"Der Rechtfertigungsliberalismus des US-amerikanischen Philosophen Gerald F. Gaus argumentiert, dass sich aus dem liberalen Ideal öffentlich gerechtfertigter Politik eine 'Verfassung der Rechtfertigung' ableiten lässt, zu deren Kernbestandteilen ein supermajoritäres Gesetzgebungsverfahren gehört. Nur supermajoritäre Wählermehrheiten seien für legitime politische Herrschaft hinreichend. Dieser Beitrag stellt den Rechtfertigungsliberalismus vor, kontrastiert ihn punktuell mit Rawls' politischem Liberalismus und setzt sich kritisch mit dem Plädoyer für supermajoritäre Entscheidungsverfahren auseinander. Supermajoritäre Gesetzgebungsverfahren spielen bei Gaus eine ähnliche Rolle wie die Pflicht zur Bürgerlichkeit bei Rawls: Sie stellen Restriktionen dar, mit deren Hilfe das Ideal öffentlich gerechtfertigter Politik in die Praxis umgesetzt werden soll. Gaus' Theorie ist aber auch für dieselbe Kritik anfällig, die gegen Rawls vorgebracht wurde: Die Restriktion selbst lässt sich nicht zweifelsfrei öffentlich rechtfertigen." (Autorenreferat)

Gerald F. Gaus' normative theory of Justificatory Liberalism argues that the liberal ideal of public justification implies a "constitution of justification" whose core components include supermajoritarian legislative procedures. Supermajoritarian voter support is necessary to fulfill the requirements of liberal legitimacy. This article introduces Justificatory Liberalism, compares it to Rawls' Political Liberalism and criticizes the argument for supermajoritarian decision procedures. The role of these procedures in Gaus' theory is similar to the role of the "duty of civility" in Rawls' theory: both are constraints intended to help realize the ideal of public justification. Yet Gaus' theory is also subject to the same objection as Rawls': the constraint itself is not conclusively justified. Adapted from the source document.

Denmark's income tax burden as the percentage of GDP is larger than the total tax burden of the United States, and it has increased further after 1980. How can this be explained, given increasing tax competition and widespread views that strong reliance on regressive taxes was conducive to building and maintaining large tax and welfare states? The article highlights three factors: First, large income taxes are feasible if the capital tax burden is moderated within the income tax. Second, the effective capital income tax burden that had developed up to the early 1980s was extremely low so that subsequent tax reforms could cut marginal tax rates on mobile types of capital income while increasing tax revenue. Third, drastic changes in the legal structure of the income tax and stability in aggregate tax policy outcomes were facilitated by proportional representation and legislative majority rule.

"Der Beitrag untersucht Konvergenzmuster in den Steuersystemen von EU- und OECD-Ländern. Am Beispiel der Steuerpolitik wird gezeigt, wie wichtig theoretische Annahmen darüber sind, was konvergiert und wie es konvergiert. Darüber hinaus werden spezifische Ergebnisse steuerpolitischer Konvergenzanalysen vorgestellt und interpretiert. Ein Ergebnis ist, dass die Konvergenz von Steuerstrukturen durch das Niveau der Besteuerung bedingt wird. Ein weiteres Ergebnis ist, dass die Konvergenz von Steuerstrukturen dann klarer zum Vorschein kommt, wenn man nicht den Mix unterschiedlichen Steuerarten (Einkommensteuern, Verbrauchsteuern etc.) betrachtet, sondern die relativen Steuerlasten von Arbeit, Kapital und Konsum. Bei der kausalen Interpretation von Konvergenzmustern sollte nicht vorschnell auf den vermeintlichen Einfluss der ökonomischen Globalisierung abgestellt werden. Vielmehr spiegelt sich in den Konvergenzmustern auch eine Rationalisierung und Modernisierung der Steuerpolitik wider, die unabhängig von internationalen Anpassungszwängen ist." (Autorenreferat)

This paper questions the argument that strong and early reliance on 'regressive' taxes (consumption and payroll taxes) made it politically easier to build and maintain a large welfare state. It develops an alternative perspective which differs in two respects. First, a crucial 'advantage' of regressive taxes is that they imply moderate capital taxation, but this can also be achieved within income tax. Second, the direction of causality moves largely from high revenue needs to strong reliance on at least one of the two major regressive taxes, rather than the other way round. The paper aims to show that this alternative argument provides a better explanation of quantitative data patterns as well as the cases of Denmark, New Zealand, South Korea and the United Kingdom. Policy implications are also discussed: policymakers have good reason to defend the progressivity and revenue-raising potential of the income tax, and in so doing may require greater European tax coordination.
Governments that wish to redistribute through budgetary policy do so mostly on the spending side, not on the taxation side of the budget. The taxation side is nevertheless important, partly because less efficient tax structures seem to be associated with lower taxation and spending levels. Hence political conflicts over spending levels may partly be fought as conflicts over tax structure. The paper provides a coherent perspective on the politics of tax structure. Specific topics include the (ir-)relevance of tax mixes, policy change in income taxation, the importance of tax competition, and the role of political institutions. ; Wenn der staatliche Haushalt zur Umverteilung genutzt wird, so geschieht dies vor allem auf der Ausgabenseite und nicht auf der Einnahmenseite. Die Einnahmeseite ist trotzdem bedeutsam, weil es offenbar einen Zusammenhang gibt zwischen der Effizienz der Steuerstruktur und dem Steuerniveau. Daraus folgt, dass politische Auseinandersetzungen über Ausgabenniveaus teilweise als Auseinandersetzungen über die Steuerstruktur geführt werden können. Das Papier entwickelt eine kohärente Perspektive zur Analyse von Steuerstrukturpolitik. Zu den behandelten Themen gehört die (Ir-)Relevanz des Steuermix, der Politikwandel in der Einkommensbesteuerung, die Bedeutung des Steuerwettbewerbs und die Rolle politischer Institutionen.
