For the past fifty years, immigration law has resisted integration ofGideon v. Wainwright's legacy of appointed counsel for the poor. Today, however, this resistance has given way toGideon's migration. At the level of everyday practice, criminal defense attorneys appointed pursuant to Gideon now advise clients on the immigration consequences of convictions, negotiate"immigration safe" plea bargains, defend clients charged with immigration crimes, and, in some model programs, even represent criminal defendants in immigration court. A formal right to appointed counsel in immigration proceedings has yet to be established, but proposals grounded in the constitution, statutes, and expanded government funding are gaining momentum.From the perspective of criminal defense, the changing role of Gideon-appointed counsel raises questions about the breadth and depth of immigration assistance that should developunder the defense umbrella. From the perspective of immigration legal services, the potential importation of aGideon-inspired right to counsel requires consideration of the appropriate scope and design for an immigration defender system. This Essay does not attempt to resolve these challenging questions, but rather provides a framework for further reflection grounded in lessons learned from the criminal system's implementation ofGideon.

ABSTRACTThis paper provides an overview of current debates questioning the relationship between migration and development. A key argument is that mainstream academic and policy discussions often remain within a non‐critical paradigm that sees the relationship between migration and development as natural, and development as something that can be achieved through direct or indirect policy initiatives. The contributions to this special issue challenge this perspective by showing that the connection between migration and development is the product of a political and scientific construction. They demonstrate that both migration and development policies are embedded in imbalanced power relations and north–south divide. This calls for building upon the findings of critical development studies to rethink the so‐called 'migration and development nexus'. Copyright © 2013 John Wiley & Sons, Ltd.

Migration Policy Centre ; In this paper I research economic, non-economic and the institutional determinants of bilateral migration flows into OECD countries. My contribution to the growing literature is two-fold. First, I explicitly account for the panel structure of migration costs information acquisition, physical costs of the move and social exclusion). Second, building upon Beine et al. (2011b), I proceed with the analysis of determinants of bilateral migration flows disaggregated by educational attainments in the panel data environment. The preliminary results show that the defined cost variables are significant in explaining the volume and composition of the flow of migrants, the result not being sensitive to the model specification. Network effects promote negative self-selection and the quality of migrants positively correlates, while the physical distance, existence of a common language and colonial links between countries are insignificant in explaining the educational composition of migrants. I further conclude that the restrictive and skill selective immigration policies of the major destination countries bias the conventional role of the economic push and pull factors. ; The MPC is co-financed by the European University Institute and the European Union

Until the mid-1980s, Korea was a major labor exporter to Arab countries. The flow of international labor migration was reversed in the late 1980s as domestic wages increased and as construction projects declined in the Middle East. Conversely, a massive influx of migrant workers, mostly from Asian countries, took place since the beginning of the 1990s. The large proportion of irregular foreign workers has been a feature of international mgiration in Korea. The government has been trying to address this problem since 1992. In recent years, three policy issues have been discussed: the impacts of foreign workers on the national economy, choosing between the industrial training program and the employment permit system, and special laws for foreign workers. To cope with the challenges of international labor migration, particularly the problems generated by irregular migration, prudent policy measures are urgently needed which should be beneficial to the national economy and the migrant workers.

Societal transformations have recently stimulated political debates and policies on the integration of migrants and minorities in most Western European countries. While transnational migration studies have documented migrants' cross-border activities there have been few empirically grounded efforts to theorise these developments in the framework of integration and status theory.Based on a case study of Ghanaian migrants, this book seeks to understand integration processes and develops a theorem of the status paradox of migration which explores the interaction between migrants' integr.

zu beseitigen. In allen einschlägigen Konzepten wird ihr eine Schlüsselrolle zugewiesen.
Dies wirft grundsätzliche Fragen nach dem Zusammenhang von Entwicklung
und Migration auf. In der wissenschaftlichen Debatte gilt seit längerem als belegt, dass
sozioökonomische Entwicklung Migration fördert, statt sie zu reduzieren. Tatsächlich
aber ist diese Kausalbeziehung nicht so eindeutig, wie es das entsprechende Modell des
»migration hump« suggeriert. Offenbar werden Wanderungsentscheidungen durch
weitere Faktoren beeinflusst. Daher ist es problematisch, wenn die Politik diese Scheinevidenz
aufgreift und daraus simple Strategien ableitet. Der Kontext von Migration
und Entwicklung muss differenzierter analysiert werden. Auf diese Weise lassen sich
entwicklungspolitische Ansätze auch für die Zusammenarbeit mit afrikanischen Partnerstaaten
