"Bis heute bringt die Rechtssoziologie für die Rechtsdogmatik, also für die Tätigkeit und die Erzeugnisse der methodisch kontrollierten Auslegung des kodifizierten Rechts, wenig Interesse auf. Ihren Gegenstand sieht die Rechtssoziologie in der Erforschung der empirischen sozialen Rechtswirklichkeit. Die gültigen Regeln der Auslegung des geltenden Rechts sind, sofern sie in der Rechtspraxis Beachtung finden, Bestandteil der Konstitution dieser Rechtswirklichkeit. Dem rechtssoziologischen Desinteresse an der Rechtsdogmatik liegt mithin explizit oder implizit die Annahme zu Grunde, dass die Rechtsdogmatik keinen beachtenswerten Beitrag dieser Art zur Konstitution der Rechtswirklichkeit leistet. Der vorliegende Beitrag untersucht einige Entwicklungslinien der Rechtssoziologie, die dieser Annahme Vorschub geleistet haben. In der Auseinandersetzung mit ihnen wird argumentiert, dass Anlass zu einer veränderten Bewertung der soziologischen Relevanz der dogmatischen Jurisprudenz besteht." (Autorenreferat)

To what extent is English Private Law being affected by the United Kingdom's membership of the European Union? I think we can try to answer this at three levels: (i) The United Kingdom's compliance with EU legislation; (ii) the influence of European ideas on English Private Law; (iii) the attitude in England towards greater harmonisation or possible unification of European Private Law

From labour law to social competition law?

It may seem dangerous to express oneself on the future of labour law, since it is widely considered to be in crisis by scholars of the field. There is no doubt that anyone attempting to predict the probable developments by presenting hypotheses regarding these developments runs the risk of making errors. Especially the impossibility to guarantee the relevancy of the chosen parameters and a correct evaluation of the nature of their relations could lead to erroneous predictions. The same applies when one has the ambition to pronounce oneself on the future of institutions, structures or procedures laid down in and protected by law.0The objective of this book is threefold. First of all, it draws attention to a number of phenomena and processes both within and outside the law that affect the protective mechanisms and essential functions of labour law. Secondly, the authors want to point out their main causes and principal consequences. Finally, the book reflects the remedies proposed by the authors to preserve the essential task of labour law. Those objectives are achieved by developing the following four themes: the existential relation between labour law, the labour market and social competition; the historical tie between labour law and human dignity; the relationship between labour law, market law and (social) competition law; and finally the risk of a renewed contestation of the dignity of working people.0The aim of this book is to provide intellectually challenging ideas for those interested in understanding, explaining and interpreting labour laws - whether they are scholars, practitioners, judges, policy-makers, or workers and employers.--Back cover

International tribunals and legal scholars have been considering the relationship between International Humanitarian Law ('IHL') and International Human Rights Law ('IHRL') for a number of years.1The International Court of Justice famously or infamously (depending on your perspective) considered their relationship in itsNuclear Weapons Advisory Opinionin 1996.2The Court concluded that while IHRL did apply in times of armed conflict, when it came to the prohibition of arbitrarily taking human life in Article 6 of the International Covenant on Civil and Political Rights 1966, the content of that prohibition had to be found in thelex specialisof IHL.
