Ordoliberalism became during the years of the financial crisis the target of a European-wide critical campaign. This school of thought is widely perceived as the ideational source of Germany's crisis politics which has even led to an "ordoliberalisation of Europe". The essay questions the validity of such assessments. It focuses on two aspects which are widely neglected in current debates. One is the importance of law in the ordoliberal vision of the ordering of economy and society. The second is its cultural and religious background in particular in German Protestantism. The influence of the ordoliberal school on European law, so the essay argues, is overrated in all stages of the integration project. Anglo-American neoliberalism rather than German Ordoliberalism was in the ideational driver seat since the 1980s. In the responses to the financial crisis the ordoliberal commitment to the rule of law gave way to discretionary emergency measures. While the foundational synthesis of economic and legal concepts became indefensible, the cultural underpinnings of the ordoliberal tradition survived and developed a life of their own in particular in German political discourses.

Зависимость появления данной категории мигрантов от правовых изменений показана в тексте статьи. ; This article discusses the result of analysis of publications in the "Russian Newspaper" in 2006-2007 dedicated to the issues of migration and legal regulation of migration processes in Russia. The analysis is based on M. Foucault's approach to the notion of subject as produced by discourse. After modification of the law on the status of a foreign citizen, many articles about 'visa-free migrants' who had earlier been ignored appeared in the "Russian Newspaper". Dependency of this journalists' interest on law changes is elaborated upon. The relations between the law and media are suggested to be understood through configurations of power that are promoted by governmentality.

The Danish Parliamentary Ombudsman occupies a central position as a watchdog over public authorities within the national context. The statutory and functional powers of the institution are wide and the ombudsman enjoys a priori sympathy from Parliament and the media. In addition, there are no specialised administrative courts in Denmark and the ombudsman is thus unrivalled on the legal scene as the primary specialist protector of good administration. Nevertheless, the Danish ombudsman subscribes to a narrow scope of focus in the protection of citizens' rights. In practice, the ombudsman often limits his review to the authorities' compliance with national law and in particular with general procedural requirements. The rights of citizens are only actively protected by the ombudsman as far as certain parts of general administrative law are concerned. The limited horizon in the control and thinking of the Danish ombudsman leaves the European Union rights of citizens largely unidentified and unprotected. The Danish ombudsman is a watchdog with teeth but with discerning taste buds. As to EU Law, the ombudsman is a watchdog with no appetite at all.

Examines the consequences of terrorism for humanitarian action, arguing that valid security requirements & prevention efforts must not be allowed to undermine international humanitarian law. Further, the distinction between required political & security action & the mandate & work of humanitarian organizations cannot be blurred. Following a firm condemnation of all forms of terrorism, it is contended that, while international humanitarian law does not treat terrorists explicitly as combatants, its core principles & protections apply in the fight against terrorism & with respect to terrorists. Thus, the basic principles of international humanitarian law should be reaffirmed & respected by the international community. Attention turns to the nature & independence of humanitarian organizations & the need to resist the urge to enlist them in the "war on terrorism." Their rejection & condemnation of terrorism should not lead to a weakening of their mandate. It is viewed as important to continue to demonstrate solidarity with the poor & underprivileged & as urgent to lay the bases of a just & universal peace, hanging on to the idea of permanent peace as not an illusion, but a necessity. Mit Hilfe einer neu entwickelten Rechtsprinzipientheorie der Legitimität, die auf die Abwägung zwischen dem Schutzinteresse der Investoren und dem effektiven Schutz der von einer Investition betroffenen Individuen abstellt, gelingt es Philipp B. The determination of whether to release a detained foreign warship and its crew is a crucial issue in law and in practice. This article examines the issue of the release of a detained foreign warship and its crewmembers through provisional measures by analyzing the ARA Libertad and Ukraine v. Russia cases. Specifically three issues must be examined. The first issue concerns the interpretation of military activities under Article 298(1)(b) of the U.N. Convention on the Law of the Sea (UNCLOS). On this issue, this article highlights that a threshold for deciding the preponderance of military or law enforcement elements is of critical importance when there are mixed military and law enforcement activities. The second issue concerns the immunity of a detained ship under UNCLOS Articles 29, 32, 95, and 96. In this regard, this article argues that UNCLOS Article 32 may apply to internal waters, even though opinions of the members of ITLOS were divided on this matter. The third issue relates to the question of urgency in ordering provisional measures concerning the release of a detained ship and its crew. Here, this article argues that when identifying the existence of a real and imminent risk, there is a need to consider three temporal elements: the alleged breach of the rights of the applicant State (the past), the existence of ongoing risk (the present), and the possibility of repetition or continuity of the risk (the future).
