Die Arbeit wirft die Frage nach der Übertragungsfähigkeit der Konzepte der Völkerrechtsfreundlichkeit und internationalen Offenheit der deutschen Rechtsordnung auf. Die einschlägige Literatur hat diese Konzepte bisher überwiegend im Bezug auf einzelne Rechtsordnungen untersucht. Vor dem Hintergrund des erreichten Kenntnisstandes des deutschen Verfassungsdiskurses entwickelt die Arbeit ein abstraktes Modell der internationalen Offenheit und Völkerrechtsfreundlichkeit, das auf beliebige Rechtsordnungen übertragen werden kann. Der Erkenntnisgewinn einer entsprechenden Untersuchung folgt daraus, dass diese Konzepte verschiedene Aspekte unter einem Begriff vereinen und so die Grundhaltung einer Rechtsordnung treffend beschreiben können. Die Verallgemeinerungsfähigkeit der entwickelten Kriterien wird am Beispiel der Unionsrechtsordnung verdeutlicht. Abschließend stellt die Arbeit Entwicklungsmöglichkeiten des Modells dar. While the terms international openness and friendliness towards international law stem from German constitutional law, they relate to concepts that can be universalized. Because they poignantly summarize different aspects of the interaction between international and national law, their universalization would be beneficial. The author develops an abstract, transferable model of these concepts. After applying the model to the European Union legal order, its potential for development is discussed. Berenike Schriewer studierte Rechtswissenschaft an der Christian-Albrechts-Universität zu Kiel, der Freien Universität Berlin und der Universidad Complutense de Madrid. Nach ihrer Tätigkeit als Wissenschaftliche Mitarbeiterin beim Walther-Schücking-Institut für Internationales Recht in Kiel absolvierte sie ihr Referendariat beim Kammergericht Berlin, u.a. in einer internationalen Kanzlei in Hanoi, Vietnam. Berenike Schriewer ist seit 2014 als Anwältin zugelassen und war zunächst in einer internationalen Kanzlei in Frankfurt tätig. Nach dem Umzug in die USA arbeitet sie in ihrem eigenen Unternehmen.

The Arctic is emerging today as an international region whose importance in political, economic, and environmental terms rivals that of the world's other major regions. What remains in doubt, at this juncture, is how the Arctic states -not to mention others — will respond to this development in policy terms. Are these states likely to upgrade their capacity to handle Arctic issues by adding substantial Arctic expertise to their policy planning staffs; creating bureaux of Arctic or northern affairs in their foreign ministries; establishing effective interagency coordinating mechanisms to handle complex Arctic issues, or devising new Arctic policies to replace the policies of benign neglect they have long relied on in dealing with Arctic matters ? These are serious concerns whose resolution will take time and may differ from state to state. Just as the recognition of the Arctic as a distinctive international region has been a major development of the 1980s, the formulation of appropriate public responses to this development seems likely to become a central Arctic concern of the 1990s.

This paper examines the legal regimes of international contracts concluded by States and public entities. These agreements come in many shape and form. Some of these contracts are long term arrangements involving massive amount of capital and touching upon key resources of the State. Other contracts are of more limited scope. The paper focuses on the law applicable to such agreements. The importance of determining the law applicable to 'state contracts' follows from the peculiar features of a contractual relation with a State, and most notably the additional risk this creates. As in the domestic context, the State is not a contractual partner like any other. It comes into the contractual relationship with its exorbitant powers and sometimes bad manners. This explains why, in contrast with private agreements, where such clauses are too often neglected, provisions on applicable law and settlement of disputes are often considered the "most sensitive legal issues" in the framework of contracts concluded by States. In this against this background that public international contracts will be examined. The attention will first focus on the determination of the law applicable to such contracts (section 1). Thereafter the focus will be on the various stabilization mechanisms used in practice (section 2). This will include both direct stabilization mechanisms and dispute resolution provisions, as these two elements are central to the legal regime of public international contracts. An attempt will be made to present both the generalprinciples and the current practice of States – even though it is difficult to draw general lessons as contracts concluded by states, which come in various formats and shapes, are not easily accessible. ; Peer reviewed

Abstract
It is widely believed that international law imposes no general prohibition on instigation – no general prohibition on states inducing, inciting or procuring other states to breach their international obligations. The absence of a prohibition on instigation stands in contrast to the now entrenched prohibition on the provision of assistance to another state that facilitates an internationally wrongful act. In this article, I argue that the orthodox position on instigation is incorrect. I argue that a prohibition on instigation is founded on a general principle of law, as envisaged in Article 38(1)(c) of the Statute of the International Court of Justice, and that it would be appropriate to transpose that general principle to the international legal system. To sustain this argument, I first construct a representative set of domestic jurisdictions for comparative analysis. Second, through a brief comparative survey, I assess whether in each of these domestic jurisdictions it is wrongful, in one way or another, for an actor to instigate another to commit an act that it would be wrongful for it to do itself. And, third, I argue that the transposition of this principle from domestic law to international law is conceptually and normatively appropriate.

"Since 1945, the United States has pursued its interests through the creation and maintenance of international economic institutions, global organizations including the United Nations and G-7, bilateral and regional security organizations including alliances, and liberal political norms that collectively are often referred to as the "international order." In recent years, rising powers have begun to challenge aspects of this order. The purpose of this report is very specific: to evaluate the order's value -- to assess its role in promoting U.S. goals and interests, and to measure its possible economic benefits in a number of specific areas. To answer the question of the order's value, we first had to define the components of the order that we proposed to evaluate for possible value to U.S. interests. We then reviewed broad assessments of the order, as well as detailed empirical work on its specific components. The resulting analysis produced five major findings: the postwar order offers significant value to U.S. interests and objectives; specifically in quantifiable and return-on-investment terms, the order contributes to outcomes with measurable value and appears to have a strongly positive cost-benefit calculus; the postwar order represents a leading U.S. competitive advantage; if the United States wants to continue to lead globally, some form of order is vital; and a functioning multilateral order will be essential to deal with emerging security and economic issues."--Publisher's description
