A estos interrogantes se les puede dar una respuesta neoliberal que no parte de la garantía multinivel de los derechos fundamentales (más bien se puede decir que es ajena al lenguaje de los derechos), sino ante todo de establecer la creación de mercados de trabajo flexibles neutralizando o dejando en un segundo plano la finalidad fundamental del ordenamiento laboral de reducir la desigualdades económicas y sociales inherentes a la relación laboral y empoderar a los trabajadores a través de la reconocimiento del papel sociopolítico de las organizaciones sindicales de identidad colectiva del trabajo. Pero cabe otro tipo de respuesta radicalmente diferente, partiendo de que esos interrogantes incorporan un fin de política del Derecho, que en el constitucionalismo con Estado Social de Derecho no puede ser otra que la de garantizar la efectividad plan de los derechos sociales fundamentales y para que el Derecho del Trabajo sea una rama del ordenamiento jurídico que garantice un doble equilibrio: entre la racionalidad económica y la racionalidad social, por un lado, y por otro, un equilibrio de los poderes empresariales y sindicales en el ejercicio de la libertad sindical, la negociación colectiva y la huelga.
