Particolare attenzione è stata dedicata al meccanismo dell'arbitrato e alle proposte di riforma del sistema ISDS, attualmente discusse in sede europea con il coinvolgimento dell'UNCITRAL.

I study the influence of minimum quality standards in a partial-equilibrium model of vertical product differentiation and trade in which duopolistic firms face quality-dependent costs and compete in quality and price in two segmented markets. Three alternative standard setting arrangements are Full Harmonization, National Treatment and Mutual Recognition. Under either alternative, standards can be found that increase welfare in both regions. The analysis integrates the choice of a particular standard setting alternative by governments into the model. Mutual Recognition emerges as one regulatory alternative that always improves welfare in both regions when compared to the case without regulation. Under certain cost conditions, both regions will prefer Mutual Recognition over all available alternatives.

The proliferation, globalization, and fragmentation of law in world politics have fostered an attempt to re-integrate International Law (IL) and International Relations (IR) scholarship, but so far the contribution of realist theory to this interdisciplinary perspective has been meagre. Combining intellectual history, the jurisprudence of IL and IR theory, this article provides an analysis of John H. Herz's classical realism and its perspective on international law. In retrieving this vision, the article emphasizes the political and intellectual context from which Herz's realism developed: the study of public law in Germany during the interwar period and in particular the contribution of Hans Kelsen and the pure theory of law to the study of international law. Herz was deeply inspired by Kelsen but he criticized the pure theory for ignoring the sociological foundations of law. Following his emigration to the United States, Herz embraced realism but without disregarding international law. Indeed, his mature, globally oriented realism offers a balanced, fruitful perspective for thinking about the relationship between politics and law that is deeply relevant for contemporary theory: it challenges modern, law-blind variants of realism and holds considerable potential for contributing to the approaches that have most successfully studied the law–politics nexus.

The aim of the article is to study legal regulation and determine the forensic aspect of international cooperation during the investigation of crimes committed by transnational organized criminal groups. Methodology. The following methods were used in the course of the research: dialectical, method of theoretical analysis and synthesis, systemic and structural, formal and logical, comparative and legal method, summarization. Research results. Attention is focused on the fact that international cooperation is a necessary condition for the investigation of certain types of crimes committed by transnational organized groups. The need for all countries of the world to coordinate and improve their legal basis for effective cooperation both in the investigation of criminal offenses and in their prevention is stressed. Practical meaning. It is noted that there are two structural subdivisions in the system of the Ministry of Internal Affairs of Ukraine, which are entrusted with the responsibility of coordinating international cooperation with law enforcement agencies of other countries on issues of combating and investigating criminal offenses. Value/originality. Based on the analysis of the cited works, the forms of international cooperation during the investigation of offences committed by transnational organized criminal groups are determined.
