The focus of this paper is on individuals' decisions to seek access to influence a legislator's policy choice from a given binary agenda under uncertainty. In the model, influence is exclusively through the provision of information regarding the true state of the world, and money is used exclusively to seek access to the legislator to exert such influence. However, bias can occur through differences in individuals' willingness to contribute to seek access and through choice of argument at the lobbying stage, conditional on access being granted. Among the results are that the decision of moderates (i.e. those with state-dependent induced preferences over the agenda) to seek access is independent of others' decisions, but this is not true of extremists (those who unequivocally favour one or other of the two alternatives); that although the policy preferences of the legislator coincide with those of the moderates, the legislator often sets the required contribution from moderates higher than that from extremists and, moreover, this is so despite the fact that extremists seeking access offer an argument to the legislator which, although informative, gives negligible payoff gains to the legislator; and, finally, that (expected) "bias« in decision making typically exists and persists even when the size of extremist groups is negligible relative to that of the moderate group.

The compromise enhancing effect of lobbying on public policy has been established in two typical settings. In the first, lobbies are assumed to act as 'principals' and the setters of the policy (the candidates in a Downsian electoral competition or the elected policy maker in a citizen- candidate model of electoral competition) are conceived as 'agents'. In the second setting, the proposed policies are solely determined by the lobbies who are assumed to take the dual role of 'principals' in one stage of the public-policy game and 'agents' in its second stage. The objective of this paper is to demonstrate that in the latter setting, the compromising effect of lobbying need not exist. Our reduced-form, two-stage public-policy contest, where two interest groups compete on the approval or rejection of the policy set by a politician, is sufficient to show that the proposed and possibly implemented policy can be more extreme and less efficient than the preferred policies of the interest groups. In such situations then more than the calf (interest groups) wish to suck the cow (politician) desires to suckle thereby threatening the public well being more than the lobbying interest groups. The main result specifies the conditions that give rise to such a situation under both the perfectly and imperfectly discriminating contests.

Der Beitrag untersucht die Interaktionen der Europaparlamentarier mit Interessenvertretern, die über ihr Lobbying des Europäischen Parlaments (EP) versuchen, den Ausgang legislativer Entscheidungen der Europäischen Union zu beeinflussen. In einem ersten Schritt wird zunächst der Frage nachgegangen, welche Anreize Interessenvertreter haben, das EP (vermehrt) zum Ziel ihrer Lobbyingaktivitäten zu machen. Im Anschluss gilt das Augenmerk der Frage, warum sich Europaparlamentarier im Rahmen ihrer legislativen Tätigkeit 'lobbyen' lassen, und welche unterschiedlichen Zugangspunkte sich Interessenvertretern bieten, um Lobbying im EP zu betreiben. Im dritten Schritt werden sodann die in der Literatur empirisch identifizierten Lobbyingmuster dargestellt, die sich aus den Interaktionen zwischen den Parlamentariern und den Interessenvertretern ergeben - sowohl bezüglich der relativen Lobbyingaktivitäten nationaler und europäischer Interessenvertreter als auch bezüglich der relativen Aktivitäten diffuser und spezifischer Interessen beim Lobbying des EP. Zusammenfassend lässt sich aus den Befunden ableiten, dass nationale Interessenvertreter eine genau so bedeutende Rolle beim Lobbying des EP spielen wie europäische Interessenvertreter. Von einer auffallend 'europäischen' Ausprägung des Lobbying gegenüber dem EP kann man deshalb nicht sprechen. (ICG2)

Die Arbeit setzt sich aus den Bereichen Lobbyismus als unreguliertes Phänomen, rechtlicher Rahmen von Lobbying samt Stellungnahme und Lobbying in der Praxis zusammen.Zur einfachen Darstellung von Lobbyismus als unreguliertes Phänomen werden der Ursprung und die Eigenschaften von Lobbying und der Zusammenhang zur Parteienfinanzierung und zur Korruption aufgezeigt.Die rechtliche Regulierung von Lobbying umfasst die genaue Darstellung und empirische Untersuchung des LobbyG. Neben dem LobbyG wird auch auf die übrigen Gesetze des Transparenzpakets und auf internationale Regulierungen von Lobbying eingegangen. Durch den Vergleich des LobbyG mit dem Lobbying Disclosure Act der USA und dem Transparenz-Register der EU ergeben sich gemeinsame Eigenschaften der Regulierung von Lobbying.In der Stellungnahme zum rechtlichen Rahmen von Lobbyismus in Österreich werden unklare Definitionen, Ausnahmebestimmungen und Lücken im LobbyG aufgezeigt, die zum einen die Abgrenzung von Lobbying zur Korruption erschweren und zum anderen den Anwendungsbereich des LobbyG verengern. Aufgrund dieser Gegebenheiten können die Ziele des LobbyG (im Wesentlichen die transparente und integre Regulierung von Lobbying) nicht erreicht werden. Diese Tatsache stellt den Bezug zur Praxis her.Lobbying unter Anwendung der derzeit aktuellen Fassung des LobbyG kann nur mit Hilfe von Compliance umfassend transparent werden. Die Mitgliedschaft bei einem Lobbying-Verband, strengere Verhaltenskodices und der Österreichische Corporate Governance Kodex sind Bausteine einer Lobbying-Compliance-Organisation. Neben einer Compliance-Organisation im Unternehmen trägt auch Reputation zur Einhaltung eines freiwillig aufgestellten Regelsystems bei. Not only the LobbyG but also the remaining laws of the Austrian legislative package for transparency and international regulations of lobbying are being discussed. The LobbyG, the Lobbying Disclosure Act of the United States of America and the transparency register of the European Union share essential commonalities referred to the legal framework of lobbying.The statement about the legal framework of lobbying in Austria shows vague definitions, admission regulations and legal loopholes, which on the one hand complicates the precise distinction between lobbying and corruption and on the other hand decreases the legal scope. This is why the LobbyG (basically transparent lobbying and the regulation of integry) fails to reach its aim. That fact connects with practical relevance.Lobbying under the valid legal position of the LobbyG can only be transparent by compliance. Being a member of a society for lobbying, doing lobbying under stricter codes of behaviour and following the principles of the Austrian corporate covernance codex, named ÖCGK, are basic modules of a lobbying-compliance-organisation. ABSTRACTI analyse the interaction between post‐election lobbying and the voting decisions of forward‐looking voters. The existing literature has shown that in models with citizen candidates from a dispersed distribution of preferences, lobbying has no influence on implemented policy. In my model with ideological parties, lobbying is shown to have an effect on policy. In terms of welfare, I show that the median voter and the majority of voters can be better off with lobbying.

Im Unterschied zu einem landläufigen, an der Praxis orientierten Verständnis wird im vorliegenden Beitrag Lobbying als ein politischer Tauschprozess zwischen Interessengruppen und politischen Entscheidungsträgern bzw. ihren Mitarbeiter- und Verwaltungsstäben verstanden. Aus einer interaktiven Perspektive stellt sich Lobbying als Resultat interdependenter Interessen dar, die sich auf Ressourcen beziehen, welche die jeweiligen Akteure nicht selbst produzieren können. Auf beiden Seiten ist der Austausch motiviert durch das Bestreben, die politischen Ressourcen zu vermehren und damit die Ausgangsbedingungen für künftige Handlungen zu verbessern. Der Erfolg des Lobbying ist daher nicht nur eine Funktion der Ressourcenausstattung, der Ziele, Taktiken und Strategien von Interessengruppen und ihrer Repräsentanten, wie dies häufig dargestellt wird, sondern das Ergebnis interdependenter Handlungen, die auf dem rationalen Kalkül beider Tauschpartner basieren. Sofern die Tauschakte freiwillig zustande kommen und zum gegenseitigen Nutzen sind, verbessern sie auch die Ressourcenlage der politischen Entscheidungsträger und tragen so zur Optimierung politischer Prozesse bei. Lobbying ist einer von vielen Mechanismen der Repräsentation und Unterstützung unterschiedlicher gesellschaftlicher Gruppen und einzelner Rechtssubjekte unter den Bedingungen der Demokratie. Das Wesen des Lobbying besteht darin, Einfluss auf die Entscheidungen zu nehmen, die von der Legislative und Exekutive getroffen werden. Charakteristikum des modernen Lobbying ist seine Spezialisierung und Professionalisierung. Seit einiger Zeit gibt es in den entwickelten Demokratien Westeuropas und in den Vereinigten Staaten Bemühungen, eine besondere rechtliche Regulierung für das Lobbying zu schaffen. Es entsteht eine spezifische »Lobby-Industrie« in Gestalt von Fachunternehmen und Organisationen, die Interessen externer Auftraggeber repräsentieren und unterstützten. Die Autoren stellen die polnischen Erfahrungen mit der Problematik der rechtlichen Regulierung des Lobbying vor dem Hintergrund von Lobbying-und Bestechungsskandalen der letzten Jahre dar. Sie unterziehen das polnische »Gesetz über das Lobbying im Gesetzgebungsprozess« aus dem Jahr 2005 einer kritischen Bewertung und stellen fest, dass es oberflächlich und wirkungslos ist.

Using a panel data of S&P 500 Index firms covering 1998–2004, this paper compares the determinants of lobbying expenditures and campaign contributions and estimates the returns to lobbying as assessed by the financial market. Lobbying depends more on managerial incentives and protection needs beyond industry structures than contributions do. Lobbying also has a positive effect on the firm's equity returns relative to the market and, to a lesser degree, relative to its industry.

To the public's eye, lobbying is still a highly obscure trade. Lobbyists are generally perceived to work behind closed doors in order to influence legislation—what really happens is unknown to the public.
