CLASSIFYING GENOCIDE IN INTERNATIONAL LAW: the substantiality requirement
This book offers an in-depth examination into genocide law by focusing on one of the lesser examined, yet practically significant, issues: the substantiality requirement'. This refers to the requirement in international law that intended destruction should be directed towards a substantial' part of a protected group in order for an atrocity to qualify as genocide. This comprehensive and detailed study draws connections between different judicial approaches to substantiality' and the varying theoretical presumptions about the constitutive concepts of the crime. This prima facia doctrinal problem is used as a springboard to scrutinise the broader theoretical problems underlying the legal conceptualisation of genocide. The book systematically explores how the individualistic and collectivistic conceptions of the crime have been able to co-exist in case law and how the different approaches to assessing substantiality have played a backdoor role between these two conceptions. The work demonstrates that these two philosophical standpoints are far from effectively representing the reality of the protected groups and fully explaining the harm inherent to group destruction. The book revisits the recent philosophical and sociological studies on the crime and, considering ideas from the emerging relational approaches to genocide', offers a third way to understand the existing legal representation of the crime and, consequently, the idea of substantiality'. It demonstrates the practical significance of its theoretical debates and applies its novel perspective through a case study on South Sudan. This book will be highly useful to students and scholars with an interest in genocide studies, international criminal law and legal theory. It will also be of interest to policymakers engaged with issues around genocide.

Economics and politics of international investment agreements
This paper investigates the design and implications of international investment agreements. These are ubiquitous, potent and heavily criticized state-to-state treaties that protect foreign investment against host country policies. We show that optimal agreements cause national but not global underregulation ("regulatory chill"). The incentives to form agreements and their distributional consequences depend on countries' unilateral commitment possibilities and the direction of investment flows. The benefits from agreements between developed countries accrue to foreign investors at the expense of the rest of society, but this is not the case for agreements between developed and developing countries.

Proliferation und Legitimation der internationalen Investitionsschiedsgerichtsbarkeit: Grundzüge einer transnationalen judikativen Legitimitätskonzeption

Das Investitionsschutzrecht gestattet es ausländischen Investoren nicht erst seit TTIP und CETA, die jeweiligen Gaststaaten vor internationalen Schiedsgerichten auf Schadensersatz zu verklagen. Problematisch ist dabei besonders, dass den Schiedsgerichten ein großer Freiraum eingeräumt wird, da die Vorschriften, auf deren Grundlage sie entscheiden, oft sehr unbestimmt sind. Mit Hilfe einer neu entwickelten Rechtsprinzipientheorie der Legitimität, die auf die Abwägung zwischen dem Schutzinteresse der Investoren und dem effektiven Schutz der von einer Investition betroffenen Individuen abstellt, gelingt es Philipp B. Donath, die Normen des Investitionsschutzrechts präzise und einzelfallbezogen auslegen zu können. Damit konkretisiert der Autor sowohl verfahrens- als auch materiellrechtliche Bestimmungen des Investitionsschutzrechts. Er zeigt so Möglichkeiten einer ganzheitlichen inneren Reform der Investitionsschiedsgerichtsbarkeit auf, die nicht auf institutionelle Änderungen angewiesen ist. »Proliferation and Legitimation of International Investment Arbitration« The debate about the legitimacy of international investment arbitration started even before TTIP and CETA called public attention. Damit zeigt er Möglichkeiten einer ganzheitlichen inneren Reform der Investitionsschiedsgerichtsbarkeit auf, die nicht auf institutionelle Änderungen angewiesen ist. Philipp B. Donath studierte nach dem Wehrdienst Rechtswissenschaft, Geschichte und Französisch in Dresden und Frankfurt am Main. Nach Praktika-Stationen im Bundestag und bei der Deutschen Vertretung bei der UNESCO in Paris ist er seit 2009 am Lehrstuhl für Öffentliches Recht, Völker- und Europarecht (Prof. Dr. Dr. Rainer Hofmann) sowie am Wilhelm-Merton-Zentrum für Europäische Integration und Internationale Wirtschaftsordnung an der Goethe-Universität Frankfurt am Main tätig. Im Anschluss an Promotion und Referendariat mit Stationen im Regierungspräsidium Darmstadt (Dezernat für Soziales, Integration und Flüchtlinge) sowie bei der Deutschen Bundesbank arbeitet er an einer staatsrechtlichen Habilitation.
Michel Houellebecq and the International Sexual Economy

This paper explores the notion of an 'international sexual economy' in the work of the French writer Michel Houellebecq, and particularly his latest novel, Plateforme (2001). Houellebecq suggests that, since westerners no longer have the time or the inclination to sleep with each other, and since those in the third world have nothing to sell but their bodies, the exchange of cash for sex on a truly international scale is likely to represent the most lucrative sector of the global economy in the coming century. Whilst acknowledging the objections to this idea, the paper shows how it is based in a serious analysis of global capitalism which has something in common with the theoretical work of Jean-François Lyotard, in terms of both the postmodern and the libidinal economies. The paper further suggests that the virulent anti-psychologism of Houellebecq's often brutal worldview implies a (largely undeclared) kinship with Friedrich Nietzsche. Finally, it offers an analysis of the ironic narrative strategies in Plateforme that are interpreted as the consequence of trying to criticize the cultural economy without being able to position oneself outside it.
