The government of Ukraine intends to intensify the work on the Association Agreement with the EU. The convergence with the progressive international political and economic union necessitates a thorough study of the EU institutions in the theoretical level.Defining of the competence of its organs and the distribution of powers among them are of particular interest, and the article is dedicated to the study of these facts.The powers of the European Council, the EU Council and the European Parliament are investigated, as well as their distribution among these authorities of the EU. The new approaches to the European Union as an international organization that has features of federation are made, and the role and importance of the European Commission in its system bodies is shown.It is emphasized that the entry into legal force of the Lisbon Treaty the European Council acquires the status of a full-fledged EU institution. Therefore, the decisions made by this organization can be regarded as acts which have legal effect and operate within both the EU and the Member States. The institutions, bodies and organizations, as well as the Member States, to which its decisions are addressed, are legally bound to meet them and to ensure their enforcement. New powers were given to the European Parliament and the Council. The Commission received higher authority like the authority of the executive power. ; Досліджено повноваження Європейської ради, Ради ЄС, та Європарламенту, а також їх розподіл між вказаними органами Євросоюзу. Summary. The defeat of the Ukrainian national forces in the liberation struggles of 1917–1921, as well as the confrontation between two centers of the state ‒ the Ukrainian People՚s Republic and the Western Ukrainian People՚s Republic, put сolonel Ye. Konovalets before the choice of what should be done next. Until August 1920 he formally remained in the Army of the Ukrainian People՚s Republic and made attempts to lead the Ukrainian Rifle Brigade in Jablonné v Podještědí. At the same time, Ye. Konovalets did not support the union of the Ukrainian People՚s Republic with Poland at the cost of the Western regions of the UPR. Similarly, he did not prop up the policy of the Western Ukrainian People՚s Republic into rapprochement with Bolshevik Russia. He began to create a revolutionary military-political organization, distancing himself from the state centers of the Ukrainian People՚s Republic and the Western Ukrainian People՚s Republic and relying on the Riflemen՚s Council. The goal of this activity was a continuation of the struggle for the revival of statehood. This work was carried out by some members of the Rifle Council in Lviv. At the same time Ye. Konovalets supported attempts to create an all-Ukrainian political center in the conditions of emigration. The principal aim of this center would be over the confrontation between the governments of the UPR and ZUNR, and leading the process of revival of statehood in the future. As a result, the All-Ukrainian National Council was established in Vienna in January 1921. Ye. Konovalets was invited to join its development. He estimated the creation of the national council positively and was a member until its dissolution in April 1921. The principles of historicism, objectivity and critical approach form the methodological basis of the research. Scientific novelty. For the first time, factual material about the activities and attitudes of Ye. Konovalets to the All-Ukrainian National Council was introduced into scientific circulation. Conclusions. Thus, it was another unsuccessful attempt to join the initiatives to create an all-Ukrainian national center in the emigration with the aim of consolidation of the military, politicians and public figures to overcome the contradictions between the UPR and ZUNR. The next stage of activity would be return to Lviv and work on the development of a revolutionary underground Ukrainian military organization which would be headed by Ye. Konovalets. ; Анотація. Поразка українських національних сил у визвольних змаганнях 1917–1921 рр., а також протистояння між двома державними центрами УНР та ЗУНР, поставили полковника Є. Коновальця перед вибором: що робити далі? До серпня 1920 р. формально залишався в складі Армії УНР та робив спроби очолити Українську стрілецьку бригаду в Німецькому Яблонному. При тому не поділяв союз УНР з Польщею ціною Західних областей УНР. Так само не поділяв політику ЗУНР на зближення з більшовицькою Росією. Дистанціювавшись від державних центрів УНР і ЗУНР та опираючись на Стрілецьку раду, розпочав творити революційну військово-політичну організацію, яка продовжила б боротьбу за відродження державності. Ця робота деякими членами Стрілецької ради проводилася у Львові. Одночасно Є. Коновалець підтримував в еміграції спроби створити всеукраїнський політичний осередок, який був би над протистоянням між урядами УНР та ЗУНР, а в перспективі очолив процес відродження державності. У результаті, в січні 1921 р. у Відні було створено Всеукраїнську національну раду, до розвитку якої отримав запрошення долучитись і Є. Коновалець. Створення національної ради він оцінив позитивно та був її членом до розпаду в квітні 1921 р. Методологічною основою статті є принципи історизму, об՚єктивності та критичного підходу. Наукова новизна. Уперше до наукового обігу введено фактичний матеріал, який комплексно розкриває діяльність та ставлення Є. Коновальця до Всеукраїнської національної ради. Висновки. Отже, це була чергова невдала спроба доєднатися до ініціатив зі створення всеукраїнського національного центру в еміграції, що об՚єднував би військових, політиків та громадських діячів для подолання суперечності між середовищами УНР та ЗУНР. Наступним етапом діяльності стане повернення до Львова і робота над розбудовою революційної підпільної організації, командиром якої і стане Є. Коновалець, – Української військової організації.

The article examines the organizational and legal aspects of the process of liquidation of national districts and village councils in the Ukrainian SSR in the 1930s. It was established, that the formation of national administrative-territorial units in the 1920s - early 1930s contributed to the involvement of representatives of national minorities in the main measures of Soviet state formation, the growth of their socio-economic and national-cultural level, ensuring the realization of constitutional rights of national minorities. It was found out, that at the stage of establishment of the totalitarian regime, the leadership of the USSR began to see the existence of national districts and village councils the threat of isolation of the population from the holistically built Soviet propaganda system and the impediment to the implementation of total control over society. In new Constitution of the USSR in 1936 and developed on its basis constitution of the USSR in 1937 constitutional and legal guarantees of existence of national districts and village councils disappeared, which in conditions of Soviet reality meant their rapid further elimination. It is determined, that a kind of catalyst that accelerated the process of liquidation of national administrative-territorial units was the introduction of the policy of deportations and mass political repression against representatives of national minorities in the second half of the 1930s. It is emphasized, that the requirement to eliminate national districts and village councils was adopted in December 1937 by the highest party leadership of the USSR. It was proved, that the process of liquidation of national districts and village councils in Ukraine had a number of features, due to both the deployment of the propaganda campaign for the election of the first composition of deputies of the Supreme Soviet of the USSR in the spring of 1938, and further organizational preparation for the January 1939 re-census of the population of the USSR, which led to the temporary ...

The Ruthenian Council as a political society, having united individuals with double-stage Ukrainian/Ruthenian-Polish identity in Halychyna under the Austrian rule in 1848, has no elaborated historiographic tradition. Within the categories of modern national consciousness the Ruthenian Council was a marginal formation harmonizing with neither Ukrainian nor Polish national historical metanarrative. Whereas Ukrainian historians used to interpret the society as a tool in the hands of Poles for the restriction of national rights of Ukrainians from Halychyna, Polish authors preferred to overlook the latter, viewing it as an example of unsuccessful Polish politics in the Ukrainian matter. The interpretations were slightly altered only within the last decade when the historians included the Ruthenian Council into the chain of national and political orientations that determined the development of Galician Ruthenian community in the middle of the 19 th century. The Ruthenian Council has no marked and complete source database. It is intertwined with a wider range of texts – act materials, press publications, reminiscences, correspondence that are mainly known to the historians but which are used just in the context of the activity of the Principal Ruthenian Council and the Polish People's Central Council – national and representative organizations that became the symbols of main tendencies in the national development. У категоріях модерної національної свідомості Руський собор був маргінальним утворен-ням і не вписувався ні в український, ні в польський національний історич-ний метанаратив. Якщо українські історики трактували товариство як зна-ряддя в польських руках для обмеження національних прав галицьких українців, то польські автори взагалі воліли обминати його увагою, позаяк бачили в ньому приклад невдалої польської політики в українському питанні. Деякі зміни в інтерпретаціях з'явилися щойно в останнє десятиліття, коли історики включили Руський собор в мережу національно-політичних орієн-тацій, які визначали розвиток галицько-руської спільноти в середині ХІХ ст. Вираженої та цілісної джерельної бази Руський собор не має. Вона вплетена в ширші тексти – актові матеріали, публікації в пресі, спогадові пам'ятки, листування, які історикам переважно відомі, але використовуються ними переважно в контексті діяльності Головної руської ради та польської Цент-ральної ради народової – національно-представницьких організацій, що стали символами магістральних напрямів національного розвитку. The article deals with the history of the construction and functioning of one of the most famous Kyiv buildings, which was used as the premises of the Ukrainian Central Council during the Ukrainian Revolution. The construction and the concept of this building are analyzed, and a description of the interior and exterior finishes. The process of transition of the building to the status of the house of meetings of the Central Rada was revealed in detail, its further fate was revealed, the functional transformation that took place with it in different periods of existence was investigated. Thus, the author found out that the building was erected in 1910-1912 by architect P. Alyoshin for the Tsarevich Aleksey (Romanov) Pedagogical Museum in the Art Nouveau style based on the Russian Empire style. From March 1917 the Ukrainian Central Rada worked here (it became a full-fledged "master" of the building since October 1917). It was time when the first changes in the exterior and interior of the house occurred - the Russian imperial coat of arms and the corresponding inscriptions were removed; the UNR coat of arms - Trizub was mounted on the wall; instead of the bas-relief portrait of Tsarevich Alexei, a portrait of Taras Shevchenko was placed, the imperial symbolism was dismantled. A little later, the boardroom was decorated with the emblems of five provinces whose Ukrainian jurisdiction was recognized by the Provisional Government (in 1923, the emblems as a relic of the "counter-revolutionary Council" would be abolished by the new government). In 1920-30s the building on Volodymyrska Street hosted many Soviet institutions (the Institute of International Relations, the Proletarian Museum and the Kyiv Provincial Eastport, the Museum of the Revolution, and the Kyiv Regional Executive Committee). In 1937 it was decided to arrange here a branch of the Moscow Museum of Volodymyr Lenin, having completed and reconstructed the existing premises. Architect Alyoshin, while maintaining the unity of style, extended the sides of the interior and closed them with a block parallel to the man's part, which formed a small courtyard. Interior planning and decoration have also undergone changes - so much of the stucco has been removed, and polychromy has been eliminated (similar activity occurred in the early 1950s). The general conclusion is that changes and transformations of the house on Volodymyrska Street, unconventional for Kyiv architecture, in most situations were controlled by architect P. Alyoshin, who retained the architectural features of the early twentieth century, and the introduction did not violate the overall impression. ; У статті розглянуто історію створення та функціонування будівлі у місті Києві, яка під час Української революції використовувалась як приміщення Української Центральної Ради. Проаналізовано будівництво та концепт, за яким зводився цей будинок, представлено опис внутрішнього та зовнішнього оздоблення. Докладно розкрито процес переходу будівлі до статусу дому засідань Центральної Ради, виявлено її подальшу долю, досліджено функціональну трансформацію, що відбувалася з нею у різні періоди існування. Так, автором з'ясовано, що споруда була зведена у 1910-1912 рр. архитектором П. Альошиним для Педагогічного музею імені царевича Олексія (Романова) у стилі модерн на основі російського ампіру. З березня 1917 р. тут працювала Українська Центральна Рада (повноцінним "господарем" споруди вона стала із жовтня 1917 р.). Саме тоді відбулися перші зміни в екстер'єрі та інтер'єрі будинку – були зняті російський імперський герб та відповідні написи; на чоловій стіні встановлено герб УНР – Тризуб; у залі замість барельєфного портрету цесаревича Олексія розміщено портрет Т.Г.Шевченка, демонтовано імперську символіку. Трохи пізніше зал засідань було оздоблено гербами п'яти губерній, чию українську юрисдикцію визнав Тимчасовий уряд (у 1923 р. герби як пережиток "контрреволюційної Ради" будут ліквідовані новою владою). У 1920-30-х рр. в приміщенні по вул. Володимирській розміщувалася низка радянських установ (Інститут міжнародних відносин, Пролетарський музей та київський губерніальний Істпарт, Музей Революції, Київський обласний виконавчий комітет). У 1937 р. було принято рішення влаштувати тут філію московського музею В. І. Леніна, добудувавши і реконструювавши існуюче приміщення. Архітектор Альошин, зберігаючи єдність стилю, поширив бічні сторони вглиб ділянки та замкнув їх блоком, паралельним чоловій частині, чим було утворено невеликий двір. Внутрішнє планування та оздоблення також зазнало певних змін – так, значну частину ліпнини було знято, ліквідовано поліхромність (аналогічна діяльність відбулася й на початку 1950-х рр. ). Зроблено загальний висновок, що зміни і трансформації досить нетрадиційного для київської архітектури будинку по вулиці Володимирській, 57 у більшості ситуацій контролювалися архітектором П. Альошиним, який зберіг стильові особливості архітектури початку ХХ століття, а привнесене не порушувало загального враження.
Transformations of the labour market and education have led to changes in the national system of professional qualifications, in particular, the search for new institutional mechanisms for public policy on qualifications. Based on the analysis of the relevant legal framework and own reflections, the article considers the activities of sectoral (sectoral-professional) councils that regulate professional qualifications and standards and serve as an institutional basis for reconciling the interests of various stakeholders in qualifications policy.Differences in the regulation of sectoral councils in the EU and Ukraine have been identified. In most European countries, sectoral councils, which develop professional standards and analyze the needs for professional qualifications, operate under a central executive body responsible for education policy or a main body that administers professional qualifications and coordinates sectoral councils. These councils have a clear structure and state funding. In Ukraine, branch councils are created by employers' organizations that do not have clear legal regulations and state funding (they are essentially self-governing and self-regulatory). At the same time, sectoral councils play an essential role in developing professional standards as requirements for the competence of employees (80% of approved professional standards in Ukraine were developed by sectoral councils).Legislative initiatives on sectoral councils to develop professional standards, which are designed to preserve the self-governing nature of councils and give them vast powers in the field of professional qualifications, are assessed. The author's vision of the functioning of sectoral councils for the development of professional qualifications as collegial bodies of the National Qualifications Agency, which are based on the principles of social partnership, includes representatives of various subjects of qualifications policy. This will allow expanding the institutional policy mechanism for professional qualifications. ; Трансформації ринку праці та освіти зумовлюють зміни у національній системі професійних кваліфікацій, зокрема, пошуку нових інституційних механізмів публічної політики щодо кваліфікацій. У статті – на основі аналізу відповідної нормативно-правової бази та власних рефлексій – розглянуто діяльність галузевих (галузево-професійних) рад, які регулюють професійні кваліфікації та професійні стандарти, та слугують інституційною основою узгодження інтересів різних стейкхолдерів політики щодо кваліфікацій.Встановлено відмінності у регулюванні діяльності галузевих рад у країнах ЄС та в Україні. У більшості європейських країн галузеві ради, які займаються розробленням професійних стандартів та аналізом потреб у професійних кваліфікаціях, діють при центральному органі виконавчої влади, який відповідає за освітню політику, або при центральному органі, який адмініструє питання професійних кваліфікацій та координує діяльність галузевих рад. Ці ради мають виразну структуру та державне фінансування. В Україні галузеві ради створюються організаціями роботодавців, не мають виразного правового унормування та державного фінансування (по суті є самоврядними та саморегулівними). Водночас галузеві ради відіграють важливу роль у розробленні професійних стандартів як вимог до компетентностей працівників (80% затверджених професійних стандартів в Україні було розроблено галузевими радами).Надано оцінку законодавчим ініціативам щодо галузевих рад із розроблення професійних стандартів, які покликані зберегти самоврядний характер рад і надати їм надзвичайно широкі повноваження в сфері професійних кваліфікацій. Запропоновано авторське бачення функціонування галузевих рад з питань розвитку професійних кваліфікацій як колегіальних органів при Національному агентстві кваліфікацій, які – на основі принципів соціального партнерства – включають представників різних суб'єктів політики щодо кваліфікацій. Це дасть змогу розширити інституційний механізм політики щодо професійних кваліфікацій.

The article examines the effectiveness of soft law as a regulator of legal relations between the member states of the Council of Europe. Existing approaches to the definition of soft law are analyzed.Author proposes to separate from the traditional conception of international law as a system of universally binding norms developed by states, taking into account postmodern trends in the transformation of national legal systems. Soft law is recognized as a real form of modern international law that has legal consequences. The article appoints the sources that make up the soft law within the legal system of the Council of Europe.The influence of soft law acts of the Council of Europe bodies on the legislation of Ukraine is investigated. Pros-pects for the development of soft law in the research area are determined.The role of "soft law" acts is presented on the example of the acts of the Venice Commission (European Com-mission for Strengthening Democracy through Law) and the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, which are specialized agencies of the Council of Europe.Examples of the impact of soft law acts of the Council of Europe on the national legal systems of the partici-pating countries are analyzed. Their axiological influence on the democratization of national legal systems and the formation of human-centered legal ideology in Europe has been determined. The article determines the orientation of the parliaments and governments of the member states of the Council of Europe on the acts of soft law of its bodies in the legislation. The place of soft law acts of the bodies of the Council of Europe in the system of sources of international and national law is considered through the prism of the sociological school of law. ; У статті досліджується ефективність м'якого права як регулятора правовідносин, що виникають між держа-вами учасницями Ради Європи. Проводиться аналіз існуючих підходів до визначення м'якого права. Пропону-ється відхід від традиційного сприйняття міжнародного права як розробленої державами системи норм загально-обов'язкового характеру, враховуючи постмодерні тенденції щодо трансформації національних правових систем.М'яке право визнається реальним різновидом сучасного міжнародного права, яке спричиняє юридичні наслідки. Визначено джерела, що складають «м'яке право» в рамках системи права Ради Європи. Дослід-жується вплив актів м'якого права органів Ради Європи на законодавство України. Визначаються перспек-тиви розвитку м'якого права у досліджуваній сфері. Розглянуто роль актів «м'якого права» на прикладі актів Венеціанської комісії (Європейської комісії за зміцнення демократії через право) та Європейського Комітету із запобігання катуванню і нелюдському або такому, що принижує гідність, поводженню, що є спеціалізо-ваними установами Ради Європи. Проаналізовано приклади впливу актів м'якого права органів Ради Єв-ропи на національні правові системи країн учасниць. Визначено їх аксіологічний вплив на демократизацію національних правових систем та формування людиноцентристської правої ідеології на просторах Європи. Визначено, що збільшення орієнтації парламентів та урядів країн учасниць Ради Європи на акти м'якого права її органів при розробці проєктів законодавчих актів та на наявність позитивного висновку цих органів щодо ключових інституційних законопроектів.Розглянено місце актів м'якого права органів Ради Європи в системі джерел міжнажнародного та націо-нального права варто через призму соціологічної школи права.
The article examines the effectiveness of soft law as a regulator of legal relations between the member states of the Council of Europe. Existing approaches to the definition of soft law are analyzed.Author proposes to separate from the traditional conception of international law as a system of universally binding norms developed by states, taking into account postmodern trends in the transformation of national legal systems. Soft law is recognized as a real form of modern international law that has legal consequences. The article deals with the status and functions of the Security Service of Ukraine. A systematic analysis of the Ukrainian legislation has been carried out and its conformity with the Recommendation PACE 1402 (1999) Control of internal security services in the Council of Europe member states has been determined. The purpose of reforming the Security Service of Ukraine is to transform it into a special service capable of effectively protecting state sovereignty, constitutional order and territorial integrity of Ukraine. Usually there are three basic - "classic" powers of the intelligence services: information gathering, analysis of collected information and counterintelligence. But current Ukrainian legislation, along with "classic" counterintelligence functions, entrusts the Security Service of Ukraine with the functions of fight against corruption and organized crime, as well as economic crimes. The author considers that the presence of such powers by the Security Service of Ukraine does not contradict Recommendation PACE 1402. Firstly, the jurisdiction of the Security Service of Ukraine is rather limited. Secondly, the risk of abuse of authority and therefore the risk of human rights violations are directly related to the form of organization and the presence of certain powers in the special services, the PACE Recommendation suggests that domestic security services do not allow criminal investigations, arrests or detentions of persons, and that they do not participate in the fight against organized crime, except in very specific cases where organized crime is a clear danger to a free democratic state. The second issue is the demilitarization of the special service. Most of the staff of the Security Service of Ukraine are military personnel. According to the author, this is not in direct contradiction with the Recommendation PACE 1402, because the Recommendation PACE 1402 states that they internal security services should preferably not be organized within a military structure.
