this approach for delivering socially just policies. The volume analyses the potentials and pitfalls of the Capabilities Approach (CA) which was initially developed by the Indian economist Amartya Sen and the American philosopher Martha Nussbaum. CA is considered as a philosophical approach to social justice, a scientific approach to research welfare production and eventually as a potentially new practically adoptable fundament for educational and social service delivery. CA is one of the currently most influential attempts to reconcile the competing demands which are associated with the fundamental conceptions of equality, recognition and liberty and advocates an egalitarian, political conception of social justice which is concerned with the cultivation, maximization and just distribution of the (real) freedom of individuals. Renowned philosophers, sociologists, psychologists, economists and educational scientists investigate the complex relation of education and welfare against the background of major economic, political and cultural transformations within and across European societies.
