La recerca vol ésser una eina que aporti informació sobre l'esperit obert i integrador que els representants institucionals de l'ensenyament superior europeu volen assolir amb la creació de l'EEES. La nova fita educativa es sustenta d'uns principis, intencions, directrius i interessos amb una clara definició europeista de reconeixement, convergència i mobilitat amb l'objectiu d'intentar assolir un tret distintiu i de qualitat en l'ensenyament superior europeu. El present estudi es fonamenta en una metodología qualitativa-interpretativa centrant-se per un costat en la recerca, anàlisi, descripció i interpretació de la documentació oficial que ha anat acompanyant el procés de construcció de l'EEES, comprenent els documents d'origen; la Magna Charta Universitatum, la Declaració de la Sorbona i la Declaració de Bolonya. I, els documents de desenvolupament referents a les diferents conferències ministerials europees dels responsables de l'ensenyament superior, que es dugueren a terme a Praga, Berlín, Bergen, Londres i Louvain, així com dels textos i informes de: UNESCO, ESIB, CRE, EUA, EURASHE, BFUG, ENQA, Comissió Europea, Eurydice, OCDE. Els quals precediren les reunions Ministerials i ajudaren a la seva constitució, que han anat avaluant, modificant i/o consolidant les directrius marcades per la Declaració de la Sorbona i Bolonya amb la finalitat d'assolir l'EEES. Tanamteix s'acompanya el fons documental amb la descripció, anàlisi i interpretació dels principis jurídics (i respectives sentències) que han permès i fonamentat la creació de l'EEES; la mobilitat i el reconeixement formatiu. I per un altre costat, consolidar els objectius de la recerca amb les pertinents entrevistes en profundiatat als principals autoritats, polítiques i acadèmiques que han participat de manera activa en el procés: Dr. Josep Maria Bricall (President de la Conferència Europea de Rectors i membre del Comité de Redacció de la Magna Charta Universitatum), sr. D. Jose Fernández Díaz (Secretari d'estat d'universitat i signatari per Espanya de la Declaració de Bolonya), sr. Guy Haug (impulsor del programa Erasmus i expert assessor de l'ensenyament superior per a la Comissió Europea), Dr. Domenico Lenarducci (President d'Honor de la Direcció General d'Educació de la Comissió Europea), Dr. Eric Froment (President de la Conferència Europea de Rectors i actual responsable de la dimensió Internacional de l'Agència de Qualitat AERES) i el Dr. Màrius Rubiralta (actual Secretari General d'Universitats del Govern d'Espanya). La Tesi s'acompanya de diferents esquemes històrics i d'una àmplia base documental bibliogràfica, tot intentant esdevenir una bona eina de difusió d'una millor comprensió de l'EEES i que alhora possibiliti futures línies d'investigació en aquest i d'altres àmbits vinculats. ; La investigación quiere ser una herramienta que aporte información sobre el espíritu abierto e integrador que los representantes institucionales de la educación superior europeo quieren lograr con la creación del EEES. El nuevo hito educativo se sustenta de unos principios, intenciones, directrices e intereses con una clara definición europeísta de reconocimiento, convergencia y movilidad con el objetivo de intentar lograr un disparo distintivo y de calidad en la educación superior europea. El presente estudio se fundamenta en una metodología cualitativa-interpretativa centrándose por un lado en la búsqueda, análisis, descripción e interpretación de la documentación oficial que ha ido acompañando el proceso de construcción de la EEES, comprendiendo los documentos de origen; la Magna Charta Universitatum, la Declaración de la Sorbona y la Declaración de Bolonia. Y, los documentos de desarrollo referentes a las diferentes conferencias ministeriales europeas de los responsables de la educación superior, que se llevaron a término en Praga, Berlín, Bergen, Londres y Lovaina, así como de los textos e informes de: UNESCO, ESIB, CRE, EE.UU., EURASHE, BFUG, ENQA, Comisión Europea, Eurydice, OCDE. Los cuales precedieron las reuniones Ministeriales y ayudaron a su constitución, que han ido evaluando, modificando y/o consolidando las directrices marcadas por la Declaración de la Sorbona y Bolonia con la finalidad d lograr l'EEES. Así mismo se acompaña el fondo documental con la descripción, análisis e interpretación de los principios jurídicos (y respectivas sentencias) que han permitido y fundamentado la creación de l'EEES; la movilidad y el reconocimiento formativo. Y por otro lado, consolidar los objetivos de la investigación con las pertinentes entrevistas en profundidad a los principales autoridades, políticas y académicas que han participado de manera activa en el proceso: Dr. Josep Maria Bricall (Presidente de la Conferencia Europea de Rectores y miembro del Comité de Redacción de la Magna Charta Universitatum), sr. D. Jose Fernández Díaz (Secretario de estado de universidad y signatario por España de la Declaración de Bolonia), Dr. Guy Haug (impulsor del programa Erasmus y experto asesor de la enseñanza superior para la Comisión Europea), Dr. Domenico Lenarducci (Presidente de Honor de la Dirección general de Educación de la Comisión Europea), Dr. Eric Froment (Presidente de la Conferencia Europea de Rectores y actual responsable de la dimensión Internacional de la Agencia de Calidad AERES) y el Dr. Màrius Rubiralta (actual Secretario General de Universidades del Gobierno de España). La Tesis se acompaña de diferentes esquemas históricos y de una amplia base documental bibliográfica, intentando acontecer en una buena herramienta de difusión de una mejor comprensión del EEES y que a la vez posibilite futuras líneas de investigación en este y de otros ámbitos vinculados. ; La recherche veut être un outil qu'aborde de l'information sur l'esprit ouvert et intégrateur que les représentants institutionnels de l'éducation supérieur européen volent obtenir avec la création de l'EEES. La nouvelle borne éducative se soutient de principes, des intentions, des directives et des intérêts avec une claire définition européenne de reconnaissance, convergence et mobilité dans le but d'essayer d'obtenir un sceau distinctif et de qualité dans l'éducation supérieure européenne. L'étude se fonde sur une méthodologie qualitative-interprétative en étant axé d'une part sur la recherche, analyse, description et interprétation de la documentation officielle qui a continué à accompagner le processus de construction de l'EEES, en comprenant les documents d'origine ; la Magna Charta Universitatum, la Déclaration de la Sorbonne et la Déclaration de Bologne. Et, les documents de développement relatifs aux différentes conférences ministérielles européennes des responsables de l'éducation supérieure, qu'ont emportée à terme à Prague, Berlin, Bergen, Londres et Louvaine, aussi bien que des textes et rapports de : UNESCO, ESIB, CRE, U.S.A., EURASHE, BFUG, ENQA, Commission Européenne, Eurydice, OCDE. Qui ont précédé les réunions Ministérielles et ont aidé à sa constitution, qu'elles ont continué à évaluer, en modifiant et/ou en consolidant les directives marquées par la Déclaration de la Sorbonne et Bologne avec la finalité d'obtenir l'EEES. De même s'accompagne le fond documentaire avec la description, analyse et interprétation des principes juridiques (et de respectives sentences) qu'ils ont permis et fondé la création de l'EEES; la mobilité et la reconnaissance formative. Et d'autre part, consolider les objectifs de la recherche avec les pertinentes entrevues en profondeur aux délégants des autorités, politiques et académiques qui ont partagé manière active dans le processus: Dr. Josep Maria Bricall (Président de la Conférence Européenne de Recteurs et membre du Comité de Rédaction de la Magna Charta Universitatum), sr. This thesis analyzes what should be the contribution from Congolese media in the process of establishing a democratic state based on the law, not only inspired by the principles that govern the Belgian media sector, especially audiovisual media of the French-speaking Community, but also by those universally accepted (international standards for the protection of freedom of expression). The research tries to evaluate, from these principles, the contribution of media (in their role of information, permanent education, cultural promotion, popularization of the principles of democracy and entertainment) in the formation of a democratic political culture (based on the emergence of values) in the Congolese public in search of legitimacy of institutions and leaders who must embody it, in a country marked by violence and wars. In this country, indeed, the rule of law is difficult to emplement. It is appropriate to know what role or values media should play or represent in the current democratic process in the Democratic Republic of Congo (DRC). The institutional and legal recognition of their fundamental role, their independence (without censorship and without any political, military, economic and social pressure), their diversity, the authonomy of their organization, their professionalism as well as their ability to be listened to by the largest audience are the factors of their development and their promotion in any democratic society. While pursuing the objectives of education to media, discovery of the press sector through legislative and professional frameworks and through its accessibility to the public, the study aims at showing the importance of the social and political role of the press in a society undergoing reconstruction, by providing media professionals, magistrates, judges, lawyers, university professors and Congolese political decision-makers, as well as civil society, a tool for objective information on the subject. In a theoretical approach, the reseach describes and defines notions and principles of a democratic state and of freedom of expression in all its components and in all its dimensions (individual and collective). It defines the scope of the international protection of the freedoms of expression, information and the press, as well as their holders. It examines the place and role of the Congolese press in various political and institutional contexts since 1885 (independent state of the Congo) to the present day by insisting on the different legislations that have governed and still govern the press. From this examination, it emerged that serious obstacles to the functioning of Congolese media exist from pre-colonial times to today. These limits are political, institutional, legal, professional, structural, cultural, geographical and economic. They prevent the Congolese public from expressing itself freely, from taking an active part in management of public affairs and from gaining access to the press. They have plunged the majority of the Congo's population into ignorance and misinformation to the detriment of a minority elite, which uses them as instrument of power and propanganda. These obstacles also deprive the same public of a common good, which is information and violate their right to freedom of information. They question is not only the role or the action that the press could play in the ongoing democratic process, but also their independence, their objectivity, their credibility, their efficiency and effectiveness. The research proposes political, institutional, legislative, professional and economic measures. It suggests other measures that can make them more accessible to the public and that can transform the public into an informed, trained and woke audience, able to participate actively, through their platforms, in debates on issues of general interest (such as the legitimization of power) and political decision-making. In order for them to become a major actor and responsible player for the reconstruction of the democratic state based on the law awaited for years by the Congolese people. ; Cette thèse analyse ce que devrait être la contribution, l'apport des médias congolais dans le processus de l'instauration d'un Etat de droit démocratique, en s'inspirant, non seulement des principes qui gouvernent le secteur médiatique belge, notamment les médias audiovisuels de la Communauté française, mais aussi de ceux universellement acceptés (les standards internationaux de protection de la liberté d'expression). Elle essaie d'évaluer, partant de ces principes, l'apport des médias ( dans leur rôle d'information, d'éducation permanente, de vulgarisation des principes de la démocratie, de promotion culturelle et de divertissement) dans la formation d'une culture politique démocratique (basée sur l'émergence de valeurs) du public congolais en quête de légitimité d'institutions et des dirigeants qui doivent l'incarner dans un pays marqué par la violence et les guerres. Dans ce pays, en effet, l'Etat de droit a du mal à se mettre en place. Il convient, n'est-ce pas, de connaître ce rôle ou ces valeurs que les médias devraient jouer dans le processus démocratique actuel en République Démocratique du Congo. La reconnaissance institutionnelle et juridique de leur rôle fondamental, leur indépendance par rapports aux pouvoirs politique, économique et social, leur diversité, l'autonomie de leur organisation et leur professionnalisme ainsi que leur capacité à être écoutés par un public plus large que possible, sont autant les facteurs de leur développement et de leur promotion dans toute société démocratique. Tout en poursuivant des objectifs d'éducation aux médias, de découverte du secteur de la presse tant dans les domaines législatif, professionnel et de celui de leur accessibilité au public, l'étude vise à faire connaître l'importance du rôle social et politique de la presse dans une société en reconstruction. Elle en met à la disposition du public, de tous les professionnels des médias, des magistrats, des juges, des avocats, des professeurs d'universités, des décideurs politiques congolais, ainsi que de la société civile, un outil d'informations objectives sur le sujet. Dans une approche théorique, elle décrit et elle définit les notions et les principes d'un Etat de droit démocratique et de la liberté d'expression dans toutes ses composantes et dans toutes ses dimensions (individuelle et collective). Elle définit le champ d'application de la protection internationale des libertés d'expression, d'information et de la presse, ainsi que leurs titulaires. Elle examine la place et le rôle de la presse congolaise dans les différents contextes politiques et institutionnels depuis 1885 (Etat indépendant du Congo) jusqu'à nos jours en insistant sur les différentes législations ayant régi et qui régissent encore aujourd'hui la même presse. De cet examen, il s'est dégagé le constat selon lequel de graves entraves au fonctionnement des médias congolais existent depuis l'époque précoloniale jusqu'aujourd'hui. Celles-ci sont d'ordre politique, institutionnel, juridique, professionnel, structurel, culturel, géographique et économique. Elles empêchent le public congolais de s'exprimer librement, de participer activement à la gestion de la chose publique et d'accéder à l'antenne de la presse. Elles ont plongé et plongent encore la majorité de la population du Congo dans l'ignorance de leurs droits et libertés fondamentaux et dans la désinformation au détriment d'une élite minoritaire qui en font l'instrument du pouvoir et de sa propagande. Celles-ci privent également le même public d'un bien commun, qu'est l'information et violent son droit à la liberté d'information. Elles remettent en cause, non seulement le rôle ou l'action que la presse pourrait jouer dans le processus démocratique en cours, mais aussi leur, indépendance, leur objectivité, leur crédibilité, leur efficience et leur efficacité. Pour qu'ils deviennent un acteur majeur et responsable de la reconstruction de l'Etat de droit démocratique tant attendu par le peuple Congolais, la recherche propose des mesures d'ordre politique, institutionnel, législatif, professionnel et économique. Education of students in today's conditions requires new ideas and concepts that are related to the peculiarities of the socio-economic situation in society, namely: revaluation of values, changes in priorities of prestigious professions, contradictory attitude to education in the labor market, lack of a clear youth policy, adequate to modern conditions.Today's education should become not just one of the subsystems of the social sphere, which satisfies a number of personal needs, but also a specific domain of social life, in which the future is modeled, resources of development are formed, and the negative effects of the functioning of other social institutions are compensated. As a result, the education system essentially extends its sphere of influence. One of the most important characteristics of student youth is its social needs, a large proportion of which is implemented in the field of education. Concerning higher education, certain requirements are put forward regarding the implementation of social needs of student youth; at the same time it is the institutional environment that mostly influences the formation of student social.Defining the development vectors of the education system requires the search for answers to questions relating to contemporary students, its social needs and expectations in relation to higher education, as well as the clarification of the conditions correspondence that education creates to realize its demands. The article highlights the peculiarities of student social needs in the field of education and their implementation; the content of such concepts as «needs», «social needs», «educational needs» were clarified.It was emphasized that social needs are connected with the inclusion of the individual in the family, in various social groups and communities, in the various spheres of production and non-production activities, in the life of society as a whole. These are the needs for work, social and economic activity, as well as spiritual culture, that is, everything that is a product of social life. They are needs of a special kind, the satisfaction of which is necessary to support the life of the social person, social groups and society as a whole.Social needs are met by the organizational efforts of society members through social institutions. Satisfying needs ensures social stability and social progress, dissatisfaction generates social conflicts. Social institutions are the leading components of the social structure of society, which integrate and coordinate the actions of society members, social groups and regulate social relations in various spheres of public life. Four groups of social needs were defined:- Vital for the social person needs, whose dissatisfaction leads to the elimination of a social person or the revolutionary transformation of social institutions, within which this satisfaction occurs;- Needs, the satisfaction of which ensures the functioning of the social person at the level of social norms, as well as allows the evolution of social institutions to be realized;- Needs, the satisfaction of which occurs at the level of minimum social norms, which ensures the preservation of the social person, but not its development; - Needs, the satisfaction of which provides comfortable (for data of socio-cultural area and social time) conditions of operation and development.The article gives attention to the relation between the concepts of «social needs» and «educational needs» and shows where they overlap. The existence of educational needs is an essential feature of students. Educational need is a need arising from the contradiction between the existing and necessary (desired) level of education and encourages the person to eliminate this contradiction.Educational needs were defined as the needs for the formation of the education means of those personal qualities that contribute to personal self-realization and the formation of personal qualities in the field of education that will enable them to obtain the desired social benefits and improve the social well-being of the individual. Such qualities are: high level of intellectual development; theoretical knowledge and practical skills necessary for professional activity; communicative skills and a high level of culture; personal qualities (integrity, workability, creativity, etc.). Education itself is a factor that allows the formation and accumulation of socially significant qualities in an individual's arsenal that enable them to receive the benefits, satisfy the urgent needs and be realized as an active and active-oriented member of society.It was emphasized that in today's conditions, students according to their characteristics are quite different from all other sections of the population, first of all ideological formation, influence mobility and their kinds of needs, which to a great extent determine its social well-being.Social needs of students are considered in connection with the functions of education, primarily with the functions of intelligence reproduction of society, vocational, economic and social. The article used data from nationwide surveys of students «Higher Education in Ukraine: Students' Public Opinion» and «Higher Education in Reform Conditions: Changes in Public Opinion» conducted by Ilko Kucheriv Democratic Initiatives Foundation in 2015 and 2017 respectively; the data of a sociological survey «Values of Ukrainian Youth», conducted in 2016 by the Center for Independent Sociological Research «OMEGA», by request of Ministry of Youth and Sport of Ukraine.Based on the data of sociological research, we concluded that the level of social needs satisfaction of students in the field of higher education is not high. We need more detailed analysis of students who are studying at various educational institutions, as well as to identify the trends that are characteristic for education sections in different areas of study. ; В современной социологии научные поиски исследователей активизируются в направлении изучения сущностных характеристик студенческой молодёжи как особой социальной группы, которой присущи динамичные изменения, значительная степень мобильности по социальным показателям, высокий интеллектуальный потенциал и активное участие в социальных преобразованиях. Внимание ученых к студенческой молодёжи обусловлено высокой динамикой развития общества и изменением статуса и роли студенчества в нём. Одной из наиважнейших характеристик студенческой молодёжи выступают её социальные потребности, часть которых реализуется в сфере образования.К высшему образованию выдвигаются определённые требования относительно реализации социальных потребностей студенческой молодёжи. В то же время оно является той институциональной средой, котрая в наибольшей мере влияет на формирование социальных потребностей студенчества.В статье обоснована актуальность исследования социальных потребностей студенческой молодёжи, освещено их содержание, уделено внимание характеристикам современного студенчества. Освещены потребности студенчества, которые удовлетворяются в процессе учёбы в высшем учебном заведении и досуговой деятельности, которая осуществляется в образовательной среде.Уточнены понятия «социальные потребности», «студенческая молодь», «образовательные потребности». Охарактеризованы потребности студенчетства как специфического слоя, уделено внимание комплексу социальних потребностей студенческой молодёжи, которые удовлетворяются при помощи института образования. ; У сучасній соціології наукові пошуки дослідників активізуються у напрямку вивчення сутнісних характеристик студентської молоді як особливої соціальної групи, якій притаманні динамічні зміни, значний ступінь мобільності за соціальними показниками, високий інтелектуальний потенціал та активна участь у соціальних перетвореннях. Увага науковців до студентської молоді зумовлена високою динамікою розвитку суспільства і зміною статусу і ролі студентства у ньому. Однією з найважливіших характеристик студентської молоді виступають її соціальні потреби, велика частка яких реалізується у сфері освіти.До вищої освіти висуваються певні вимоги стосовно реалізації соціальних потреб студентської молоді, водночас вона є тим інституційним середовищем, яке впливає найбільшою мірою на формування соціальних потреб студентства. У статті обґрунтована актуальність дослідження соціальних потреб студентської молоді, висвітлено їх зміст, приділено увагу характеристикам сучасного студентства. Висвітлені потреби студентства, які задовольняються у процесі навчання у вищому навчальному закладі та суспільній і дозвіллєвій діяльності, яка здійснюється у освітньому середовищі.Уточнено сутність понять «соціальні потреби», «студентська молодь», «освітні потреби». Охарактеризовано потреби студентства як специфічної верстви, приділено увагу комплексу соціальних потреб студентської молоді, які задовольняються за допомогою інституту освіти.

La reconnaissance institutionnelle et juridique de leur rôle fondamental, leur indépendance par rapports aux pouvoirs politique, économique et social, leur diversité, l'autonomie de leur organisation et leur professionnalisme ainsi que leur capacité à être écoutés par un public plus large que possible, sont autant les facteurs de leur développement et de leur promotion dans toute société démocratique. Tout en poursuivant des objectifs d'éducation aux médias, de découverte du secteur de la presse tant dans les domaines législatif, professionnel et de celui de leur accessibilité au public, l'étude vise à faire connaître l'importance du rôle social et politique de la presse dans une société en reconstruction. Elle en met à la disposition du public, de tous les professionnels des médias, des magistrats, des juges, des avocats, des professeurs d'universités, des décideurs politiques congolais, ainsi que de la société civile, un outil d'informations objectives sur le sujet. Dans une approche théorique, elle décrit et elle définit les notions et les principes d'un Etat de droit démocratique et de la liberté d'expression dans toutes ses composantes et dans toutes ses dimensions (individuelle et collective). Elle définit le champ d'application de la protection internationale des libertés d'expression, d'information et de la presse, ainsi que leurs titulaires. Elle examine la place et le rôle de la presse congolaise dans les différents contextes politiques et institutionnels depuis 1885 (Etat indépendant du Congo) jusqu'à nos jours en insistant sur les différentes législations ayant régi et qui régissent encore aujourd'hui la même presse. De cet examen, il s'est dégagé le constat selon lequel de graves entraves au fonctionnement des médias congolais existent depuis l'époque précoloniale jusqu'aujourd'hui. Celles-ci sont d'ordre politique, institutionnel, juridique, professionnel, structurel, culturel, géographique et économique. Elles empêchent le public congolais de s'exprimer librement, de participer activement à la gestion de la chose publique et d'accéder à l'antenne de la presse. Elles ont plongé et plongent encore la majorité de la population du Congo dans l'ignorance de leurs droits et libertés fondamentaux et dans la désinformation au détriment d'une élite minoritaire qui en font l'instrument du pouvoir et de sa propagande. Celles-ci privent également le même public d'un bien commun, qu'est l'information et violent son droit à la liberté d'information. Elles remettent en cause, non seulement le rôle ou l'action que la presse pourrait jouer dans le processus démocratique en cours, mais aussi leur, indépendance, leur objectivité, leur crédibilité, leur efficience et leur efficacité. Pour qu'ils deviennent un acteur majeur et responsable de la reconstruction de l'Etat de droit démocratique tant attendu par le peuple Congolais, la recherche propose des mesures d'ordre politique, institutionnel, législatif, professionnel et économique. Elle suggère d'autres mesures qui peuvent les rendre plus accessibles au public et qui peuvent transformer celui-ci en un public informé, formé et éclairé, capable de participer activement, à travers leur plateformes, aux débats sur les questions d'intérêt général le concernant (comme la légitimation du pouvoir ) et à la prise des décisions politiques. ; (DROI - Sciences juridiques) -- UCL, 2018

The Arctic is experiencing rapidly warming conditions, increasing predator abundance, and diminishing population cycles of keystone species such as lemmings. However, it is still not known how many Arctic animals will respond to a changing climate with altered trophic interactions. We studied clutch size, incubation duration and nest survival of 17 taxa of Arctic-breeding shorebirds at 16 field sites over 7years. We predicted that physiological benefits of higher temperatures and earlier snowmelt would increase reproductive effort and nest survival, and we expected increasing predator abundance and decreasing abundance of alternative prey (arvicoline rodents) to have a negative effect on reproduction. Although we observed wide ranges of conditions during our study, we found no effects of covariates on reproductive traits in 12 of 17 taxa. In the remaining taxa, most relationships agreed with our predictions. Earlier snowmelt increased the probability of laying a full clutch from 0.61 to 0.91 for Western Sandpipers, and shortened incubation by 1.42days for arcticola Dunlin and 0.77days for Red Phalaropes. Higher temperatures increased the probability of a full clutch from 0.60 to 0.93 for Western Sandpipers and from 0.76 to 0.97 for Red-necked Phalaropes, and increased daily nest survival rates from 0.9634 to 0.9890 for Semipalmated Sandpipers and 0.9546 to 0.9880 for Western Sandpipers. Higher abundance of predators (foxes) reduced daily nest survival rates only in Western Sandpipers (0.9821-0.9031). In contrast to our predictions, the probability of a full clutch was lowest (0.83) for Semipalmated Sandpipers at moderate abundance of alternative prey, rather than low abundance (0.90). The concern about food insecurity in rural populations needs to be rethought and adapted to the overall living conditions of households by shifting to a concentrated spatial scale and a long-term analysis. This change will allow identifying territories on a finer scale than the national level in order to allocate development objectives and to link them to areas with high development potential. The finer level of analysis will also allow regrouping the actions carried out on a smaller scale in order to structure all the activities carried out on the targeted area and population. The general comment that the development and emergency aid has been focused in circumscribed areas and that the level of analysis is based on two scales, one "macro" (national, regional, departmental) and the other "micro" (village, community, household, individual and community) reinforces the need to create an intermediate level of analysis. The latter will serve to improve the structure other actions carried out at different levels and the articulation of the activities to be carried out and the targeted population. From a state of the art analysis of subject such as development, targeting, territory, food security, resilience, etc; different finding have led to the definition of a major question and an objective which form the core structure of the present dissertation. The research question is defined as "how to structure the targeting and identification of areas with high potential to articulate all the emergency and development actions carried out on several scales of analysis?". At the end of these observations, the objective of this research is "the establishment of a tool to support spatial and temporal decision making in structuring the emergency and development actions and targeting of populations subjected to food insecurity ". Three considerations emerge from this objective and research question: spatiotemporal analysis and targeting, development potentials, rural production systems. The various productions are also studied over a long series in order to consider the yield variations over time. Finally, these two analyzes, spatial (systems) and temporal (yields) are crossed in order to demonstrate the contribution of this decision-supporting tool in the articulation and structuring of the other two levels of targeting populations to food insecurity. The decision-supporting tool has been tested on the case study of the Nigerian population. The main outcomes are: the characterization of the opportunities and constraints of the Nigerian rural production systems; the identification of the products to be developed by production system; the identification of the most promising pathways by means of the distribution of the yields by systems. Finally, an essential point must be made about the increase of conservation methods and transformations for increasing the added value obtained by Nigerian households. At the end of this dissertation, the tool demonstrated its importance in structuring and articulating the targeting of food insecurity in the field of emergency aid and development: The territorial zones in the production systems identify the problems to which one or several solutions must be found. Production systems allow a concentration of actions according to the definition of the general and specific objectives of the agricultural development assistance programs. Potential outputs to be developed in production systems allow diversification of agriculture and structuring of development from a national point of view. The actions defined by the Technical and Financial Partners at the level of a village, a community and / or a commune can be more easily integrated into this scale of analysis and can be structured later in national development policies Agricultural policy. The increase in productivity in Niger depends on the development of products within the most favorable zones and not on the whole territory. However, this tool is complementary to the other targeting tools already in place. It should also be complemented by the same type of analysis at the level of West Africa and an analysis of the flows and prices condition to favor the flow of production. ; Le ciblage des potentialités de développement agricole en milieu rural doit être repensé et adapté à l'ensemble des conditions de vie des ménages d'un point de vue d'une échelle spatiale concentrée et d'une analyse sur une longue période. Ce ciblage identifie des territoires sur une échelle plus fine que le niveau national afin de répartir les objectifs de développement agricole et de les articuler sur des zones ayant un haut potentiel. Ce niveau d'analyse permettra aussi de regrouper les actions menées à une échelle plus « micro » afin de structurer l'ensemble des activités menées sur la zone. En effet, le constat que l'aide au développement et d'urgence se concentre dans des zones circonscrites et que le niveau d'analyse repose sur deux échelles, l'une « macro » (national, régional, départemental) et l'autre « micro » (village, collectivité, ménage, individu et communauté) renforce le besoin de créer un niveau d'analyse intermédiaire afin d'assurer une meilleure structuration des actions menées à différents niveaux et une meilleure articulation entre un territoire considéré (zone d'actions), les activités à mener et la population cible. A partir d'un état de l'art sur les sujets connexes à notre réflexion (développement, ciblage, territoire, sécurité alimentaire, résilience), différents constats ont permis d'aboutir à la définition d'une question majeure et d'un objectif structurant la présente dissertation. La question de recherche est définie comme suit : « comment structurer le ciblage et l'identification des zones à fortes potentialités permettant d'articuler l'ensemble des actions d'urgence et de développement menées sur plusieurs échelles d'analyse ? ». A l'issue de ces constats et réflexions, l'objectif de la présente recherche est « la mise en place d'un outil d'aide à la décision spatiotemporelle articulant et structurant le ciblage des potentialités de développement agricole en matière d'aide d'urgence et de développement ». Trois considérations ressortent de cet objectif et question de recherche : l'analyse et le ciblage spatiotemporels, les potentialités de développement, les systèmes de production ruraux. L'analyse spatiale est caractérisée par l'étude des systèmes de production ruraux. Ceux-ci sont définis selon des paramètres biophysiques et socioéconomiques. Ils reflètent une vision systémique identifiant des systèmes agraires. Les différentes productions sont aussi étudiées sur une série longue afin de montrer la tendance des produits à considérer (analyse temporelle). Enfin, ces deux analyses, spatiales (systèmes) et temporelles (produits) sont croisées afin de démontrer l'apport de ce type d'outil en matière d'articulation et de structuration des deux autres niveaux de ciblage (« macro et micro »). Les principaux résultats reposent sur l'identification des produits à développer par système de production, la caractérisation des opportunités et contraintes des systèmes de production ruraux nigériens. De plus, cette analyse spatiotemporelle permet une meilleure identification des potentialités grâce à la distribution des rendements par système et leur comparaison. A l'issue de cette dissertation, l'outil a démontré son importance en matière de structuration et d'articulation du ciblage structurant à l'insécurité alimentaire dans le domaine de l'aide d'urgence et du développement agricole. Les zones territoriales définies en systèmes de production permettent une concentration des actions en fonction de la définition des objectifs généraux et spécifiques des programmes d'aide de développement agricole. Les potentiels produits ont été répartis dans les systèmes de production et permettent de diversifier l'agriculture tout en structurant le développement d'un point de vue national. A l'inverse, les zones à faible potentiel de développement agricole ont été analysées. Elles représentent les zones les plus vulnérables en matière de développement agricole. En outre, les actions définies par les Partenaires Techniques et Financiers (PTF) à l'échelle d'un village, d'une communauté et/ou d'une commune peuvent s'insérer plus facilement dans cette échelle d'analyse et se structurer par après dans les politiques nationales de développement agricole. Il est à noter que l'accroissement de la productivité au Niger passe par le développement de produits au sein des zones les plus propices et non sur l'ensemble du territoire. Le présent outil permet d'acquérir une vision en réseau voire maillage de l'ensemble des potentialités agricoles et d'élevage en fonction des systèmes de production. Toutefois, il serait souhaitable d'insérer le présent outil et de le transposer à une échelle sous-régionale afin de caractériser les échanges au sein de la sous-région et d'orienter les excédents vers des zones consommatrices.

Climate change concerns have set the transportation sector under increasing pressure to reduce its fuel consumption and greenhouse gas (GHG) emissions. At the same time, economists and policy makers are concerned with the so-called energy efficiency paradox or energy efficiency gap: the notion of a gap between observed and supposedly cost-effective levels of energy efficiency. Besides environmental externalities, a number of further explanations—barriers to energy efficiency—for this seemingly suboptimal energy efficiency adoption behavior as well as policy recommendations to overcome these barriers have been brought forward. We review the academic literature on this issue and apply it to the domain of light-duty vehicle (LDV) fuel economy. The bottom line is that both theory and empirics suggest, although not entirely uncontended, that the market for fuel economy is characterized by several externalities as well as internalities (that is, welfare reductions—due to fuel cost undervaluation—consumers impose on themselves), leading to suboptimally low fuel economy levels and therefore providing a rationale for policy interventions. This thesis focusses on a policy instrument that is specifically dedicated to improving vehicle fuel efficiency and enjoys high popularity among policy-makers: mandatory standards for either fuel economy or specific carbon dioxide (CO2) emissions of passenger vehicles, which are key tools in many major automobile markets for meeting CO2 mitigation targets, for reducing dependence on oil imports, and increasing the welfare of motorists. By means of a theoretical model, we assess the relative favorability of different standard designs—uniform standards and manufacturer-specific standards based on a reference attribute such as weight (EU policy) or size (U.S. policy)—as well as the implications of credit trading across manufacturers. Uniform standards ignore heterogeneity in manufacturers' abatement costs; thus, in the absence of a credit trading mechanism, they impair the cost-effectiveness of achieving the fleetwide efficiency target and cause perceived inequities. By differentiating the manufacturer-specific emissions targets, weight- or size-based standards may then improve the economic efficiency of the regulation and balance the cost distribution through a more equitable allocation of required abatement efforts, but they distort the decision among different available abatement options. This distortion can possibly offset the gains from differentiating emissions targets to a large extent or even worsen the overall cost-effectiveness. We emphasize the crucial impact of the choice of the reference attribute on the magnitude of distortion-induced welfare losses and the regulation's overall economic efficiency properties. Making fuel efficiency standards tradable tends to improve their cost-effectiveness; yet, in case of distortionary attribute-based standards, and under certain circumstances, introducing tradability may actually have a deteriorating effect. Conducting numerical simulations, we identify the role of several structural factors (e.g., market concentration rates, technology cost structures, heterogeneity among vehicle manufacturers) for the relative cost-effectiveness and distributional equity of each kind of standard. We briefly contrast the U.S. and European policy approaches in the light of our theoretical results, arguing against the appropriateness of vehicle weight as reference parameter for attribute-based CO2 emissions or fuel economy standards. The subsequent chapters deal with the challenges arising from the upcoming, stepwise, and for ambitious GHG cuts indispensable electrification of the LDV fleet. Given growing market shares of electric drivetrains (battery-electric vehicles, plug-in hybrids, fuel cell electric vehicles), the currently widespread tailpipe CO2 emissions standards become increasingly inappropriate. With tailpipe standards implemented, electric vehicles (EV) have a large leverage on the (required) fuel economy of conventional internal combustion engine vehicles; as a consequence, uncertainty about the future market penetration of EV jeopardizes both GHG abatement targets as well as the realization of beneficial fuel cost savings. Thus, we assess potential alternative metrics for regulating vehicle efficiency—with well-to-wheel GHG standards and energy consumption standards appearing particularly promising, despite methodological challenges remaining to be resolved. In addition, we examine the interactions of vehicle efficiency standards with the broader climate policy framework—emissions trading schemes with varying sectoral scope, in particular—under consideration of different standards metrics and uncertain LDV electrification scenarios. Finally, we explore the interplay of LDV efficiency standards with other policy instruments specifically dedicated to improving new vehicles' CO2 performance or fuel economy. We show that—contingent upon the precise design of the efficiency standards—the implementation of such complementary policies can worsen the effectively realized fuel efficiency of the fleet. The simultaneous use of multiple instruments may still be beneficial and unfold synergies, however, if the regulator is aware of the instrumental interplay and adjusts the standards as well as the complementary policy instruments accordingly. ; Im Rahmen der Bemühungen um eine Begrenzung der globalen Klimaerwärmung gerät der Verkehrssektor zunehmend unter Druck, seinen Energieverbrauch und seine Treibhausgas-Emissionen zu verringern. Zugleich findet in Wissenschaft und Politik eine Diskussion um das sogenannte Energy Efficiency Gap (Energieeffizienzlücke) oder Energieeffizienz-Paradoxon statt. Das Energy Efficiency Gap beschreibt eine systematische Abweichung des tatsächlich realisierten vom vermeintlich optimalen bzw. kosteneffizienten Energieeffizienz-Niveau. Für dieses scheinbar suboptimale Verhalten hinsichtlich Energieeffizienzinvestitionen werden neben Umweltexternalitäten noch eine Reihe weiterer Gründe, sogenannte Energieeffizienz-Hemmnisse, sowie Politikempfehlungen für deren Überwindung diskutiert. In dieser Arbeit wird die wissenschaftliche Literatur zum Energy Efficiency Gap aufgearbeitet und auf den Bereich Personenkraftwagen (Pkw) angewendet. Sowohl Theorie als auch Empirie deuten darauf hin, dass der Pkw-Markt durch eine Vielzahl von Externalitäten als auch durch Internalitäten (d.h. eine dem rationalen Eigeninteresse zuwider laufende Unterbewertung der zukünftigen Kraftstoffkostenbelastung) gekennzeichnet ist, auch wenn dieser Befund nicht unumstritten ist. Resultiert hieraus eine gesamtwirtschaftlich zu geringe Kraftstoffeffizienz der Pkw-Flotte, erwächst eine grundsätzliche Legitimation für staatliche Eingriffe. Der Fokus dieser Arbeit richtet sich auf ein Politikinstrument, das gezielt die Effizienz von Pkw adressiert und in der regulatorischen Praxis weit verbreitet ist: Verbindliche Grenzwerte für den spezifischen CO2-Ausstoß bzw. den Kraftstoffverbrauch von Pkw sind in zahlreichen Ländern implementiert oder in der Planung, um die Treibhausgas-Emissionen des Verkehrssektors zu mindern, die Abhängigkeit von Ölimporten zu reduzieren und die Konsumentenwohlfahrt zu erhöhen. Mittels eines theoretischen Modells werden verschiedene Designs solcher Pkw-Effizienzstandards miteinander verglichen und bewertet. Zu unterscheiden sind hierbei insbesondere Standards mit einheitlichem Grenzwert und solche Ausgestaltungsformen, bei denen herstellerspezifische Zielwerte auf Basis eines Referenzattributs—wie beispielsweise das Fahrzeuggewicht in der EU oder der "Fahrzeug-Fußabdruck" (d.h. das Produkt von Spurweite und Radstand) in den USA—zugewiesen werden. Zudem werden die Implikationen der Einführung eines sogenannten Baseline-and-Credit-Handelsmechanismus untersucht. Standards mit einheitlichem Grenzwert vernachlässigen die Heterogenität in den Vermeidungskosten zwischen den Fahrzeugherstellern. Dies beeinträchtigt—bei Fehlen eines Credit-Handelsmechanismus—die Kosteneffizienz, mit der das flottenweite Emissionsziel erreicht wird, und kann überdies zur Wahrnehmung einer ungerecht verteilten Kostenbelastung führen. Attributbasierte Standards, die—nach Fahrzeuggewicht oder "Fahrzeug-Fußabdruck" differenzierte—herstellerspezifische Grenzwerte zuweisen, können durch eine ausgewogenere Allokation der geforderten Verbrauchsreduktionen zu einer Verbesserung der ökonomischen Effizienz der Regulierung und einer als gerechter empfundenen Kostenverteilung beitragen. Allerdings verzerren attributbasierte Standards die Entscheidung der Hersteller zwischen verschiedenen Optionen zur Verbrauchs- bzw. Emissionsreduktion. Diese Verzerrung kann die Effizienzgewinne, die zunächst aus einer verbesserten Allokation der geforderten Reduktionsleistungen resultieren, weitgehend neutralisieren oder sogar überkompensieren, sodass sich die Kosteneffizienz letztlich insgesamt verschlechtert. Die Analyse unterstreicht die zentrale Bedeutung der Wahl des Referenzattributs für die Höhe verzerrungsbedingter Wohlfahrtsverluste und die Gesamteffizienz der Regulierung. Der Handel mit Credits (bei Über- bzw. Unterschreitung der herstellerspezifischen Vorgaben) führt grundsätzlich zu einer Verbesserung der Kosteneffizienz. Im Falle verzerrender attributbasierter Standards kann die Einführung eines Handelsmechanismus unter bestimmten Bedingungen jedoch auch zu einer Verschlechterung führen. Mittels numerischer Simulationen wird der Einfluss verschiedener struktureller Faktoren (bspw. Marktkonzentration, relative Kosten verschiedener Vermeidungstechnologien, Heterogenität der Fahrzeughersteller) auf die relative Kosteneffizienz der untersuchten Standard-Designs und auf deren distributive Wirkungen analysiert. Schließlich werden in knapper Form die europäischen und die US-amerikanischen Effizienz-Standards für Pkw vor dem Hintergrund der zuvor abgeleiteten theoretischen Erkenntnisse miteinander verglichen. Hierbei ist insbesondere die—angesichts einer starken Verzerrungswirkung—mangelhafte Eignung des Fahrzeuggewichts als Referenzparameter der europäischen Regulierung hervorzuheben. Die nachfolgenden Kapitel beschäftigen sich mit den Herausforderungen, die aus der schrittweisen, klimapolitisch langfristig notwendigen Elektrifizierung des Pkw-Verkehrs erwachsen. Mit steigenden Marktanteilen elektrischer Antriebe (batterie-elektrische, Plug-in-Hybrid-, Brennstoffzellen-Fahrzeuge) wird der gegenwärtig weit verbreitete Tailpipe-Ansatz, d.h. die Regulierung der während des Betriebs im Fahrzeug selbst anfallenden CO2-Emissionen, zunehmend ungeeignet. Bei einer Regulierung durch Tailpipe-Standards hat die Zulassungszahl von Fahrzeugen mit elektrischem Antrieb eine starke Hebelwirkung auf die (geforderte) Kraftstoffeffizienz konventioneller Pkw mit Verbrennungsmotor. Unsicherheit hinsichtlich der künftigen Marktdurchdringung elektrischer Antriebe gefährdet somit einerseits die Erschließung aus gesellschaftlicher Perspektive und aus Konsumentensicht wirtschaftlicher Potenziale zur Verbesserung der Kraftstoffeffizienz und andererseits, dass die gesteckten Klimaziele erreicht werden. Daher werden im Anschluss an die kritische Bewertung des Tailpipe-Ansatzes potenzielle alternative Metriken zur Regulierung der Fahrzeugeffizienz auf ihre Eignung geprüft. Energieverbrauchs- und sogenannte Well-to-Wheel-Standards, bei denen die über den gesamten Lebenszyklus des Kraftstoffs anfallenden Treibhausgas-Emissionen erfasst werden, erscheinen dabei—trotz noch zu lösender methodischer Probleme—als vielversprechendste Alternativen. Für verschiedene Metriken und unter besonderer Berücksichtigung der Unsicherheiten von Pkw-Elektrifizierungs-Szenarien wird zudem untersucht, wie Fahrzeugeffizienz-Standards mit dem breiteren klimapolitischen Rahmen—insbesondere Emissionshandelssystemen mit unterschiedlicher sektoraler Abdeckung—interagieren. Abschließend wird das Zusammenspiel von Pkw-Effizienzstandards mit anderen Politikinstrumenten, deren explizites Ziel ebenfalls die Verringerung des spezifischen Kraftstoffverbrauchs bzw. der spezifischen Treibhausgas-Emissionen ist (z.B. CO2-basierte Kfz-Steuern, F&E-Förderung, Verbrauchsinformationen), beleuchtet. Es wird gezeigt, dass—in Abhängigkeit vom jeweiligen Design der Pkw-Effizienzstandards—die Implementierung solch komplementärer Instrumente letztlich sogar zu einer Verschlechterung des tatsächlich erreichten Effizienzniveaus der Fahrzeugflotte führen kann. Ist sich der Regulierer des instrumentellen Wechselspiels bewusst und stimmt die Effizienzstandards sowie die komplementären Maßnahmen adäquat aufeinander ab, können durch den parallelen Einsatz verschiedener Politikinstrumente hingegen Synergien erzeugt werden.

Sincerity is a key notion within theories of deliberative democracy and a crucial feature of those approaches to public reason that give deliberation a prominent role for the functioning of a just and legitimate democratic society. Indeed, among political theorists sympathetic to the deliberative project, sincerity has been defended in various manners: as a fundamental criterion of validity to identify shared social and political understandings (Habermas 1984); as a means to achieve the practical benefit of promoting free discussions and open debates (Freeman 2000, 383); as an expression of respect among citizens stating their equal membership in the sovereign political body (Cohen 1997, 416); as necessary to sustain the value of civic friendship (Rawls 1997); as an antidote to rhetoric and manipulation (Quong 2010, 265); as a tool to secure relations of trust among citizens and to generate shared commitments (Goodin 2008, 263). Despite such common appraisal of sincere behaviour in democratic deliberation, few theorists have put forward a clear and definite account for it. It seems that norms of sincerity are at most stipulated to solve problems linked with the moral integrity of citizens (Greenawalt 1988; Murphy 1998; Eberle 2002) or strategic actions (Cohen 1989). Two interesting and recent attempts to provide a distinct argument for sincerity in deliberation are Schwartzman's Principle of sincerity in public justification (SPJ) (2011) and Gaus's defence of convergence in public reason as a way to ensure sincerity in public discourse (2011, 288-292). In this paper, I question and reject both accounts and propose a substitute for principles of sincerity in general. First, I tackle Schwartzman's proposal and argue that both his conceptual and his instrumental arguments fail. Drawing from a consensus model of public justification, Schwartzman defends an idea of public reasons as shared, in the sense of drawn from a common set of liberal political values. Accordingly, he proposes a principle of sincerity requiring citizens to offer public reasons they sincerely think are sufficient to justify their preferred norms. In this way, citizens can have other convictions and even express such beliefs in public deliberations, as long as they also provide reasons they believe are public and with an adequate justificatory force. To defend such a view, Schwartzman argues that SPJ is simply an instantiation of the principle of respect: if one is to respect her fellow citizens, she ought to conform to the principle of sincerity. However, the problem is that, conceptualized in this way, SPJ is in tension with the wide view of public reason and the related idea of reasoning by conjecture (Rawls 1997) Schwartzman explicitly claims to adhere to (2012). Indeed, the wide view of public reason and the principle of sincerity cannot be both implied by the principle of respect because if reasoning from conjecture is pursuable, it is not true that the principle of respect always require conforming to SPJ. The second argument Schwartzman advances for SPJ is instrumental in kind and it relies on the idea that the principle of sincerity is justified because of the benefits it brings to deliberation. Schwartzman thinks that actual knowledge of the reasons presented in public justification is necessary to deliberate correctly because it permits to uncover mistakes in reasoning and to discover potentially defeating counterarguments to one's position. However, the link between sincerity and the epistemic enhancement of deliberation cannot help to be controversial for, although it seems reasonable to think that deliberation improves citizens' decisions, would not it be better to have open access to all sort of reasons? The point is that if what is important of deliberation is to evaluate and verify the correctness of political positions and their justifications, then all reasons should be, in principle, admissible for all reasons could help improving the understanding of political principles and decisions. Turning to Gaus's argument, I argue that convergence in public justification is incompatible with sincere deliberation because, although some sort of philosophical relativism about reasons might support it, it is nevertheless over-demanding and unrealistic in the actual context of deliberation. Convergence approaches to public justification rely on the idea that for reasons to be public there is no need to enjoy some property of shareability (Vallier 2011), but simply to be intelligible (Gaus 2011). In this sense, public reasons are those reasons that others can recognize as belonging and consistent to one's sound, and logically coherent, set of beliefs. On this account, when citizens deliberate, they need not to find reasons sharable by all members of the citizenry. Rather, they need to offer each other reasons consistent with their respective sets of beliefs and deep convictions. Although it might seem that convergence in public justification may well be suited to secure sincerity in deliberation, it is not clear whether it can admit of sincerity at all. The problem lies in the actual possibility of being sincere in believing a fellow citizen justified when one does not share her set of beliefs and considers it wrong. To rebut this objection, a convergent theorist can endorse some version of moral relativism, but this move is nevertheless highly problematic. Indeed, it would be incoherent for a political theorist like Gaus, who intends to avoid metaphysical problems and ontological debates (2011, 14, 233), to embrace such a controversial account of the nature of moral reasons. Moreover, the relativist strategy has a problem of practice when it comes to sincere convergence: even if relativism was true, it is not possible to expect all people to endorse it. Accepting a relativist framework of understanding is not only controversial at the philosophical level, but also incredibly demanding of citizens for it would require them to consider the normative status of their beliefs the same as that of others. In discussing both Schwartzman and Gaus's proposals, I argue that sincerity, as a general notion, is not only controversial, but also practically irrelevant when it comes to the political domain. Indeed, in being linked with citizens' intentions and inner mental states, which are impossible to ascertain, sincerity ends up being unworkable. As a substitute, I propose a principle of reliability in deliberation (PRD) apt to achieve those political goods theorists have associated with sincerity. Indeed, it is undeniable that manipulation in deliberation is undesirable, given that it constitutes a problem for the relation of trust among citizens and the possibility of deliberation itself. If citizens knew others were to deceive and manipulate them, it would be reasonable for them to refrain from discussion. So, drawing from Audi's idea of reliability as a virtue (2008), I specify some normative features that citizens need to display in order to secure the possibility of deliberation and shelter mutual trust by excluding the possibility of tricking others. In particular, PRD requires citizens to be stable in their commitment to reach the best justification they can for their claims, and to engage in deliberation after careful reasoning and judgment; to be predictable in their behaviour when they engage in deliberation, in their reactions to other people's arguments, challenges, and the possibility of disagreement. Finally, it requires them to be correct most of the times, by not advocating for ideas clearly in opposition to general normative understanding, and by not lying about the factual content of the reasons they propose. PDR does not require citizens to offer the best reasons they have, or the ones they find most convincing in defending those laws they want to enact, maintain, or remove. Rather, citizens need to have justifications for their proposals and can offer different reasons to convince their fellow citizens to agree with them, provided that they are not based on false evidence or in opposition with general normative understandings. PRD neither demands nor prohibits citizens to be sincere about their reasons, but it bans cheating. In the end, the reasons why we care about sincerity in deliberation concern the need to prevent manipulation and cheating among citizens. To achieve that, it is sufficient to use a less controversial and more parsimonious concept than that of sincerity, as the notion of reliability is.

Japan nimmt eine besondere Stellung in der Weltgeschichte ein, indem es als einzige nicht-westliche Macht unter den Großmächten die Geschicke der Weltpolitik im 19. und 20. Jahrhundert mitbestimmte. Als solche spielte es auch eine bedeutende Rolle in der Entwicklung der modernen Völkerrechtsordnung. Innerhalb weniger Dekaden stieg Japan von der Position einer peripheren Nation im Schatten Chinas zur Hegemonialmacht in Ostasien auf und wurde – zumindest formal – gleichberechtigt in die Gemeinschaft der Nationen aufgenommen. Dieser Aufstieg zeigte überdeutlich, dass der souveräne Gebrauch von Völkerrecht nun nicht mehr nur eine Domäne der westlichen Mächte war und dass das Völkerrecht damit endgültig die Grenzen eines ius publicum europaeum hin zu einem "Weltrecht" überschritten hatte. Untersuchungen der Rezeption des westlichen Völkerrechts konzentrieren sich im Wesentlichen auf dieses frühe Kapitel der Rezeptionsgeschichte, sind jedoch bei aller Anerkenntnis der Erfolge Japans erstaunlich verhalten in der Bewertung der Rezeption selbst. So wird diese von vielen als zu passiv, eurozentrisch, "positivistisch" (ein Merkmal mit eher negativer Konnotation in Japan) und epigonal kritisiert. Ein alternativer Interpretationsentwurf sieht Japans Völkerrechtsrezeption zwischen 1905 und 1945 als Vorläufer einer revisionistischen Bewegung, die die normative Vormachtstellung des Westens in Frage stellt und eigene Ordnungsvorstellungen verfolgt. Dieser Diskurs steht in Zusammenhang mit der jüngeren Debatte um sogenannte "Asiatische Werte" und der postkolonialen Kritik an Völkerrecht in jüngster Zeit. Beide Argumentationsstränge sind jedoch, wie ihre innere Widersprüchlichkeit zeigt, irreführend hinsichtlich der Rolle, die das Völkerrecht in den Außenbeziehungen Japans spielte. Dieser Aufsatz möchte daher ein umfassenderes und zutreffenderes Verständnis dieser Rolle ermöglichen, indem es die Geschichte der Rezeption und Anwendung von Völkerrecht in Japan seit Anbeginn im Jahre 1853 bis zum Ende Japans als Imperialmacht im Jahre 1945 nachzeichnet und noch einmal die Frage nach ihrem kritischen bzw. konstruktiven Potential für die allgemeine Völkerrechtsentwicklung stellt. Zusammenfassend zeigt sich, dass das Völkerrecht in Japan anfangs eine rein funktionale Rolle innehatte, insofern seine Observanz gegenüber den westlichen Mächten einen hohen Grad an "Zivilisiertheit" signalisieren sollte und gegenüber den ostasiatischen Nachbarn als argumentative Waffe einer aggressiven Imperialpolitik diente. Japan hatte mit dieser Strategie auch Erfolg und konnte die verhassten "ungleichen Verträge" bereits 25 Jahre nach Abschluss des letzten Vertrages revidieren und sich nach 1905 als Hegemonialmacht in Ostasien etablieren. In Anbetracht dieser Funktion ist es daher kaum verwunderlich, dass japanische Völkerrechtler und Politiker eine eher passive, eurozentrische und "positivistische" Haltung gegenüber dem Recht einnahmen. Eine offene Kritik an der Völkerrechtspraxis vor 1919 hätten Japans Ziele eher gefährdet und wäre, selbst wenn ein solcher Wille dazu bestanden hätte, angesichts der Machtverhältnisse auch weitgehend wirkungslos geblieben. Aus den gleichen Gründen betrachteten japanische Politiker jedoch die liberalen Entwicklungen des Völkerrechts in der Zwischenkriegszeit eher als Bedrohung der japanischen Sonderstellung in Ostasien und schlossen sich dieser nur mit äußersten inneren Vorbehalten an. Dies gilt für den Völkerbund ebenso wie für das Verbot des Angriffskrieges durch den Briand-Kellogg-Pakt, und nur äußeres Prestige und die Furcht vor Isolation bewegten Japan, diesen beizutreten. Zudem wäre es irreführend, den "Positivismus" japanischer Völkerrechtler als Ausdruck eines Mangels an Kritik schlechthin zu verstehen. Kritik und Reserviertheit gegenüber dem westlichen Völkerrecht existierten seit Beginn seiner Rezeption und nahmen mit jeder subjektiv empfundenen Zurücksetzung Japans in der Weltpolitik noch zu. Diese Entfremdung brachte eine Tradition der "kritischen" Völkerrechtswissenschaft in Japan hervor, die insbesondere die politische, wirtschaftliche, soziale und historische Bedingtheit des angeblich "universalen" Völkerrechts in Augenschein nahm. Seine Hochzeit hatte dieser Ansatz in den Kriegsjahren von 1931 bis 1945, als Japan aktiv den status quo der internationalen Ordnung herausforderte und eine eigene normative Ordnung in Ostasien zu begründen suchte. Allerdings waren japanische Völkerrechtler wider Erwarten, auch wenn sie die kontinentale Expansion argumentativ unterstützen, nicht deren glühendsten Befürworter, sondern argumentierten aus einer defensiven Stellung heraus. Angesichts der Herausforderung, ein "Ostasiatisches Völkerrecht" erfinden zu müssen, warnten sie eher vor einer radikalen und irrationalen Abkehr vom normativen status quo und traten für eine graduelle Entwicklung neuer völkerrechtlicher Konzepte auf Grundlage des kritischen Studiums klassischen Völkerrechts ein. Sie suchten damit ihr Gebiet und ihre Profession gegen die zunehmenden Angriffe und Spott in der japanischen Öffentlichkeit zu verteidigen, allerdings mit geringem Erfolg. Die häufigen Verletzungen humanitären Rechts in den Schauplätzen des Krieges zeugen von der zersetzenden Kraft des "totalen Krieges", der ihre Argumente zunichte machte und sie selbst überrollte hätte, wenn nicht die Kapitulation im Jahre 1945 dieser Entwicklung Einhalt geboten hätte. Aus diesem Grund jedoch dient die Völkerrechtsrezeption Japans auch nicht als historisches Beispiel für eine "Herausforderung der normativen Hegemonie des Westens", sondern eher als warnendes Beispiel für die Notwendigkeit eines rationalen und konstruktiven Diskurses um normative Konzepte internationaler Ordnung heute. ; Japan takes a special place in global history as the only non-western power among the great powers which shaped the course of world politics during the late nineteenth and early twentieth century. Within less than half a century, Japan rose from a peripheral power in the shadow of China to the hegemonic power in Northeast Asia and was accepted as equal power (at least on the formal level) into the hitherto all-European family of nations. As such, it also played a significant role in the development of the modern international legal order as it is today. Japan's accession to the hitherto all-European concert of powers in 1905 demonstrated that the competent use of international law was not the exclusive domain of western powers anymore and that international law had shed its last vestiges of being a merely "European public law" and become a truly universally applied law. And yet, studies of the reception of international law in Japan, which largely focus on the early period between 1853 and 1905, often conclude their analysis with a mixed appraisal of the process, as they characterize it as being overly passive, Euro-centric and "positivistic" (a word of negative connotation in the Japanese context) and therefore merely derivative. An alternative interpretation, however, places Japan at the vanguard of a revisionist movement that challenged the hegemony of western international legal discourse and sought to establish an autonomous order in East Asia in the second phase of its engagement with international law between 1905 and 1945. This discourse ties in with the so-called "Asian values" debate and postmodernist criticism of international law in recent times. However, both narratives, as the inherent contradiction indicates, are misleading in their representation and analysis of the role which international law played in modern Japanese internationalist relations. This article aims to present a more coherent and consistent picture of international law in Japan by pursuing the whole trajectory of its reception and application in Japan's foreign politics, from the opening up of the country in 1854 until the final demise of Japan's imperial project in 1945. It argues that western international law during the initial phase of its reception had a purely functional role, as a signal of "civilization" and co-operation towards the western power, and as an argumentative weapon of expansion towards its East Asian neighbours. As such, it served its overall purpose well, as Japan managed to renegotiate the odious "unequal treaties" twenty-five years after the last was concluded and by 1905 had established itself as the hegemonic power in Northeast Asia. Considering this functional role, it is therefore not surprising that Japanese experts and politicians took a passive, Euro-centric and "positivistic" attitude towards the law. It did not serve Japan's interests to criticize international legal practice until 1919, nor would it be realistic to expect that Japan had the power to change it, even if it wanted to. However, it is also for the same reasons that Japan was inwardly reluctant to go along with the "Wilsonian" changes of international law in the 1920s, as multilateral institutions and the outlawry of war served Japan's purposes less than the classical law. It is merely for reasons of prestige and fear of abandonment that Japan would go along with these developments until 1933. Moreover, it would be erroneous to confuse Japan's apparent "positivism" with a lack of criticism in general. Feelings of estrangement and inner reservations co-existed with the apparent compliance right from the start and were carefully nurtured by successively felt slights and discriminations on the political side, whatever their claims to reality. This estrangement engendered a tradition of critical studies of international law in Japan which specifically addressed the political, economic, social and historical contingency and particularity of "universal" international law. This approach had its heyday during the war years between 1931 and 1945, when Japan actively challenged the political status quo of the international order and tried to carve out its own autonomous sphere in East Asia. However, contrary to expectations, international lawyers, although advising the Japanese authorities and justifying Japan's aggressive policy with their arguments, were not its most ardent supporters, but argued from a defensive and losing position. Faced with the challenge of inventing an "East Asian International Law", they warned against an irrational iconoclasm that would uncritically destroy the normative status quo and argued for a gradual evolvement of normative concepts on the basis of the existing order. Thus they tried to defend the law and their profession against a rising tide of criticism and contempt of international law in the public, with diminishing success. The frequent violations of international law in the theatres of war gave testimony to the eroding forces of "total war" that undermined their position and would have swept them away if surrender had not intervened in 1945. However, it is also for this reason that Japan's reception of international law does not serve as an historical example of "challenging the normative hegemony of the West", as more recent commentators would have it with a view to other rising powers, but rather as a warning reminder of the necessity of rational and constructive negotiation of concepts of normative order today.

More specifically, our interest is in electronic exchanges between universities belonging to the same university department. This environment, close to that of the company (as an institutional unit determined by a project), nevertheless differs from the ab-sence of exclusive research of competitiveness and profitability, the fact that the university in France re-poses on principles of scientific research and transmission of knowledge to students and not of supplies of goods or services to clients/users, but also and above all on the question of hierarchical relations between colleagues who do not arise in the same way colleagues. In this case, it is more about conflicts of function and how to consider tasks and career-for example between a PRAG (teaching) and a research teacher (teaching and research)-or conflict of choice of direction of a department's policy, or even research areas, etc. However, always, without a direct hierarchical "threat" or risk of grade downgrade, etc.). They were formed from reflections born within institutional groups (of the company itself but also of other collaborating companies), proposals from trade unions, contributions from researchers, etc. We could still mention the netiquette (RFC 1855) or the Netiquette documents (Shea, 1994), Netiquette Guidelines (Hambridge, 1995) and The Net: Users guidelines and netiquette (Rinaldi, 1996). Designating the corporate environment, Cordelier and Breduillieard show, describe and analyze how companies have implemented "charters of use, use or codes of conduct on social digital networks (RSN)" (2012: 128) 1. They proposed to show the scope of such charters beyond the professional environment. Indeed, these charters (referred to as social media policy-Manpower: 2009) correspond to forms of codes of conduct (cf. name given to them by Huet and Loneux: 2009) and belong to what is called soft law (Bo-det and Lamarche: 2007) in that they are less restrictive than a law while adopting a solemn form proposing a framework for relations between individuals (Geindre: 2005). Although they appeared in France (Bouygues Telecom and Orange, 2010) as well as in the United States in the late 2000s, they are still in their infancy since "in 2009, about 20% of HRManagers (HRDs) had social networking charters in their businesses (strengthening the confidentiality clause, innovating access to NSRs) and 50% of those who did not, thought it necessary to elect one (Digital Jobs and Novametry, 2009). Some even talked about digital ethics. Another study conducted in 2011 by Novametry for the National ASSOCIATION of HRDs confirms the results of the previous study. However, for some HRDs, it is better to see the place that these new practices will take on a daily basis before they want to regulate them. These different studies show the eagerness of companies to adopt charters that will provide more guidance on actions. ; Réflexions pour une élaboration d'une charte éthique des relations interdiscursives : le cas de la messagerie universitaire Introduction Notre interrogation première visait à comprendre et analyser les phénomènes de violence verbale constatés dans les échanges de courriels entre plus de deux personnes en milieu professionnel institutionnels. Plus spécifiquement, notre intérêt se porte sur les échanges électroniques entre universitaires appartenant à un même département universitaire. Ce milieu, proche de celui de l'entreprise (en tant qu'unité institutionnelle déterminée par un projet), s'en distingue néanmoins du fait de l'absence de recherche exclusive de compétitivité et de rentabilité, du fait que l'université en France repose sur des principes de recherche scientifique et de transmission de savoir à des étudiants et non de fournitures de biens ou services à des clients/usagers, mais aussi et surtout sur la question des relations hiérarchiques entre collègues qui ne se posent pas de la même manière entre collègues. En effet, dans ce cas, il s'agit davantage de conflits de fonctions et de manière d'envisager les tâches et la carrière -par exemple entre un PRAG (enseignement) et un enseignant chercheur (enseignement et recherche)-ou de conflit de choix d'orientation de la politique d'un département, ou encore de domaines de recherche, etc. Cependant, toujours, sans « menace » hiérarchique directe ou risque de déclassement de grade, etc.). Par ailleurs le milieu professionnel de l'entreprise et celui de l'université ont en commun d'avoir introduit dans leurs pratiques de communication technologique le cour-riel électronique. Tran (2010 : 200), conduisant ses recherches sur le milieu de l'entreprise, souligne d'ailleurs que « le courrier électronique est l'une des premières technologies utilisées et les plus diffusées dans les entreprises ». Comme nous allons l'observer, et en raison d'une nivellement hiérarchique relatif, ces caractéristiques conduisent les échanges de courriels entre universitaires d'un même département à se rapprocher sous certains aspects d'échanges similaires non professionnels où la tension peut rapidement intervenir au cours d'un échange. Ces dernières années des chartes de bonne pratique du courriel électronique ont déjà vues le jour dans le milieu de l'entreprise pour définir les règles de conduite et de politesse visant l'usage des médias de communication électronique (cf. charte proposée en 2011 par l'ORSE - observatoire sur la responsabilité sociétale des entreprises). Elles ont été constituées à partir de réflexions nées au sein des groupes institutionnels (de l'entreprise elle-même mais aussi d'autres entreprises collaboratrices), de propositions des syndicats, de contributions de chercheurs, etc. Nous pourrions encore évoquer ici la nétiquette (RFC 1855) ou encore les documents Netiquette (Shea, 1994), Netiquette Guidelines (Hambridge, 1995) et The Net : Users guidelines and netiquette (Rinaldi, 1996). Concernant le milieu de l'entreprise, Cordelier et Breduillieard montrent, décrivent et analysent comment les entreprises ont mis en place « des chartes d'utilisation, d'usage ou codes de bonne conduite sur les réseaux socionumériques (RSN) » (2012 : 128) 1. Ils ont proposé de montrer la portée de telles chartes au-delà du milieu professionnel. En effet ces chartes (désignées par le terme social media policy -Manpower : 2009) correspondent à des formes de codes de bonne conduite (cf. appellation qui leur est donnée par Huët et Loneux : 2009) et appartiennent à ce qui est nommé la soft law (Bodet et Lamarche : 2007) en ce qu'elles sont moins contraignantes qu'une loi tout en adoptant une forme solennelle proposant un cadre aux relations entre les individus (Geindre : 2005). Bien qu'elles soient apparues en France (Bouygues Telecom et Orange, 2010) comme aux États-Unis des la fin des années 2000, elles en sont encore néanmoins à leurs premiers balbutiements puisque « en 2009, environ 20 % des directeurs des ressources humaines (DRH) avaient mis en place des chartes d'utilisation des réseaux sociaux dans leurs entreprises (renforcement de la clause de confidentialité, interdiction d'accès aux RSN) et 50 % de ceux qui n'en avaient pas, pensaient nécessaire d'en élaborer une (Digital Jobs et Novamétrie, 2009). Certains parlaient même de déontologie numérique. Une autre étude réalisée en 2011 par Novamétrie pour l'Association nationale des DRH confirme les résultats de la précédente étude. Cependant pour certains DRH, il est préférable de voir la place que prendront ces nouvelles pratiques au quotidien avant de vouloir les réguler. DescriptionThis thesis consists of two papers. The first gives a game-theoretical treatment of the institutional homogenization of value-oriented firms. It explains why intrinsically motivated, value-oriented firms like non-profits may become similar to for-profit firms in terms of organization and norms. It highlights and explains the pairs: value-oriented and flat organizations in contrast to value-neutral managers and hierarchical organizations. We consider a major donor like the government who delegates a project to an organization without endowments under asymmetric information. The non-profit is able to adapt its organization by establishing a hierarchy with an intrinsically motivated manager. The donor can in turn react by employing institutions in order to cope with information asymmetries regarding the mission of the organization and the unverifiable values of the manager. Two main cases are examined, one without competition and a competitive case. The equilibrium in the first case is a flat organization or alternatively highly altruistic hierarchy. The second competitive case is characterized by a value-neutral hierarchy.Surveillance, hierarchy and bureaucracy emerges as a consequence of strategic interaction e.g. local competition over one source. Wealthy or 'small' organizations can afford idealism and an egalitarian structure. Such organizations are free to choose the management which best suits their needs or even work in a completely flat organization if they want to. Such solipsism is however not attainable in all environments.Organization and culture adapt to socioeconomic constraints. When competition is fierce, the 'ethics of neutrality' is in line with the aims of finance/power – perceived diversity and radicalism is reduced to symbolic deviations which do not challenge status quo.Please note that in contrast, global competition between systems emerges if additional sources of power/finance are introduced, these may promote different values. Once local equilibrium is established the simplest cases of global competition become obvious – it is just a matter of counting organizations and sources.Please note that technical jargon is used which may not correspond to the everyday sense of the words. E.g. verifiability and altruism are terms which concern what is contractible or relate to what is defined in the literature. Bonuses and reimbursements are expressions of solutions to the underlying tensions – these may be thought of as intangibles as well. My report of how such details relate to previous literature should primarily be seen as means to convey information of how effects may remain invariant even when the structure of the arguments is altered, not specific applications.It is easy to tinker with parameters to model specific situations, especially regarding different modes of reimbursement, wasteful behavior or perks. Because such considerations are theoretically trivial/mainstream (e.g. w.r.t. delegation problem), they are abstracted from in order to emphasize the emergence of bureaucracy or inefficiency (depending on the point of view) as the result of interaction. Similarly, assumptions should not be taken literally. For example: Just because I argue that organizations/workers behave as if they do not move, it does not follow that we should believe they cannot – It is however arguably very interesting if the result still is as if they do not. Nevertheless, there are quite obvious intuitions to be invoked in this case: For instance, researchers may be thought to compete for the same hierarchy of journals, which radically diminishes the importance of geographical distance. (See the Cambridge Conspiracy)What if economic theory is applied to ourselves (e.g. economists)? What kind of economic output should we expect according to economic theory? How is the production of knowledge and the organizational structure related? This thought experiment gives a game-theoretical treatment of such questions. Its insights carry over to a more general set of institutions under limited liability, and could in principle be employed to discuss media, environmental non-profits, human rights organizations, foreign aid etc. with minor modifications. If the non-profit sector fails altruism or its grass-roots stakeholders when confronted with powerful interests, it stands to reason that other sectors will face similar difficulties or worse. Please forgive the typos involving old notation. If you see them, you probably understand anyway. Paper 2Economists have been puzzled over the fact that most schools are public. For instance, in his 'fixture of graduate programs in economics', Macroeconomic Analysis, the famous economist Varian (1992) insists that education is a schoolbook example of an 'inherently private good'. According to him, it is treated as a public one for political reasons. (Varian, p.414)However, I argue that if one departs from basic facts of what constitutes an education, it becomes immediately obvious that externalities and thus market failure is at the heart of the really-existing education systems. Profit oriented ones especially. The bare-bones framework of this paper essentially relies on a few natural assumptions: Knowledge accumulates, i.e. it is based on previous insights; the relationship between a tutor and a student is relativistic in terms of their (costly) contributions to the accumulation of knowledge; and decisions today may be based on future prospects.In Economics, the remedy to externalities in an environment of private firms, and in the grey areas of public-private partnerships, comes from the Nobel laureate Oliver Hart. From a list of stylized facts, the most crucial were selected and reconciled with his work on contract theory to improve on the details. The resulting framework is then shown to be qualitatively consistent with the whole set of observations, and thus an acceptable minimalist theory of the education system from a contract-economics perspective. It is moreover consistent with pedagogical perspectives and intuition unknown to me at the outset. However, the main result is that these uncontroversial facts are not simultaneously consistent with a contract which can meaningfully optimize production. Socioeconomic reality and opportunistic behavior overwhelms such attempts.Thus, the literature drawing upon Hart's work up to that point is confronted with formidable challenges in education settings as well. In view of this, the neoclassical stance seems out of touch with even modest attempts to describe reality. The mainstream link between effort and personal characteristics, such as ability, exists only as a special case in a decision embedded in a richer set of socioeconomic relations. The finesse of this thought experiment is to be found in what a still-life modeler would see as a weakness – namely its simplicity, and adherence to standard assumptions regarding functional form. Human-capital formation is treated as a game of strategic interaction between a citizen and the educational system consisting of two separate stages which correspond to elementary and higher education. The product of the interaction is human capital and the equilibrium outcome at the first stage affects the student's productivity at the second stage of higher education. This research shows how the intertemporal nature of learning opens up for opportunism between elementary and higher education and limits the scope of using non-profits against cost-savings in the presence of for-profit firms. The character of relevant school reform will in general depend on the impact of changes at the structural level relative to the impact of reform aimed at the interpersonal level within the classroom domain. Hindu nationalism has seen a dramatic growth in India and abroad from the nineteen eighties. This growth has coincided with – and relates in complex ways to – several other highly significant developments, including (in no particular order) the instituting of liberalization in the economy; the legislation on reservations for 'Other Backward Castes' and its implementation; the intensification of the integration of the middle classes into the global economy; and the intensifying pauperization of the rural poor. These developments as well as Hindu nationalism's links with them have been the subject of scholarly attention from a variety of perspectives and disciplines. Apart from these however, one may also note the unfolding of less obvious, but equally significant and related developments in this period: the growth and intensification of female feticide and infanticide; the increase in dowry related violence and deaths; the targeting of women as objects of sexual violence, especially during communal riots, but also routinely; the increasing presence of women in rightwing organizations and mobilizations; an intensification in the policing of sexual discourses and sexuality; conversely and paradoxically, there has also been an increase in the visibility of women in the public sphere (through for instance, the widening of options for employment for women). Feminist scholarship has addressed several of these issues, independently and in their intersections; it has also addressed the rise of Hindu nationalism. However, there is little work on the relations that obtain between these issues and the more obvious ones set out above. Specifically, there was and remains a serious deficiency of attention to the relations between masculinity and Hindu nationalism. This study hopes to contribute towards addressing this deficiency in several ways. Firstly, it seeks to locate itself in the theoretical and analytical spaces between gender studies and political economy. It attempts to do so by reviewing and then parting from, the dominant trends in the theoretical and analytical debates on men and masculinity. In my thesis I have therefore focused, not on kinds and forms of masculinity – which remains the dominant approach in masculinity studies – but on the ways in which institutions, organizations and structures come to be gendered, and consequently, on the processes of gendering that are invoked in the articulation and elaboration of power within specific structural, institutional and/or organizational relations. I have sought to develop this argument specifically with regard to masculinity/ies by proposing the idea of 'masculine hegemony'. Briefly, through this term I wish to suggest that uneven power distribution may be understood in Gramscian hegemonic terms, and that this hegemony is usually gendered as masculine. Any given society is organised along multiple and intersecting hierarchies of domination and subordination that determine the access to and exercise of power – the distribution and possession of its resources and rights – within it, as well as the terms within which that power is (to be) exercised. Further, the organisation of these hierarchies may be discerned as hegemonic formations that favour specific social groups and/or alignments. Any given hegemonic condition is thus layered by multiple and intersecting hierarchies of domination and subordination that extend far beyond conventionally recognised macro manifestations –race, nation, region, religion, community, class – to its manifestations at the fundamental 'cellular' (or in Gramsci's terms, 'molecular') level of the family and the organisation of sexuality. Thus, while the multi-layered hegemonic formations that constitute the given hegemonic condition are all diversely marked by other signs – of race, class, age, region, religion, etc – they are all inflected by the foundational discourse of gender. This is the broad theoretical perspective within which the thesis is elaborated, because it provides for the multiple articulation of complex phenomena with each other, across history as well as across regions. Based on this, and secondly, it seeks to approach the issue of Hindu nationalism from a historical perspective. The study therefore begins by chronologically examining the term 'Hindu' and the various semantic and social transformations in its history, beginning with its early derivation from 'Indus', through the medieval period when it gradually but nebulously came to identify a community, to its coalescence into the more concrete religio-social entity that emerged through the colonial encounter and the caste and other reform movements of the nineteenth century, to its politicization under B G Tilak and V D Savarkar (among others) into a religio-cultural nationalism in the early part of the twentieth century. Crucial to understanding this evolution, the study argues, is the pan-Indian spread of the Brahmin castes (as opposed to the localized presence of the lower-castes), and the consequent identification of 'Hindu' territory with the presence of the Brahmins. In mapping this process, I emphasize the gender and caste dynamics inherent to the construction of this identity, especially in the concretizing of communal lines around the issue of personal laws, and elaborate on the economic, communal and political determinants of this gendered dynamic in the construction of the identity 'Hindu'. It thus argues that the strongly Brahmanical caste-profile of the anti-colonial nationalist movement indicates the extent to which Brahmanical patriarchy (or masculine hegemony) and its practices came to define the hegemonic understanding of the identity 'Hindu' as well as 'India' – and continued to do so even after independence. The argument of the thesis is that, unless one takes account of these processes, it is difficult to fully comprehend the depth, scale and reach of Hindu nationalism – as a latent and as an active ideology. Thirdly, I argue the need to factor in another process in the understanding of Hindu nationalism, which also has its roots in the colonial encounter but which gains a different dynamic after independence: the idea and practice of 'development'. The study proceeds to briefly historicize the idea of development and then to chart the trajectories of its implementation through the Nehruvian emphasis on Planning and state driven social change, and the consequent impact on the changing social, economic and political theatre of the country after independence. It analyses this impact specifically on the gender and caste dynamics of this period, arguing that the Brahmanical hegemony of the pre-independence period begins to transform in the seventies, as it negotiates with and then accommodates the increasing visibility and volubility of lower caste presence in the political domain. Similarly, even as women's movements successfully moved the state to implement policies that actually empowered women and made possible their greater participation in the public sphere, the gradual and ongoing process of shifting control of the economy from the state to the private sector has ensured that safeguards for women, labor, lower castes and other marginal groups are almost non-existent, or at best, remain arbitrary and at the mercy of the private sector. The study proposes that the processes of liberalization and privatization were thus crucial to the transformation of Brahmanical masculine hegemony, in its strategies to retain hegemonic power. In other words, the study argues that the developmentalist agenda of the post-independence Indian state contributed, in no small measure, to the resurgence of Hindu nationalism on the political stage, from the late seventies and particularly in the eighties, into the present. Finally, the study explores the tensions and relations that obtain between the multiple dichotomies generated in the thesis – the personal and the political, the hegemonic and the hegemonised, upper caste and lower caste, Hindu and non-Hindu, masculine and feminine, modern and traditional, etc. I argue that Hindu nationalist positions should not be understood as manifest only in its organizational and/or institutional manifestations, but in and through this field of beliefs, actions and relations that constitute the masculine hegemony of Brahmanical patriarchy, within and from which Hindu nationalism finds its visceral roots. I close by proposing that unless we take cognizance of this, and look beyond the electoral performances of the Bharatiya Janata Party to the ways in which hegemonies are maintained using the very tools and structures intended to dismantle them we will not truly be able to counter the Hindu right or its masculinist violences.
