The referendum is one of the main institutions of a democratic state. It allows citizens to participate directly in the process of the state decision making and to influence public policy. At a special meeting of the Commission of Omsk region Public chamber for the development of civil society, communications, information policy, was made a decision to support the initiative group of Omsk and to hold a citywide referendum concerning escalated vicinal issues. In addition, the Commission decided to involve sociological organizations to conduct a survey of citizens. Centre of Humanitarian, SocialEconomic and Political Research – 2 (GEPICentre – 2) consider it as a professional and civic duty to entertain a suggestion of the initiative group and undertake a research for studying a public opinion on the referendum and the issues that should be carried over for consideration.

There are some territories exist in Europe trying to get some level of sovereignty, and recent years have shown that these areas will not be satisfied with limited autonomy or some concessions from their governments. Scotland referendum like the example of this desire took place on September 18, 2014. The results were not legally binding for London, but it was considered by all sides as the most important internal political event which determined the future of their state. Simultaneously it compelled international attention, focused mostly by the separatist movements and central governments in many countries.Referendum background can be considered from two sides – from Scotland, as a territory, which requires independence since the beginning of its existence, and by the UK government, which is quite long delayed implementation of this. London made numerous concessions and there were a line of successful referendums for autonomy so sooner or later direct question about independence would come on the agenda.Besides that, the law of Scotland has the norm, which allowed starting the referendum process if there are 65 people in territory parliament and they are ready to vote for it. After the elections 2011 there were 69 members in parliament, all of them – members of the Scottish National Party, which is fighting for the independence of the territory since its appearance in 1930-ies. As a result, on October 15, 2012 British Prime Minister David Cameron and head of the autonomous government of Scotland Alex Salmond signed an agreement which defines the procedure for holding a referendum in autumn 2014.Referendum for independence caused many questions between its supporters and opponents, because the most important part of independence was not the independence itself but willingness of Scottish Government to solve a number of complicated problems. Opponents of the independence noted that independence – is not only a future possibility as nationalists say, but also a high level of responsibility. Three major questions were kept unanswered before the referendum – the national currency, defense and EU membership. There are equally important questions as relationship with the British Crown, using energy resources and social security status.Before the referendum the British Sociological Agency reported that about 150 000 people did not decide how to vote. It was believed that their choice will decide the fate of the region. As a result, for the Scotland independence from the UK voted 44,7 % of people or 1 617 989 Scots; – against 55,3 % or 2 001 926. The difference amounted to 383 937 persons. Victory of country unity supporters was quite confident. The results of the referendum could be different but the reaction of the British authorities on election forecasts was decisive – all three British parties released document during the last week of the campaign which guaranteed the empowerment of the Scottish government.A referendum in Scotland, conducted democratically, showed that the world can come to compromise in any question, but even failed attempts to legitimate independence left a big sigh on internal and foreign policy of states and territories. ; На внешнюю политику самых влиятельных международных акторов активно влияет внутриполитическая ситуация, поэтому референдум в Шотландии 2014 года привлек внимание международного сообщества как событие, способное повлиять на будущее международных отношений в целом. В статье рассмотрены причины, ход и последствия референдума в Шотландии в 2014 году. В центре внимания – причины проведения референдума и его результаты как для Великобритании, так и для мирового сообщества. Обозначены особенности шотландского выбора, проблемы, которые возникли перед шотландцами на пути к незави-симости в XXI веке. ; На зовнішню політику найвпливовіших міжнародних акторів активно впливає їхня внутрішньо-політична ситуація, тому референдум у Шотландії 2014 року привернув увагу міжнародного співтовариства як подія, здатна вплинути на майбутнє міжнародних відносин у цілому. У статті розглянуто причини, перебіг та наслідки референдуму в Шотландії 2014 року. У центрі уваги – причини проведення референдуму, його результати як для Великобританії, так і для світового співтовариства. Визначено особливості шотландського вибору, проблеми, які постали перед шотландцями на шляху до незалежності в XXI столітті

В статье оцениваются плюсы и минусы российской практики проведения референдумов на региональном уровне. Отмечается, что референдум, являясь одной из высших форм непосредственного выражения власти народа, обладает большими возможностями для разрешения противоречий между разными ветвями государственной власти. Вместе с тем автор указывает, что проведение референдумов в России на муниципальном и региональном уровнях связано с преодолением ряда трудностей, связанных с решением организационных вопросов, необходимостью грамотной и юридически выверенной формулировки вопросов референдума, предотвращением превращения референдума в механизм манипулирования общественным мнением, который может быть использован политиками для достижения определенных целей. ; Pluses and minuses of Russian practice of conducting public referendum on regional level are assessed in the article. It is noted that referendum, being one of the highest forms of the direct expression of the people's power, obtains great possibilities for the solution of contradictions between different branches of the state power. At the same time the author points out that realization of a referendum in Russia is connected with overcoming of a number of difficulties connected with the solution of organizational tasks, with the necessity of competent and juridically verified formulation of referendum questions, and with prevention of transformation of a referendum into a mechanism of manipulation with public opinion, which can be used by politicians for their own aims.

Выделяются периоды: советский (1936 г. 1985 г.); разрушение СССР (1985 г. 1991 г.); постсоветский (1991 г. сентябрь 1993 г.); переходный к современному (сентябрь 1993 г. декабрь 1993 г.) и современный (декабрь 1993 г. 2014 г.). При обобщающей характеристике каждого периода используется классификация референдумов по видам, а также классификация государств по уровню развития политического самоуправления граждан (демократии) исходя из критерия конституционно-правового регулирования и практики проведения референдумов. Обосновывается основная тенденция развития законодательства о референдуме РФ в современной России. ; The article analyses constitutional and legal regulation, practice, results of the carrying out national referendums as well as their realization in the USSR, the RSFSR and the Russian Federation from 1936 to 2014. There are notable periods: Soviet (1936-1985); dissolution of the USSR (1985-1991); post-Soviet (1991 September of 1993); transition to modern (September of 1993 December of 1993) and modern (December of 1993 2014). During overall characteristic of each period classification of referendums by type as well as classification of States by level of development of political self-governing of citizens (democracy) are used based on the criterion of constitutional and legal regulation and practice of carrying out referendums. In the article the general tendency of development of legislation about the Russian Federation's referendum in the modern Russia is given.

The article identifies theoretical and practical problems of the referendum institute as a form of direct democracy and directions of their solution in the legislation of Ukraine. The genesis of the term "referendum" was considered, the development of the referendum institute in Switzerland, and it was proved that more than 50 percent of all national referenda held in the world belong to it, and it is stated that the referendum in Switzerland is a real mechanism of influence of the public on policy making. It is justified that the term "elections" cannot be confused or equated with the term "referendum" because their difference lies in the object of the will of the voters. It is stated that after the Second World War and the completion of the decolonization process, the referendum became a universally recognized, universal institution of direct democracy and enshrined in the constitutions of most states of the world. Examples of holding referendums in Ukraine are given and attention is drawn to the fact that the referendum decision of April 16, 2000. has not been implemented in national legislation. It was noted that the referendum, which is considered to be the most democratic form of expression of the will of citizens, is fixed at the constitutional level in 36 of the 42 states of continental Europe. It is emphasized that the referendum plays a decisive role in society, is a way of forming public opinion, a form of exercising citizens' political rights, and can also be used even in a democratic state as a counterweight to representative democracy, but subject to certain conditions. First, the referendum question must be accessible to the ordinary voter; secondly, before the referendum is held, the issues that are at the discretion of the voters should be discussed beforehand, especially in the media. Only by fulfilling these conditions does the referendum enable the people to express their will and avoid political manipulation by the state. The opinions of some scholars on the concept of the term "referendum" are given. It is stated that the term "plebiscite" is considered synonymous with the term "referendum" in the legal literature. Attention is drawn to the fact that the meaning of these terms does not always coincide, and therefore, in different countries, the current legislation differently approaches these institutions. That is, plebiscite is regarded as one of the varieties of referendum on the subject, at the same time, by their political and legal nature and procedure, they are identical. V. Kovalchuk's proposal that the new law on the all-Ukrainian referendum should provide for the right to hold consultative referendums, including "plebiscite referendums", was supported.The expediency of studying the positive experience of foreign democratic states regarding the holding of referenda, making necessary changes and additions to section III "Elections, referendum" of the Constitution of Ukraine and adopting a legislative act on the all-Ukrainian referendum, the absence of which adversely affects the further development of the society, which further influence the further development of society, are substantiated. and enhancing the role of citizens in making major political and foreign policy decisions in particular. ; У статті визначено теоретичні та практичні проблемні питання інституту референдуму як форми безпосередньої демократії та напрями їх вирішення в законодавстві України. Розглянуто генезу появи терміну "референдум", розвиток інституту референдуму в Швейцарії та доведено, що понад 50 відсотків усіх проведених загальнонаціональних референдумів у світі припадає саме на неї, а також стверджується, що референдум у Швейцарії є справжнім механізмом впливу громадськості на вироблення державної політики. Обґрунтовано, що не можна змішувати або ототожнювати термін "вибори" з терміном "референдум" у зв'язку з тим, що їх відмінність полягає в об'єкті волеви-явлення виборців. Констатується, що після Другої світової війни і завершення процесів деколонізації референдум стає загальновизнаним, універсальним інститутом безпосередньої демократії та закріплюється в конституціях більшості держав світу. Наведено приклади проведення референдумів в Україні та звернута увага на те, що рішення референдуму від 16 квітня 2000р. так і не було імплементовано до вітчизняного законодавства. Зазначено, що референдум, який вважається найдемократичною формою волевиявлення громадян, закріплено на конституційному рівні в 36 із 42 держав континентальної Європи. Наголошується, що референдум виконує в суспільстві визначальну роль, є способом формування громадської думки, формою реалізації політичних прав громадян, а також може використовуватися навіть у демократичній державі як противага представницькій демократії, але при дотриманні певних умов. По-перше, питання яке виноситься на референдум, повинно бути доступним для розуміння звичайному виборцю; по-друге, до початку про-ведення референдуму слід попередньо обговорити питання, що виноситься на розсуд виборців, насамперед у засобах масової інформації. Тільки за виконанням цих умов референдум дає можливість народу висловити свою волю та уникнути політичного маніпулювання з боку держави. Наведено думки окремих науковців щодо поняття терміну "референдум". Констатується, що в юридичній літературі термін "плебісцит" вважається синонімом терміна "референдум". При цьому звернута увага на те, що смислове позначення цих термінів не завжди співпадають, і тому в різних державах чинне законодавство по-різному підходить до зазначених інститутів. Тобто, плебісцит розглядається як один з різновидів референдуму за предметом, водночас за своєю політико-право-вою природою і порядком проведення вони є тотожними. Підтримано пропозицію В. Ковальчука про те, що в новому законі про всеукраїнський референдум, повинно бути передбачено право на проведення консультативних референдумів, у тому числі "плебісцитних референдумів". Обґрунтовано доцільність вивчен-ня позитивного досвіду зарубіжних демократичних держав щодо проведення референдумів, внесення необхідних змін і доповнень до розділу ІІІ "Вибори, референдум" Консти-туції України та прийняття законодавчого акту про всеукраїнський референдум, відсутність якого нега-тивно впливає на подальший розвиток демократичних засад, розвитку громадянського суспільства взагалі, та підвищення ролі громадян у прийнятті найважливіших рішень внутрішньополітичного та зовнішньополітичного значення зокрема.

Освещается проблема проведения референдума в Шотландии по вопросу выхода из состава Соединенного королевства Великобритании и обретения статуса независимого государства. Авторами приводится описание исторического контекста данного политического процесса, основных целей и мотивов шотландского правительства для получения самостоятельности. Рассматриваются основные потенциальные проблемы независимого государства, наличие или отсутствие их решений у правительства страны. Осуществляется суммирование приведенных факторов и оценка их потенциального воздействия на итог референдума. ; The article covers the problem of Scotland secession from the United Kingdom of Great Britain and Northern Ireland. Mainly the article is devoted to the agreement between the Scottish Government and the UK government on the arrangement of the independence referendum in September 2014 in Scotland. The authors give the short overview of some facts from the history of Scotland, as well as the current authorities and the principal goal of the government to attain independence. The result of the independence referendum will show if Great Britain preserves its current structure or, on the contrary, Scotland receives the status of an independent state. It is generally known, that the secession of Scotland will bring about alterations in the internal economic policy of the country, in its membership in supranational organizations and its participation in military conflicts. Aiming at the detailed coverage of the situation, the authors analyze a number of pro and contra arguments on the issue of independence of Scotland. The supporting arguments list includes the following aspects: the liquidation of nuclear submarine base, its own vote in the UN and membership in the EU, economic strength of Scotland. The national internal dept which proves the dependence of Scottish economic and social spheres on the subsidies from the British budget appears to be one of the leading factors, which prevents Scotland from being separated from the UK and thus becoming the independent state. Other economic issues to be settled are the currency of the state and the location of banking sector of Scotland. Contrary to the opinion of the Scottish party, the solutions for the above-mentioned questions and for the question on the membership in the EU can not be found so easily. The latter point a complex one as it involves economic, political and national components. For the reason of political identity, the Scottish government has no right for "back-pedals", so it continues its great campaign to popularize the separation ideas, to encourage the youngsters above the age of 16 to vote. The article contains some examples of public opinion and the statistics of social surveys, which, on the one hand, stress the emotional support of independence, and, on the other hand, show the distrust to the program of the First Minister and worries about the future of the state. Moreover, the article deals with the alternative way, the so called "Light Independence", which implies the widening of powers of the Scottish government as a part of the UK. In the article the authors try to sum up the above-mentioned factors, to scrutinize their influence on the current situation and thus to make a supposition about the result of the political process in the analysis.

Author shows as a process of development of the new constitution of Venezuela passed. In article value and functioning of National constitutional assembly and two referenda of 1999 are explained. The main points of view and disagreements according to contents of the text of the constitution are presented.
