Every legitimate exercise of political power owes its very existence to Church. On the other hand, every Church power lies in papal power. Therefore, the power of the Pope himself, even in earthy matters, is a total, absolute power, sine pondere, numero et mensura, as Egidio points out. Two powers, two swords but just a unique authority: that of the Pope.

Unter der Perspektive der neuzeitlichen Rechtsphilosophie ist die vorliegende Studie um die kirchenpolitische Streitschrift De ecclesiastica potestate des Aegidius Romanus (1242 - 1316) zentriert, dessen Lehre an der Schwelle zu einem modernen Verständnis von Recht steht. Intention ist hierbei die Darstellung der sukzessiven Abkehr von der thomasischen und scotischen Naturrechtslehre innerhalb der mittelalterlichen Rechtsphilosophie. Wie die Interpretation der aegidischen Texte zeigt, verwirft Aegidius Romanus zentrale Elemente der traditionellen Lehren und postuliert eine nur durch die innere Widerspruchsfreiheit und die göttliche Offenbarung eingeschränkte Gesetzgebungskompetenz. Dieser auf neuzeitliche Theorien hinweisende Befund wird allerdings durch das zweite Resultat der Studie eingeschränkt. Denn wie die Darstellung der von Aegidius in Anspruch genommenen Metaphysik zeigt, bleibt seine Lehre aufgrund ihrer Reminiszenz an neuplatonische Theoreme dem Denken des Mittelalters verhaftet

Aegidius Romanus is a prominent author within several theoreticians on the relationship between Temporal & Spiritual Power in Christian Medieval Theocratic Thought. However, in the process leading to his work (early XIV Century) some relevant antecedents can be found: Hugh of Saint Victor anticipated in the XII Century the main tenets of Aegidius' Political and Theological view, while Augustine of Hippo (early V Century), and Pope Gelasius I (late V Century) also held doctrines present in Aegidius' work. This paper presents the incipient Division of Powers in the V Century, the subordination of Temporal Power to the Spiritual one in Hugh of Saint Victor, and the radical submission of the Temporal Power to the Churchly Might in Aegidius. ; Egidio Romano es un autor prominente dentro del cuadro de teóricos que discutieron la relación entre el poder temporal y el espiritual en el pensamiento teocrático de la Cristiandad medieval. Sin embargo, su trabajo (principios del siglo XIV) puede encontrar ciertos antecedentes relevantes: Hugo de San Víctor anticipó, en el siglo XII, los postulados centrales de la visión política y teológica de Egidio. Y también Agustín de Hipona (a principios del siglo V) y el Papa Gelasio I (a fines del siglo V) defendieron doctrinas presentes en el pensamiento de Egidio. Este trabajo expone, así, la incipiente división de poderes en el siglo V: la subordinación del poder temporal al espiritual en el pensamiento de Hugo de San Víctor y, luego, la sumisión radical del poder temporal frente al poder religioso propuesto por Egidio.

Scholars who devoted their attention to Medieval political thinking have correctly typified Aegydius Romanus's doctrine as the purest model of the so-called Papal Theocracy or Hierocracy. It was precisely that theocratic character which left unadvertised its theoretical importance and, consequently, minimised the strength of the conceptual groundings of Aegydius's political theory on absolute power. This article points to two directions: in the first place, it reconstructs the argumentation that Aegydius used to get to the notion of casus imminens; in the second place, it points out (and stresses) the theoretical links that relate the casus imminens with the theory of the totality of power (plenitudo potestatis). ; Los estudiosos que se dedican al pensamiento politico medieval han tipificado correctamente a la doctrina de Egidio Romano como el modelo más puro de la así llamada Teocracia o Hierocracia papal. Fue precisamente este carácter teocrático el que hizo pasar desapercibido su importancia teórica y, consecuentemente, minimizó la fuerza de los fundamentos conceptuales sobre el poder absoluto de la teoría política de Egidio. El problema de la lectura directa de la "Política" de Aristóteles por parte de Dante sigue sin resolverse en los estudios sobre la formación intelectual y la biblioteca del poeta. La digresión política en el libro IV del "Convivio" permite tejer más factores de la tradición cultural que ha transmitido el pensamiento y el texto de Aristóteles: desde la versión latina de Guillermo de Moerbeke y los comentarios de Tomás de Aquino y Pierre d Auvergne hasta el tratado de Egidio Romano (probablemente conocido por Dante gracias a una vulgarización toscana). The "political digression" in the fourth book of the Convivio allows to weave more factors of the cultural tradition that has conveyed Aristotles's thought and text: from the Latin version of William of Moerbeke to the commentaries of Thomas Aquinas and Pierre d'Auvergne up to the treatise of Aegidius Romanus (probably known by Dante thanks to a Tuscan vulgarization). The methods of reusing and transforming the text of the Politics also make it possible to reflect on the survey methodology, used hitherto with the aim of tracing certain evidence of Dante's knowledge (or the lack of knowledge) of the Aristotelian treatise.
