This thesis expands on the status of legal protection of landscape in the two Countries. The Constitutional level of landscape preservation is older and specific in Italy, in France it is most recent and environment based in general. In regards to the ordinary legislation, beyond the Alps, we find a large number of institutions of preservation, differing according to the asset or the considered territory. There are overabundant administrative/urban instruments, that often provide only a formal protection and create some doubts. However, the preservation is high for some assets or areas, such as those in charge of the "Architectes des Bâtiments" or for the coastal areas. It is important the role of the administrative judge. On the contrary, in Italy, the fundamental tools (constrains, urban planning and permission) work for assets and protected territories in a generalized way. The planning has been little and badly implemented, while the permission has been used by the Regions with ease. However, the absolute right to the landscape presents itself in both Countries. In the conclusion, in regard to France, we advance, amongst other things, a specific system of legal permissions, the reduction of urban/environment documents, the introduction of more binding regulations and a specific scheduling. In regard to Italy, we think it appropriate to create a landscape planning, or better, to unify the landscape planning to the local urban one, creating a coordination, missing for the time being. In addition, we advance that authorization will be on State exclusive jurisdiction. Most calmodulin (CaM) targets are α-helices. It is not clear if CaM induces the adoption of an α-helix configuration to its targets or if those targets are selected as they spontaneously adopt an α-helical conformation. Other than an α-helix propensity, there is a great variety of CaM targets with little more in common. One exception to this rule is the IQ site that can be recognized in a number of targets, such as those ion channels belonging to the KCNQ family. Although there is negligible sequence similarity between the IQ motif and the docking site on SK2 channels, both adopt a similar three-dimensional disposition. The isolated SK2 target presents a pre-folded core region that becomes fully α-helical upon binding to CaM. The existence of this pre-folded state suggests the occurrence of capping within CaM targets. Dans les conclusions, on propose notamment pour la France un système spécifique d'autorisations, la réduction des documents urbanistiques et environnementaux, l'introduction d'une discipline plus contraignante et un aménagement spécifique. Pour l'Italie la réalisation de l'aménagement du paysage est indispensable ou mieux encore, la planification du paysage pourrait être unifiée à l'aménagement urbanistique local, on créerait ainsi un lien qui n'existe pas. En outre, on propose que l'autorisation devienne exclusivement compétence de l'Etat. Il paesaggio è proiettato verso la qualificazione di vero e proprio diritto, anche fondamentale. Il lavoro continua con lo studio analitico di numerosi istituti che connotano la protezione nei due paesi. La Francia si caratterizza per un sistema che potremmo definire binario, uno dedicato alla generalità dei territori e l'altro alle numerose zone particolarmente sensibili. L'Italia presenta invece una certa omogeneità di protezione per tutti i territori presi in considerazione. Nel corso della tesi si effettua una comparazione dei due sistemi, pur tenendo conto delle evidenti differenze. Nelle conclusioni si sottolineano punti di forza e di debolezza e si prospetta qualche ipotesi di miglioramento dei due sistemi giuridici.

Abstract: In the Portuguese legal system, consumer rights are considered fundamental rights. According to the law, the Constitution's provisions with regard to rights, freedoms and guarantees are directly applicable to and binding on public and private persons and bodies. So the question is: can/should consumer rights listed in Article 60 of the Portuguese Constitution be thought to have direct horizontal effect? To answer this question, it is important to analyze whether this legal provision is enough to produce such effect and whether directly invoking the Constitution would, in fact, benefi t consumer protection.
Zusammenfassung: Im portugiesischen Rechtssystem werden Verbraucherrechte als Grundrechte angesehen. Auch sollen dem Gesetz nach die konstitutionellen Bestimmungen über die Rechte, Freiheiten und Gewährleistungen direkt anwendbar und bindend für öffentliche und private Personen und Körperschaften sein. So ist die Frage: Können/Sollen Verbraucherrechte, die in Artikel 60 der Portugiesischen Verfassung aufgelistet sind, so gesehen werden, dass sie eine direkte Horizontalwirkung haben? Um diese Frage zu beantworten, ist es wichtig, zu analysieren, ob diese echtliche Bestimmung genügt, eine solche Wirkung zu erzeugen, ob die direkte Berufung auf die Verfassung tatsächlich einen Vorteil für den Verbraucherschutz darstellt, und schließlich, ob das Fehlen einer Verfassungsbeschwerde ein Hindernis der Existenz von Direktwirkung von Rechten, Freiheiten und Gewährleistungen in rechtlichen Beziehungen zwischen Privaten darstellen würde.

Résumé: Dans le système juridique portugais, les droits des consommateurs sont considérés comme des droits fondamentaux. Aussi, conformément à la loi, les dispositions de la Constitution en ce qui concerne les droits, libertés et garanties sont directement applicable set s'imposent aux personnes et organismes publiques et privés. D'où la question suivante: les droits des consommateurs visés à l'article 60 de la Constitution portugaise peuvent–ils/ doivent–ils être considérés comme ayant un effet horizontal direct? Pour répondre à cette question, il est important d'analyzer si cette disposition légale est suffisante pour produire un tel effet, si l'invocation directe de la Constitution représenterait effectivement un avantage pour la protection des consommateurs, et, enfi n, si l'absence d'un recours individuel constitutionnel serait un obstacle à l'existence d'un effet direct des droits, libertés et garanties dans les relations juridiques privées.

Eine UNO-Arbeitsgruppe erarbeitet seit mehreren Jahren ein international verbindliches Abkommen zur Regulierung der Aktivitäten von Unternehmen in Bezug auf die Respektierung der Menschenrechte. Der am 6. August 2020 veröffentlichte dritte Entwurf wird aktuell von den Staaten und der Zivilgesellschaft diskutiert. Das SKMR hat im Auftrag des Bundes den neuen Entwurf analysiert und festgestellt, dass er gegenüber dem letzten Entwurf weder in konzeptioneller noch in inhaltlicher oder systematischer Hinsicht grundsätzliche Änderungen enthält. Vorgenommen wurden insbesondere zahlreiche Detailanpassungen. Diese führen dazu, dass sich der neue Entwurf stärker an die UNO-Leitprinzipien für Wirtschaft und Menschenrechte anlehnt und sich besser in das sonstige regulatorische Umfeld einfügt. Nach wie vor nicht geklärt ist, welchen grundsätzlichen Ansatz die Konvention verfolgt: Soll sie Umsetzungsaufträge an Staaten erteilen, oder will sie konkrete, unmittelbar anwendbare Normen einführen? So beinhaltet der Entwurf nicht nur bei den Haftungsvoraussetzungen, sondern auch in Bezug auf verfahrensrechtliche Fragen zahlreiche konkrete Bestimmungen. Für die weiteren Diskussionen wäre es hilfreich, diese konkreten Bestimmungen des Entwurfs von 2020 bzw. seines vermutlich 2021 erscheinenden Nachfolgers vertieft auf ihre grundsätzliche Vereinbarkeit mit der Schweizer Rechtslage und den für die Schweiz massgeblichen internationalen Instrumenten zu überprüfen. ; Un groupe de travail des Nations Unies travaille depuis plusieurs années en vue de l'élaboration d'une accord international contraignant pour réguler les activités des entreprises en ce qui concerne le respect des droits humains. Le troisième projet publié le 6 août 2020 est actuellement discuté par les États et la société civile. Après avoir analysé le nouveau projet sur mandat de la Confédération, le CSDH a constaté qu'il ne contient aucun changement fondamental par rapport au projet précédant, ni à l'égard de la conception, du contenu ou du système. Ce sont en particulier de nombreuses modifications de détail effectuées qui font que ce projet est plus étroitement aligné sur les principes directeurs des Nations Unies relatifs aux entreprises et aux droits humains. Ainsi il s'inscrit mieux dans l'environnement réglementaire déjà existant. Ce qui reste encore flou, c'est l'approche fondamentale suivie par la convention. En effet, est-ce que des mandats de mise en oeuvre seront délivrées aux États ou est-il plutôt question d'introduire des normes automatiquement applicables ? Toutefois, le projet contient de nombreuses dispositions concrètes, non seulement en ce qui concerne les exigences en matière de responsabilité, mais aussi en ce qui concerne les questions de procédure. Pour la suite des discussions, il serait donc utile d'examiner de plus près si les dispositions concrètes qui se trouvent dans le projet de 2020, respectivement dans le prochain probablement publié en 2021, sont compatibles avec la situation juridique suisse et les instruments internationaux pertinents pour la Suisse.

In this study the concept of surplus expenditures is introduced, and a theory of surplus expenditures is explored. The study examines the disposition of surplus revenues that emerged from the imposition of a binding tax and spending limit in Colorado. The study concludes that the accumulation of surplus revenue requires a major overhaul of budgetary reporting and decision making to reflect the impact of binding tax and spending limits on the budgetary process. The reporting recommendations are designed to make the budget more transparent and provide both taxpayers and legislators the information they need to make more rational decisions. The policy recommendations explore options for a more efficient and equitable disposition of surplus revenue.

Separate individual dispositions to action are not a sufficient condition for demonstrations. Organizational & institutional factors have an equal importance. Ultimately, a demonstration results from a power struggle between organizations to get individuals to support or defend their objectives. In the mobilization process, these organizations use control mechanisms & techniques to influence their members: exploitation of affective & instrumental ties binding individuals to the organization, access to & use of mass media, selective communication by the organizational leaders, & the induction of frustration. Trade also impacts global biodiversity, for instance through the 'virtual' water, land, and deforestation contained in EU imports. Economic theory shows that trade with countries that fail to protect a renewable resource can be detrimental for all. Protecting global biodiversity calls for a variety of instruments, at the EU border as well as in the provisions of preferential agreements. The EU already includes biodiversity-re lated non-trade provisions in trade agreements, but these provisions are not legally binding and hardly effective. This is partly explained by the complexity of the issues posed by biodiversity: since there is no simple synthetic indicator, policy instruments are difficult to enforce. However, an effort to specify measurable and verifiable commitments is needed; more binding mechanisms, along with transparent and automatic sanctions in case of non-compliance should be considered. ; Le commerce international a un impact direct sur la biodiversité de l'UE, comme l'illustrent les espèces invasives et les agents pathogènes importés. The EU already includes biodiversity-re lated non-trade provisions in trade agreements, but these provisions are not legally binding and hardly effective. This is partly explained by the complexity of the issues posed by biodiversity: since there is no simple synthetic indicator, policy instruments are difficult to enforce. Dioxin (2,3,7,8‐tetrachlorodibenzo‐p‐dioxin; TCDD), a widespread polychlorinated aromatic hydrocarbon, caused tumors in the liver and other sites when administered chronically to rats at doses as low as 0.01 μg/kg/day. It functions in combination with a cellular protein, theAh receptor, to alter gene regulation, and this resulting modulation of gene expression is believed to be obligatory for both dioxin toxicity and carcinogenicity. The U.S. EPA is reevaluating its dioxin risk assessment and, as part of this process, will be developing risk assessment approaches for chemicals, such as dioxin, whose toxicity is receptor‐mediated. This paper describes a receptor‐mediated physiologically based pharmacokinetic (PB‐PK) model for the tissue distribution and enzyme‐inducing properties of dioxin and discusses the potential role of these models in a biologically motivated risk assessment. In this model, ternary interactions among the Ah receptor, dioxin, and DNA binding sites lead to enhanced production of specific hepatic proteins. The model was used to examine the tissue disposition of dioxin and the induction of both a dioxin‐binding protein (presumably, cytochrome P4501A2), and cytochrome P4501A1. Tumor promotion correlated more closely with predicted induction of P4501A1 than with induction of hepatic binding proteins. Although increased induction of these proteins is not expected to be causally related to tumor formation, these physiological dosimetry and gene‐induction response models will be important for biologically motivated dioxin risk assessments in determining both target tissue dose of dioxin and gene products and in examining the relationship between these gene products and the cellular events more directly involved in tumor promotion.

The author contextualizes the Final Award issued on 29 June 2017 by the Permanent Court of Arbitration in The Hague on the Slovenian-Croatian border dispute, a dispute which began in 1991 when the two Yugoslav republics became independent states. After joining the European Union in 2004, Slovenia began to use its membership to attempt to force its neighbour to agree to its terms. In November 2009 the two countries signed an Arbitration Agreement that temporarily solved the problem. The Final Award of the Court of Arbitration in The Hague of June 2017 has not been acknowledged by Croatia, though, on the ground of an audio surveillance scandal in 2015 that involved a Slovenian arbitrator. The Slovenian side has advocated the Final Award of the Tribunal as the only legal, internationally binding, and "European" solution to the border question, while the Croatian side continues to ignore the tribunal's disposition.
