The Rule of Law and the Rule of God examines the competing regimes of law and religion, using the concept of rule to illustrate the patterns of their interactions, and a multidisciplinary approach to demonstrate the global scope of their influence. It argues that the tension that often characterizes the relationship between these two cultural institutions results from their disagreements about the kinds of rule that should govern human life and society, and from where they should be derived. By combining theoretical analyses with tradition-specific and regional case studies, the book aims to advance our understanding of how the rule of law and the rule of religion should properly relate to each other, not only in a general way, but also in the context of addressing conflicts that may arise from their inevitable interaction. In addition to legal academics, the humanities scholars and students as well as the general public, will benefit from this book.

L'article se propose, en tenant compte du développement des études simmeliennes, de saisir les relations entre sociologie pure du phénomène religieux et analyse de la catégorie religieuse comme cadre général de formation de la réalité. Une première partie rappelle les grands thèmes de la sociologie pure de Simmel. La seconde partie précise les étapes qui mènent à la monographie de 1906 puis commente l'idée centrale de Die Religion : la religion est la mise en forme d'une religiosité diffuse présente dans de nombreuses manifestations ou relations sociales, qui ne sont pas à strictement parler religieuses. Une approche de certains phénomènes sociaux en terme de religiosité, l'étude des conditions du passage de la religiosité diffuse à la religion, l'approche enfin des analyses par Simmel de la situation religieuse de son temps complètent le tableau et illustrent l'intérêt d'un nouveau regard critique des sociologues des religions sur une oeuvre encore trop méconnue.

"Die ökonomische Forschung nutzt bei der Analyse der Religion im Wesentlichen zwei Herangehensweisen. Der erste Ansatz beschäftigt sich mit dem Einfluss der Religion auf die Wirtschaft. Die Religionen beinhalten ein Wertesystem, welches ökonomische Einstellungen und die Produktion beeinflussen. Innerhalb des zweiten Ansatzes wird religiöses Verhalten mit Hilfe ökonomischer Modelle erklärt. Diese zeigen, wie Individuen Nutzen aus Religion ziehen können. Die moderne Glücksforschung ermöglicht es des Weiteren, den Einfluss von Religion auf das subjektive Wohlbefinden empirisch zu messen. Wir bestätigen die positive Korrelation von Religion und Glück für die Schweiz und zeigen, dass vor allem der positive Effekt des Kirchgangs auf das Wohlergehen robust und beträchtlich ist." Article 17 TFEU has been mainly interpreted as a "safeguard clause" aimed at preventing the EU from affecting (even indirectly) national disciplines religiously connoted. Although this traditional interpretation seems to find confirmation in the letter of the provision, in the systematic reading with Article 4 TEU, second paragraph, as well as in the original will of the parties, some scholars started giving credit to a different interpretation: the Article could allow the development of a European Law and Religion System. This article aims to investigate the current possibility for the aforementioned change of prospective. It focuses on three key factors: the interpretative difficulties concerning the Article, the recent jurisprudential evolution of the Court of Justice of the European Union and the growing axiological-systematic relevance of the Charter of Fundamental Rights of the European Union. This work argues that Article 17 TFEU does not recognize a national competence ex ante in all religious matters; it only requires the EU to refrain from regulating cases that are concretely characterized by a high rate of denominational specificity.

Im einleitenden Beitrag zur Plenarveranstaltung "Religion und Ressentiment", die gemeinsam von der Sektion "Entwicklungssoziologie und Sozialanthropologie" und der Sektion "Religionssoziologie" vorbereitet und organisiert wurde, wird der Zusammenhang von Religion und Ressentiment sowohl auf einer theoretischen als auch auf einer empirischen Ebene durch einige Begriffsbestimmungen knapp skizziert.Ressentiment beschreibt ein gefühlsbedingtes Bedürfnis von sozial, kulturell und/ oder ökonomisch negativ privilegierten (bzw. sich selbst so einschätzenden) Gruppen nach "Abwertung" der Qualitäten und Leistungen der Anderen, das sich bis hin zum offenen Hass gegen die "Bessergestellten", "Vornehmen" und "Mächtigen" steigern kann. Ziel der "Abwertung" der Anderen ist in der Regel die moralische und ethische "Aufwertung" der eigenen Gruppe. Seit Friedrich Nietzsches These von der Entstehung der christlichen Liebesmoral aus dem Geist des Ressentiments von Max Weber aufgegriffen und generalisiert wurde, scheint festzustehen, dass Ressentiment eine charakteristische Begleiterscheinung einer jeden "Erlösungsreligion" und einer jeden religiösen Ethik der negativ Privilegierten ist. Worauf die Deprivation der jeweiligen Gruppen auch im Einzelnen beruhen mag, auf niederem sozialen Status, auf einer ethnischen Minderheitenposition, auf der Diskriminierung oder Verunglimpfung religiöser Gemeinschaften oder auf politischer Unterdrückung, sie kann dazu führen, dass die ethischen Gebote der jeweiligen Religion in ihr Gegenteil umschlagen und der Hass auf die Konkurrenz über alle "Gebote der Liebe" siegt.
