В статье идёт речь о коммуникативно-креативной стратегии цвета в рекламной деятельности, являющейся неотъемлемой частью культуры как вида искусства. Основное внимание автора уделено концептуальной направленности мира духовного и потребительского при позиционировании товара, идеи, услуг. В статье затронуты понятия рекламного образа, фирменного стиля, товарного знака, символа, как некоего отличия. Рассмотрены физические аналогии, «Эффект Пуркиное», разнообразные ассоциации и смыслы, владение рыночным инструментарием на уровне экономической интеграции, политической целевой установкой, сакрализуя в себе возможности управления природными стихиями, в мифологических пространственных рамках рекламно-креативной стратегии. Целью статьи является изучение политтехнологий на базовом этапе разработки бренда, товарного знака для выявления цветовых предпочтений человека. Автором отмечены особенности формирования рекламного образа, наполненного смыслами. Данная проблема мало изучена в области цветового восприятия, как и её элементы, представленные базовыми установками И.В. Гете, М. Люшера, Пуркинье. В то же время, автор подчёркивает освоение практических навыков коммуникационного устройства того или иного социума. ; The article deals with a strategy to use color as another means of communication and creativity in advertising. Color is an integral part of culture, it is an art form. The main attention in the paper is given to the author's vision to the spiritual world and to a consumer in the positioning of goods, ideas and services. The article clarifies what an advertising image, a corporate identity, a trademark and a symbol are. The author studies physical analogy, "Purkinoje effect", a variety of associations and meanings, possession of market instruments at the level of economic integration, political target setting, sacralization of the capabilities of natural elements, in the mythological space within the advertising and creative strategy. The purpose of the paper is to study political technologies on the base during the development phase of the brand, trademark, to identify human color preferences. The author gives description of the marked features of formation of meaningful advertising image. The author emphasizes the development of skills of communication devices of a particular society.

В данной статье ставится проблема соответствия самодеятельных и управленческих начал взаимодействию муниципальной власти и местного сообщества, востребованному социальной и управленческой практикой. По мнению автора, следует отойти от крайностей в трактовке местного сообщества и мифологического понимания местного самоуправления. Местное сообщество рассмотрено с опорой на социально-поселенческий и социокультурный критерии. В статье представлено социологическое объяснение необходимости оптимизации взаимодействия муниципальной власти с местными сообществами через поиск меры в использовании самодеятельных и управленческих начал местной власти. Автором указывается необходимость формирования на низовом, муниципальном уровне взаимовыгодных форм взаимодействия и совершенствования управленческих и самодеятельных взаимосвязей. Вместе с тем, в статье подчёркивается назревшая проблема отстраненности муниципальной власти от нужд и потребностей населения, уход от их злободневных проблем, что снижает политико-социальную активность жителей локализованных территорий и тормозит формирование гражданского общества. ; In the work the problem of compliance of the amateur and administrative beginnings to the interaction of municipal authority and local community demanded by social and administrative practice is stated. According to the author, it is necessary to depart from extremes in treatment of local community and mythological understanding of local government. The local community is considered with a support on social and settlement and sociocultural criteria. In the article the researcher furnishes a sociological explanation of the need for optimization of interaction of municipal authority with local communities through the search of a measure in use of the amateur and administrative beginnings of local government. The author specifies the need for formation at the grassroots, municipal level of mutually advantageous forms of interaction and improvement of administrative and amateur interrelations. At the same time in the article the ripened problem of dispassionateness of municipal authority from needs and requirements of the population is emphasized; the author shows that governors prefer ignore topical problems of people. This reduces political and social activity of inhabitants of the localized territories and slows down formation of civil society.

В статье освещаются проблемы реорганизации войск Белого движения в России в период Гражданской войны. Проведён анализ объединения их в единую, возрождение актуальных позиций построения Вооруженных Сил, уставов и традиций. Рассматриваются способы комплектования Белой армии, как на добровольной основе, так и на основе мобилизаций. Углубленно анализируется вопрос о роли военных судов в деле поддержания дисциплины и правопорядка в войсках, а также возможностях, которые командование могло задействовать, используя военные суды и для борьбы проявлениями беззакония со стороны военной администрации. Исследуется нормативная основа организации военно-судебных органов. Уделено внимание причинам поражения Белой армии в Гражданской войне и ликвидации большинства военно-судебных органов к 1922 г., которые не позволили в полном объёме восстановить военно-судебную систему. Статья носит междисциплинарный характер, написана на стыке истории и юриспруденции, имеет историко-правовую направленность. ; The article deals with the problem of reorganizing the troops of the White movement in Russia during the Civil War. The author carries out an analysis of combining them into a single Russian army, the revival of the construction of the current position of the Armed Forces, its statutes and traditions. The author considers methods of recruiting of the White Army on a voluntary basis and on the basis of mobilization. The research thoroughly analyzes the role of military courts in maintaining discipline and order in the army, as well as the opportunities that the command could involve using military courts and to combat manifestations of lawlessness on the part of the military administration. The author studies the regulatory framework of military organization of the judiciary. The researcher pays attention to reasons that led to the defeat of the White Army in the Civil War and the elimination of most of the military judiciary by 1922, which did not allow full restoring of the military judicial system. The article is an interdisciplinary research, written at the crossroads of history and jurisprudence, and has a historical and legal orientation.

В данной статье рассматривается проблема специфики создания автобиографического героя в творчестве современного прозаика Андрея Рубанова. Основное содержание исследования составляет анализ следующих произведений писателя: романов «Сажайте, и вырастет» и «Великая мечта», а также рассказов из сборника «Стыдные подвиги». На основе изучения указанных текстов установлено, что ключевой характеристикой автобиографического героя Рубанова является его максимальное сходство с автором и что сюжеты автобиографических произведений писателя основаны на событиях, происходивших в жизни самого прозаика. Это обусловлено творческой концепцией Рубанова: литературные произведения должны создаваться только на том материале, который хорошо известен писателю. Автор приходит к выводу, что автобиографический герой Рубанова также является своеобразной попыткой прозаика нарисовать портрет «потерянного поколения», то есть русской молодежи, чьё мировоззрение формировалась в период смены политического строя в России конца XX века: от социализма к капитализму. ; The research paper discusses the problem of specificity of creation of an autobiographical character in works by a contemporary novelist Andrey Rubanov. The main contents of the research is an analysis of the following novels: "Plant and It'll Grow" and "The Great Dream", as well as the stories from a collection book "Shameful Deeds". The work is based on the study of these texts and shows that a key characteristic of an autobiographical character by Rubanov is the maximum similarity with the author himself and that the stories by Rubanov are actually autobiographical novels, which are based on the events from the life of the writer. This conclusion of the article's author reveals the creative concept of Rubanov: literary works should be created only on the material, which is well known to the writer. The author believes that the autobiographical character of Rubanov is also an attempt of the writer to draw a portrait of "the lost generation", i.e., the Russian youth, whose worldview was formed in the period of change of the political system in Russia in the late twentieth century: from socialism to capitalism.

Рассматриваются вопросы обеспечения исполнения кредитных обязательств посредством банковской гарантии. Объектом исследования выступает институт банковской гарантии, напрямую отнесенный законодателем к обеспечительным механизмам. Подробно анализируется правовая природа гарантии с учетом дискуссионности проблемы независимости банковской гарантии. В статье отражены особенности применения банковской гарантии в связи с обеспечением кредитных обязательств. Изучается механизм применения банковской гарантии при обеспечении кредитов, обозначается сфера действия банковской гарантии в кредитовании, обращается внимание на проблемы реализации обеспечительного механизма в условиях неисполнения или ненадлежащего исполнения кредитных обязательств. Для проведения исследования были использованы общенаучные, специальные и междисциплинарные методы, в частности, диалектический, конкретно-исторический, сравнительно-правовой методы. Сделан вывод о необходимости детального законодательного закрепления механизма банковской гарантии, что позволит сделать этот способ обеспечения исполнения обязательств одним из эффективных в сфере кредитования. ; The article is devoted to the questions of ensuring execution of credit obligations by means of the bank guarantee. The object of research is the institution of the bank guarantee ranked by the legislator as a security mechanism. The author analyzes in detail the legal nature of a guarantee taking into account the argumentativeness of the problem of independence of the bank guarantee. Features of application of the bank guarantee in connection with credit obligations ensuring are reflected in the article. The mechanism of application of the bank guarantee at credit security is studied; the coverage of the bank guarantee in crediting is designated. Attention is paid to the problems of realization of the security mechanism in the conditions of non-execution or inadequate execution of credit obligations. To carry out the research, the author used general scientific, special and interdisciplinary methods, in particular, the dialectic method, the concrete historical method, the comparative and legal method. The author came to a conclusion that there is a need for detailed legislative fixing of the mechanism of the bank guarantee, which will allow to make this way of ensuring the obligations execution one of the effective methods in the sphere of crediting.

The author reflects on the prosecution institutions role in a democracy, and its designs. He conducts a brief review of the constitutional and legal regulations of the prosecution service in Argentina. He looks critically upon the processes of appointing and removing prosecutors and the practice of life tenure. The author problematizes the fact that prosecutors are not elected by citizens through a direct vote, and meditates about the potential benefits of democratic debate in penal prosecution policy contents, and its virtues on enhancing accountability and control mechanisms. Se realiza un breve repaso sobre la regulación constitucional y legal del Ministerio Público desde una mirada crítica sobre el régimen de designaciones, estabilidad y remoción de los fiscales, y se cuestiona la ausencia justificaciones para que no sean elegidos popularmente.\nTras plantearse el problema de la legitimidad democrática del Ministerio Público Fiscal, se esbozan algunas ideas sobre las potenciales virtudes que el debate democrático ofrece al contenido de la política criminal, y a la rendición de cuentas y el control sobre la actividad de los fiscales. In the article the analysis of problems in the field of political management in modern Russia is carried out. Initially, the author considers the possibility of explaining the nature of these problems through the theory of the "Resource curse", but it allows only updating the vulnerable areas of the system of political governance in our country, without identification of their nature. The author highlights such aspects of the current state of the political system of Russia, as ethno-federalism, its risks in modern conditions, state capitalism and examines its manifestations in the economy and politics of the country. From the author's point of view, the analyzed theory of "resource curse" cannot fully explain and solve the multidimensional problems of political management of modern Russia. There are deeper and more systematic characters than a statement about possession of hydrocarbon resources, the sale of which is in the ground budget replenishment. The attention is focused on the fact that one of the weak points in the political management of modern Russia is a decreased credibility and role of the Parliament, as well as the weak institutionalization of small and medium businesses. The factor causing destabilization of social relations and inefficiency of the system of state administration in the Russian Federation is an established model of ethno-federalism - "Matreshka". Such system of administrative and territorial structure of the country decreases the values of the statehood. The author highlights that the article largely reflects the positions of those political scientists who try to go beyond logical, but at the same time limited postulates of liberal theories when searching for a way out from difficult socio-political situation in the country. These concepts are ideologized and cannot escape the temptation of stigmatization of Russia as a country "cursed" by its natural resources. (author's abstract)

Collection of short stories of James Joyce in a book under the title of "Dubliners" (1914) is a collection composing of 15 short stories, which topic of all of them is living in Dublin (stories about death, love, live in school, etc.). Short story of "sisters" narrates feelings of a boy about death of a priest. The first woman, who is afraid of love, a mother in law speaks about ambition and destroys her daughter. It ispainful narrative of a single man, who leaves the woman he loves and the woman finds in the time of her death that he has been in his loneliness all his life. Accordingly, it could be mentioned that the author has selected in his short stories a style that Flober has been its establisher. Hence, stories in the collection of Dubliners have been strongly image-based and have been less relied on storied actions. (Stein et al, 2008)The present study has analyzed two short stories of the mentioned collection under the titles of "The Dead Persons" and "The sisters\s". In this analysis, the author has considered internal modes and feelings of characters of the story. Process of analyzing the two works has been firstly related to analysis of every story separately and then has been related to goals and destinies of creator of the work and totally his collection of short stories. Finally, the study has considered investigation and analysis of short stories of James Joyce, which analysts and critics of his works have presented it and it is that Dubliners should be considered as an origin and generality. Considering stories of this artist separately can't be a competent work, since as it is obvious in this collection, the author has been tended to achieve a specific goal through considering a certain order for these stories.

The article is devoted to the research about the criteria for defining the "concept" in the modern linguistics. The existence of a number of concepts and terms doesn't allow the scientists to agree on its clear definition. The author points out that the base of concept emergence is founded on the processes of conceptualization, these processes are supported by the basic types of metaphorical judgment. In this article, the analysis of different approaches in order to define the structure of the concept indicates that the concept structure consists of a number of components, and for the most part they are permanent and the rest are interpretative. Until recently the linguistic development of "concept" was mainly limited by the framework of subject-thematic criteria. Along with this the scientists focused on and are still focusing on non-contradictory construction of concept logic in a language discourse. The author of the article states that the forming of the notions and perceptions about space, time, life is based on the conceptualization processes and reflected in the language and concepts. The understanding of concept is being achieved through the number of notions revealed during the speaking process, i.e. discursively, as well as through images, symbols, expression of feelings, and different emotional states. The evaluation of different occurrences, emerged within a certain situation is considered the beginning of the concept emergence. Thus, the author is inclining, that the concept is transsituational; its status is cognitive because the thinking process plays an important role in the cognition of the concept. It is particularly interesting to note the author's conclusion that it is incorrect to mix this important philosophical and linguistic notion with the notion/definition of "word". 'Word' is an objective side of conceptualization and it can not be considered a 'concept'. With all that the processes of conceptualization in the language can be considered in two ways: semasiologically and onomosemasiologically.

Jean-Jacques Rousseau is one of the most important philosophers for the Chinese intellectuals in the 20e century. This study focuses firstly on different groups of society, not only the intellectuals, but also average people and they were inspired by Rousseau. Secondly, the historical materials the author employed are not limited to political commentaries, academic articles, but also included a number of novels, plays or other literary works. In order to provide a complete interpretation of this subject, the author employed especially the imperial exam papers in the late Qing, which is breakthrough of the early studies in the similar subject. Over all speaking, this thesis is an excellent exploration of the themes which author sets but there are still some problems which should be modified for further study, such as content about the complexity of the thinking of Rousseau. The first part of this thesis collects more than two hundred historical documents mentioned Rousseau. By analyzing the historical source according to the time, the authors and the species, the thesis reveals an overall historical course how the Rousseau's ideas spread in the late Qing Dynasty. The second part of the article focuses on the intellectual elite and how they accept and understand Rousseau's thoughts. According to the historical database of this thesis, at late Qing, Liang Qichao is the intellectual who advocated the most the ideas of Rousseau. His attitude towards Rousseau turns from the praise to suspect and finally to criticize, but from the perspective of the history of the human civilization, Liang always holds a "stable" position towards Rousseau. The revolutionary intellectuals elites have an special mode in propagation of Rousseau's thoughts. Their propaganda system is from shallow to deep, covering all sectors of society crowd. Yan fu, although he criticized the political philosophy of Rousseau, also recognized the contribution of Rousseau as educator. El texto analiza La casa de enfrente (1960), última novela escrita por Carmen de Icaza (1899-1979), que ha sido ignorada por los críticos. Primero, tratamos de encontrar la voz narrativa en episodios relativos a Auxilio Social ‒organización dedicada a asistir a la población durante la Guerra Civil española‒. Los métodos de Auxilio Social y los ganadores de la guerra están considerados desde el punto de vista de los vencidos por una autora que fue secretaria general de Auxilio Social en la vida real. Segundo, comparamos estos episodios con sus anteriores discursos políticos de apoyo al régimen. Concluimos que la autora critica algunas intervenciones de Auxilio Social y tiene una visión más compleja de la realidad lo que la lleva a una técnica narrativa más elaborada. Tenemos que señalar que hemos encontrado un personaje secundario en la trama de la novela que es un alter ego de la misma autora. ; The text analyses La casa de enfrente (1960), the last novel written by Carmen de Icaza (1899-1979), which has been ignored by the critics. Firstly, we try to find the narrative voice in the episodes related to Auxilio Social –an institution devoted to assist the population during the Spanish Civil War and the dictatorship–. Auxilio Social methods and the war winners are considered from the losers' point of view by an author who was General Secretary of Auxilio Social in real life; secondly, we compare these episodes to her early political discourses aimed to back up the regime. We conclude that the author criticizes some interventions of Auxilio Social and that she has a more complex view of the reality which she expresses with a more elaborate technique. We have to point out that we have found a secondary character in the plot of the novel which is an alter ego of the author herself.

The author considers the correspondence between oprichnina terror and the unsolved issues in military service between the 1550s and 1560s. The analysis references a vast number of records, i. e. court records (1550s), desyatni, Boyar books (1555–1556), cadastres, Novgorod order books, and private acts. The author studies the functional potential of the social reforms of the Select Council (Izbrannaya rada). This approach enables the author to sketch a gradual increase in problems for the Muscovite government and its attempts to solve them. The inefficient mobilization of the service class, resulting from the earlier Boyar rule, caused the service class's poor combat readiness and lack of property. The reforms that were carried out to resolve the situation were limited and worked slowly; thus, constraint and repression were crucial for the policy of the oprichnina years, which continued the policy of the 1550s, radicalizing it. ; Ставится вопрос о связи механизма опричного террора с нерешенными вопросами организации службы, актуальными для времени 50-х – начала 60-х гг. XVI в. Исследование основано на привлечении широкого круга делопроизводственных документов: Дворовая тетрадь 50-х гг. XVI в., десятни, Боярская книга 1555/56 гг., писцовые книги, материалы новгородской приказной избы, частные акты. Рассматривается функциональный потенциал социальных реформ «Избранной рады». Такой подход позволяет выстроить картину постепенного нарастания проблем и попыток их решения, исходя из средств, имеющихся в арсенале московского правительства. Комплекс проблем, доставшийся со времен боярского правления, не позволял эффективно использовать мобилизационные возможности массы служилых людей, негативно сказываясь на их обеспеченности землей и боеготовности. Проводившиеся с этой целью реформы были ограничены по своему характеру и не могли обеспечить быстрые результаты. Форсировать этот процесс должны были принудительные методы воздействия и репрессии, взятые за основу политики в опричные годы. В этом отношении опричнина продолжала начинания 1550-х гг., радикализировав их внутреннее содержание.

Menschen leben in "kollektiven Verletzungsverhältnissen". Mit diesem sozialtheoretischen Begriff wird die Tatsache fokussiert, dass sich Personen als verletzbare und verletzungsfähige Subjekte begegnen, deren in Dispositionen verfestigte Vulnerabilität auch als Ergebnis erlittener und zugefügter Gewalt in historischen Konstellationen aufgefasst werden kann. Im Anschluss an psychoanalytische Forschungsergebnisse wird das Konzept der transgenerationellen Transmission gravierender (traumatischer) Verletzungen vorgestellt und die Bedeutung von Enactments als einer besonderen Form der unbewussten aktionalen Erinnerung in sozialen Situationen betont. Es wird argumentiert und an Beispielen dargelegt, dass solche und andere Spuren kollektiver Gewalt - auch solche, die bis in frühere Jahrhunderte zurückreichen - in modernen Einwanderungsgesellschaften überaus präsent sind (z. B. in Interaktionen mit politischen Flüchtlingen). In einer normativen Perspektive wird für eine gesteigerte Verletzungssensibilität plädiert, die einen differenzierten, auch symbolische und psychische Formen einbeziehenden Gewaltbegriff voraussetzt. Nach knappen Erläuterungen von zwei in Migrationsgesellschaften wichtigen Modi symbolischer und psychischer Verletzung - der "Dyspräsentation" und gewissen Formen der Unterlassung, namentlich dem Schweigen - wird abschließend auf die "Gefahr" eingegangen, durch die zunehmende (wissenschaftliche) Sensibilisierung für Verletzungsverhältnisse eine zwielichtige Tribunalisierung psychosozialer Wirklichkeiten zu befördern. This social-theoretical concept focuses on the fact that people interact as vulnerable subjects and subjects capable of violence whose vulnerability, solidified in dispositions, may be considered the result of violence sustained and inflicted in historical constellations. Following an outline of psycho-analytical research results, the author presents the concept of transgenerational transmission of serious (traumatic) injuries and emphasizes the importance of enactments as a special form of unconscious actional retrospection in social situations. It is argued and illustrated that these and other traces of collective violence - even those dating back to the early centuries - are eminently manifest in modern immigration societies (e. g. in interactions with political refugees). From a normative perspective, the author advocates a heightened sensibility towards harm that presupposes a differentiated concept of violence that also includes symbolical and psychological forms. After giving a short explanation of two modes of symbolical and psychological injury that are important in migration societies - "dyspresentation" and certain forms of omission, namely silence -, the author finally discusses the "danger" of promoting a dubious "tribunalization" of psycho-social realities through an increasing (scientific) sensitization for relationships of harm and vulnerability. Данная статья посвящена анализу государственно-частного партнерства, в настоящий момент активно развивающемуся в Российской Федерации, с позиции конституционного права, а именно, с точки зрения возможности использования его в качестве инструмента, позволяющего реализовывать конституционные принципы в сфере предпринимательской и иной экономической деятельности. В статье подвергается анализу само понятие «государственно-частное партнерство» и предпринимается попытка разрешить вопрос о корректности его применения с терминологической точки зрения. Возможность рассмотрения государственно-частного партнерства как инструмента реализации конституционных принципов рассматривается путем анализа точек зрения ведущих авторов, монографической и периодической литературы, а также существующих нормативно-правовых актов и готовящихся к принятию законопроектов. Основными научными методами, использованными в статье, являются методы комплексного и сравнительного анализа. Научная новизна тезисов, излагаемых в статье, подтверждается тем фактом, что государственно-частное партнерство ранее в контексте конституционного права не рассматривалось, а актуальность выбранной темы обосновывается активно развивающимися социально-экономическими процессами, поспособствовавшими появлению государственно-частного партнерства в Российской Федерации. ; The article is devoted to the analysis of a public-private partnership, currently developing in the Russian Federation, with the application of Constitutional Law principles, namely, whether it is possible to use it as a means for implementation of constitutional principles in the sphere of entrepreneurial or any other economic activity. To prove the validity of his position, the author analyses the concept of publicprivate partnership and attempts to tackle the issue concerning the correctness of itsapplication as a term. Moreover, the author analyses the views of top researchers, monographs and periodical publications, legal documents and bills. The basic research methods applied in the article are complex and comparative analysis. The novelty of the views expressed by the author is proved by the fact that public-private partnership has never been considered in the context of the Constitutional law and the topicality of the theme chosen is substantiated by the developing social and economic processes that stimulated the emergence of public-private partnership in the Russian Federation.
