O ensaio reconstrói, em largos traços, a interpretação que Foucault faz da Aufklärung kantiana. Procura mostrar, por um lado, que tal interpretação serve-lhe de auto-esclarecimento filosófico, isto é, como certificação da noção de filosofia como pensamento da atualidade. Por outro, que esta noção de filosofia torna-nos produtiva a própria idéia de uma filosofia da educação baseada na Aufklärung como maioridade pedagógica.

Often portrayed as a period bound by the dogma of slavish obedience to the diktats of reason and progress, the Age of Enlightenment is revealed by this profound analysis to have been riddled with skeptical attitudes and characters, even in the Enlightenment's most codified locations, such as Germany. Der freiheitliche liberale Rechtsstaat, so wie wir ihn heute kennen, beruht ganz wesentlich auf geistigen Grundlagen, die in der europäischen Aufklärung des 17. und 18. Jahrhunderts gelegt wurden. Dazu gehören die Zurückweisung religiös begründeter Autoritäten, Toleranz gegenüber anderen Lebensentwürfen, und die Vorstellungen von Freiheit, Gleichheit und Solidarität, die sich seit dem beginnenden 19. Jahrhundert in fast ganz Europa durchsetzten. -- Der vorliegende Band versammelt die Vortragstexte einer Tagung zur Strafrechtsphilosophie der Aufklärung, die im Juni 2015 von Sergio Seminara und Eric Hilgendorf in Pavia, dem Studienort Cesare Beccarias, veranstaltet wurde. Die Vorträge wurden für die Drucklegung überarbeitet und mit einem Fußnotenapparat versehen. Die Herausgeber hoffen, dass der kleine Band dazu beitragen wird, das heute wieder so gefährdete Gedankengut der europäischen Aufklärung für die Zukunft zu sichern. / Legal Philosophy of the Enlightenment -- This volume presents the lecture texts of a conference on the criminal law philosophy of the Enlightenment, which was held in June 2015 by Sergio Seminara and Eric Hilgendorf in Pavia, the study site of Cesare Beccaria. The lectures were revised for printing and provided with a footnote apparatus. The editors hope that the small volume will contribute to securing the future of the European Enlightenment's ideas, which seem once again so endangered today.
