Abstract

This article identifies the possible concept of justice proper to the Zenú indigenous community in the department of Sucre based on Will Kymlicka's theory of multiculturalism, which allowed us to understand what practices, ideas and principles are associated by this community with the concept of justice that they have historically elaborated. For this, a bibliographic, legislative and jurisprudential review was carried out, which was complemented with interviews that, together, allowed to recognize how for them justice emanates from the conscience and work of their community, from the judicial investigation, from the process itself and the proportionality of its measures with regard to the crimes committed. ; En este artículo se identifica el posible concepto de justicia propio de la comunidad indígena Zenú en el departamento de Sucre a partir de la teoría del multiculturalismo de Will Kymlicka, lo que permitió comprender qué prácticas, ideas y principios son asociados por esta comunidad con el concepto de justicia que históricamente han elaborado. Para ello se realizó una revisión bibliográfica, legislativa y jurisprudencial, que fue complementada con la realización de entrevistas que, en conjunto, permitieron reconocer cómo para ellos la justicia emana de la conciencia y labor de su comunidad, de la investigación judicial, del propio proceso y de la proporcionalidad de sus medidas para con los delitos cometidos.
