Abstract

Les gouvernements des sociétés modernes sont constitués en principe, sur base d'élection. Aucune société politique contemporaine qui se veut démocratique ne peut se passer, pour la désignation de ses dirigeants, du principe d'élection. Dès lors, ce dernier devient une source de légitimité, à savoir la légitimité électorale. Pourtant, cette légitimité électorale ne garantit pas tout à fait des actes politiques posés sous l'égide du système représentatif, l'élection étant un principe fondamental de ce système. Dans cette thèse, nous nous intéressons à démontrer que la démocratie délibérative est le véritable système démocratique capable de fonder normativement une gouvernance politique qui se veut être juste et efficace. Ce fondement normatif prescrit par la démocratie délibérative doit être encadrée toutefois, par une théorie de l'État. Aussi, proposerons-nous dans cette thèse la théorie de la gouvernance délibérative paternaliste libertaire et néo-républicaine, que nous serons tenté de mettre en perspective en considérant l'exemple d'Haïti. ; Abstract: The governments of modern societies are constituted in principle on the basis of election. No contemporary political society that claims to be democratic can do without the principle of election for the appointment of its leaders. Therefore, the latter becomes a source of legitimacy, namely electoral legitimacy. However, this electoral legitimacy does not quite guaranty political acts carried out under the aegis of the representative system, election being a fundamental principle of this system. In the thesis, we are interested in demonstrating that deliberative democracy is the true democratic system capable of establishing normatively a political governance that wants to be fair and efficient. This normative foundation prescribed by deliberative democracy must be framed, however, by a theory of state. Also, we will propose in this thesis the theory of paternalistic libertarian and neo-republican deliberative governance, which we will be tempted to put into perspective by considering the example of Haiti.
