Taking the increasing importance of the EU in cultural matters as a starting point, this article attempts to assess to what extent the right to participate in cultural life (as defined based on various human rights instruments) is protected under EU law. Second it discusses the impact of EU law and policies on the enjoyment of this right. It highlights that the respect, protection and promotion of the right to participate in cultural life within EU law are obstructed by the asymmetry that exists at the European level and which favors on the one hand, non-political decision-making over political processes, and, on the other hand, negative on positive integration. This asymmetry indeed weakens national cultural policies without allowing space for specific European policies for positive integration. Third, it explores avenues for a better protection of the right to participate in cultural life under EU law.
This article argues that there is no normative conflict between IIL and international cultural law, but a conflict between the cultural interest of host states and the interest of foreign investors ( the culture-investment conflict of interests ) instead. Beyond, this article puts forth, and aims at shedding light on, the 'sensitiveness' of IIL to cultural heritage, i.e. the fact that the conventional granting of rights to foreign investors does not result in a regulatory chill with respect to the protection/promotion of cultural heritage. Medical research applied to humans operated without specific rules until the enactment of the Law of 20 December 1988 entitled: "Protection of persons who lend themselves to biomedical research". This law is the result of a proposal by two senators, Claude Huriet and Franck Sérusclat, a doctor and pharmacist respectively. Since recently, the legal arsenal in the hands of the public authorities has been enriched by an instrument that has long been broken down by the Belgian legislators, namely the right of pre-emption — for several years the regional legislators of the three Regions seem to be attracted by this procurement instrument. French foresters began to open out onto the outside world towards the end of the 19th century with the 1882 "RTM" law, which integrates the work done by the forestry corps in mountain areas into agriculture. In the footsteps of Georges Fabre in the Aigoual Forest and the Leplaysians between 1890 and 1914, two precursors opened the way towards the new doctrine of urban planning, its parks and gardens first, later extending it to managed and organised spatial planning of the entire country, including rural and montane areas. They were Jean Forestier and Pierre Randet, who in spite of their 35-year age difference, had in common their mountain roots and a taste for town planning, that might have led them to meet. Θέματααιχμής κατά την αναθεώρηση της Οδηγίας 86/609 θα αποτελέσουνη ηθική αξιολόγηση των πειραματικών πρωτοκόλλων, η ανάλυσητου κόστους της χρησιμοποίησης ζώων σε σχέση με το αναμενόμενοόφελος, η κατηγοριοποίηση της σοβαρότητας του προκαλουμένουπόνου και της αγωνίας, καθώς και η διαδικασία τηςαδειοδότησης των φυσικών προσώπων, κυρίως των υπευθύνωνκτηνιάτρων και των άλλων επιστημόνων-πειραματιστών και τωνεγκαταστάσεων. ; The use of animals for experimental and educational purposes is regulated by a national legal framework in accordance to the European Directive 86/609 and the European Convention ETS 123 of the Council of Europe. Main issues regulated by the above legislation are the license procedure for the use of laboratory animals, the registration of breeding, supplying and experimental establishments, the implementation of guidelines for the appropriate care and use of the animals, the collection of statistical information and the promotion of alternative to animal experimentation methods. The veterinarian plays an important role for the protection, the health and the welfare of laboratory animals. This role is well defined within the existing legislation. The supervision of the veterinarian guarantees also the quality of the obtained results from animal experimentations. After twenty years, the scientific community and the animal welfare associations recognized the need for the revision of the existing European legal framework under the new obtained scientific knowledge. The Council of Europe has recently revised the Appendix A of the European Convention ETS 123 and the Commission of the European Union initiated the process for the revision of the European Directive 86/609. Ethical evaluation, authorization procedures and registration of establishments are, also, expected to be revised.
