The unique Scottish legal system stands apart from the better-known Anglo-American legal system, with variations relating to jury size (15 vs. 12), the number of verdicts available (3 vs. 2) and majority size (simple majority vs. unanimous). At present, only a handful of investigations have explored the effects of the Scottish 'not proven' verdict on jurors, and only a single study has explored the combined impact of the unique elements of the Scottish legal system on juror and jury decision making. The current study is the first to investigate the views of Scottish legal professionals on the three-verdict system, 15-person jury and simple majority verdict system. The aim of the study is to inform public and political debate, involve legal stakeholders in policy changes and decision making and compare legal professionals' views with findings from previously conducted juror studies. Seventy-eight legal professionals took part in an online survey which asked for ratings and open responses on their attitudes to the Scottish (a) three-verdict system, (b) 15-person jury and (c) simple majority system. The results highlighted strong positive attitudes towards the 'not proven' verdict (particularly in a binary-verdict system of proven and not proven), 15-person juries and both the simple and qualified majority verdict systems. There was minimal support for reform towards an Anglo-American system. Instead, the reforms preferred by the legal professionals would be to require a qualified majority of 12/15 jurors, and to use a binary-verdict system of proven and not proven.

AbstractThe objective of this study is to explore and determine the legal constraints related to adult male rape and the consequences as they exist in the Bangladeshi criminal justice system. Primary and secondary data sources for the study were derived from the narratives of adult male rape survivors, blood relatives of rape survivors, police officers, and legal practitioners. A snowball sampling technique was applied. The study reveals that there is an absence of a police-support response to adult male rape victims, which is attributable to the lack of a gender-neutral definition of rape. This legal definition vacuum diverts complainants to a range of other futile options, such as submitting a general diary and/or adjacent complaints and seeking assistance from other law enforcement agencies. Finally, this study demonstrates that the landscape of the Bangladeshi criminal justice system is likely to remain unchanged until its legal foundation is better developed.
The paper discusses some emerging issues of criminal liability for assaults against public officials in various jurisdictions. Emphasis is placed both on the comparative approach to analyzing the relevant criminal statutes and on the specific legal framework for the protection of the life and health of law enforcement officers. Based on the provisions of statutory criminal law and the case law of several countries, it is shown that the life, health and property of law enforcement officers enjoy a higher level of protection. This is explained by the fact that such persons are direct representatives of the state, perform their duties in public, remain under public scrutiny and, therefore, may become an easier target for assault crimes. In the conclusions of the research, it has been argued that the determination of the legal grounds, scope and limits of protection of public officials by criminal law should be carried out at the national level (or state level in a federal jurisdiction), based on the orientations and principles of the domestic criminal law policy and program of a given nation.

Таким виміром, який може слугувати загальним полем для правових дискусій є людський досвід, коли людина і право зустрічаються між собою. Подібний досвід права є тією точкою відліку, де правові дослідники, чи то аналітики, чи герменевти, починають шлях до осмислення права. Різниця між цими двома напрямками полягає у тому способі, яким правовий досвід стає ключовою точкою, яка привертає їх увагу. У аналітичній традиції цей досвід є необхідно пов'язаним з юридичними інституціями, такими як норми закону, рішення судів, правовідносини з компетентними особами та багатьма іншими ситуаціями, де людина зустрічається з різноманітним юридичним сущим. Подібний досвід буття серед юридичного сущого можна назвати «досвідом юридичного». У герменевтичній правовій філософії досвід буття людини у праві є кардинально відмінним. Він не має необхідного зв'язку з офіційними юридичними інституціями. The reason for such a situation is the lack of the common conceptual dimension and language as the ground of the dialogue between them. In any case, instead of the discussing the reason of law, its essence, modes of Being or some others fundamental issues, philosophy of law turns into the endless debates about the concept of law, its connection with morality or racial, gender or some other kind of the politically correct discourse. So, to avoid the scholastic debates, contemporary philosophy of law has to find its original dimension, where the analytical and hermeneutical researchers both would be able to speak with one another reasonably. Such a dimension as the common field of legal discussing is human experience, when the law encounters the man and man encounters the law. This experience is the starting point, where the legal researcher, whether the analytical or hermeneutical, begins to think toward the reasoning of law. The difference between the two trends of the legal philosophy is rooted in the way, in which the legal relevant experience becomes the focal point of its attention. In the analytical tradition this experience is necessarily connected with the legal institutions, such as norms of legislation, decisions of courts and some other legal bodies, relations with the state officials and many other situations, when the human being encounters itself among the various legal entities. The experience of Being among the legal entities could be named "legal experience". In the hermeneutical legal philosophy, the human experience of law is quite different. There is no necessary connection with the legal institutions. Instead of that, human being experiences law as the part of its ordinary Being-with-one-another, which is more originally than any contact with the legal norms or officials. The focal point of this experience is the reason of the Being-with-one-another, which is always unique and concrete. This kind of experience could be named "experience of law". But, despite the difference, both kinds of experience have the common starting point – human being, who is concerned about what's going on in his life, what reason/meaning have these legal/law events and occurrences and so on. In any case, even if the ways of the hermeneutical and analytical traditions lead in the opposite directions, they have the common beginning, which could serve as the field of the dialogue between them.

After a period of relative stagnation, the past few months witnessed the adoption of a plethora of legislative instruments under the third pillar. These instruments can be seen as the third wave of third-pillar law, following the wave of measures adopted post-Maastricht and the second wave of measures adopted post-Amsterdam and Tampere. The third wave of third-pillar law extends to most major areas of European integration in criminal law. New legislation involves the harmonization of substantive criminal law (including the terrorism, organized crime and racism and xenophobia), mutual recognition (with measures such as the European Evidence Warrant and legislation on the recognition of probation decisions and the transfer of sentenced persons), the work of EU criminal justice bodies such as Europol and Euro just, and the development of standards to regulate the proliferation of third pillar mechanisms to collect, analyze and exchange personal data. By analyzing the background and content of these instruments, this article will assess their impact on the future development of EU criminal law and justice. As a very dangerous form that damage the economies of states, without a doubt considered and economic criminality, which caused by economic criminal action taken, as actions that impede business between business entities. Evidence indicates that substance use and mental health treatment is often associated with reduced criminal activity. The present systematic review examined this association among military veterans, and aimed to provide a comprehensive summary of needed research to further contribute to reduced criminal activity among veterans. This systematic review was derived from a scoping review that mapped existing research on justice-involved veterans' health. For the current systematic review, a subset of 20 publications was selected that addressed the question of whether criminal activity declines among veterans treated for substance use and mental health disorders. Generally, veterans improved on criminal outcomes from pre- to post-treatment for opioid use, other substance use, or mental health conditions, and more sustained treatment was associated with better outcomes. This occurred despite high rates of criminal involvement among veterans prior to entering treatment. Needed are substance use and mental health treatment studies that include women justice-involved veterans, follow criminally-active veterans for longer periods of time, and use validated and reliable measures of criminal activity with fully transparent statistical procedures. Future randomized trials should evaluate new treatments against evidence-based treatments (versus no-treatment control conditions). Subsequent studies should examine how to link veterans to effective treatments, facilitate sustained treatment engagement, and ensure the availability of effective treatments, and examine mechanisms (mediators and moderators) that explain the association of treatment with reduced criminal activity among veterans. Best practices are needed for reducing criminal activity among the minority of justice-involved veterans who do not have diagnosed substance use and/or mental health disorders.
The latest casualties in the war on drugs are pregnant, chemically dependent women, who are viewed as the perpetrators of fetal abuse. Recent litigation has elevated the rights of the fetus over the rights of the mother. This article examines the medical and legal basis for the punitive policies directed at pregnant, chemically dependent women and suggests an alternative policy.
