The separation of a public & a private sphere is essential for the normative self-understanding of liberal democracies. But the question of where to draw the line is a matter of intense public debate. The essay discusses problems of liberal self-containment with regard to private forms of life. It concentrates on the debate about reforms in family policies that is going on in Germany at present & concludes that the principle of neutrality is consistent with & even demands political measures of non-discrimination. The special section on democratic theory discusses the lasting impact of the late Iris M. Young's (1949-2006) thought for political theory today. In his introductory essay, Peter Niesen suggests that the two central motives of Young's work, her political conception of justice addressed to phenomena of oppression, & her understanding of democracy as communicative rather than deliberative, are both oriented towards an ideal of maximal social inclusion as equals. The articles in the special section take up various facets of Young's thought, from gender difference to global inequalities to the theory of civil society & democratic public spheres. Inspired by Young's characteristic style, the contributions refer back to concrete social observations & perceptions of injustice in order to sharpen & revise the analytical & normative concepts of political theory. Ina Kerner gives a reading of Young's writings on the phenomenology of the female body, showing how Young purposely subverts the lines between 'essentialist' & artificial interpretations of sex & gender differences in order to use the resources of 'body language' as a reservoir of critique. Regina Kreide takes up Young's writings on global justice & the question of whether there exists a 'just way of producing' a T-Shirt, and, if not, who ought to be considered responsible for that fact. She discusses & modifies Young's 'social connection' model of responsibility as not involving strict individual liability for past action or inaction, but as involving collective duties geared to future relations. Moving from the theory of justice to democratic theory, Elisabeth Conradi invokes the practice of 'greeting' to suggest that argumentative democratic practices ought to be supplemented by alternative forms of inclusion & recognition. Sandra Seubert develops Young's idea of a civil society structured by group affinities & struggles. She suggests that support for marginalized groups need not necessarily strengthen a society's democratic credentials, as it may empower the destructive potential of 'uncivil' groups. Der Beitrag fragt nach den Möglichkeiten und Perspektiven der Reform (politischer) Institutionen. Er setzt sich zunächst kritisch mit der verbreiteten Tendenz auseinander, sich unter Hinweis auf die Systemerfordernisse gestiegenen Wettbewerbdrucks an Effizienz und Leistungsfähigkeit zu orientieren. Häufig wird hier argumentiert, dass gehandelt werden müsse, statt zu diskutieren, dass Partizipationsbegehren der Bürger sachgerechte Problemlösungen erschweren, dass Entschlossenheit und Geschlossenheit wichtiger seien als demokratische Verfahren und Kontroversen. Werden Input- und Output-Dimension allerdings derart gegeneinander ausgespielt, droht der Zusammenhang zwischen beiden aus dem Blick zu geraten. Die vorliegende institutionentheoretische Reflexion macht deutlich, dass Institutionen für die Erzeugung von rationalen Politikergebnissen nie einfach nur funktional in Dienst genommen werden können, sondern immer zugleich eine sozialisatorische Dimension haben, ein bürgerbildendes oder -missbildendes Potential. Sie sind ein "Erfahrungsraum", der Ermutigungs- bzw. Entmutigungseffekte bereithält. Insbesondere für demokratische Institutionen ist nämlich nicht nur wichtig, dass Leistungen erbracht werden, sondern wie dies geschieht. Vor dem Hintergrund dieser Problemstellung wird für eine Perspektive institutioneller Reform argumentiert, die sich an dem republikanischen Ziel der Konstitution einer autonomen Bürgerschaft orientiert. Gegenstand des Beitrags sind die Spannungen zwischen zwei demokratietheoretischen Positionen, der republikanischen und der liberalen. Die Verfasserin setzt sich mit der Frage auseinander, wie demokratische Institutionen so gestaltet werden können, dass nicht nur die Legitimität, sondern auch die Rationalität politischer Willensbildung gefördert würde. Sie diskutiert zunächst Kriterien bürgerschaftlicher Rationalität und erörtert unter Rückgriff auf republikanische Elemente deren demokratietheoretischen Stellenwert. Vor diesem Hintergrund wird die Bedeutung von Institutionen als Kontexten rationaler Selbstbindung problematisiert. Eine Reform dieser Institutionen muss so gestaltet sein, dass sie der gewachsenen Bedeutung der Mikroebene des bürgerschaftlichen Engagements Rechnung trägt, ohne assoziationstheoretischem Optimismus oder elitistischem Pessimismus anheim zu fallen.
