In der Bundesrepublik steht der Widerstreit um die Prozessabsprache und die Einhegung des Deals im Mittelpunkt der Auseinandersetzung zur Verfahrensreform. Zur Begründung des Deals werden allenthalben die Überlastung der Gerichte und der daraus resultierende Zeitdruck angeführt, häufig in Verbindung mit dem finanziellen Aufwand. Diese Begründung aber trägt für den Autor nicht. Am Beispiel der Prozesse um den ehemaligen VW-Personalvorstand Peter Hartz sowie dem "Fall Mannesmann" wird gezeigt, dass der deutsche Strafprozess einer radikalen Veränderung unterliegt. Diese Entwicklung vollzieht sich nicht in gesetzlichen Formen, sondern auf dem Wege der außergesetzlichen Rechtspraxis des Aushandelns des Urteilsspruchs zwischen den Prozessbeteiligten. In ihrem Grundmuster folgt diese Absprachepraxis dem plea bargaining der USA, weshalb der Autor einen Blick über den Atlantik wirft. Der Begriff plea bargaining trifft den Nagel auf den Kopf: Schuld und Strafmaß des Angeklagten werden letztlich ausgehandelt. Zu diesem Zweck schlägt der Staatsanwalt im Austausch für ein Geständnis eine geringere Bestrafung als die im Gerichtsverfahren abzusehende vor. Indem der Angeklagte den Vorschlag annimmt, bekennt er sich vor dem Richter als schuldig. Gewissermaßen als Belohnung für das Geständnis ist dann das Strafmaß zumeist mit dem Vorschlag des Staatsanwalts identisch. Auf diese Weise wird ein "Handel mit der Gerechtigkeit" betrieben. (ICA2)

Der Autor erläutert in seinem Vortrag die These, dass der "neue Kapitalismus" der Demokratie die Substanz raubt. Die demokratische Willensbildung wird dadurch mediatisiert, "dass sie die Exekutive auf Kosten von Parlament und Interessengruppen stärkt und die Definition und Bearbeitung von Problemen (an) international zusammengesetzte und nicht zuletzt deshalb gegen demokratische Politik immunisierte Gremien von Fach- und Verhandlungsexperten delegiert" (Streeck). Ist damit die Koevolution von Kapitalismus und Demokratie an ein vorläufiges Ende gelangt? Wieviel Eigenlogik der Politik lässt sich noch erkennen, wenn die Logik der Ökonomie die Gesellschaft und Politik vor sich hertreibt bzw. durchdringt? In seiner Erörterung dieser Fragen geht der Autor u.a. aus (1) von einer Gleichursprünglichkeit von modernem Kapitalismus und moderner konstitutioneller, liberaler Demokratie (Parlamentarismus); (2) von einer staatlich-politischen Einhegung des "Laissez-faire Kapitalismus"; (3) von der Tatsache, dass die außerparlamentarischen Arbeiterparteien und Gewerkschaften dazu beigetragen haben, die liberale in eine soziale Demokratie zu überführen; (4) von der Tatsache, dass der neue, sich globalisierende Kapitalismus den Rückbau der sozialen Demokratie verlangt und dass sich die (Parteien-) Politik in Richtung einer "regressiven Modernisierung" bewegt. "Mit dem Beginn der Europäischen Währungsunion am 1. Januar 1999 ändert sich die Machtfigur der Atlantischen Gemeinschaft. Die Dollardominanz geht zu Ende, der Euro wird zur gleichberechtigten Weltwährung. Der amerikanischen Handlungsfreiheit wird eine deutliche Grenze gezogen. Die Veränderung von Machtfiguren war historisch immer von bedeutenden Konflikten begleitet. Auf sie ist die Atlantische Gemeinschaft nicht vorbereitet; sie könnten sich durch den Generations- und Politikwechsel, der in Europa stattgefunden hat, noch verschärfen. Für die Bearbeitung solcher Konflikte besitzt die Atlantische Gemeinschaft keine Organe. Zwar ist die NATO-Reform in Arbeit, versteht sich die Militärallianz immer mehr auch als politische Organisation. Zur Bearbeitung solcher Strukturkonflikte wird sie dennoch nicht imstande sein, ebensowenig zur Einhegung der weltpolitischen Differenzen, die sich in der Atlantischen Gemeinschaft ausbreiten. Amerika hat den 1995 erneut geäußerten Wunsch der Europäer nach einer Neuordnung der transatlantischen Beziehungen mit einer Verstärkung seiner hegemonialen Führungspolitik beantwortet. Sie spiegelt auch die politische Entscheidungsschwäche der Europäischen Union wider. In dieser Lage sollten sich die Vereinigten Staaten auf ein Verfahren besinnen, das sie 1945 und danach immer mit großem Erfolg benutzt haben: den Multilateralismus." (Autorenreferat)

This paper seeks to expand recent interest in the material practices, policy techniques and technopolitics of borders, migration and solidarity initiatives in Europe by connecting this debate to Sloterdijk's spherological philosophy. With his thematization of enclosures, atmospheres, foams and life support Sloterdijk helps us to give a more morphological account of borders. We illustrate the benefits of this move by reflecting on the recent questions of hostile environment and the criminalization of migrant solidarity practices and movements. The paper also highlights certain limitations in Sloterdijk's thoughts, which appear when it is brought into migration research. Arguing that Sloterdijk remains somewhat sedantarist in his approach to atmosphere we introduce a concept of the envelope as a way to foster a more dynamic, agonistic and mobilityfocused conception of enclosure.

This article examines the role of open government data in capital accumulation. Open government data is a relatively new phenomenon that involves the pro-active and regular release of government data, in the form of downloadable records, for use and re-use by anyone. Private capitalist enterprises are among those who make use of such data. Publicly produced data is transferred into the hands of private capital through a non-rivalrous form of enclosure. Capital then uses government datasets to create new commodities by the application of skilled labor to the data, in processes including data mashup and data visualization. Inherent in all commodity production is the extraction of surplus value from labor by capital. This, together with the process of enclosure, provides opportunities for capital accumulation from open government data.

Abstract Both animals and human toddlers can find an object in a rectangular enclosure after they have been disoriented. They use geometric cues (relative lengths of walls) to discriminate among different corners (e.g. long wall to the left, short to the right). It has been claimed that this ability is 'modular', i.e. exclusively geometric. The present study demonstrates that the ability toddlers exhibit is a more general one, namely, an ability to discriminate relative quantity. Using a square enclosure, we show that toddlers use the relative sizes of the figures on different walls to characterize different corners. We also show that they do not use simple non‐relative features to distinguish different corners. Possible reasons for differences in the ability to use relative versus non‐relative cues are discussed.

Seventy employees at four job levels in a large corporation completed a questionnaire on their office environments six months before and six weeks after moving from a conventional office to an "open-plan" office. Secretarial employees and their supervisors (job level 1) moved from freestanding desks to partly enclosed workspaces. Staff specialists (job level 11) left double offices for individual, doorless enclosures. Managerial employees (job levels Ill and IV) left walled offices for large, doorless enclosures. Neither satisfaction with commu nications nor perceptions of noise changed after relocation, but satisfaction with privacy declined among former occupants of walled offices. The decrease in privacy reflected a decrease in confidentiality of conversation, as shown by the questionnaire and acoustical measurements. Implications for office design are discussed.

Comment penser l'espace numérique et rendre compte de son caractère à la fois structuré, mouvant et collectif ? Comment trouver un dispositif qui permet un dialogue ouvert, parvenant à saisir le sens des infrastructures numériques, sans les cristalliser en une essentialisation appauvrissante ? L'échange de courriels nous a semblé le moyen le plus approprié de faire de la théorie ainsi que de mettre en place un geste de pensée qui s'accorde avec la culture numérique et qui rend possible d'envisager cette dernière avec un regard critique. Pendant un an et demi (de septembre 2015 à mars 2017), nous avons donc échangé questions et réponses, afin d'essayer d'identifier les caractéristiques du numérique — espaces, temps et enjeux politiques — en continuité avec la tradition du dialogue philosophique. ; How could we consider the digital space and give full account of its structured, moving, and simultaneously collective attributes ? How could we find a device that enables an open dialogue, which allows us to understand the meaning of digital infrastructures without any impoverishing essentialization ? This e-exchange appeared to us the most appropriate way to theorize and create an act of thought that fits in with the digital culture and allows a critical eye on it. For about a year and a half (from September 2015 to March 2017), we shared questions and answers, trying to identify the digital world's characteristics — its spaces, times, political challenges —, in continuity with the philosophical dialogue.

As a figure of thought, the concept of freedom tends to shuttle between abstraction and ideal -- the first exemplified by Isaiah Berlin's contrast between negative and positive liberty, and the second by Philip Pettit's neo-republican conception of freedom as non-domination. Located within the realm of lived experience however, freedom is invariably forged from context-specific constraints, hence the title of the proposed pamphlet: degrees of freedom. The point of departure is to approach freedom as a practice which is 'conditioned' by enclosures of power/knowledge which are also enclosures of the imagination. In terms of destination, the objective is to explore the question of how to breach such enclosures, thereby opening out spaces for alternative ways of practising freedom to emerge. The analysis will encompass three fields of practice and examine how freedom is drawing inwards around the freedom to compete in a zero-sum game among winners and losers. To get to grips with the 'how' of this requires dispensing with analytical tools that operate on the basis of dichotomy (such as power/resistance, freedom/domination, top-down/bottom-up) while also stretching the analysis across distinct-yet-related fields of action. The book will thus begin with a brief discussion that sets out key concepts and ideas before putting these to work through an analysis of 1. Sport & Academia, and 2. Art.
