The article reveals topical issues related to the legal regulation of procedural costs in the criminal procedure of Ukraine. It is emphasized that the legislative standardisation of this concept is important because, on the one hand, it is an integral economic component of the State, and on the other, the embodiment of the practical implementation of the principle of procedural economy. The author argues that, in contrast to the previous term, "court costs," the term "procedural costs" in relation to this concept is more accurate, since such costs are connected not only with court proceedings but also with pre-trial investigation. The lawmaker's involvement of costs associated with providing legal aid in procedural costs is recognized as positive. The study of procedural costs under the legislation of individual foreign countries is considered, accordingly, the CPC of Ukraine should be amended. Based on the results of the study, it was concluded that it is necessary to expand the list of procedural costs that today need reimbursement. In particular, the existing list of procedural costs should be added, as follows: 1) costs related to reimbursement of material losses incurred as a result of investigative (search) actions by victim witnesses and other participants involved in criminal proceedings; 2) costs related to applying security measures to participants in criminal proceedings and other persons who contribute to the prevention and disclosure of a criminal offense, as well as their close relatives; 3) costs, related to payment of lump sum cash assistance in the event of the decease (death) of a person or in the event of personal injury or other harm to his health in connection with participation in criminal proceedings. The aim of the article is to determine the modern model of the concept of procedural costs, to highlight its positive aspects and to form certain ways of its improvement on the basis of foreign experience study. To achieve this goal, the authors use historical, system-structural and comparative-legal methods, which enable to formulate scientific proposals and conclusions.

We examine the diversification of administrative and procedural costs on patent stockusing a large dataset from the European Patent Office with 15,000firms for the periodbetween 1995 and 2015. The results reveal that administrative and procedural costs aresignificant forfirm-level patenting activity. However, not all administrative and proceduralcosts have equal effects. Higher administrative costs often encourage patent applicationand validation by solving the adverse selection problem and short-run opportunism, aswell as other sources of asymmetric information. The effective administration of intel-lectual property law and low-cost enforcement are found to considerably foster patentingactivity. The effects are robust for various mis-specification checks and do not disappearonce country-level research and development infrastructure proxies are controlled for. Theextreme bounds of administrative and procedural costs are computed across more than 5billion regressions, and the sizeable impact of administration on patent application andvalidation outcomes is confirmed.

Досліджуються питання визначення та розподілу судових витрат у кримінальному провадженні. На підставі проведеного узагальнення судової практики зроблено висновок про відсутність єдності у підходах до визначення видів процесуальних витрат у кримінальному провадженні, віднесення судового збору до судових витрат у кримінальному провадженні. Проаналізовано термінологію, що використовується у кримінальному процесуальному та цивільному процесуальному законодавстві. Констатовано недоцільність ототожнення понять «процесуальні витрати» та «судові витрати», адже останні є поняттям більш широким, ніж «процесуальні витрати», оскільки у цивільному судочинстві судові витрати включають в себе судовий збір та витрати, пов'язані з розглядом справи. Зроблено висновок про недоцільність справляння судового збору з потерпілого, який пред'являє до обвинуваченого цивільний позов у кримінальному провадженні, а відтак стягнення з обвинуваченого судового збору як процесуальних витрат. ; Исследуются вопросы определения и распределения судебных расходов в ходе уголовного производства. На основании обобщения судебной практики сделан вывод об отсутствии единства в подходах к определению видов процессуальных издержек в уголовном процессе, отнесении судебного сбора к судебным издержкам. Проанализирована терминология, используемая в уголовном процессуальном и гражданском процессуальном законодательстве. Констатируется нецелесообразность отождествления понятий «процессуальные расходы» и «судебные расходы» в связи с тем, что последние являются более широким понятием, поскольку в гражданском судопроизводстве судебные издержки включают в себя судебный сбор и расходы, связанные с рассмотрением дела. Сделан вывод о нецелесообразности взимания судебного сбора с потерпевшего, предъявляющего к обвиняемому гражданский иск в уголовном производстве, а в связи с этим и взыскание с обвиняемого судебного сбора как процессуальной издержки. ; The article deals with the issues of determination and distribution of court costs during criminal proceedings. On the basis of the generalization of judicial practice, it was concluded that there was no unity in the approaches to determining the types of procedural costs in criminal procedure, the assignment of litigation fees to court costs. The terminology used in the criminal procedural and civil procedural legislation is analyzed. This gave the possibility to state the inappropriateness of identifying the concepts of «procedural expenses» and «court costs», because the latter are broader concept, since in civil proceedings the court costs include litigation fees and expenses which are connected with the hearing of the case. It is concluded that it is inappropriate to charge the litigation fee from the victim, who submit to the accused the civil action in criminal proceeding, and in connection with this the charge from the accused the litigation fees as a procedural expense.

Abstract
One argument against using cost-benefit analysis to justify policies aimed at promoting human life and health or protecting the environment is that it requires putting a price on priceless goods. This distorts the value of these goods, and it can affect their value by cheapening them. This argument might be rejected by a moral consequentialist who believes that a rational agent should always be able to reflect on his values, even priceless goods, and assess their costs and their importance. This article defends the argument against cost-benefit analysis and suggests that a proper understanding of priceless goods shows that they also raise difficulties for consequentialist moral theories.

I will criticise the treatment of the minimisation of relevant procedural costs which have inspired the authors of Law and Economics. I will suggest a legislative treatment of the procedural cost optimization. In any case, it must respect the requirements of due process, which can veto the optimizations infringing upon such requirements. ; El presente artículo se enmarca en la tradición del Análisis Económico del Derecho Procesal. Al respecto, se critica el tratamiento de minimización de los costos procesales relevantes que ha motivado a los autores del Law and Economics. A partir de dicha crítica se formula un tratamiento de óptimo de costos procesales para el legislador, resguardando en todo caso las exigencias del debido proceso, que opera con poder de veto respecto de aquellos óptimos que pudieran vulnerar tales exigencias.

AbstractThis paper examines the contribution of administrative and procedural transaction costs to economic growth under common legal system. We show that administrative and procedural costs vary quite a lot even within the institutional environment sharing the common legal system. States with low‐cost business registration, low‐cost access to property rights and greater judicial efficiency tend to have consistently higher growth. The established effects are robust to alternative model specifications, heterogeneity bias, and to a variety of control variables that might confound the effects of administrative and procedural costs on growth. Such differences in costs are far from being trivial as we show that these within‐system differences might be instrumental in influencing economic growth. Lower administrative and procedural costs induce growth by increasing investment rate, lowering unemployment rate, encouraging labor supply and improving total factor productivity. In the counterfactual scenario, the transition from high‐cost to low‐cost regime is associated with substantial growth and development gains over time. By exploiting the variation in the disease environment, ethnic fractionalization and historical urbanization, we show that the negative effect of rising procedural and administrative costs on growth and development appears to be causal.
