The Accusatory System in Colombia: changes and legal habitus ; El sistema oral acusatorio en Colombia: Reforma y habitus jurídico

Abstract

This article is the result of an ongoing investigation that takes place at the Facultyof Law at Santo Tomas University in Bogotá, and what the group aims to study isthe behavior of the "agents" due to the innovation of legislation who gets involvedthe Colombian penal system.The theory Bourdieu fields is the starting point of the investigation to determinethe aspects of legal sociology that affect the habitus of the agents involved in litigation.Therefore research on adversarial criminal justice system and legal habitusdetermine the variables that are more difficult to assimilate to the parties and thosewho appropriate easily. The result of the research will be an academic support indiscussions on the issue in favor of contributing the system to establish unfulfilledobjectives and breeding strategies for most effective litigation and a process thatguarantees fundamental rights fully. ; El presente artículo es el resultado de una investigación en curso de la facultadde Derecho de la Universidad Santo Tomas de Bogotá, que pretende estudiar loscomportamientos de los "agentes" al verse enfrentados al sistema innovador penalacusatorio.La teoría de los campos de Bourdieu es el punto de partida de la investigación paradeterminar los aspectos de la sociología jurídica que repercuten en el habitus de losagentes intervinientes en los litigios. De esta manera el análisis sobre sistema penalacusatorio y habitus jurídico determinará las variables que resultan, para las partes,más difíciles de asimilar y aquellas que se apropian fácilmente.El resultado de la investigación será un apoyo para las discusiones académicas sobreel tema, en pro de coadyuvar al sistema a establecer los objetivos propuestos nocumplidos y las estrategias de mejoramiento para un litigio más eficaz y un procesoque garantice a cabalidad los derechos fundamentales.
