İkinci Dünya Savaşı'ndan sonra Avusturya'da, ırkçı partilerin ve sivil toplumkuruluşlarının faaliyet yürütmesi yasaklanmıştı. Günümüzde, aşırı sağın oylarını artırmasıve siyasette güç kazanmasıyla, faşizm ve Nazizm farklı şekilde tezahür etmektedir. İlkolarak 1999 seçimlerinde Avusturya Özgürlük Partisi'nin Nasyonal Sosyalist Parti'yedönüşmemesi için uluslararası toplum, baskı ve yaptırım tehdidi uygulamıştı. Neticede,baskılara dayanamayan aşırı sağ parti, hükümetten düşmek zorunda kalmıştı. Ekonomikkrizler, göç hareketleri ve terör olayları, korumacı eğilimlerin ve milliyetçi siyasidalganın yeniden yükselmesine neden olmaktadır. Avrupa'da aşırı sağın en güçlü olduğuülkelerden biri olan Avusturya'da aşırı sağ partileri zaman zaman iktidar ortağı olmaktave kademeli olarak oylarını artırmaktadır. Etki gücü artan aşırı sağın sadece popülistsöylemlerle yetinmediği, aynı zamanda, Avusturya'da ana akım siyaseti ve kurumlarıetkileyerek göçmenlerin haklarını kısıtlayıcı uygulamalara başladığı da görülmektedir.Başta hak ihlalleri olmak üzere göçmenlerin hayatını zorlaştırıcı uygulamalar artarakdevam etmekte, ancak ulusal ve uluslararası kamuoyunda bu duruma tepkiler cılızkalmaktadır. Bu çalışmada, Avusturya'da aşırı sağın popülist söylemlerinin yanında,göçmenlere yönelik hak ihlallerine ve kurumlara olan etkisi incelenecektir. Avusturya'daaşırı sağ ve merkez partilerin söylemleri, gündelik hayatta göçmenlerin yaşamlarınane derece yansımaktadır? Bu araştırma geçmişten bugüne göçmenlerin Avusturya'davarlığını sorgularken, diğer taraftan aşırı sağın yükselişi, tarihsel ve kuramsal perspektifle anlaşılmaya çalışılacaktır. Ayrıca, bu çalışmada, aşırı sağın yükselişindeki temelsebep-sonuç ilişkisini doğru biçimde anlayabilmek için dünyadaki sosyoekonomik gelişmelere bağlı olarak neo-liberalizm ve küreselleşme tartışmalarına da yer verilmiştir. ; After the Second World War, racist parties and non-governmental organizations were prohibited from operating in Austria. Today, fascism and Nazism are manifested differently, with the far-right increasing their vote and gaining power in politics. The international community first applied pressure and sanctions to prevent the Freedom Party of Austria from becoming the National Socialist Party in the 1999 elections. As a re-sult, the far-right party, unable to withstand the pressures, had to fall out of government. Economic crises, migratory movements and terrorist incidents lead to a resurgence of protectionist tendencies and the nationalist political wave. Far-right parties occasionally become partners in power and gradually increase their votes in Austria, which is one of the most powerful countries in Europe. It is argued that the far-right, whose influence is growing, is not only content with populist rhetoric, but has begun to restrict the freedoms of migrants by influencing mainstream politics and institutions in Austria. Practices that make the life of migrants difficult, especially the violations of rights, continue to increase, but reactions to this situation remain weak in the national and international public opinion. This study will examine the populist rhetoric of the far-right in Austria, as well as its impact on rights abuses against immigrants and institutions. To what extent do the rhetoric of far-right and centre parties in Austria reflect on the lives of migrants in everyday life? While this research questions the existence of immigrants from the past to the present in Austria, on the other hand, the rise of the far-right will be examined from a historical and theoretical perspective. In addition, this article discusses Neo-liberalism and globalization in relation to socioeconomic developments in the world in order to accurately understand the fundamental cause-and-effect relationship in the rise of the far-right.
AB vize politikası 1957 tarihli Kişilerin Serbest Dolaşımına ilişkin Anlaşma çerçevesinde Avrupa Konseyi üyesi ülkeler arasında visesiz seyahatin gerçekleşmesi ile başlamıştır. AB vize politikasının gelişimi ise Schengen Anlaşması, vize taşıması gereken üçüncü ülke vatandaşlarına ilişkin Avrupa Konseyi'nin 539/2001 Sayılı Vize Tüzüğü ve Avrupa Konseyi'nin 1683/95 Sayılı Tek Tip Vize Tüzüğü ile olmuştur. AB vize politikası ortak bir vize (Schengen Vizesi) uygulaması ile de entegrasyon seviyesine ulaşmıştır. Avrupa Konseyi bünyesinde oluşan 1957 tarihli Kişilerin Serbest Dolaşımına ilişkin Anlaşmaya Türkiye de taraftı. Hem Türkiye hem de Avrupa Topluluğu üyesi ülkeler 1957 tarihli Kişilerin Serbest Dolaşımına ilişkin Avrupa Konseyi Anlaşmasına taraf olduğundan, söz konusu Anlaşma çerçevesinde vizesiz seyahat uygulaması her iki tarafın vatandaşları için de geçerliydi. Bu bağlamda, 1980 tarihine kadar Türkiye ve AB arasında kişilerin serbest dolaşımı bulunmaktaydı. Buna karşın AB üyesi ülkeler söz konusu Anlaşmayı Türkiye'ye yönelik askıya alarak Türk vatandaşlarına karşı vize uygulamaya başlamışlardır. Bu bağlamda çalışmada Türk vatandaşlarının vizesiz seyahate ilişkin ortaklık hukukundan kaynaklanan hakları ele alınmakta ve AB'nin Türk vatandaşlarına yönelik uygulamalarının ortaklık hukukuna aykırı olduğu savunulmaktadır. Bununla birlikte, çalımada vize konusu üzerinden Türkiye-AB ilişkileri ele alınarak AB'nin olumsuz tutumunun Türkiye'nin üyelik sürecine etkisi sorgulanmaktadır. Bu anlamda çalışmada, AB'nin olumsuz tutumuna karşı Türkiye'nin tercih edebileceği alternatif politika önerileri değerlendirilmektedir. ; European Union's visa policy started with abolution of visa requirements between the member states of the Council of Europe within the framework of the Council of Europe Agreement on Free Movement of Persons in 1957. The development of the European Union's visa policy has been with Council Regulation (EC) No 1683/95 of laying down a uniform format for visas, Council Regulation (EC) No 539/2001 of listing the third countries whose nationals must be in possession of visas and Schengen Agreement. In addition to this, European Union's visa policy with a common visa (Schengen Visa) has reached the level of integration. Turkey also was bound to the Council of Europe Agreement in 1957 governing Free Movement of Persons between Member States of the Council of Europe. Because both Turkey and the member states of European Community were parties to the Council of Europe Agreement on Free Movement of Persons in 1957, visa free travel application within the framework the agreement was valid for nationals of each sides. In this context, there was free movement of persons between Turkey and the EU until 1980. However the member states of European Union suspended the application of the agreement with regard to nationals of Turkey. In this context, in the study are examined the rights of Turkish nationals arising from Additional Protocol providing rules on the implementation of the Ankara Agreement relating to visa-free travel and are argued that EU's practices against Turkish nationals are contrary to association law. In addition to this, in the study are examined EU and Turkey relations relating to visa issues and are questioned to effect on Turkey's EU accession negotiations of the EU's negative attitude. In the study are evaluated the alternative policy recommendations Turkey might prefer against the EU's negative attitude.
Bu tez çalışmasında, 1950'lerden itibaren ABD'de başlayan ve ardından Avrupa'da benzer uygulamalarının gözlemlendiği "Amerikanvari" siyasal seçim kampanyalarının, Türk siyasi yaşamındaki izleri araştırılmaktadır. Türkiye'de çok partili siyasal sisteme geçilmesinin getirdiği rekabet ortamıyla birlikte, siyasetin değişim ve dönüşümü "Politainment" (eğlenceli siyaset) kavramı ile açıklanmaya çalışılmaktadır. Türkiye'de toplumun her katmanında kitle iletişim araçları vasıtasıyla ortak bir arzu nesnesi haline gelen eğlence arayışının siyasi arenadaki rolünün giderek arttığı savının ispatı amaçlanmaktadır. Türkiye'de ABD'de olduğu gibi siyasal seçim kampanyalarının profesyonellere devredilmesinin ilk örneğine, tarihe "Mor Afiş Kampanyası" olarak geçen, Cenajans tarafından 1977 genel seçimleri için hazırlanan Adalet Partisi kampanyasında rastlanmaktadır. 1983 genel seçimlerinden itibaren Amerikanvari siyasal seçim kampanyalarının özellikleri, neredeyse birebir adapte edilmek sureti ile Türk siyasal seçim kampanyalarında da uygulanmaya başlandığı gözlemlenmektedir. Bu çerçevede hazırlanan tez üç bölümden oluşmaktadır. Birinci bölümde iletişim ve siyaset kavramlarının arka planı, ikinci bölümde eğlence içerikli siyasal seçim kampanyalarının niteliklerinin kuramsal ve kavramsal boyutları değerlendirilmektedir. Üçüncü bölümde ise, Türkiye'de siyasal iletişimin gelişimi ve siyasal seçim kampanyaları sonucu TBMM'de temsil hakkı kazanan siyasal partilerin kampanya örneklerine geniş bir literatür taraması ile yer verilmektedir. Elde edilen bulgular doğrultusunda, Türkiye'de 1977'den itibaren kitle iletişim araçları vasıtasıyla kamuoyuna seslenen siyasilerin, eğlence enstrümanlarını siyasal seçim kampanyalarına dahil ettikleri, kampanyaların profesyonellerce yönetildiği, kampanya süreçlerinin bir meta değeri taşır nitelikte alınıp satılabildiği saptanmıştır. ; This thesisis comprised of a comprehensive study regarding the effects on Turkish political life of the "American style" political campaigns which started in the 1950's and subsequently the similar types of campaigns that also spread throughout Europe. It intends to clarify the changes observed in Turkish political life as a consequence of the competitive environment created upon transition to a multi-party system, in correlation with "Politainment" (a concept that refers to politics combined with entertainment). It also aims to verify the argument that the political role of the pursuit for entertainment, which became a collective requirement through mass media at all levels of the Turkish community, has shown to be a trend that continues to strengthen. The transferring of control of political election campaigns to professionals, as practiced in the USA, was first observed in Turkey at a Justice Party campaign which went down in history as the "Purple Poster Campaign" prepared by Cenajans for the 1977 general elections. Starting with the 1983 general elections, it was observed that the Turkish political campaigns adopted exactly the same type of campaigns implemented in the USA. This thesis consists of three sections. The first section elaborates the background of "communication" and "politics"; and the second section evaluates theoretical and conceptual aspects of American-style campaigns. The third section studies the development of political communication in Turkey and presents sample cases of campaigns made by political parties which have been granted the right to represent the Grand National Assembly of Turkey as a result of their political election campaigns. According to the findings, it was determined that the politicians addressing public opinion through mass media have introduced instruments of entertainment into Turkish political campaigns since 1977; the campaigns are carried out by professionals; and the campaign processes can be bought and sold as they were commodities with specific values placed on them.
Over a long history, the city of Edirne has been developing as an important settlementcentre due to its geopolitical location. The importance of Edirne increased especially after it wasconquered by the Ottoman Turks and served as the capital city of the Ottoman Empire for a long periodof time. It is a city of a peculiar character and identity with its many monuments and samples of civilarchitecture. Kaleiçi, as the first settlement nucleus of Edirne, has still many historic houses which couldmanage to survive, reflecting the social and cultural life of the city around the end of 18th and beginningof the 19th centuries. This makes Kaleiçi even more important as a historic settlement unit shedding lightonthe physical and socio-cultural structure and hence contributing to the further development of Edirne.During a detailed study of determination and documentation, there have been 214 historic houseidentified. There are a lot of similarities between the historic Kaleiçi houses and the traditional Turkishhouses as they both have internal halls.It is key to include these houses in our daily life by renovatingthem to satisfy the needs of the contemporary life. This would also ensure that the cultural continuity issustained and transferred to the next generations. Kaleiçi was consist of many historic houses untilaround mid 1970s but has started to lose its peculiar character and identity owing to construction ofmany multi-storey apartments as a result of wrong council decisions, applications serving to speculative purposes. Unconscious and indifferent approach against the historic houses and structures were theother causes of this tragic result. The purpose of the study that was made on Kaleiçi houses which weregenerally designed to serve the minorities in the community, was to research on the detailedcharacteristics and to provide data and a sort of design guide for the new structures to be built in thisarea. A particular endeavour was also made, during this study, to determine the details of design andfrontal structure of these historic houses. ; Edirne kenti tarihsel gelişimi boyunca jeopolitik konumu nedeniyle önemli bir yerleşim merkeziolarak gelişimini sürdürmüştür. Özellikle Türkler tarafından alınmasıyla önemi artmış, uzun yıllarOsmanlı İmparatorluğuʹna başkentlik yapmış, çok sayıdaki anıt ve sivil mimarlık örneği yapıları ilekendine has tarihi dokusunu ve kimliğini oluşturmuş bir kenttir. Edirneʹnin ilk yerleşim çekirdeğinioluşturan Kaleiçiʹnde günümüzde ayakta kalmayı başarmış 18.yy. sonu ve 19.yy. başlarına ilişkin kentinsosyal ve kültürel yaşamının göstergesi olan çok sayıda tarihi konut yer almaktadır. Kaleiçi bu yönüylekentin geçmişteki fiziksel ve sosyo-kültürel yapısına, gelişmesine ışık tutacak bir yerleşim birimidir.Kaleiçi yerleşim biriminde yapılan detaylı bir saptama ve belgeleme çalışmasında 214 tarihi konut tespitedilmiştir. Geleneksel Türk konutu iç sofalı plan tipi ile benzerlikler gösteren tarihi Kaleiçi konutları,kültürel süreklilik açısından gelecek kuşaklara aktarılmaları gereğindeki önemi dikkate alınarak,günümüz yaşam koşullarında, kullanıcı gereksinimlerini karşılayacak biçimde yenilenme olanaklarınınsağlanması ve uygun fonksiyonlarla günlük hayata katılmaları gerekmektedir. 1970'li yıllara değinçoğunluğu tarihi konutlardan oluşan yerleşim, bu yıllardan sonra alınan yanlış kararlar, uygulamalar,tarihi konutlara karşı ilgisizlik, bilinçsizlik ve tamamen spekülatif amaçlara hizmet eden katlıyapılaşmanın getirdiği çirkin görüntü sonucu giderek özgün dokusunu yitirmeye başlamıştır.Çoğunlukla kentte yaşayan azınlıklar için tasarlanan bu konutlarda yapılan saptama ve belgelemeçalışmalarıyla; hem konutların tanıtımına yönelik, hem de bu alanda yapılacak yeni yapılara verioluşturacak özelliklerinin irdelenmesi ve bir tasarım rehberi niteliğine dönüştürülmesi amaçlanmıştır.Bu amaçla ele alınan çalışmada, yerleşme alanı içinde yer alan tarihi konutların tasarım ve cepheayrıntıları saptanılmaya çalışılmıştır.
ÖZETII. Dünya Savaşı sonrasında oluşan iki kutuplu sistem içerisinde hem varlığını korumak hem de oluşan gıda sorununa çözüm bulabilmek için Batı Avrupa devletleri aşamalı entegrasyon sürecine girmiştir. Avrupa Kömür Çelik Topluluğu'nun Kurulmasından sonra 1957 yılında Roma Antlaşması Ortak Tarım Politikası'nın genel hatları çizilmiştir. 1962 yılında Ortak Piyasa Düzeni uygulamasının başlaması ile Ortak Tarım Politikası uygulanmaya başlanmıştır. Bu yıllarda Avrupa Tarımsal Yönlendirme ve Garanti Fonu ile Ortak Tarım Politikası'nın finansmanı sağlanmıştır. 1980 yılların başlarında Ortak Tarım Politikası Topluluğun genişlemesi, ekonomik ve sosyal değişimden ötürü reform hareketlerine başlanmıştır.1957 yılında Türkiye, Avrupa Topluluğu'na üyelik için başvurmuş, 12 Eylül 1963 yılında da Ankara Antlaşması ile aday adaylığı üyelik statüsüne girmiştir. İşbu antlaşma ile tespit edilen nihai aşamaya 1996 yılında geçilmiştir. Türkiye bu süreçte Avrupa Topluluğu'na uyumunu çeşitli reform hareketleri gerçekleştirmiş ve günümüzde de bu reform hareketleri süregitmektedir. Türkiye-Avrupa Topluluğu ile tarım ilişkisi tercihli ticaret rejimine dayanmaktadır. Ayrıca sadece sanayi ve işlenmiş tarım ürünleri, Gümrük Birliği kapsamında yer almaktadır. Bütün tarım ürünlerini Birlik kapsamında yer almaması doğal olarak Türkiye tarım sektörü için önemli sorunları yaratmaktadır. Türkiye'nin tarımsal alt yapı sorunları çok iyi tespit edip çözümler üretmesi ile ancak Birliğe tam üyeliği gerçekleşebilir. Son olarak; Türkiye tam üye olmadan Ortak Tarım Politikası kapsamında yer almaması gerekir. Aksi takdirde finansman sorunları ile yüzyüze gelecektir ve başarılı olamayacaktır. ABSTRACTThe Western European Nations, in the bipolar system that formed after the 2nd World War, entered into a step by step integration period for both protecting their existence and to find a solution for the food deficiency. After the establishment of the European Cool and Steel Community in 1957, the basic points of the Common Agriculture Policy was decided by the Rome Treaty, end this policy was started to be applied by the Common Market System in 1962. In these years, the finance of this system was provided by the European Agricultural Guidance and Guarantee Fund. In the beginning of the 1980s, The Common Agriculture Policy has started to have reform movements, because of the social and economic developments in both the European Union and the whole world.In 1957, Turkey has applied for membership to the Union and on 12 September 1963, it was recognized as a candidate for being candidate by the Ankara Treaty. Turkey could reach the final situation that was pointed at this treaty in 1996 (Customs Union), en it has achieved in many social and economic reforms for integration to the Union, and it was going on its studies for the final integration. The relationship between European Union and Turkey about agriculture is based on the "Preferred Trade Regime", but we have to point out that only the ready to use agricultural and industrial products were involved in the Customs Union, all the agricultural products were not involved in the Customs Union and this causes serious problems for the Turkish Agriculture Sector, but we have to remember that Turkey has to clarify its problems well end try to find good solutions to achieve in the integration period to the European Union.As a last point, Turkey shouldn't agree the Common Agricultural Policy before being a member of the Union otherwise it will cause finance problems for Turkey and it can not be successful in the system.
Uluslararası sistemde temel örgütlenme birimi olarak kabul edilen ulus devlet sistemi Ortaçağ döneminde Avrupa'dan tüm dünyaya yayılarak gelen bir yapıya karşılık gelmektedir. Bu yapının 1648 Westphalia Antlaşmasından başlayarak bir dizi siyasi, ekonomik ve sosyal gelişmeler sonucunda özellikle Fransız İhtilali sonrasında tüm dünyaya yayıldığı ve uluslararası politikada hakim siyasal örgütlenme biçimi olduğu kabul görmektedir. Modern devlet sistemi olarak adlandırılan bu yapıda tüm devletlerin sınırları belirli bir toprak parçası üzerinde vatandaşları üzerinde son sözü söyleme yetkisine sahip oldukları ve meşru güç kullanma tekelini elinde bulundurdukları genel kabul gören bir anlayıştır. Söz konusu bu modern devlet sistemi tüm devletlerin aynı özelliklere sahip olduğu veya olması gerektiği ön kabulüne dayanmaktadır. Tüm ulus devletlerin benzer gelişmeler neticesinde kurulduğunu öngören bu yaklaşım sistemde var olan tüm devletlerin bazı asgari standartlara sahip olduğunu ve standart kalıplar içinde var olduklarını ifade etmektedir. Bir başka deyişle modern ulus devlet modeli esasında tek tip ve standart bir devlet modeli öngörmektedir. Oysaki ulus devlet sistemi Avrupa dışındaki bölgelerde Avrupa'da yaşanan sürece benzer bir gelişim süreci göstermemiştir. Bu nedenle dünyanın birçok bölgesinde ortaya çıkan ulus devlet modelleri bir ulus devlette olması gereken şartları taşımadan ortaya çıkarak varlıklarını sürdürmektedirler. Özellikle Birleşmiş Milletler Sisteminin kurulmasının ardından bağımsızlıklarını kazanan birçok eski sömürge devleti bir ulus devlette olması gereken asgari standartlara sahip olmadan devletleşme sürecine girmişlerdir. Bu devletler hukuki olarak uluslararası toplum tarafından ulus devlet formunda kabul edilmiş olmalarına rağmen fiili olarak bir ulus devlette olması gereken özelliklere sahip olamadıkları için standart bir ulus devlette olması gereken işlevleri yerine getiremedikleri görülmektedir. Gelinen noktada bu tür devletler başarısız olarak adlandırılarak diğer devletlerden olumsuz olarak ayrışmaktadırlar. ii Bu durum bu devletlerin başarısız ve uluslararası sistemin hatalı veya bozuk parçaları olarak görülmelerine neden olmaktadır. Çünkü bu devletler vatandaşlarına diğer başarılı devletlerin sağladığı güvenlik, sağlık, eğitim gibi temel hizmetleri sağlayamadıkları gibi ülke içinde yaşadıkları silahlı çatışmalar nedeniyle gerek komşuları gerekse küresel sistem için kitlesel göçler, salgın hastalıklar, küresel terörizm gibi birçok soruna neden olmaktadır. Bu çalışma uluslararası politikada başarısız devlet sorununa odaklanarak başarısız devletselliğe neden olan unsurları tartışmaya açmaktadır. Bu noktada çalışmanın ortaya koyduğu tez; başarısız devletselliğin başarısız devletlerin kendilerinden kaynaklanan bir sorun olmasının yanında bu durumun aynı zamanda küresel kapitalist sistem ve sömürge devletlerinin uyguladıkları yanlış politikalardan kaynaklanmasıdır. Bu açıdan çalışma öncelikli olarak modern ulus devletin oluşum süreci ve unsurlarını inceledikten sonra başarısız devletlerin temel özelliklerini ortaya koyarak bu duruma neden olan sebepleri incelemeyi amaçlamaktadır. Ayrıca başarısız devletlerin neden olduğu uluslararası sorunlara dikkat çekerek bu sorunun çözümü için yeni yaklaşımlara ihtiyaç olduğunu vurgulamaya çalışmaktadır. ; The nation state system, which is accepted as the basic organization unit in the international system, corresponds to a structure that has spread from Europe to the whole world starting from in the middle ages. It is accepted that this structure has spread all over the world especially after the French Revolution as a result of a series of political, economic and social developments starting from the 1648 Treaty of Westphalia. It is a dominant form of political organization in today's international politics. In this structure, which is called the modern state system, it is generally accepted that all states have the authority to say the last word on the territory of a certain territory and hold the monopoly of using legitimate power. This modern state system is based on the assumption that all states have or must have the same characteristics. This approach, which envisages that all nationstates are established as a result of similar developments; states that all the states in the system have some minimum standards and exist within standardized patterns. In other words, the modern nation-state model provides a uniform and standardized state model. However, the nation-state system has not shown a similar development process in the regions outside Europe. Therefore the nation-state models that emerged in many parts of the world continue to exist without having to meet the requirements of a nation-state. Especially after the establishment of the United Nations System, many former colonial states, which gained their independence, entered the process of state building process without having the minimum standards required in a nation state. Although these states were legally accepted by the international community in the form of nation-state, they cannot fulfill the functions they should have in a standardized nation-state because they do not actually have the characteristics that should be in a nation-state. At this point, such states are considered to be unsuccessful and they are negatively differentiated from other states. This causes these states to fail and be seen as faulty or damaged parts of the international system. Because these states do not provide basic services to their iv citizens like other successful states, such as security, health and education and also they cause many problems such as mass immigration, epidemics, global terrorism for both the neighbors and the global system due to the armed conflicts in the country. This study focuses on the problem of the failed state in international politics and discusses the factors causing failed statehood. At this point, the thesis of the study; Besides the fact that the failed statehood is a problem arising from the failed states themselves, this is also due to the false policies implemented by the global capitalist system and the colonial states. In this respect, the study primarily aims to examine the main features of the failed states after examining the formation process and elements of the modern nation-state and to examine the reasons that cause this situation. It also tries to emphasize the need for new approaches to solve this problem by drawing attention to the international problems caused by the failed states. Son iki yüzyılını "gerileme-savaş-gerilemeye karşı mücadele-modernleşme çabaları- modernleşmeye karşı çıkanlar–demokratik açılım–baskı–yeniden açılım" sarmalında geçiren 621 yıllık büyük bir İmparatorluğun bakiyesi olan Türkiye'de örgütlü sivil toplum, Cumhuriyet döneminde özellikle çok partili sisteme geçişle birlikte, siyasette etkin olma çabası içerisinde olmuştur. 1960'lardan en son 15 Temmuz 2016'ya kadar yaklaşık her 10 yılda bir darbe, muhtıra, darbe girişimi altında kalınması Sivil Toplum Örgütlerinin gelişimini yavaşlatsa da, durduramamıştır. İş dünyasının örgütlenmesi ile ilgili Cumhuriyet dönemi gelişmeleri de benzer bir seyir izlemiştir. Odalar, borsalar, birlikler, vakıflar vb. örgütlenmelerin üzerine 1950'lerde ilaç ve müteahhitlik sektörlerinde kurulan Dernekler ile başlayan sektörel örgütleşme çabaları, Türkiye'de ve Dünya'da yaşanan ekonomik gelişmelere bağlı gelişmiştir. Kuruluştaki adıyla, Avrupa Ekonomik Topluluğu ile ilişkiler ve petrole bağımlılık, yeni kentleşme, tarım ve gıdaya bağlı ekonomiden, sanayi ve hizmet sektörlerine geçiş, sektörel derneklerin kuruluşunu da beraberinde getirmiştir. Birlikte hareket ederek gücünü ve etkinliğini artırmak, siyasal ve ekonomik hayatta üyeleri adına kazanımlar elde etmek sektörel derneklerin en temel kuruluş amacıdır. Bunu sağlamanın yolu da kuşkusuz, baskı grubu olarak, mevzuatı ihtiyaçları doğrultusunda düzenletebilmekten geçmektedir. Tezimin amacı, genelde iş örgütlerinin, özelde sektörel derneklerin bu yöndeki etkilerini ortaya çıkarmaktır. Derneklerin yapısından talep ettikleri düzenlemelere, taleplerin iletiliş şeklinden yöntemine, taleplerinin gerçekleşme düzeyine, siyasal güç ile ilişkilerine pek çok konu mercek altına alınacaktır.Türkiye ekonomisinin kalbi olarak milli hasılanın ¼'ten fazlasını, dış ticaretin yarısına sahip İstanbul merkezli gerçekleştirilen ve iş dünyasının etkin pek çok iş dünyası örgütü yöneticisi ile yapılan görüşmeler ve bir dernek yöneticisi olarak bizzat yaşadığım deneyimler de literatürün üzerine tezin şekillenmesini sağlayacaktır. --- Organised Civil Society has always been in a struggle for achieving a place in policy making, especially after the establishment of multi party system of the Republic of Turkey, which is the follower of a great empire of 621 years, of which last 2 centuries face the vicious circle of, "decline in all areas-battles-modernisation efforts to stop decline- resistance to modernisation – democratic initiatives – pressure of the monarchs" and so on. The interruptions of democracy starting in 1960 till 15 July 2016, with almost every decade repeating coup detats or coup attempts could not stop, but slow down the progress of organised sivil society movement. Same path has been followed by the business society organizations during the republican period. In addition to the newly established chambers, unions, foundations, etc,, sectoral differentiation efforts in organizations which started in 1950's with the associations founded in pharmaceuticals and construction sectors moved in parallel with the developments in Turkey's and World economy. Relations with the then called European Economic Community, dependency on petroleum, emerging urbanization, shifting economy to industry and services from agriculture and foodstuffs etc. has all brought new associations. Increasing power and efficiency by collective activity and achieving political and economic gains on behalf of their members, is the basic underlying target of existence. The best way to reach this aim, is definitely be possible by having the legislation designed according to their will. The purpose of my thesis is to reveal out the efficieny of the business civil societies in general and associations in particular. This study focuses on many subjects varying from the structure of associations, to the matters demanded, from the form of submission, to the method of submission, as well as the realization of demanded matters and the relations with the ruling authority.Istanbul, the heart of Turkey's economy, is chosen as the field of this study because of representing more than a quarter of national production and half of foreign trade. Interviews with various outsstanding associations, in addition to Chambers of Trade and Commodity Exchange, as well as my personal expreience as an association Secretary General has shaped this thesis.

Modernleşmek, ayrıca din ve devlet işlerinin birbirinden ayrılması ve laik yönetim anlayışının uygulanmasını gerektirir. Avrupalılaşma, "aydınlanma" anlamına gelmemektedir. Avrupalılaşma, bu çalışma kapsamında, Avrupa yaşam standartlarını, Avrupa hukukunu, Avrupa'nın demokratikleşme düzeyini, Avrupa alt yapısını, rasyonel dış politika düşüncelerini, istihdam politikalarını ve insan haklarını kendi iç politikalarımız haline getirmemiz anlamına gelmektedir. Türkiye, bölgesel bütünleşme hareketleri içinde en başarılı olan Avrupa topluluğu doğrultusunda, tercihini 1963 yılında imzalanan Ankara Antlaşması ile AB'den yana yapmıştır. AB'ye olan coğrafi yakınlık, dış ticaretin büyük bir kısmının AB ile yapılması bu tercihin nedenleri arasında sayılabilir; ancak en önemli neden AB'nin batılı anlamda modernleşmenin merkezi oluşudur. Nihai hedefi tam üyelik olarak belirleyen, Türkiye, 1963'de yürürlüğe giren Ortaklık Anlaşması daha sonra 1994'de Gümrük Birliği anlaşmasının imzalanması ile tam üyeliğe doğru yol almaktadır. Yapılan anlaşma 3 dönemden oluşmaktadır. AB açısından, Gümrük Birliği, kurumsal temelinin bir parçasını oluştururken, Türkiye için ise uluslararası alanda rekabet gücünü artıran ve dünya ticaretini teşvik eden, ülke mevzuatının önemli bir bölümünü AB mevzuatı ile uyumlaştıran bir çerçeve olarak hizmet vermektedir. Ortaklık ilişkisi, bu süreçte gelişirken Türkiye 1987 yılında Tam üyelik başvurusu yapmış ve 1999 Helsinki zirvesinde aday ülke olarak tanınmıştır. 3 Ekim 2005 tarihinde ise üyelik için en önemli adım olan Katılım Müzakereleri başlamıştır. Bu çalışmada, Gümrük Birliği ve Tam üyelik görüşmelerinin Türkiye'nin Avrupa Birliği uyum sürecine katkısı incelenecektir. Bu incelemeyi yapabilmek için, Birinci bölümde; Türkiye Avrupa Birliği ilişkilerinin tarihçesi ve Avrupalılaşmanın ne olduğu ve neden hedeflenildiği anlatılacaktır. İkinci bölümde ise; Gümrük Birliğinin Türkiye'nin Avrupalılaşmasına katkısı, Üçüncü bölümde ;Avrupalılaşma süresince Türkiye'nin AB müktesabatına uyumu ve Dördüncü bölümde; Türkiye'nin Avrupalılaşmasında siyasal, sosyal ve kültürel boyutu ele alınıp incelenecek ve irdelenecektir. ; Europeanization is emphasized with modernization. Separation of the religion and the government comes with modernization and it also brings the secular management system. Europeanized means: `to become luminous'. In this study, Europeanization mean to have the life standards of Europe, to have the law system of Europe, to have the level of Democracy in Europe, to have the infrastructure of Europe, to have the rational foreign policy ideas of Europe, to have the fortification politics of Europe, and to have the human rights policy of Europe and turn them all into our own political system. Within the most successful regional totalitarian movements, being part of European Union has been the choice of Turkey with the 1963 Agreement of Ankara. There are several reasons for the choice of Turkey to want to be part of European Union. Some of which are; the geographical advantages of the closeness of Turkey to Europe, most of the export businesses are done within Turkey and Europe and if you compare the European Union with other Unions in different part of the world, EU is the most well known Union. Moreover, the most important reason for Turkey to want to be part of European Union is because Europe is the center of western modernization. The Partnership Agreement that came into effect in 1973 determines as the final target of Customs Union Agreement between Turkey and European Economic Community. The purpose of the agreement forms in 3 different terms. For the European Union, Customs Union is the foundation of corporate. For Turkey, in the international arena, Customs Union triggers the competition power, it encourages the world trade and it also serves as the body of current law of Turkey that brings a harmonize frame with the body of current law of European Union. During development of the partnership, in 1987, Turkey applied for the full membership for the European Union. In 1999, Helsinki Summit Turkey was well-known as a candidate. In October 3rd 2005, the most important step for the membership, consultation of participation has started. In this study, Customs Union and full membership negotiations and how this can be for the benefit of Turkey's harmonization process will be examined. In this study: the first part examines and inspects the history of Turkey and European Union relations and what is to be Europeanized and why this is a target for Turkey; The second part examines and inspects the impact of the Customs Union over Turkey's target towards Europeanization; The third part examines and inspects the Turkey's adjustment during the Europeanization process.; finally the fourth part of the study examines and inspects Turkey's diplomatic, social, and cultural dimensions.

The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.
YÖK Tez No: 417554 ; Küreselleşme, "yerelleşme" ve "kentleşme "gibi birbiri ile yakından ilgili ve ilişkili üç kavramın, birbirlerini ve aslında her şeyi az veya çok bir şekilde etkilediği ve belirlediği günümüz dünyasında, devletleri ve dolayısı ile yapısal anlamda devletlerin örgütsel yapısını ifade eden kamu yönetim sistemlerini etkilememesi olanaksızdır. Bilindiği üzere, kamu yönetim sistemlerinin toplumun gereksinimlerini karşılayan etkin bir araç durumuna dönüştürülebilmelerinin başlıca koşullarından birisi, söz konusu bu sistemlerin gelişen ve değişen koşullara ayak uydurmasını sağlayacak şekilde ve sürekli bir biçimde yenilenerek geliştirilmesidir. Fakat Türkiye'de 2004 yılına kadar yapılan ve "yeniden düzenleme", "yeniden yapılanma" veya "idari reform" gibi farklı kavramlarla ifade edilen "idarede reform çalışmaları" dar ve kısa vadeli bir bakış açısı ile yapılmış olup, sistemin daha geniş ve daha uzun vadeli bir bakış açısı ile ele alınması ise ancak bu tarihten sonra mümkün olmuştur. "Vizyon" olarak da isimlendirilen bu yeni ve farklı bakış açısı ile hazırlanan "2023 Türkiye Vizyonu" kapsamında başlatılan idari reform çalışmaları ise Türk idari ve siyasi hayatını büyük ölçüde etkilemiştir. Çünkü söz konusu bu reformlar sonucunda «Kocaeli Modeli» ismi ile bilinen yeni bir yerel yönetim modeli Türk siyasi ve idari hayatına girmiştir. Kamuoyunca da bir yerel yönetim reformu olarak bilinen ve on yıl süre ile İstanbul ile birlikte Kocaeli ilinde de uygulandıktan sonra yirmi sekiz büyükşehirde daha uygulanmaya başlayan bu yeni yerel yönetim modeli aslında, Türk Devlet geleneğinde ve devletin görev ile sorumluluklarının dayanağı olan devlet felsefesinde köklü değişikliklere neden olacak bir reform çalışması niteliğine sahip bir çalışma olmuştur. Bu tez çalışmasının ana temasını, Kocaeli Modeli olarak adlandırılan ve yakın bir gelecekte ülkenin tamamında uygulanması beklenen söz konusu bu yerel yönetim modelinin sadece geleneksel yerel yönetim anlayışını ve yapısını değiştirmekle kalmayıp, Türk idari yapısının geleneksel yönetim felsefesini ve genel yönetim yapısını da etkileyeceği ve değişime zorlayacağı iddiaları oluşturmuştur. Ayrıca, bu model için İstanbul ve Kocaeli illerinin seçilmesinin nedenleri ile Türk yerel yönetim geleneğinin halen oluşamaması gibi daha birçok konu da bu çalışmada ana tema ile ilişkili olacak bir biçimde ele alınmaya çalışılmıştır. Neticede ise köklü bir yerel yönetim geleneği bulunmamasına rağmen oldukça uzun sayılabilecek bir süre örgütlenme tecrübesine ve bunun sonucunda ise merkeziyetçi bir yönetim geleneğine ve buna uygun bir örgüt yapısına sahip olan Türk Devletinin bu yapısının, söz konusu bu reform çalışmalarından genel olarak olumsuz etkilendiği/etkileneceği görülmüştür. "Vision" also called and prepared with different perspectives of this new "Vision 2023 Turkey" administrative reform efforts initiated under Turkish administrative and political life is influenced to a great extent. As a result of these reforms , because these « Kocaeli Model » known by the name of a new local government model has entered the Turkish political and administrative life.Publicized in local government, known as the reform and ten years with then applied in Kocaeli with Istanbul that began to be applied more in the twenty-eight metropolitan new local government model in fact, the philosophy of the Turkish state tradition and the government which is the mainstay of the state's duties and responsibilities will lead to fundamental changes has been working with a reform of qualifications. The main theme of this thesis, Kocaeli Model, which is expected to be applied throughout the country and in the near future this question will not only change the structure of local governance and local traditional management model,but also Turkish administrative structure that will force to change and affect the structure and general management philosophy traditional management of claims constituted. Also, reasons for the selection of this model for the provinces of Kocaeli and İstanbul with The Turkish tradition of local Government still not occur as many more that will be associated with the main theme in the study in a way that tried to be addressed. After all, although there is not a deeply rooted tradition of a local government, the Organization for quite a lengthy time of experience and as a result, the tradition of a centralized management structure and the organizational structure of the Turkish state appropriately, which has overall negative influencers that would be affected by the reform in question was observed.

Anlaşmazlık, birbirine zıt veya düşmanca bir durum ya da bir mücadele veya kavga olarak tanımlanır. Bir uyuşmazlık, dava konusu olabilen meseleler şeklinde ortaya çıkan bir anlaşmazlık çeşidi olarak görülebilir. Bu konferansta, uyuşmazlık çözümündeki alternatif usûllerin, özellikle arabuluculuk ve tahkimin, tıkanmış halde bulunan mah-kemeleri rahatlatacağı, uyuşmazlıkların çözüm süresini kısaltacağı ve giderlerini asgariye indireceği sonucuna varılmıştır. Arabuluculuk hizmeti sunan mahalli adalet merkezlerinin ve çok seçenekli mahkeme teşkilatı programlarının kurulması teşvik edilmiştir. Çok seçenekli mahkeme teşkilatı terimi (ya da çok seçenekli ADR), bir dizi seçimlik uyuşmazlık çözüm usûlü sunan mahkemeleri ifade eder. Bu programlar, ihtilaflı tarafları, onlar için en uygun olan uyuşmazlık çözüm yöntemine yönlendirirler. Bunlar: Kolaylaştırma, arabuluculuk veya tahkimdir. Bazı çok seçenekli mahkeme teşkilatı prog-ramları belli türdeki bütün davaları belirli bir ADR programına havale et-mekteyken, diğer bazı programlar davacılara seçimlik bir liste sunmaktadırlar. ADR, uyuşmazlık çözümü için mahkemeler vasıtasıyla yürütülen davalarda alternatif olarak işleyen, genellikle tarafsız bir üçüncü kişinin aracılığı ve yardımını içeren bir dizi usûller olarak tanımlanır. Doktrine göre ADR usûlleri aşağıdaki yararları içerebilir: 1. Mahkemelerin iş yükünü ve giderlerini azaltmak, 2. tarafların yargılama için harcadıkları giderleri ve zamanı azaltmak, 3. topluluklara veya tarafların ailelerine zarar veren uyuşmazlıkların hızlı bir şekilde çözümünü sağlamak, 4. bireylerin adalet sisteminden daha iyi bir şekilde tatmin olmasını sağlamak, 5. tarafların ihtiyaçlarına uygun olan çözümleri teşvik etmek, 6. tarafların uyuşmazlık çözüm usûllerine gönüllü olarak uymalarını sağlamak, 7. komşuluk ve topluluk değerlerini ve toplulukların ilişkilerini onarmak, 8. ihtilaflı taraflarca ulaşılabilecek usûller oluşturmak, 9. halka, uyuşmazlıkların çözümünde ihlâl ya da dava yolu yerine daha etkili olan usûlleri denemelerini öğretmek, ADR tarafların bir araya getirilmesinde pek çok farklı yöntem gerektirir; bununla birlikte temel ADR usûlleri arabuluculuk ve müzakeredir. Arabuluculuk ve uzlaştırma terimleri eş anlamlı olarak kullanılırlar. Arabuluculuk (veya uzlaştırma), tarafların bir anlaşmayı müzakere etmeleri için onlara yardım eden tarafsız bir üçüncü kişice gerçekleştirilen bağlayıcı olmayan bir müdahaledir. Üç tür arabuluculuk vardır. Bunlar geleneksel arabuluculuk, yargısal arabuluculuk ve modern arabuluculuktur. Arabulucunun yapısı ve işlevi, arabuluculuk usûlünü diğer uyuşmazlık çözüm usûllerinden ayırmaktadır. Arabulucu bir kolaylaştırıcıdır. Arabulucu, ihtilaflı konular üzerindeki kendi kararını taraflara dikte etmemelidir. Arabulucululuk esnek yapısıyla şekillenerek farklı bir usûl haline bürünür. Arabulucunun yaklaşımı doğrudan veya dolaylı ya da bunların arasında bir usûlde kendini gösterebilir. Arabuluculukta bir ya da birden fazla oturum olabilir. Arabuluculuyla caucuses adında ayrı toplantılar yapılabilir. Arabuluculuk oturumları gizlidir ve tarafların iletişimine yadım etmek amacıyla gerçekleştirilir. Arabuluculuk geliştikçe, kolaylaştırma ve değerlendirme arabuluculuğu gibi farklı arabuluculuk türleri ortaya çıkmaktadır. Mahkeme veya arabulucu tarafından hangi arabuluculuk modelinin izlendiğine bakılmaksızın, arabuluculuk usûllerinin çoğu aşağıdaki aşamaları izler: Arabuluculuk öncesi aşama, arabuluculuk aşaması ve arabuluculuk sonrası aşama. Türk hukuk sisteminde Avukatlık Kanunu, Ceza Muhakemesi Kanunu, İş Kanunu, Tüketicinin Korunması Hakkında Kanun ve Vergi Usûl Kanunu gibi kanunlarda ADR ile doğrudan ilgili düzenlemeler bulunmaktadır. Türk hukukunda, ADR ye ilişkin iki temel düzenleme mevcuttur. ADR yi destekleyen ilk yasal düzenleme Avukatlık Kanunundadır. Avukatlık Kanunu nun 35/A maddesine göre, müvekkilin talep etmesi halinde bir avukat, dava veya duruşma başlamadan önce ihtilaflı tarafları uzlaştırabilir. Kanun, tarafların uzlaştırma süreci sonunda bir anlaşmaya varmaları halinde, taraflar ve avukatların uyuşmazlığı çözen bir yazılı anlaşma yapmalarını hükme bağlamıştır. Uzlaşma tutanağı olarak adlandırılan bu anlaşma avukatlar ve müvekkillerince imzalanır. Uzlaşma tutanağı diğer mahkeme hü-kümleri gibi icra edilebilir. İkinci düzenleme, 1 Nisan 2005 te yürürlüğe giren yeni Ceza Muhake-mesi Kanunu ve Ceza Kanununda bulunmaktadır. Ceza Muhakemesi Kanununun 253. maddesi ve Ceza Kanununun 73. maddesi, savcının veya hâkimin kararına bağlı olarak, bir ceza davasında mağdur-fail uzlaştırmasına ilişkin hükümler içermektedir. Sadece takibi şikâyete bağlı suçlar uzlaştırmaya uygundur. Kanımca, ADR Türk yargı sisteminde medenî hukuk, ticaret hukuku ve ceza hukuku uyuşmazlıklarının çözümünde temel bir işleve sahip olacaktır; zira, yargılama üzerinde çalışan veya dava yolunda büyük güçlüklerle karşılan avukatlar, ADR nin, hukuk davalarının tamamına teşmil edilmesini be-lemektedirler. Hukuk Muhakemeleri Kanunu hâlen, ADR nin kullanılması için gereken yetkiyi vermemektedir. Ancak, ADR yollarının hukuk davalarının tamamında kullanılması için, Hukuk Muhakemeleri Kanunda geniş bir yetki verilmesi gereklidir. Yakın bir gelecekte, özel hukukun bütün alanlarında ADR nin daha önemli ve merkezî bir rol oynayacağı açıktır. There is an essential distinction between conflicts and disputes, though the literature often uses the two terms interchangeably. Conflict is defined as a stole of opposition or hostilities a fight or struggle. A dispute may be viewed as a class or kind of conflict which manifests itself in distinct, justiciable issues. It involves disagreement over issues capable of resolution by negotiation, mediation or third party adjudication. A dispute is an interpersonal conflict that is communicated or manifested. A conflict may not become a dispute if it is not communicated to someone in the form of a perceived incompatibility or a contested claim. Alternative dispute resolution (ADR) represents a movement, away from formal adversarial proceedings on the part of the courts, toward informal processes. ADR can be seen as lying within the framework of the world-wide access-to-justice movement. The beginning of ADR is usually traced to the 1970s in the United States. In the federal district courts, the first mediation and arbitration programs date from the 1970s. Additional expansion of ADR occurred in 1988 when the United States congress authorized ten district courts to implement mandatory arbitration programs and an additional ten to establish voluntary arbitration programs. A major impetus for ADR s rapid growth was a 1976 American Bar Association sponsored National Conference on the Causes of Popular Dissatisfaction with the Administration of Justice. The Conference concluded that alternative forms of dispute resolution, in particular mediation and arbitration, would ease congested courts, reduce settlement time, and minimize costs. The development of neighborhood justice centers (which practice mediation) and multi-door courthouse programs were encouraged. The terms of multi-door courthouse or multi-option ADR describe courts that offer an array of dispute resolution options. These programs direct disputants to the most appropriate dispute-resolving mechanism: facilitation, mediation or arbitration. Some multi-door courthouses refer all cases of certain types to particular ADR programs, while others offer litigants a menu of options. ADR is defined as a range of procedures that serve as alternatives to litigation through the courts for the resolution of disputes, generally involving the intercession and assistance of a neutral and impartial third party. Accordingly in literature the benefits provided by ADR processes may include: 1. lower court caseloads and expenses, 2. reduce the parties? expenses and time, 3. provide speedy settlement of those disputes that were disruptive of the community or the lives of the parties? families, 4. improve public satisfaction with the justice system, 5. encourage resolutions that were suited to the parties? needs, 6. increase voluntary compliance with resolutions, 7. restore the influence of neighborhood and community values and the cohesiveness of communities, 8. provide accessible forums to people with disputes, and 9. teach the public to try more effective processes than violence or litigant for settling disputes. ADR involves many different techniques of bringing parties together, however the main ADR processes are negotiation and mediation. The terms mediation and conciliation are used synonymously. Mediation (or conciliation) is the non-binding intervention by a neutral third party who helps the disputants negotiate an agreement. These are traditional mediation, judicial mediation and modern mediation. The nature and role of the mediator is what distinguishes the process of mediation from other dispute resolution processes. The mediator is a facilitator. The mediator should not impose his or her own judgment of the issues upon that of the parties. Mediation is characterized by its flexibility, taking shape in a variety of models. Mediator approach may manifest in either directive or non directive fashion, or somewhere in between. There may be only one session or several. There may or may not be separate meetings, called caucuses, with the mediator. Mediation sessions are confidential and structured to help parties communicate. As mediations develops, distinct mediation strategies such as facilitative and evaluate are emerging. Regardless of which mediation model a court or mediator follows, most mediations progress through the following stages: Pre-mediation phase, the mediation proper and post-mediation phase. There are direct interested provisions about ADR in the Turkish law system such as Code of Lawyer, Code of Criminal Procedure, Code of Labor, Code of Consumer Protection, and Code of Tax Procedure. There are two main provisions on ADR in the Turkish Law. The first statutory provision that supports ADR is in the Code of Lawyer. According to the article 35/A of the Code of Lawyer if the client claims for conciliation, an attorney may invite the opposite sides to conciliation when the case or the trial is not commenced. If the parties reach an agreement at the end of the conciliation, the statue provides that the parties and the attorneys will execute a written agreement disposing of the dispute. The agreement called conciliation minute? signed by clients and their attorneys. Conciliation minute is enforceable in the same manner as any other final judgment. The second provision is in the new Code of Criminal Procedure and in the Penal Code which came into force on June 1, 2005. Article 253 of the Code of Criminal Procedure and article 73 of the Penal Code, contain provisions about victim-offender mediation in a criminal case, depend on a decision by the prosecution or the judge. Only offenses which can be prosecuted by the public prosecutor only upon complaint of the injured party are suitable for mediation. In my view, ADR will be recognized in Turkish judicial system as having a fundamental role to play in the resolution of civil, commercial and criminal disputes. Because lawyers who work on trials or those who encounter enormous difficulties in litigation expect the ADR to be extended to all civil cases. Nowadays, the Code of Civil Procedure does not provide necessary authority to use ADR. However, a broad authority for using ADR process in all civil actions must be given in the Code of Civil Procedure. It is clear that in all fields of civil dispute resolution ADR will play a central and rather important role in the near future.

Population is decreased year by year, but unemployment.2. BULGARIA BEFORE 1989Ottoman empire had governorship on the Bulgaria more 500 years till 1908. Then, Bulgarian Kingdom is founded in 1908. Stamboliyski is in powered from Farmer Party in 1920. A new fascism supporter government is founded but communists and farmers were outside of government.Bulgaria is allied with Germany in 1941. Economical growing is dynamically continued in spite of reducing the productivity on agriculture sector, building sector and investments in Bulgaria. Especially, price volatility on agriculture sector is a reason of suspicion about real value of growth in 1988 according to 1987.Productions on agriculture and industry of Bulgaria are reduced according to statistics. Main problem on agriculture sector is delivery prices of goods.A stagnation indicator on Bulgarian economy is weakness of building and construction sector. Manufacturing products such as cement and weawing is in necessity. Manufacturing level is inadequate on that area and also unqualificationed organisations have been affected.2.3 - FOREIGN TRADEThere are no definite results on foreign trade reason of inadequate of numerical data's.However, export is increased up to the rate of 4 percent in 1988 and import is reduced to the rate of 1.8 percent. Bulgaria finance deficit is 600 million dollars result of trade with west countries in 1998. Tourism revenues are positive. At the same time, this decision is more benefit to foreign investors too.3. 1989 – 1997 TRANSITION PERIOD3.1 – ECONOMICAL REFORM ACTIVITIESAlteration is started in east block countries after 1989 and together with this alteration. Comecon is losted the activity. So, idle capacities are commenced and Bulgaria is losted the production markets.The reforms are making started by new government in February 1991. They were 1,096 milliard dollars with 22,3 percent in 1997 and 983 million dollars with 19.4 percent of total export in 1998.AGRICULTURE, FOOD AND TOBACCORate of plan tablelands are 34 percent in Bulgaria. Principal are; Machine parts, tractor, bus, ship, building and auto spare parts.CONSTRUCTIONPrivate firms in the sector have share with 13 percent in 1991. That share is grown to 62 percent in 1995 but then; it is reduced reason of financial inadequate ships.TOURISMTourism revenues are approximately 280 million dollars in 1995.4.5 million of transits and totally 8 million tourists are visited the Bulgaria in 1996.3.3. TRADE AFTER ECONOMICAL REFORMSExport of Bulgaria is totally 4.9 milliard dollars in 1997. The import nest export products are fuel oil, other fuels, cooper and its products and nuclear reactors. Import is 4.5 milliard dollars in 1997 and included the product such as mineral fuels, nuclear reactor heaters and spare parts, electric machines, mineral substances, cotton, synthetic fibres, cereals, auto and tractors.3.4. EXTERNAL DEBTSRate of the external debts to export revenues were 249.9 Percent in 1993 but then, back to 188.2 percent in 1994.Official external debts were 10.363 dollars in the end of 1997.3.5. FOREIGN INVESTORS EXTERNAL CAPITALMost investments with 636.2 million dollars by foreigners are made in 1997. This amount is 526 million dollars in 1998. Principal foreign investors are European countries and U.S.A. A new foreigner investment law is prepared in Oct 1997. Main sectors to investment are industry, trade, finance and tourism.3.6. COMMERCIAL BANKINGState banks are privatization by associate. Regulations relate to control of banking are valitidied by government. In the middle of 1997, a new law on banking are validated after economical crisis in 1996, Central Bank Law are rebuilt. High levels of capital and capital qualifications are obligationed.3.7.
