En el año 2012 en Colombia, aproximadamente 104 personas fallecieron cada día por enfermedad oncológica y 196 personas enfermaron de cáncer (1). Para el año 2015 se desarrolló el protocolo para la aplicación de procedimiento de eutanasia, donde se generan resoluciones y decretos juntos con la despenalización de la eutanasia a partir de la sentencia T-970 de la Corte Constitucional (2). Es de nuestro interés caracterizar los grupos poblacionales con diagnóstico de enfermedad oncológica en fase terminal que solicitan y reiteran eutanasia, con el objetivo de determinar las características del tipo de personalidad, y el entorno psicosocial del cual hace parte este individuo que permitiría como unidad de cuidados paliativos mejorar la prestación de servicios frente a los pacientes en el final de la vida: Métodos: Estudio observacional descriptivo. Resultados: Los pacientes oncológicos evaluados presentaron una mediana de edad de 60 años, donde el 75% de los pacientes fueron hombres con estadios terminal de la enfermedad. Las causas de negación de eutanasia fueron en el 100% por trastornos afectivos. La causa reiterada de solicitud de eutanasia por los pacientes fue por dolor y disnea. El 50% presentaron personalidad tipo A y el 50% restante personalidad tipo B. Conclusiones: La causa reiterada de solicitud de eutanasia en pacientes oncológicos con estadio terminal de la enfermedad, con mediana de edad de 60 años, generalmente es por dolor y disnea refractarios al tratamiento paliativo ofrecido por el equipo multidisciplinario. ; Introduction: in 2012 in Colombia, approximately 104 people died every day from oncological disease and 196 people became ill from cancer (1). For the year 2015, the protocol for the application of the euthanasia procedure was developed, where resolutions and decrees are generated together with the decriminalization of euthanasia based on the ruling T-970 of the Constitutional Court (2). It is in our interest to characterize the population groups with a diagnosis of terminal oncological disease that request and repeat euthanasia, to determine the characteristics of the personality type, and the psychosocial environment of which this individual is a part, which would allow as a care unit Palliative improve service delivery to patients at the end of life. Methods: cross sectional study. Results: The oncology patients evaluated had a median age of 60 years, where 75% of the patients were men with terminal stages of the disease. The reasons for denial of euthanasia were 100% due to affective disorders. The repeated cause of request for euthanasia by patients was pain and dyspnea. 50% had to type A personality and the remaining 50% had type B personality. Conclusions: The repeated cause of request for euthanasia in cancer patients with the terminal stage of the disease, with a median age of 60 years, is generally due to refractory pain and dyspnea to palliative treatment offered by the multidisciplinary team. ; Grupo de investigación Méderi, Dolor y cuidados Paliativos

Baskground. One of the priority directions of scientific research in the field of social medicine and health care is the development and substantiation of the best models for the organization of an affordable, high-quality and efficient PHC System in Ukraine, that requires the formation of a state policy of the PHC support and its implementation with taking into account the best international and national experience, opportunities and conditions of the country. The urgency of the problem and the global need for PHC are growing in connection with the unbridled aging of the population and the spread of severe chronic progressive diseases, including those, a treatment of which is ineffective or hopeless. Purpose: to carry through a medical and social analysis of the current legal framework (CLF) of Ukrainian and some international documents regulating the PHC providing organization, that are the basis for the creation and development of affordable, high-quality and efficient PHC System to the population in Ukraine. Materials and methods. In our analysis Ukrainian and international normative and legal documents, scientific literature were used. The following research methods were applied: system-analytical, comparative content analysis, system approach, generalization and grouping. Results. The legal regulation of the provision of PHC to the population of Ukraine at the state level is carried out by the relevant Laws of Ukraine, decrees of the President of Ukraine, resolutions of the Cabinet of Ministers of Ukraine, orders of the Ministry of Health (MOH) of Ukraine and the Ministry of Social Policy of Ukraine. In particular, the Law of Ukraine "On the Basis of the Legislation of Ukraine on Health Care" dated 19.11.1992, No. 2801-XII, for the first time at the legislative level in 2011, palliative care was recognized as a form of medical care, as well as the definition of the term "palliative care" was defined. Provision of PHC to cancer patients and TB patients was foreseen in the relevant Laws of Ukraine, which are not valid today. Currently, only the "National Targeted Social Program for HIV/AIDS Response for 2014-2018" is in force, which was approved by the Law of Ukraine dated 20.10.2014 No.1708-VII, which defined certain tasks related to the organization and access to PHC to people who live with HIV, training the appropriate staff to provide such care. Unfortunately, the tasks defined by these laws were not implemented: the PHC standards to patients in the facilities of palliative and hospice medicine (PCM) of the MOH of Ukraine have not yet been approved, the system of training has not been implemented, etc. Also today, PHC in Ukraine are regulated by a number of departmental regulatory acts, in particular, by Order of the MOH of Ukraine of 21.01.2013 № 41 "On the organization of palliative care in Ukraine", but there is now a significant need to complete and improve this order, taking into account Ukrainian and international development PHC experience, the results of reforming the Health Care System in Ukraine, new WHO documents, Council of Europe, EAPC, ІАНРС. It is important that valid clinical protocols from different nosologies are complemented by sections "PHC" or "Palliative Medical Care and Care at the End of Life", which has both practical and legal significance. Of particular importance is the Order of the Ministry of Social Policy of Ukraine dated January 29, 2016, No. 58 "On Approval of the State Standard of Palliative Care", which regulates the activities of social protection institutions for the provision of PHC to patients in outpatient settings and at home, and other orders. Conclusions. 1. The content-analysis of the current Laws of Ukraine and some documents of WHO, the Council of Europe, ЕАРС, ІАНРС and other authoritative international institutes on the PHC organization allowed us to identify positive trends, in particular, the legislative approval of palliative care in Ukraine as a type of medical care, but only in relation to incurable patients with limited predictive life expectancy, and this fact goes in to a discrepancy with modern international documents. 2. The main shortcomings of the acts regulating the PHC organization delivery in Ukraine are the lack of systematic and coordinated regulatory norms, the uncertainty of the criteria of PPs with different nosologies, the lack of mechanisms for determining the status of PPs, the problems of the organization of the PHC providing for incurable sick in both in-patient and out-patient conditions and at home. 3. The aforecited statements require the urgent development and approval of the Order "About the Procedure for the Providing of Palliative Medical Care to the Population in Ukraine and the List of Medical Indications for Its Delivery" by the MOH of Ukraine, in which mechanisms and coordination of the various levels of medical care providing, standards of palliative care and maintenance of various category of PPs, criteria for the status of PPs definition, etc should be determined. 4. In order to optimize Ukrainian legislation in its part of the PHC providing organization to the population of Ukraine, there is an urgent need for the elaboration and adoption of a Law of Ukraine "About Palliative Care" by Ukrainian Parliament, in which the priorities of state policy, adequate financing of PHC from the State and Regional Budgets and extrabudgetary sources, clearly outline the system of such type of care, determine the state regulation of the provision of PHC, provide a systemicity, continuity and structuring of Ukrainian PHC, help to eliminate inter-departmental barriers on personnel policy issues, provide motivation for specialists in PHC training, PPs and their families with adequate drugs, care facilities, social, psychological and spiritual support etc. 5. An extremely urgent task that will ensure the development of an accessible, high-quality and efficient PHC System is the development and approval of the "State Social Program for the Development of Palliative and Hospice Care in Ukraine" by the Cabinet of Ministers of Ukraine and Parliament of Ukraine. This document will help to realize a right of palliative patients and their families members for appropriate quality of life and its worthful ending. ; Актуальность. Одним из приоритетных направлений научных исследований в области социальной медицины и организации здравоохранения является разработка и обоснование оптимальных моделей организации доступной, качественной и эффективной системы паллиативной и хосписной помощи (ПХП) населению в Украине, что требует формирования государственной политики поддержки ПХП и внедрение оптимальной нормативно-правовой базы (НПБ), которая учитывает лучший международный и национальный опыт, возможности и условия страны. Глобальная потребность в ПХП будет и дальше возрастать в связи с неуклонным старением населения и распространением тяжелых хронических прогрессирующих заболеваний, в т.ч. в терминальной стадии их развития, лечение которых, направленное на излечение (выздоровление пациента), является неэффективным или бесперспективным. Цель исследования: осуществление медико-социального анализа действующей НПБ Украины и некоторых международных документов, регулирующих организацию оказания ПХП, что является основой для создания и развития доступной, качественной и эффективной системы ПХП в Украине. Материалы и методы. В работе были использованы отечественные и международные нормативно-правовые документы, отечественная и зарубежная научная литература и применены следующие методы исследования: системно-аналитический, сравнительный контент-анализ, системного подхода, обобщения и группировки. Результаты. Правовое регулирование оказания ПХП населению Украины на государственном уровне осуществляется Конституцией Украины, соответствующими Законами Украины, указами Президента Украины, постановлениями Кабинета Министров Украины, приказами Министерства здравоохранения (МЗ) Украины и Министерства социальной политики Украины. В частности, в 2011 году Законом Украины «Основы законодательства Украины о здравоохранении» от 19.11.1992 года № 2801-XII впервые на законодательном уровне паллиативная помощь была определена как вид медицинской помощи, а также дано определение понятия «паллиативная помощь». Оказание ПХП онкологическим больным и больным туберкулезом было предусмотрено в соответствующих законах Украины, которые сегодня не действуют. На сегодня действует только «Общегосударственная целевая социальная программа противодействия ВИЧ-инфекции/СПИДа на 2014-2018 годы», которая была утверждена Законом Украины от 20.10.2014 № 1708-VII, в которой определены конкретные задачи по обеспечению организации и доступа к ПХП людям, живущих с ВИЧ, подготовка соответствующих кадров для оказания такой помощи. К сожалению, задачи, которые были определены этими законами не были выполнены: стандарты оказания ПХП больным в условиях учреждений паллиативной и хосписной медицины (ПХМ) МОЗ Украины до сих пор не утвердило, система подготовки кадров не внедрена и т. д. Также сегодня ПХП в Украине регулируется рядом ведомственных нормативно-правовых актов, в частности, приказом МЗ Украины от 21.01.2013 № 41 «Об организации паллиативной помощи в Украине», но сейчас существует значительная потребность дополнить и усовершенствовать этот приказ, учитывая украинский и международный опыт развития ПХП, результаты реформирования системы здравоохранения в Украине, новые документы ВОЗ, Совета Европы, ЕАРС, ІАНРС. Важно, чтобы действующие клинические протоколы по разным нозологиям были дополнены разделами «ПХП» или «Медицинская помощь и уход в конце жизни», что имеет как практическое, так и юридическое значение. Чрезвычайно важным является приказ Министерства социальной политики Украины от 29.01.2016 № 58 «Об утверждении Государственного стандарта паллиативного ухода», регламентирующий деятельность учреждений социальной защиты населения в вопросах предоставления паллиативного ухода пациентам в амбулаторных условиях и на дому, и другие приказы. Выводы. 1. Контент-анализ действующей НПБ Украины и некоторых документов ВОЗ, Совета Европы, ЕАРС, ІАНРС и других авторитетных международных организаций по вопросам организации оказания ПХП населению позволил определить положительные тенденции, в частности законодательное определение в Украине паллиативной помощи как вида медицинской помощи, которая применяется только в отношении инкурабельных больных с ограниченным прогнозом продолжительности жизни, что не соответствует современным международным документам. 2. Основными недостатками законодательных и нормативно-правовых актов, регламентирующих организацию оказания ПХП в Украине, является отсутствие системности и скоординированности регулирующих норм, неопределенность критериев паллиативных пациентов (ПП) с различными нозологиями соответствующими клиническими протоколами, отсутствие механизмов определения статуса ПП, недостаточно решены проблемы организации оказания ПХП инкурабельным больным как в стационарах заведениях ПХМ, так и в амбулаторно-поликлинических условиях и дома, что требует оптимизации нормотворческой деятельно МЗ Украины и скоординированности разрабатываемых нормативно-правовых актов, с действующими постановлениями КМУ, приказами Министерства социальной политики Украины и других органов государственной власти. 3. Указанное выше требует неотложной разработки и утверждения МЗ Украины приказа «О порядке оказания паллиативной медицинской помощи населению в Украине и Переченя медицинских показаний для ее оказания», который определит и обеспечит механизмы и скоординированность различных уровней оказания медицинской помощи, стандартов паллиативного лечения и содержания различных категорий ПП, критерии определения и порядок предоставления статуса ПП, особенности ПП детского и старческого возраста и т. п. 4. С целью оптимизации отечественного законодательства по организации оказания ПХП и паллиативного ухода в Украине есть необходимость в разработке и принятию Верховным Советом Украины отдельного Закона Украины «О паллиативной помощи», который должен определить приоритеты государственной политики, обеспечить адекватное финансирование ПХП и паллиативного ухода из Государственного и региональных бюджетов и внебюджетных источников, четко очертить систему такой помощи, главные аспекты межведомственной координации в этой области, определить порядок государственного регулирования оказания ПХП и основные требования к учреждентям ПХМ, а также обеспечить системность, преемственность и структурированность отечественного законодательства в области ПХП и паллиативного ухода, способствовать устранению межведомственных барьеров, с четким определением юридической, медицинской, социальной составляющей ПХП. 5. Очень актуальной задачей, которая обеспечит развитие доступной, качественной и эффективной системы ПХП, является разработка и утверждение Кабинетом Министров Украины и Верховным Советом Украины «Государственной целевой социальной программы развития паллиативной и хосписной помощи населению в Украине», что позволит реализовать право паллиативных больных и членов их семей на соответствующее качество жизни и достойне его завершение. ; Актуальність. Одним з пріоритетних напрямів наукових досліджень у галузі соціальної медицини і організації охорони здоров'я є розробка та обґрунтування оптимальних моделей організації доступної, якісної та ефективної системи паліативної та хоспісної допомоги (ПХД) населенню в Україні, що потребує формування державної політики підтримки ПХД та впровадження оптимальної нормативно-правової бази (НПБ), яка враховує кращий міжнародний і національний досвід, можливості та умови країни. Глобальна потреба у ПХД буде і далі зростати у зв'язку з неухильним постарінням населення і поширенням важких хронічних прогресуючих захворювань, у т.ч. у термінальній стадії їх розвитку, лікування яких, що спрямоване на вилікування (одужання пацієнта), є неефективним або безперспективним. Мета дослідження: здійснення медико-соціального аналізу чинної НПБ України і деяких міжнародних документів, які регулюють організацію надання ПХД, що є основою для створення і розвитку доступної, якісної та ефективної системи ПХД населенню в Україні. Матеріали та методи. У роботі були використані вітчизняні та міжнародні нормативно-правові документи, вітчизняна та зарубіжна наукова література та застосовані наступні методи дослідження: системно-аналітичний, порівняльний контент-аналіз, системного підходу, узагальнення та групування. Результати. Правове регулювання надання ПХД населенню України на державному рівні здійснюється Конституцією України, відповідними Законами України, указами Президента України, постановами Кабінету Міністрів України, наказами Міністерства охорони здоров'я (МОЗ) України та Міністерства соціальної політики України. Зокрема, у 2011 р. Законом України «Основи законодавства України про охорону здоров'я» від 19.11.1992 року № 2801-XII вперше на законодавчому рівні паліативну допомогу було визнано як вид медичної допомоги, а також дано визначення поняття «паліативна допомога». Надання ПХД онкологічним хворим та хворим на туберкульоз було передбачене у відповідних Законах України, які сьогодні не чинні. На сьогодні чинна лише «Загальнодержавна цільова соціальна програма протидії ВІЛ-інфекції/СНІДу на 2014-2018 роки», що була затверджена Законом України від 20.10.2014 № 1708-VII, якою визначені певні завдання щодо забезпечення організації та доступу до ПХД людям, які живуть з ВІЛ, підготовка відповідних кадрів для надання такої допомоги. На жаль, завдання, що були визначені цими законами не були виконані: стандарти надання ПХД хворим в умовах закладів паліативної і хоспісної медицини (ПХМ) МОЗ України досі не затвердило, система підготовки кадрів не впроваджена тощо. Також сьогодні ПХД в Україні регулюється низкою відомчих нормативно-правових актів, зокрема, наказом МОЗ України від 21.01.2013 № 41 «Про організацію паліативної допомоги в Україні», але зараз існує значна потреба доповнити і удосконалити цей наказ, враховуючи український і міжнародний досвід розвитку ПХД, результати реформування системи охорони здоров'я в Україні, нові документи ВООЗ, Ради Європи, ЕАРС, ІАНРС. Важливо, щоб чинні клінічні протоколи з різних нозологій були доповнені розділами «ПХД» або «Медична допомога і догляд наприкінці життя», що має як практичне, так і юридичне значення. Надзвичайно важливим є наказ Міністерства соціальної політики України від 29.01.2016 № 58 «Про затвердження Державного стандарту паліативного догляду», який регламентує діяльність закладів соціального захисту населення у питаннях надання паліативного догляду пацієнтам в амбулаторних умовах і вдома, та інші накази. Висновки. 1. Контент-аналіз чинної НПБ України та деяких документів ВООЗ, Ради Європи, ЕАРС, ІАНРС та інших авторитетних міжнародних організацій з питань організації надання ПХД населенню дозволив визначити позитивні тенденції, зокрема законодавче затвердження в Україні паліативної допомоги як виду медичної допомоги, яка застосовується тільки стосовно інкурабельних хворих з обмеженим прогнозом тривалості життя, що має невідповідність з сучасними міжнародними документами. 2. Основними недоліками законодавчих та нормативно-правових актів, що регламентують організацію надання ПХД в Україні, є відсутність системності і координованості регулюючих норм, невизначеність критеріїв паліативних пацієнтів (ПП) з різними нозологіями відповідними клінічними протоколами, відсутність механізмів визначення статусу ПП, недостатньо вирішені проблеми організації надання ПХД інкурабельним хворим як в стаціонарних закладах ПХМ, так і в амбулаторно-поліклінічних умовах та вдома, що потребує оптимізації нормотворчої діяльності МОЗ України і координованості нормативно-правових актів, що розробляються, з чинними постановами КМУ, наказами Міністерства соціальної політики України та інших органів державної влади. 3. Зазначене вище вимагає нагальної розробки та затвердження МОЗ України наказу «Про порядок надання паліативної медичної допомоги населенню в Україні та Перелік медичних показань для її надання», що визначить та забезпечить механізми та скоординованість різних рівнів надання медичної допомоги, стандартів паліативного лікування та утримання різних категорій ПП, критерії визначення та порядок надання статусу ПП, особливості ПП дитячого і старечого віку тощо. 4. З метою оптимізації вітчизняного законодавства щодо організації наданні ПХД та паліативного догляду в Україні є нагальна потреба розробки і прийняття Верховною Радою України окремого Закону України «Про паліативну допомогу», який мав би визначити пріоритети державної політики, забезпечити адекватне фінансування ПХД та паліативного догляду з Державного і регіональних бюджетів та позабюджетних джерел, чітко окреслити систему такої допомоги, головні аспекти міжвідомчої координації у цій галузі, визначити порядок державного регулювання надання ПХД й основні вимоги до закладів ПХМ, а також забезпечити системність, наступність та структурованість вітчизняного законодавства у галузі ПХД та паліативного догляду, сприяти усуненню міжвідомчих бар'єрів, із чітким визначенням юридичної, медичної, соціальної складової ПХД. 5. Надзвичайно актуальним завданням, що забезпечить розвиток доступної, якісної та ефективної системи ПХД, є розробка та затвердження Кабінетом Міністрів України та Верховною Радою України «Державної цільової соціальної програми розвитку паліативної та хоспісної допомоги населенню в Україні», що дозволить реалізувати право паліативних хворих і членів їх родин на належну якість життя і гідне його завершення.

Euthanasia has been leading the debate about the end of life, lately. The "right to a dignified death" is proposed; however, "dying" does not constitute a right in itself and dignity is an attribute of all human life. For its part, Psychiatry has been concerned during the last century with preparing documents, such as, the Hawaii Declaration (1977) and the Madrid Declaration (1996) to ethically regulate the practice of the profession. Surprisingly, countries like the Netherlands and, recently, Spain approve euthanasia in their legislation, at the risk of falling into the "slippery slope" phenomenon and losing control. As a solution, palliative care seeks the dignified treatment of the person who is about to die. ; Últimamente, la eutanasia ha encabezado el debate del final de la vida. Se plantea el "derecho a una muerte digna"; sin embargo, "morir" no constituye un derecho en sí mismo y la dignidad es un atributo de toda vida humana. Por su parte, la Psiquiatría se ha ocupado durante el último siglo de elaborar documentos, como la Declaración de Hawái (1977) y la Declaración de Madrid (1996) para regular éticamente el ejercicio de la profesión. Sorprendentemente, países como Holanda y, recientemente, España aprueban la eutanasia en su legislación, con el riesgo de caer en el fenómeno "pendiente resbaladiza" y llegar a perder el control. Como solución, los cuidados paliativos procuran el trato digno de la persona próxima a morir.

Background: By 2013, the UK government's Migration Advisory Committee had listed sonography as an official 'shortage specialty' (Migration Advisory Committee, 2013; Parker & Harrison, 2015). As a consequence of the working stresses allied to this shortage, British sonographers have increasingly been reducing hours or leaving clinical practice entirely (Society and College of Radiographers, 2014). Moreover, among those who remain, incidences of reported chronic pain and active injury are also on the increase within a profession that was already synonymous with high rates of work-related musculoskeletal disorder (WRSMD; Harrison & Harris, 2015). While contemporary research has described the rates of WRMSD among ultrasound practitioners (Bolton & Cox, 2015), none has to date extensively explored its personal and professional impacts. Methods: Using a model of Interpretative Phenomenological Analysis with proven facility in medical imaging research (Miller et al., 2017), extended semi-structured interviews with N=10 experienced sonographers were analysed. Results: Participants routinely reported a sensation of guilt and depleted self-efficacy that not only permeated any working absence resultant of their own WRMSD, but also to taking legitimate leave when colleagues were suffering from WRMSD. An upshot of this was to recurrently "take one for the team" and work through excessive pain, even when this would likely result in greater prospective physical damage. While the basic shortage of sonographers was the core attribution for such behaviours, participants also cited (1) increasingly obese patients, (2) increasingly unhelpful (i.e. profiteering) equipment manufacturers, and (3) their own paternalism regarding healthcare. Conclusions: The present situation in ultrasound mirrors a culture of potentially dangerous pain acceptance that been noted in the psychology of sport for some time (Weinberg et al., 2013) albeit for altruistic, rather than egotistic, reasons. There is a clear body of evidence to suggest that sonographers are in crisis point both in terms of staffing levels and in terms of inter-related issues of WRMSD. The issue of WRMSD remains complex and under-researched and few studies are able to establish a definitive cause of the condition, because the causes are multifactorial. However, the majority of the literature seems to agree that poor posture, repetitive movements and insufficient strength seem to be the main physical causes, but little has been explored in terms of how the philosophy of being a sonographer, their behaviours and cultures might also be contributing to this issue. This study contributes to a new body of knowledge, looking at the unique experiences of (n=9) individual sonographers and the ideological dilemmas they are facing. It is acknowledged that extensive deeper levels of analysis and interpretation need to take place around the data collected for this study in order to draw more comprehensive conclusions. Objective The Gynecologic Cancer InterGroup (GCIG)-Symptom Benefit Study was designed to evaluate the effects of chemotherapy on symptoms and health-related quality of life (HRQL) in women having chemotherapy for platinum resistant/refractory recurrent ovarian cancer (PRR-ROC) and potentially platinum sensitive with >= 3 lines of chemotherapy (PPS-ROC >= 3). Methods Participants completed the Measure of Ovarian Cancer Symptoms and Treatment (MOST) and European Organization for Research and Treatment of Cancer (EORTC) Quality of Life Questionnaire QLQ-C30 questionnaires at baseline and every 3-4 weeks until progression. Participants were classified symptomatic if they rated >= 4 of 10 in at least one-third of symptoms in the MOST index. Improvement in MOST was defined as two consecutive scores of = 10 points above baseline in the QLQ-C30 summary score scale (range 0-100). Results Of 948 participants enrolled, 910 (96%) completed baseline questionnaires: 546 with PRR-ROC and 364 with PPS-ROC >= 3. The proportions of participants symptomatic at baseline as per MOST indexes were: abdominal 54%, psychological 53%, and disease- or treatment-related 35%. Improvement was reported in MOST indexes: abdominal 40%, psychological 35%, and disease- or treatment-related 38%. Median time to improvement in abdominal symptoms occurred earlier for PRR-ROC than for PPS-ROC >= 3 (4 vs 6 weeks, p=0.044); median duration of improvement was also similar (9.0 vs 11.7 weeks, p=0.65). Progression-free survival was longer among those with improvement in abdominal symptoms than in those without (median 7.2 vs 2.5 months, p= 3 (p=0.29), and 102/481 (21%) of those with abdominal symptoms at baseline. Conclusion Over 50% of participants reported abdominal and psychological symptoms at baseline. Of those, 40% reported an improvement within 2 months of starting chemotherapy. Approximately one in six participants reported an improvement in HRQL. Background: Austria has recently been embroiled in the complex debate on the legalization of measures to end life prematurely. Empirical data on end-of-life decisions made by Austrian physicians barely exists. This study is the first in Austria aimed at finding out how physicians generally approach and make end-of-life therapy decisions. Methods: The European end-of-life decisions (EURELD) questionnaire, translated and adapted by Schildmann et al., was used to conduct this cross-sectional postal survey. Questions on palliative care training, legal issues, and use of and satisfaction with palliative care were added. All Austrian specialists in hematology and oncology, a representative sample of doctors specialized in internal medicine, and a sample of general practitioners, were invited to participate in this anonymous postal survey. Results: Five hundred forty-eight questionnaires (response rate: 10.4%) were evaluated. 88.3% of participants had treated a patient who had died in the previous 12 months. 23% of respondents had an additional qualification in palliative medicine. The cause of death in 53.1% of patients was cancer, and 44.8% died at home. In 86.3% of cases, pain relief and / or symptom relief had been intensified. Further treatment had been withheld by 60.0%, and an existing treatment discontinued by 49.1% of respondents. In 5 cases, the respondents had prescribed, provided or administered a drug which had resulted in death. 51.3% of physicians said they would never carry out physician-assisted suicide (PAS), while 30.3% could imagine doing so under certain conditions. 38.5% of respondents supported the current prohibition of PAS, 23.9% opposed it, and 33.2% were undecided. 52.4% of physicians felt the legal situation with respect to measures to end life prematurely was ambiguous. An additional qualification in palliative medicine had no influence on measures taken, or attitudes towards PAS. Conclusions: The majority of doctors perform symptom control in terminally ill patients. PAS is frequently requested but rarely carried out. Attending physicians felt the legal situation was ambiguous. Physicians should therefore receive training in current legislation relating to end-of-life choices and medical decisions. The data collected in this survey will help political decision-makers provide the necessary legal framework for end-of-life medical care.

"Contemporary medical models focus predominantly on the technical and financial aspects of care. While these are important aspects of care, they fail to include what may be the most critical need of patients and families - that is, the whole-person approach to care where psychosocial and spiritual needs are viewed as essential and just as important as the physical. Cecily Saunders, the founder of hospice, was one of the first to describe the concept of 'total pain', which led to the biopsychosocial and spiritual model of care. In 2014, the World Health Assembly for the WHO passed a resolution which included spiritual care as an essential domain of palliative care, stating that Palliative Care is an approach that improves the quality of life of patients "through the prevention and relief of suffering by means of early identification and correct assessment and treatment of pain and other problems, whether physical, psychosocial or spiritual." WHO also noted that "it is the ethical duty of health care professionals" to alleviate pain and suffering, whether physical, psychosocial or spiritual and further supported an interdisciplinary model by noting the need for collaboration between professional palliative care providers and support care providers, including spiritual support and counseling"--

Background: Doctors, particularly general practitioners, play a significant role in assisting patients to create advance care plans. When medically indicated, these documents are important tools to promote congruence between end-of-life care and patient's personal preferences. Despite this, little is known regarding the availability of these documents in hospitals. The aim of this study was to identify the proportion of people who died in hospital without an advance care plan and how many of these had advance care planning (ACP) documents in their general practice records. Methods: A retrospective cohort study was conducted of patient hospital records with manual linkage to general practice records. The large regional hospital in Victoria, Australia has a catchment population in excess of 300,000 people. The study sample was patients aged 75 years and over who died in the hospital between 1 January 2016 and 31 December 2017. The hospital records of these patients were examined to identify those which did not have a system alert for ACP documents on the file. Alerted ACP documents were limited to those legislated in the state of Victoria: advance care plan, Enduring Power of Attorney (Medical Treatment) or Enduring Power of Guardianship. Where no ACP document system alert was found in the hospital record, the patient's nominated general practice was consented to participate and the corresponding general practice record was examined. Data were analysed using descriptive statistics. Results: Of the 406 patients who died in hospital, 76.1% (309) did not have a system alert for any ACP document. Of the 309 hospital records without a system alert, 144 (46.7%) corresponding general practice records were examined. Of these, 14.6% included at least one ACP document, including four advance care plans, that were not available in hospital. A Atrofia Muscular Espinhal (AME) é uma doença neurodegenerativa, na qual o gene SMN1 não é expresso, caracterizada por fraqueza muscular, paralisia e dificuldades respiratórias. Trata-se de uma doença crônica que não possui prognóstico de cura, porém existe um fármaco chamado nusinersena em processo de incorporação junto ao Sistema Único de Saúde (SUS), que traz avanços ao seu tratamento. Este trabalho tem como objetivo compreender a necessidade e o processo de incorporação do nusinersena ao SUS, através de revisão bibliográfica feita em bancos de dados científicos eletrônicos. A AME apresentava tratamento paliativo de difícil acesso, contudo o nusinersena promove melhorias no quadro clínico dos pacientes. Anteriormente à padronização deste no SUS, os pacientes tinham que entrar com ação judicial para conseguir o acesso ao medicamento, o que era um processo demorado em função de questões burocráticas, porém através da portaria nº 24, de 24 de abril de 2019 houve a incorporação deste ao SUS. A análise deste processo mostra que o fármaco é de alto custo e visto o impacto que este pode gerar no orçamento do SUS, permitiu-se o uso do fármaco para pacientes com diagnóstico genético obrigatório, que não estejam fazendo uso de ventilação mecânica e somente em centros de referência durante três anos, sendo o processo reavaliado após o prazo.

Abstract
Spinal Muscular Atrophy (AME) is a neurodegenerative disease - SMN1 gene is not expressed - which causes muscle weakness, paralysis and breathing difficulties. It is a chronic disease that has no prognosis for cure, but there is a recent drug called nusinersen in the incorporation process with SUS that brings advances in its treatment. This work aims to understand the need and the process of incorporating nusinersen to SUS, through a bibliographic review made in electronic scientific databases. EBF presented palliative treatment that is difficult to access, however nusinersen promotes improvements in the patients' clinical conditions . Prior to its standardization in SUS, patients had to take legal action to obtain access to the medication, which was a lengthy process due to bureaucratic issues, however, through Ordinance No. 24, dated from April 24th, 2019, this was incorporated into SUS. The analysis of this process shows that the drug is of high cost and given the impact it can have on the SUS budget, the use of the drug was allowed for patients with mandatory genetic diagnosis, who are not using mechanical ventilation and only in referral centers for three years, the process being reassessed after the deadline.

This paper describes a process of policy formation through the parliamentary committee system. The nature of a Victorian investigatory committee and its function as a medium for public consultation regarding complex social and ethical issues is explored. The Public Inquiry into 'Options for Dying with Dignity' is discussed as a case study. The Inquiry led to benchmark Australian legislation through the Medical Treatment Act 1988, as well as promoting significant changes in terminal palliative care.

The article deals with the political and legal problems of palliative and hospice care for incurable patients in Ukraine. The author considered the basic concepts in this area («incurable patient», «palliative care», «hospice», «palliative policy»), analyzed the legal framework for hospice care in Ukraine. The author notes that all people hope for a good death, or rather, «a good life to the very end». Unfortunately, this doesn't happen to everyone. Many people have to be in pain and suffering at the end of their lives. The goal of the palliative care is to prevent suffering and to alleviate the condition of the patient suffering from an incurable disease – by active identification of syndromes, like pain, and by providing adequate treatment that will balance the syndromes as much as possible during day and night. Public engagement and policy interventionsto improve the quality of death through the provision of high quality palliative care have gained momentum in recent years, and some countries have made greatstridesin improving affordable accessto palliative care. Unfortunately, Ukraine is a country with a low index of «quality of death», due to lack of political will, imperfection of legislative and regulatory framework, practical lack of funding, as well as informational silence on this topic. So thousands of Ukrainian's citizens today do not receive any palliative care in the end of their lives. This situation is violates their constitutional rights to health, life, honor and dignity. Palliative care is aimed primarily at alleviating pain and painful symptoms, and includes social, psychological and moral support that enables the patient to maintain the most fulfilling and active life until her last day. In addition, it includes a support system for near patient to help them cope with the loss when it will happen. ; Стаття присвячена розгляду політико-правових проблем надання паліативної та хоспісної допомоги інкурабельним хворим в Україні. Автором були розглянуті основні поняття в цій сфері («інкурабельний хворий», «паліативна допомога», «хоспіс», «паліативна політика»), зроблений огляд нормативно-правової бази, яка регулює цю сферу в Україні. Кожна людина сподіваються на добру смерть, чи, якщо бути точнішими, на «добре життя до самого кінця». На жаль, це відбувається не з кожним. Багато людей змушені проходити в кінці свого життя через біль та страждання. Мета паліативної допомоги полягає в запобіганні стражданню та полегшені стану пацієнта, який страждає невиліковною хворобою – шляхом активного медичного втручання з метою зняття больових синдромів, та наданням адекватного лікування, яке дозволить збалансувати ці синдроми протягом доби. На жаль, Україна є країною з низьким індексом «якості смерті», через відсутність політичної волі, недосконалість законодавчої та нормативно-правової бази, практичну відсутність фінансування, а також інформаційне замовчування цієї теми. Всі ці фактори створюють ситуацію, коли тисячі громадян України щодня потерпають від страждань, не отримуючи належної паліативної допомоги, що призводить до порушення реалізації їх конституційних прав на охорону здоров'я, життя, честь і гідність, а також підриву довіри суспільства до політичної влади в країні, яка вважає таку ситуацію «нормальною». Паліативна допомога спрямована, перш за все, на ослаблення болю та болісних симптомів, а також включає в себе соціальну, психологічну і моральну підтримку, що надає можливість хворому зберегти максимально повноцінне та активне життя до останнього її дня. Крім того, вона включає в себе систему підтримки для близьких хворого, щоб також допомогти їм справитися з його втратою, коли це відбудеться. В статті наголошується, що тематика паліативної та хоспісної допомоги, як правило, ігнорується науковцями політологами та є недостатньо дослідженою ними. Також в роботі окреслені основні напрями, в яких, на нашу думку, має розвиватися паліативна політика України на сучасному етапі її розвитку.

Background: Cancer patients' end-of-life care may involve complex decision-making processes. Colombia has legislation regarding provision of and access to palliative care and is the only Latin American country with regulation regarding euthanasia. We describe medical end-of-life decision-making practices among cancer patients in three Colombian hospitals. Methods: Cancer patients who were at the end-of-life and attended in participating hospitals were identified. When these patients deceased, their attending physician was invited to participate. Attending physicians of 261 cancer patients (out of 348 identified) accepted the invitation and answered a questionnaire regarding end-of-life decisions: a.) decisions regarding the withdrawal or withholding of potentially life-prolonging medical treatments, b.) intensifying measures to alleviate pain or other symptoms with hastening of death as a potential side effect, and c.) the administration, supply or prescription of drugs with an explicit intention to hasten death. For each question addressing the first two decision types, we asked if the decision was fully or partially made with the intention or consideration that it may hasten the patient's death. Results: Decisions to withdraw potentially life-prolonging treatment were made for 112 (43%) patients, 16 of them (14%) with an intention to hasten death. For 198 patients (76%) there had been some decision to not initiate potentially life-prolonging treatment. Twenty-three percent of patients received palliative sedation, 97% of all patients received opioids. Six patients (2%) explicitly requested to actively hasten their death, for two of them their wish was fulfilled. In another six patients, medications were used with the explicit intention to hasten death without their explicit request. In 44% (n = 114) of all cases, physicians did not know if their patient had any advance care directives, 26% (n = 38) of physicians had spoken to the patient regarding the possibility of certain treatment decisions to hasten death ...

Results: Of the 9344 respondents, 1543 (17%) answered the open-ended question. Two prominent themes were revealed: (i) a need for improved quality of end-of-life and palliative care, and access to this care for patients and families and (ii) the recognition of the importance of death and dying, the cessation of treatments to extend life unnecessarily and the need for holistic care to include comfort and support. Conclusions: Within Europe, the public recognizes the importance of death and dying; they are concerned about the prioritization of quantity of life over quality of life; and they call for improved quality of end-of-life and palliative care for patients, especially for elderly patients, and families. To fulfil the urgent need for a policy response and to advance research and care, we suggest four solutions for European palliative and end-of-life care: institute government-led national strategies; protect regional research funding; consider within- and between-country variance; establish standards for training, education and service delivery.

CONCLUSIONS: Within Europe, the public recognizes the importance of death and dying; they are concerned about the prioritization of quantity of life over quality of life; and they call for improved quality of end-of-life and palliative care for patients, especially for elderly patients, and families. To fulfil the urgent need for a policy response and to advance research and care, we suggest four solutions for European palliative and end-of-life care: institute government-led national strategies; protect regional research funding; consider within-and between-country variance; establish standards for training, education and service delivery.
